HomeMy WebLinkAbout1962_10_17 Town Board Minutes T MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD OCTOBER 17th, 1962, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8.15 p. m. ROLL CALL Present; Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Cook Absent; None Also Present: Mr. Gronberg - Town Clerk Mr, Delius - Town Attorney Mrs, Brewer - Secretary Mr, Kellogg - Town Engineer Mr. Altieri - Town Accountant Mr, Kronenberger - Supt, of Recreation WELCOME TO GUESTS The Supervisor, on behalf of the Board, greeted Mr, John Oliver and Mrs, Austin Phillips of the Board of Park Com- missioners, Mr, John Stahr of the Recreation Commis- sion, and Mr, Sydney Bierman of the Zoning Board of Ap- peals, who were attending the meeting by invitation of the Board, APPROVAL OF MINUTES Upon presentation and on motion duly made and seconded, the minutes of the regular meeting of July 11th, 1962 were ap- proved as corrected, and the minutes of the regular meeting of August lst and special meeting of August 3rd, 1962 were approved as submitted, OPENING OF BIDS - Construction of Myrtle Boulevard Park and Playground Following presentation.of.the affidavit of publication of the notice for bids and acceptance of two late bids with the At- torney's approval as upon his inquiry there was no objection to such acceptance voiced by any bidder present, which the Attorney requested be noted in the record, the Clerk opened and read aloud the following bids: Bidder Bid Micelli Bros, $ 114, 086, 10 Nigro Bros, 111, 028, 35 Felix Contracting Corp. 103, 2190 95 -1- At this time, Councilwoman Helwig, the Engineer and the Ac- countant were excused from the meeting in order to meet with Mrs, Phillips, Mr. Oliver and Mr. Stahr of the Park and Rec- reation Commissions, to review the bids as submitted, The Supervisor then suggested pursuant to the Engineer's memorandum of October lst and recommendations of the Park and Recreation Commissions herewith presented and filed for the record, that since the bid for the Comfort Station (Con- tract No. 2 which had not been re-advertised) had been opened on September 19th and therefore must be awarded on October 19th, the Board meet in special session on that date so that both contracts could then be awarded. Whereupon, the Board in line with this suggestion, on motion by Councilman Kane, seconded by Councilman Cook, RESOLVED, that a special meeting be held on Fri- day evening, October 19th, 1962, at 7 o'clock, in the Council Room of the Weaver Street Firehouse for the purpose of awarding the bids for Contract No. 1 and Contract No. 2 for the construction of Myrtle Boulevard Park and Playground, OPENING OF BIDS - Sewer Installation, Boston Post Road Following presentation of the affidavit of publication of the no- tice for bids, the Clerk opened and read aloud the following bids, which were referred to the Town Attorney, the Engineer and Accountant for study and report at the next meetings Bidder Bid Lindine Const. Report - Comfort Station Bid (Myrtle Boulevard Park and Playground) By common consent, the Board directed that this report be held for presentation at the special meeting to be held on Friday evening, October 19th. -2- Z. Report - Civil Defense Bids In accordance with the recommendation contained in a memo- randum addressed to the Board by the Town Accountant, Here- with presented by Councilman Cook and ordered received and filed for the record, on his motion, which was seconded by Councilman Brush, it was RESOLVED, that this Board hereby awards the bid for furnishing to the Town of Mamaroneck-Village of Larchmont Civil Defense Department equipment specified in Groups 1 and 2 of the bid notice and proposal, to Harbor Radio, the only bidder sub- mitting a bid on all items therein, as follows; Group 1 in the amount of $2, 231, 98 Group Z in the amount of 1, Z98. 40; or a total bid in the amount of $3, 530, 38, 3, Report on Rezoning of Baldwin Property Councilman Cook advised the Board that the Planning Board would be ready to submit its report and recommendations in this matter at the next meeting of the Board. 4. Report - Application for Rezoning, Rudolph Novak In accordance with request of Councilmen Cook and Kane for more time to study further certain aspects of this application, it was directed that this matter be put over to the next regu- lar meeting, NEW BUSINESS There was no new business to come before the Board. COMMUNICATIONS 1. Public Notice, Zoning Board of Appeals Village of Larchmont The Attorney presented a notice of hearing before the Zoning Board of Appeals of the Village of Larchmont on October 18, 1962, advising that the matter concerned had no effect on the Town and therefore required no action by this Board. The communication was ordered received and filed, 2. Communication from Department of Agriculture and Markets For the Board's 'information and the record, the Clerk pre- sented a communication from the State of New York Depart- went of Agriculture and Markets, enclosing the delegation of authority for the Dutch Elm program, which was ordered received and filed. -3- �'u SJL 3, Letter from Mrs, Phillips (Board of Park Commissioners) The Clerk read a letter addressed to the Supervisor by Mrs, Elizabeth B. Phillips tendering her resignation as a member of the Board of Park Commissioners because of moving from the community, The Board expressed its deep regret at the loss of Mrs. Phillips' service, and in accordance with her dir- ection that this resignation be acted upon at the discre- tion of the Board prior to December 1st, ordered the communication received and filed with no action taken at this time, REPORTS The Town Clerk The Clerk presented the following reports which were or- dered received and filed. Report of Receipts & Disbursements, Town of Mamar- oneck, for the period from January 1 through Septem- ber 30, 1962, Affidavit of publication of Registration Notice - 1962, Affidavits of publication and posting of resolution amending Chapter V of the General Ordinances. New York State Department of Health Permit and ap- proved plans for Sewer Extension, Lakewood Lane, Sewer District #1, Section "H", Mamaroneck (T), Westchester County, Memorandum from Town Engineer and Westchester County Permit Application #10460 - installation and maintenance of pipes under Murray Avenue Bridge - Myrtle Boulevard Park and Playground Improvement, The Supervisor -- 1, United Nations Day The Supervisor presented Mr, Lee Bloom, Chairman of United Nations Week for the Town of Mamaroneck, who presented a proclamation , which on motion by Councilman Kane, seconded by Councilman Cook, was unanimously approved as follows. WHEREAS the United Nations' vigor and effectiveness have increased over the years; and WHEREAS the United Nations has become the prin- cipal forum for open discussion of world affairs; and WHEREAS the United Nations is now an effective in- strument against hunger, illiteracy, disease and despair; and -4- WHEREAS the United Nations is a main avenue for co- operation in the peaceful uses of outer space; and WHEREAS the United Nations' peacekeeping potential, provides a key to world disarmament; and WHEREAS the United Nations' activities have been beneficial to the national interests of the United States; and WHEREAS the United Nations' authority depends on the moral and financial support of the world's nations and people; and WHEREAS the General Assembly of the United Nations has resolved that October twenty-fourth, the anniver- sary of the coming into force of the United Nations Charter, should be dedicated each year to making known the purposes, principles, and accomplishments of the United Nations: NOW, THEREFORE, I, GEORGE D. BURCHELL, Su- pervisor of the Town of Mamaroneck, do hereby urge the citizens of this Town to join with those throughout the nation in observing Wednesday, October 24th, 1962 as UNITED NATIONS DAY by means of communitypro- grams which will demonstrate their faith in the United Nations and contribute to a better understanding of its aims, problems, and accomplishments. I also call upon the officials of our government to en- courage our schools, citizen groups, and publicity agencies to engage in appropriate observance of UNITED NATIONS DAY throughout the Town of Mamaroneck. It was also directed in accordance with Chairman Bloom's re- quest that the United Nations Flag be flown during United Na- tions Week. 2, Signalization - Weaver Street and Harmon Drive The Supervisor read a letter addressed to him by Lloyd A. Maeder, Chief Traffic Engineer of the State Traffic Com- mission, advising that a Semi-Traffic-Actuated signal would be installed at the subject location, which was or- dered received and filed for the record, The Supervisor remarked on the successful conclusion of many long and arduous months of effort on the part of this Board to obtain this light, and Mr, Lee Bloom addressed the Board to express the thanks and gratitude of the Larch- mont Gardens Civic Association for obtaining this long- requested signalization. Councilman Gook -- Councilman Cook stated that he had no further report, -5- Councilman Brush -- Councilman Brush stated that he had no report other than that pertaining to Fire matters, Councilman Kane -- 1, Brook Enclosure - Laurel Avenue to Cabot Road In accordance with a memorandum from the Town Engineer requesting authorization to advertise for bids for pipe to en- close the brook from Laurel Avenue to Cabot Road, pre- sented by Councilman Kane and herewith filed for the rec- ord, on his motion, seconded by Councilman Brush, it was unanimously RESOLVED, that pursuant to Town Law the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for bids for supplying and delivering to the Town of Mamaroneck certain amounts and sizes of pipe in accordance with the specifications prepared by the Town Engineer and set forth in the "Notice to Bidders"" said bids to be opened and read aloud at a regular meeting of this Board to be held at 8:15 p.m. , E.S. T. , on Wednesday evening, November 7th, 1962, in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck. Z. Change of Meeting Dates On motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED, that the dates of the regular meetings in November of 1962 shall be on the first and second Wednesday evenings of the month, November 7th and November 14th, rather than on the first and third Wednesdays thereof - November 7th and November 21st, 1962. 3, Acquisition of Property Marshland, Dillon Park In accordance with memorandum addressed by Councilman Kane to the members of the Board under date of September 14th, on - motion by him, seconded by Councilman Cook and approved by the Town Attorney, it was RESOLVED, that an expenditure of not to exceed the sum of $250, 00 is hereby authorized as fee for a title search of certain lands known as Block 504 - Parcels 471 and 480; Block 504 - Parcels 1000 and 1006; Block 505 - Parcel 229; Block 505 - Parcel 510; Block 505 - Parcel 264; Block 506 - Parcel 325; Block 506 - Parcel 487 and Block 506 - 320. -6- RETURN OF COUNCILWOMAN HELWIG AND OTHERS At this time, Councilwoman Helwig, the Town Engineer and the Town Accountant, along with Mrs. Phillips, Mr, Oliver and Mr. Stahr, who had been excused to review the bids for Myrtle Boulevard Park and Playground - Contract No, 1, returned to the Council Room, and the Supervisor asked Councilwoman Helwig whether she was ready to report on any matters at this time. Councilwoman Helwig -- 1. Dutch Elm Program Councilwoman Helwig reported on the excellent response to date on the letters requesting removal of dead or diseased dutch elms by private property owners, and in accordance with her suggestion, the Board, by common consent, dir- ected that a letter of thanks be sent to those who had been of such great assistance to the Town in implementing this program. 2. Gross County Lands Study Committee Councilwoman Helwig submitted a written report on the activities and program of this Committee, which was or- dered received and filed for the record. 3, Noise Abatement For the Board's information and the press, Councilwoman Helwig announced the presentation of the Noise Abatement Program given before the Joint Legislative Commission on Motor Vehicles and Traffic Safety hearing at Hofstra College, on W. Y. 0.X. on Monday from 7.45 to 8;45 a.m. 12.05 and between 3:30 and 4:30 p.m. For the record, the Board commented on the excellence of this presentation and recommended publication of this announcement in the local press, The Town Engineer -- 1. Street Lighting Program The Engineer presented a memorandum with reference to the Street Lighting Program - Jobs #3 through #7, which was ordered received and filed, Z. Bonnie Way Drain The Engineer reported that he was preparing the specifica- tions for the notice for bids for installation of the subject bid and hoped to be ready to advertise for same early in December, -7- �e G7 ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared ad- journed at 9.10 p.m. , to reconvene on November 7, 1962, BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was con- vend immediately upon the adjournment of the Town Board meeting, 1, Claims Commissioner Brush presented for payment the follow- ing claims, which had been audited by the Comptroller and approved by the Fire Chief, Whereupon, on his motion, seconded by Commissioner Kane, it was unanimously RESOLVED, that the following claims be and they hereby are approved and the Supervisor and Comptroller authorized to pay the same out of the budget for the Fire Departments Stateliners Drum & Bugle Corp, $ 175. 00 Humble Oil & Refining Co, 67.85 Suburban Electric Service Inc. 151, 25 William B. Reports There were no reports to be presented at this time, 3, Communications There were no communications to be presented at this time, 4, Other Business 1. Information to Northern Section of Town The matter of getting information about the Fire Depart- ment to the residents of the northern section of Town -8- 41 was discussed at some length with the following two suggestions offered. 1st) That Commissioner Brush and the Fire Chief make an effort to attend the meetings of the Murdock Woods, Stonewall Lane and Prince Willows Civic Associations in order to be- come acquainted with the members, to dis- tribute Fire Department stickers, and to disseminate information about the Depart- ment and fire control in this section of Town. 2nd) That the Assessor forward to the Fire Chief a monthly report of all new residents in the Town. This was so ordered, 2. Annual Inspection, Parade and Dinner Announcement was made of the Annual Inspection, Parade and Dinner, to be held on Thursday evening, October 25th, 5, Adjournment There being no further business to come before the meet- ing, on motion duly made and seconded, it was declared adjourned at 9.20 p.m. , to reconvene on November 7th, 1962, Y Town ler t' ai S' -9-
