BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney ABSENT: Councilwoman Abby Katz CALL TO ORDER - WORK SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00PM. TAKEN OUT OF ORDER Update – Fire House Renovation Costs and Referendum Additionally Present: Joe Russo, Deputy Fire Chief and Rob Wasp Town Engineer Mr. Altieri’s original memo, dated August 17, 2018, outlined the original estimated project costs, the additional required work, and an outline of the new estimates. Mr. Altieri’s addendum memo outlined and discussed the additional work and the associated change orders effecting the cost of the project. Chief Russo and Rob Wasp answered questions from the Town Board on specifics of the project. The Town Board also received the feasibility analysis prepared by the Town’s consultant, Calgi Construction. The next step for this project is to prepare construction plans and bid documents. Approval is being requested to retain Calgi Construction and Michael Smith Architects to prepare the plans and bid documents. The Board discussed the financing for the project and the timing for a referendum. Bond council has advised the Town that the entire amount of the financing can be listed as one item on the referendum ballot. The referendum will be scheduled after the receipt of the bids. Lease Agreement – Rental Ladder Truck & Purchase of Ladder Truck The lease agreement was discussed and its approval will be subject to the form of agreement by the Town Attorney. Chief Russo discussed the details of the new firetruck. Proposed Legislation – Parking on Boston Post Road – Food Trucks It was noted that the food truck has not been seen in quite some time. The Town Board discussed waiting until the fall to determine if a problem still exists. Westchester Power Renewal / Community Choice Aggregation – Memorandum of Understanding The Town Board reviewed a recap memo from Supervisor Seligson, as well as the draft Memorandum of Understanding. Approval of this memorandum of understanding is on the regular agenda for approval this evening. 1 August 22, 2018 Discussion – Westchester Joint Water Works Rate Increase The Town Board reviewed a memo from Mr. Altieri discussing the evaluation of a proposed water rate increase. Mr. Altieri’s memo also outlined the Town’s Water District expenses for 2018 and projections for 2019. The Town Board would like to announce the rate increase this evening, but will not vote on its approval it until the next Town Board meeting. The Town is proposing a 3.5% increase, effective September 1, 2018. Discussion – Veterans Memorial – Myrtle Boulevard The Town has been contacted by Al Bender, a Town resident and former Commander of American Legion 347who would like to raise funds to restore the Veterans Memorial at Myrtle Park. There are some different opinions as to how it should be restored, and Liz Paul had contacted restoration companies in order to generate how best to repair it. One cost estimate received was $40,000. The Town will await further contact from Mr. Bender. Review of Proposals – RFQ Comprehensive Plan Supervisor Seligson stated that the next three items on the worksession agenda are all integral to the Comprehensive Plan. Supervisor Seligson thinks it would be helpful to look at these under the guidance of a consultant; especially since these proposals had a shorter time frame for completion than expected. The Town Board reviewed the three proposals and the experiences of each firm. The Town Board would like to invite them each to come for an interview. Supervisor Seligson added that Memorial Park should be added as a priority item on the agenda for the Comprehensive Plan. ADDED ITEM It was announced that the Town will be hosting a ‘Car Fit’ for Senior Citizens’ to be held in Commuter Lot #1 st on October 1. This is a program to help seniors set up their vehicles safely. Supervisor Seligson noted that the September 11 Ceremony is planned and invites are going out. Councilwoman Elkind Eney updated the Town Board on the recent meeting of the United Westchester Executive Committee. The Executive Committee is chaired by County Executive George Latimer and State Assemblyman David Buchwald. It is comprised of representatives of some municipalities, some County Legislators and some State Assemblymen and was formed to address the poor response by Con Edison and NYSEG to the storms last March. Representatives of Con Edison and NYSEG were at a public hearing earlier this year. Representatives of the Public Service Commission are scheduled to meet with the Executive Committee of United Westchester. Update – Street Light Services – Celtic Energy Mr. Altieri recapped the current issues of concern with the Energy Service Contract with Honeywell. They are as follows: 1) The software running the lights is close to obsolete 2) There are problems with the fixtures themselves 3) When retrofitted Con Edison performed an analysis of the fixtures, and that process was not done correctly. Based on the performance contract, $70,000 is currently due to the Town from Honeywell. Celtic Energy has completed both phases of their analysis, the second phase focused strictly on the street lighting. The Town Board would like Celtic Energy to discuss and explain their findings specific to the second phase. The Town will then bring all the parties together for a final resolution. Update - Washington Square Residential Parking Permit Usage It has been brought to the Town’s attention that there appears to be abuse of the Washington Square residential parking permit system. The Town would like to make the guidelines for receiving these permits stricter. The Town Clerk distributed a draft proposal for stricter guidelines for obtaining a permit. Update – Old Jefferson Street Mr. Altieri stated that it appears the portion of Old Jefferson proposed for sale to 16 N. Chatsworth Avenue is owned by Westchester County. This may have happened when the County transferred Memorial Park to the 2 August 22, 2018 Town in 1962, and a strip of land may have gotten overlooked. Mr. Altieri has been in contact with the County, and a title report is also being conducted by Ken Gould, a representative for 16 N. Chatsworth. Discussion – Shared Police Dispatch Supervisor Seligson stated that at the recent Town Village School (TVS) Meeting there was discussion of utilizing a shared dispatch for Police. During the meeting each municipality was asked to bring this back to their Boards for discussion. It was also noted that the Westchester Municipal Officials Organization is reviewing a civilian dispatch proposal. Supervisor Seligson will report back to the TVS that the Town is open to further discussions. Update – BLD Diner Site Mr. Altieri noted that he and Bill Maker have had an additional meeting with the owners of the BLD Diner. The owners are closing the diner and an initial proposal was for an AutoNation Jaguar dealership. The latest proposal is to build housing. The BLD site has been consolidated, but does not include the site of Fuji Mountain. The initial concept is for 80 units at 7 stories. Mr. Altieri noted that at the meeting the owners were informed that as Town law requires, any residential development would need to include affordable housing. Additionally the Town would like to see a ‘Green’ component. ADDED ITEM Supervisor Seligson informed the Board that the NYS Department of Environmental Conservation (DEC) has st declared the Larchmont Reservoir to have a harmful alga bloom. The DEC took samples on July 31. Supervisor Seligson will follow up with the Village of Larchmont, who owns the Lake, to discuss a public announcement. On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss the purchase of land. EXECUTIVE SESSION Purchase of Land On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PUBLIC HEARING –“ Restriction on Parking on the Portion of the West Side of North Chatsworth Avenue from Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue” Law The following Notice of Public Hearing is entered into the record as follows: LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on July 11, 2018 a Public Hearing will be held on Wednesday, August 22, 2018 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Restriction on Parking on the Portion of the West Side of North Chatsworth Avenue from Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue” Law. 3 August 22, 2018 Purpose The parking of automobiles on the west side of North Chatsworth Avenue from the corner formed by the intersection of the west side of North Chatsworth and the south side of Lafayette Road to the driveway entrance to 35 North Chatsworth Avenue creates visual obstructions for automobiles. Preventing parking along this length of the west side of North Chatsworth Avenue will improve safety for automobiles and pedestrians. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: July 19, 2018 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously opened. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. Ed Lieber, a resident of N. Chatsworth Avenue, stated that commuter parkers seem to be taking over the Town. Supervisor Seligson responded that this is not a new problem, and the Town plans to address this in an upcoming Comprehensive Plan. Elizabeth Fishman, 1 Overlook Circle, stated that she is concerned that if you restrict parking on N. Chatsworth Avenue the overflow will move to Overlook Circle. Mary McCarthy, spoke of the dangerous turn coming out of Edgewood Avenue onto N. Chatsworth Avenue. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously closed. On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the following Local law was approved: Local Law No. 6 - 2018 This local law shall be known as the “Restriction on Parking on the Portion of the West Side of North Chatsworth Avenue from Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue” Law. Preventing parking along this length of the west side of North Chatsworth Avenue will improve safety for automobiles and pedestrians. 4 August 22, 2018 Section 2 – Restriction on Parking on a Portion of the West Side of North Chatsworth Avenue from its Intersection with Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue No motor vehicle shall be parked on the west side of North Chatsworth Avenue from the corner formed by the intersection of the west side of North Chatsworth Avenue and the south side of Lafayette Road to the driveway entrance to 35 North Chatsworth Avenue. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of North Chatsworth Avenue indicating where and when parking is prohibited by this law. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz ABSENT Seligson Aye SUPERVISOR’S SUMMARY REPORT August is typically a quiet month in the Town of Mamaroneck as camp ends and many employees and residents travel for vacation. We had a successful summer of community activities with 4 outdoor concerts and one movie. We have the last outdoor movie, Toy Story, scheduled for Friday th September 7. Thanks to volunteers and the Sustainability Collaborative, the concerts and movies were zero-waste events resulting in as little waste as possible because most food and trash were recycled. The Town summer day camps were all well attended and successful. The restoration and planting plan for Gardens Lake, aka the Duck Pond, will go out to bid in late August for a fall installation. The LGCA helped fund the purchase of water fountain bubblers in the pond to decrease the algae in the lake. The Town was fortunate not to experience serious flooding during the heavy and frequent rain storms this past month. The Town’s capital work to repair sanitary sewer lines will go out to bid in the fall for a proposed winter start date. We expect to repair all of the sewer lines in the New Rochelle Sewer District and up to 50% of the lines in the Mamaroneck Valley Sewer District. That is good news. stth Please remember that the 1 installment of school taxes are due September 30. I know my reports for September will be quite different with much more activity. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. Cathy Sears and Tom Dorf, representing the Larchmont Gardens’ Civic Association, addressed the Town Board. Ms. Sears thanked the Town, on behalf of the Association, for how beautiful the Lake looks. She then asked for an update on the path along the Lake. Mr. Altieri responded by stating that completion is expected in late October. Mr. Dorf stated that information was received regarding fescue grass as not being liked by geese. Supervisor Seligson stated that the Town is aware and is planning to plant fescue grass. The invasive vines along the Brook were noted, and Supervisor Seligson responded that the Highway Department will get a handle on it before it gets too out of control. An update on the repair work being done on Myrtle 5 August 22, 2018 Boulevard was requested, and Mr. Altieri responded that this is not a permanent fix and the Town is working with Con Edison on the permanent repairs. Finally it was noted that there are locations where hedges are causing blind spots. Ms. Sears will email the list to Mr. Altieri for follow up. Authorization – Equipment Lease Agreement On motion of Commissioner Elkind Eney, seconded by Commissioner King, it was RESOLVED, that the Town of Mamaroneck Board of Fire Commissioners does hereby approve the Lease Agreement between the Town of Mamaroneck Fire District and SWD Seagrave to lease a 1999 Seagrave Aerial Truck, subject to approval of the form of the agreement by the Town Attorney, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization – Purchase of Fire Department Ladder Truck On motion of Commissioner Elkind Eney, seconded by Commissioner King, the following was approved, WHEREAS, with the cancellation of the last aerial truck order the Fire Department has been researching an alternative apparatus and has prepared a recommendation for the Fire Commission’s approval. NOW THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck Board of Fire Commissioners does hereby approve the purchase of one Seagrave Custom Aerial Ladder Truck at a total cost of $1,239,071, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to sign off on the purchase order pursuant to the Town’s Contract with H-GAC. Authorization – Preparation of Fire House Renovation Plans and Bid Documents On motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, it was RESOLVED, that the Town of Mamaroneck Board of Fire Commissioners does hereby approve the contracts with Calgi Construction and Smith & Pucillo Architects to prepare the plans and the bid documents for the Fire House Basement Renovation, at a total cost of $24,000, and BE IT, FURTHER 8 August 22, 2018 RESOLVED, that the Town Administrator is hereby authorized to execute said contracts on behalf of the Town and the Board of Fire Commissioners. Set Public Hearing – Parking Restrictions – Murray Avenue at Forest Avenue On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on “ Restriction on Parking on a Portion of the East Side of Murray Avenue from its Intersection with Forest Avenue” Law, for Wednesday, September 5, 2018 at 8:00PM at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, 9 August 22, 2018 RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. Authorization – Management and Non-Union Employees On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the 2018 Salary Schedule for Management and Non-Union Personnel and the associated recommendations for compensation, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to amend employees agreements as required to account for the compensation changes. Authorization – Celtic Energy On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby accept the June 28, 2018 proposal from Celtic Energy to compile the contract resolution services with Honeywell Inc., at a cost of $16,300, including travel, for the scope of tasks listed in the proposal, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Approval – Memorandum of Understanding - Westchester Power / Community Choice Aggregation On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute the Memorandum of Understanding between the Town of Mamaroneck and Sustainable Westchester, Inc., the purpose of which to establish participation in the Community Choice Aggregation Program, for the Con Edison service area, to be managed on the Town’s behalf by Sustainable Westchester, subject to the following conditions as per the memorandum dated July, 31, 2018 from Nancy Seligson, Supervisor as follows: 1. Sustainable Westchester shall secure a “compliant bid” – i.e. that the price per kilowatt hour for the Green Option is less than the average Con Edison price for the same customer class over the proceeding twelve (12) month period (“the Benchmark”) 2. The price secured shall be guaranteed for a twenty (24) month period 3. A customer may “opt out” at any time without penalty or charge. 4. The electricity supplier is determined as having the creditworthiness and overall financial capacity to meet its obligations under its contract with Sustainable Westchester and the Town of Mamaroneck. 5. The Memorandum of Understanding is substantially the same as to form and content as that which the Town entered into previously and is subject to final review by the Town Attorney. Westchester Joint Water Works Rate Increase The Town Board presented the Town Water District expenses for 2018 and the projections for 2019, with the anticipation of a water rate increase proposed at 3.5% effective September 1, 2018. The Town Board will vote on this rate increase at the September 4 Town Board Meeting. 8.
