MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON OCTOBER 3, 2018, BEGINNING AT 5:00PM IN
CONFERENCE ROOMS C and D AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF
THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was
unanimously opened at 5:00PM.
Discussion with Comprehensive Plan Consultants
The Town Board first met with representatives from AKRF Planning Consulting. Present were, Anthony
Russo Vice President, John Neill Vice President and Peter Feroe Technical Director.
The AKRF representatives gave a PowerPoint presentation, followed by a question and answer period with
the Town Board.
The Town Board met with representatives from BFJ Planning Consultants. Present were Frank Fish
Principal, George Jacquemart Resource Principal, Taylor Young Project Manager and Susan Favate Resource
Principal.
The BFJ representatives distributed a handout for the Town Board and then led a discussion referencing the
handout. This was followed by a question and answer period with the Town Board.
The Town Board discussed the presentations and noted that they will meet with a third consultant at the
next Town Board worksession.
Update – Residential Parking Permits
The Town Clerk gave a brief update on the current renewals of the residential parking permits for
Washington Square and Lester Place, specifically any issues with the new residency requirements. Ms.
Battalia stated that permitting is continuing to go smoothly.
Discussion – Westchester County Immigration Protection Act (IPA)
The Town Board reviewed the County’s IPA legislation and discussed whether the Town should draft their
own similar legislation. Supervisor Seligson reminded the Town Board that a year or so ago the Town
reaffirmed its commitment to support all our Town residents by restating the Town of Mamaroneck Police
Department’s role and practices with respect to our immigrant community. The Town Board asked Mr.
Maker and Mr. Altieri to review this with the Police Chief and with respect to possible Town legislation.
Review – 2019 Budget Calendar
The Town Board discussed whether an offsite location should be considered for one of the budget sessions.
The Board also requested the start times be moved from 5:00p.m. to 5:30p.m. Mr. Altieri will look into off
site locations.

Review – Revised Sexual Harassment Policy
The Town Board reviewed a memo from Connie Green O’Donnell, dated September 27, 2018, outlining the
New York State Sexual Harassment – Related Initiatives. Connie Green O’Donnell wrote that “New York
State recently adopted new legislation targeting sex discrimination and sexual harassment in the
workplace. As part of the 2018-2019 state budget the legislature included several sexual harassment-
related initiatives”. Ms. Green-O’Donnell stated that although the Town has in place a sexual harassment
policy, the Town is obligated to adopt a policy and complaint form that complies with the new state
legislation. Approval of this policy and form is on the regular agenda for this evening.
New Business
Supervisor Seligson informed the Town Board of a recent situation whereby Westchester County Water
Works employees participated in a utility workers strike in White Plains, adding that she felt the Town
Board should be aware of this. Supervisor Seligson added that she believes the Water Works has been
negotiating with their utility workers in good faith.
Supervisor Seligson discussed again with the Town Board the Army Corp of Engineers proposal to
strengthen New York Harbor. She attended another meeting at which congressional, state and local
officials as well as various environmental groups were present. A study was issued that does not
address the residual effects of this proposal, specifically it does not address any effects to Long Island
Sound. Supervisor Seligson added that many officials and environmental organizations see this proposal as
ridiculous.
Supervisor Seligson stated that the Sustainability Collaborative is seeking to utilize funds allocated to them
in the 2018 budget. In doing so they are seeking guidance from the Town Board as to whether they need
additional Town Board approval for an expenditure. The Town Board discussed a threshold of $1,000 of
budgeted funds can be expended without Town Board approval. Supervisor Seligson will reiterate that to
the Collaborative.
Supervisor Seligson was recently contacted by Ralph Engel inquiring about the Town’s intention to move
forward with a deck at the Senior Center. Mr. Engel has offered to help fund the deck, up to an amount of
$30,000, from funds he previously offered for upgrades to the median on New Jefferson Street. Mr. Altieri
will check with the Town Comptroller as to the status of the funds Mr. Engel sent to the Town previously.
Supervisor Seligson stated that the Town will need to establish a capital project fund that would require
additional Town funding of somewhere between $5,000 and $7,000 dollars to complete the deck.
Councilwoman Elkind Eney asked Mr. Altieri to provide to the Fire Department contact information
regarding who the Department should contact regarding the Thruway Authority’ intention to remove the
physical toll booths. The Fire Department would like to discuss with the Thruway Authority the installation
of a feeder ramp to provide safer access for emergency vehicles onto the opposite side of I95.
Councilwoman Elkind Eney noted that she recently was accessing North Chatsworth Avenue from
Edgewood Avenue and was able to experience firsthand the issues being addressed at that intersection.
Councilwoman Elkind Eney said she agreed with Councilman Jeffery King that eliminating two more parking
spaces would make the turn safer. The Town Board will look at this area again, and Mr. Altieri will add it to
the Traffic Committee agenda.
Councilmember King reported that he recently met with the Library staff to consult with them on their
HVAC units, adding that the Library is in need of a comprehensive plan with respect to their HVAC.
The Town revisited the 2019 Budget Calendar, specifically the conflict on October 29 with the Westchester
Planning Federation’s forum on Comprehensive Planning. The Town Board made modifications to the
budget calendar and will vote on these changes during the regular meeting.

CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents are welcome to attend.
SUPERVISOR’S SUMMARY REPORT
I commented at a hearing held by the Army Corps of Engineering about the construction of sea
barriers in NY harbor. The Corps is reviewing 5 options to protect New York City from flooding
during a storm. Unfortunately, the reviews and options do not take into account the effects on
the Long Island Sound ecosystem or the shoreline communities around Long Island Sound. The
barriers could have devastating flooding effects in areas outside of NYC. The Paine to Pain Trail

Half Marathon is this Sunday, October 7. There will be hundreds of runners on the Colonial

Greenway enjoying the region’s best trail race. Leaf collection begins Monday October 15 and
th
organic pickup ends October 26. The staff budget will be presented to the Town Board on

October 17.
CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience would like to address the Board.
George Roniger, representing the Larchmont Gardens’ Civic Association addressed the Town Board. Mr.
Roniger stated that the Lake looks great. He announced the upcoming Halloween event, the date still to be
determined.
BOARD OF FIRE COMMISSIONERS
The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind
Eney, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared
open.

1. Authorization – Transfer of Funds – Fire Department HVAC
On motion of Commissioner Katz, seconded by Commissioner Elkind Eney, it was
RESOLVED, that the Town of Mamaroneck Board of Fire Commissioners does hereby
approve the budget amendment and transfer of funds in the amount of $18,000.00, to
replace the existing Honeywell JACE unit with a new Honeywell JACE 8000 Module HVAC
Controller unit including re-wiring, at the Fire Headquarters building, as detailed by the Town
Comptroller in the following schedule:

1. Transfer of Funds – Hommocks Ice Rink – HVAC Controls
On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the budget amendment
and transfer of funds in the amount of $16,500.00, to replace the existing Honeywell JACE unit
with a new Honeywell JACE 8000 Module HVAC Controller unit at the Hommocks Ice Rink.

2. Approval – 2019 Annual Town of Mamaroneck Public Housing Agency Plan
On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby renew and approve the Annual
Public Housing Agency Plan for 2019, and authorizes its submission to the US Department of
Housing and Urban Development as required.

3. Authorization – Renewal of Health Department Permits – Senior Nutrition Programs
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator
to execute the Health Department Applications to renew the permits to operate the Meals on
Wheels and Nutrition Site Programs annually.

4. Resolution – New York State Deferred Compensation Plan
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was
approved,
WHEREAS, the Town of Mamaroneck wishes to adopt the Deferred Compensation Plan for
Employees of the State of New York and Other Participating Public Jurisdictions (the “Plan”) for
voluntary participation of all eligible employees, and
WHEREAS, the Town of Mamaroneck is a local public employer eligible to adopt the Plan
pursuant to Section 5 of the State Finance Law, and
WHEREAS, the Town of Mamaroneck has reviewed the Plan established in accordance with
Section 457 of the Internal Revenue Code and Section 5 of the State Finance Law of the State of
New York, and
WHEREAS, the purpose of the Plan is to encourage employees to make and continue careers
with the Town of Mamaroneck by providing eligible employees with a convenient and tax-
favored method of saving on a regular and long-term basis and thereby provide for their
retirement.
NOW THEREFORE, BE IT
RESOLVED, that the Town of Mamaroneck hereby adopts the Plan for the voluntary
participation of all eligible employees, and
BE IT FURTHER
RESOLVED, that the appropriate officials of the Town of Mamaroneck are hereby authorized to
take such actions and enter such agreements as are required or necessary for the adoption,
implementation, and maintenance of the Plan, and
BE IT FURTHER
RESOLVED, that the Administrative Services Agency is hereby authorized to file copies of these
resolutions and other required documents with the President of the State of New York Civil
Service Commission.

5. Consideration – Revised Sexual Harassment Policy
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following was
approved,
WHEREAS, New York State recently adopted new legislation targeting sex discrimination

WHEREAS, as part of the 2018-2019 State Budget the legislature included several sexual
harassment-related initiatives, and
WHEREAS, although the Town has in place a sexual harassment policy, the Town is
obligated to adopt a policy and complaint form that complies with the new state legislation.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby adopt the Sexual Harassment
Prevention Policy and Complaint Form for reporting sexual harassment.

6. Salary Authorization – Probationary Police Officers
On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was
RESOLVED, that the Mamaroneck Town Board does hereby appoint Sean Lynch to the position
of Probationary Police Officer, at an annual salary of $57,708.00, with an anticipated
appointment date of no later than October 31, 2018.
