CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. Reale & Son Inc. 17, 124. 00 PUBLIC HEARING - Appeal for Sign Variance (Rudolph Novak) On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED, that the Public Hearing be and it now is declared open. The Clerk presented for the record the affidavit of publi- cation of the notice of hearing and read two letters ad- dressed to the Board by M. Lerman of Eagle Knolls Road in opposition to the application and Charles Mayone, Pres- ident of the Larchmont Motel, in favor of the application, which were herewith ordered received and filed for the record. The Supervisor then inquired whether anyone present wished to address the Board, either in favor of or in oppo- sition to the application, whereupon the following persons were heard: -2- In favor: -- Mr. R. A. Novak - Applicant Mr. Novak stated that he would leave the reply to Mr. Lerman's letter to the Board since it was well aware of what he had done in the conduct of his business these past twenty years. Further, in reply to questioning as to design (height of letters and height of sign) and consideration of other types of signs, Mr. Novak stated that he would be very glad to consider any suggestions, but that since he had been in the business of designing signs for many years, he did not feel that the design submitted could be improved upon very much -- nor that any other type of sign which the particular construction of his building would permit, would afford sufficient advertising to him. In opposition: -- Mr. Irving Taub - 10 Copley Road Mr, Taub stated that the windows of his home overlooked the Post Road and that he was therefore opposed to any down-grading or changing of the present ordinance. Whereupon, following some further discussion since no one else wished to be heard and Councilman Cook's sugges- tion that the Building Inspector, Engineer and members of the Board meet with Mr. Novak and review the application on the premises prior to final determination met with Mr. Novak's approval, the Board was ready for the question, and thereupon on motion by Councilman Kane, seconded by Councilman Cook, it was unanimously RESOLVED, that the public hearing be and it now is declared closed and decision reserved. OLD BUSINESS There was no old business to come before the meeting. NEW BUSINESS There was no new business to come before the meeting. COMMUNICATIONS (Not on Agenda) 1. Snow Control - State Highways (1963-1964) Pursuant to communication requesting authorization of contract for Town snow control on State highways within the Town during 1963-64, addressed to the Board by the Commissioner of the Westchester County Department of Public Works under date of October 11, 1963, herewith -3- ® pia presented and filed for the record, on motion by Coun- cilman Kane, seconded by Councilman Brush, the fol- lowing resolution was adopted unanimously: WHEREAS, Sect. 12 of the Highway Law, as amen- ded by Chapter 305 of the Laws of 1946, provides that if the removal of snow and ice from the State Highways is taken over by the County, the County can arrange with the Town Superintendents or - Village Street Commissioners of the various towns/villages in the County of Westchester and the villages therein for the removal of the snow and ice from such State.Highways as are within their municipal boundaries and the entire cost of such work will be reimbursed by the State, and WHEREAS, the Town of Mamaroneck under date of November 8, 1946 entered into a contract with the County of Westchester for the removal of snow and ice from the State Highways within the said Town in accordance with the provisions of Section 12 of the Highway Law as amended, and under date of August 30, 1962 extended the said contract for the season 1962 - 1963, NOW, THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck extend the above mentioned contract with the County of Westchester for an additional year, and be it further RESOLVED, that a certified copy of this resolution be forwarded to the Westchester County Commis- sioner of Public Works. 2, Snow Removal - County Roads (1963 - 1964) Upon presentation of a communication from the County Public Works Department, dated October 10th, 1963, re- questing execution of the enclosed proposed agreement with the County for snow removal on County Roads within the Town during the 1963 - 1964 season at the flat rate of $300, 00 per mile, herewith Ir esented and filed for the record, on motion by Councilman Kane, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized to sign the Agreement with the County of Westchester for the removal of snow and ice on County Roads within the unincorporated area of the Town of Mamaroneck at a flat rate of $300, 00 per mile for the 1963 - 1964 season, -4- REPORTS The Town Clerk The Clerk presented the following reports which were or- dered received and filed: Town Clerk's Report for the month of September, 1963. Report of the Building Inspector for the month of Sep- tember, 1963. Report of the Westchester Shore Humane Society, Inc. for the month of September, 1963. Report of Receipts & Disbursements, Town of Mamar- oneck, for the period from January 1st through Sep- tember 30th, 1963. Affidavit of publication of notice listing the dates and polling places for registration and election as re- quired by law. The Supervisor -- 1. Larchmont Gardens Civic Association Communication re Petition for Traffic Survey - Gardens Area For the Board's information, the Supervisor presented - a communication addressed to Larchmont Gardens Resi- dents by Donald H. Chapin, President of the Larchmont Gardens Civic Association under date of October 15, 1963, reporting the action taken in response to a residents' pe- tition presented to the Town Board by the Association, which was herewith ordered received and filed for the record. 2. Water Main Installations Fern Road and Birchfield Road Extension Pursuant to memorandum herewith presented and filed for the record, which was addressed to the Supervisor and Councilmen by the Engineer under date of October 15, 1963, recommending the installation of a new 6" main in Fern Road and connecting extension of the existing 61, main in Birchfield Road to Glen Road in accordance with estimates prepared by the Westchester Joint Water Works and therewith appended, on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the Westchester Joint Water Works to install 400 feet of 6" water main in Fern Road from Valley Road to North Chatsworth Avenue at a cost not to exceed the sum of $4, 000. 00 and extend the 6" existing -5- �m main in Birchfield Road to Glenn Road at a cost not to exceed the sum of $700. 00. 3. Communications For the Board's information, the Supervisor presented the following communications which were herewith ordered re- ceived and filed: a) Two notes of thanks and appreciation from the family of the late Jennie Hopson, Deputy Town Clerk. b) Note of thanks and appreciation from the family of the late Arthur Johnson, Assistant Foreman of the Park Department. c) Letter of appreciation of the Town's efforts in ob- taining signalization at the Harmon Drive-Weaver Street intersection written by Mr. Martin Bach on behalf of the residents of Harmon Drive. d) Letter from Mrs. Betty Carroll, President of the Larchmont Gardens Tenants' Association, dated October 8, 1963, thanking the Board for its coop- eration in having the sidewalks repaired along Richbell Road and requesting assistance in se- curing proper heat (boiler repair and conditioning) this winter, which matter was referred to the at- tention of the Building Inspector and Engineer. 4. Proclamation United Nations Week and United Nations Day The Supervisor presented a communication from Lee Bloom, Chairman of United Nations Week for the Town of Mamaro- neck, requesting that the week of October 21st, 1963 be pro- claimed as United Nations Week with Thursday, October 24th , observed as United Nations Day, pursuant to the Proclama- tion therein enclosed, and that the United Nations flag be flown with our flag during this entire week, which, on motion duly made and seconded, was so ordered by unanimous vote of the Board. Councilwoman Helwig -- 1. Request for Use of "Rockland Strip" Councilwoman Helwig presented a communication addres- sed to her by Joseph T. Downey, Principal of the Murray Avenue School on behalf of the Fifth Grade, requesting the use of a section of the area known as the "Rockland Strip" on October 23rd for conducting a historical "Old Colony" project as described therein, which was herewith or- dered received and filed for the record. -6- f_y- a�' Whereupon, following discussion during which the ques- tion of fire hazard was reviewed at length, on motion by Councilwoman Helwig, seconded by Councilman Kane, it was unanimously RESOLVED, that this Board hereby approves the re- quest of the Fifth Grade of Murray Avenue School for use of a certain section of the area known as the "Rockland Strip" to conduct a historical "Old Colony" project on Wednesday, October 23, 1963, in accor- dance with the plan outlined in letter signed by Joseph T. Downey, Principal, Murray Avenue School, dated October 14, 1963 and herewith filed, and subject to approval by the Town of Mamaroneck Fire Department; and be it further RESOLVED, that if it rains on October 23, 1963, this project will be conducted on October 30, 1963 subject to the same conditions and provisions as heretofore mentioned. Z. Thruway Noise Abatement Committee Councilwoman Helwig presented for the Board's informa- tion, a picture of Mr. Lewis C. Kibbie, Director of the En- gineering Department of the American Trucking Associa- tions, taken at the noise tests conducted in Saugerties, New York, with the cooperation of the New York State Motor Truckers Association, Inc. and the C. & E. Trucking Cor- poration, a member of the Albany branch of the Motor Truckers Association, together with a detailed written re- port thereof, which was herewith ordered received and filed for the record. 3. Park Commission Pursuant to the Commission's request for authorization of salary for replacement for Ralph Robins, who succeeded the late Arthur Johnson as Park Department Assistant Foreman, on motion by Councilwoman Helwig, seconded by Councilman Cook, it was unanimously RESOLVED, that Carl Reino, employed as a Park Department laborer to replace Ralph Robins, be compensated at the rate of $2. 32 per hour effec- tive as of September 30, 1963. Councilman Kane -- 1. Highway Department a) Request for Salary Authorization Pursuant to request of the Superintendent of Highways -7- os{ � � for authorization of salary for a Sanitation Man, on motion by Councilman Kane, seconded by Council- man Brush, it was unanimously RESOLVED, that Giovanni Molle, employed as a Town of Mamaroneck Sanitation Man on September 25, 1963, be compensated at the rate of $5, 150. 00 per annum starting as of that date (September 25, 1963). Z. Proposed Street Lighting Job 418 Pursuant to memorandum from the Town Engineer re- questing authorization for the installation of 10 new street lights as therein described, which was herewith pre- sented and filed for the record, on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously, RESOLVED, that the installation of 10 new street lights of the types and at the locations set forth herebelow, at a total cost of not to exceed the sum of $700. 00, be and it hereby is authorized: Rockland Avenue from 5 new "admirals hats" Winged Foot Drive to 1 new "quadriliner" Forest Avenue (Replacing 6 old type fixtures) Murray Avenue at corner 1 new "quadriliner" of Forest Avenue Murray Avenue in front Relocated "admirals hat" of school from Murray & Forest (pole presently unlit) North Chatsworth at 1 new "quadriliner" Huguenot Drive North Chatsworth between 1 new "admirals hat" Garfield Street and (pole presently unlit) Huguenot Drive 1 relocated "admirals hat" ( pole presently unlit) South Drive at inter- 1 new "quadriliner" section of West Drive (replacing old type Con Ed owned light) Councilman Kane also called attention to the fact that the Engineer noted in his memorandum that a savings in excess of $1, 500. 00 would result by the end of this year in the maintenance and energy accounts as a result of getting rid of the rental and control facility charges dur- ing the past year, as well as taking bids for, and award- ing a new type maintenance contract having a more fa- vorable price structure which included elimination of annual maintenance costs on "quadriliners". -8- 1 -I 3. Communications 1. Letters of Commendation Highway Sidewalk Repair Councilman Kane presented for the Board's infor- mation, communications addressed to the Superinten- dent of Highways by Mr. Lawrence E. Brown and Mr. Carl Cordes, residents of the Town, commending the Superintendent and Highway Department on the ex- cellence of its job performance in the sidewalk repair program, which were herewith ordered received and filed for the record. Councilman Brush -- Councilman Brush stated that he had no report other than Fire matters. Councilman Cook -- Councilman Cook stated that he had no report at this time. The Town Attorney -- In the Attorney's absence, there was no report. The Town Engineer -- The Engineer stated that he had no further report.other than presented by Councilman Kane. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:25 p. m. , to reconvene on November 6, 1963. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was con- ' vened immediately upon the adjournment of the Town Board meeting. 1. Claims - Commissioner Brush presented for payment the follow- ing Fire Department claims, which had been audited by the Comptroller and approved by the Fire Chief, and thereupon on his motion, which was seconded by Commis- sioner Cook, it was unanimously -9- t RESOLVED, that the following Fire Department claims, as audited by the Comptroller and ap- proved by the Fire Chief, are approved, and the Supervisor and Comptroller authorized to pay the same out of the Fire Department budget: Atlantic Service Center $ 13. 40 R. Communications There were no communications. 4. Other Business 1. Annual Inspection The annual inspection, parade and dinner on the evening of October 24, 1963 was announced. 2zv',Invitation to Property Owners The Fire Chief advised the Commission that there had not been any fires in any wooded areas border- ing any pr operty in the unincorporated area -- also that an invitation was issued to all property owners in the Fire District to visit and inspect the Fire- house and equipment. This invitation, the Chief added, was also extended to all school children in the district. 5.
