CALL TO ORDER The Supervisor called the meeting to order at 8.15 p. m, ROLL CALL Present; Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Cook Absent. None Also Present. Mr, Gronberg - Town Clerk Mr, Delius - Town Attorney Mrs, Brewer - Secretary Mr. Altieri - Town Accountant Mr, Kellogg - Town Engineer Mr, Orsino - Receiver of Taxes Mr, Fischer - Supt, of Highways Mr, Stahr - Chairman , Recreation Commission APPROVAL OF MINUTES The minutes of the regular meeting of May 2nd, 1962, on motion duly made and seconded, were approved as submitted, OLD BUSINESS There was no old business to come before the meeting, NEW BUSINESS a, Application for Swimming Pool (Max Youngstein, Hommocks Road) Upon presentation of the subject application, in accordance with the Building Inspector's recommendation that the permit be granted following his inspection of the site for the proposedpool and review of the plans, on motion by Councilman Brush, sec- onded by Councilman Cook, the following resolution was adopted unanimously with direction that certified copies be forwarded to the Building Inspector and applicant. WHEREAS, Max Youngstein heretofore presented an appli- cation for a permit to construct a swimming pool and ap- purtenances on premises located on Hommocks Road, Town, and known as Block 417, Parcel 50 on the Tax _I- Assessment Map of the Town of Mamaroneck; and WHEREAS, the Building Inspector of the Town of Mamar- oneck has examined the plans and specifications for the proposed pool; and WHEREAS, the Building Inspector finds that the plans - and specifications for the proposed pool conform in all respects with the requirements of the swimming pool or- dinance (Article 23 of the Building Code), and therefore recommends that the application be approved; NOW, THEREFORE, BE IT RESOLVED, that the application of Max Youngstein for a permit to construct a swimming pool on his premises lo- cated on Hommocks Road, Town, and known as Block417, Parcel 50 on the Tax Assessment Map of the Town of Ma- maroneck, is hereby approved and the Building Inspector is hereby authorized to issue a permit for same provided the pool is constructed in conformance with the plans and specifications submitted and filed with the application, and be it FURTHER RESOLVED, that all work as shown on the said plans must be completed and an occupancy certifi- cate permit obtained from the Building Inspector before the pool is filled and put in use, b. Authorization for Collection of School Taxes - 196z The Supervisor presented a memorandum addressed to him by the Receiver of Taxes under date of June 19th, 1962, con- taining detailed information regarding the implementation of the new legislation permitting payment of school taxes in two installments without penalty, which was herewith ordered re- ceived and filed for the record; A discussion followed during which the Supervisor briefly ex- plained the additional costs involved, and thereupon on a mo- tion by Councilman Brush, which was seconded by Council- woman Helwig, the following resolution was adopted by unani- mous vote: RESOLVED, that the Town Board of the Town of Mamar- oneck, in accordance with Section 550a of the Westches- ter County Tax Act, being Article 16 of the Westchester County Administrative Code as amended by Chapter 386 of the Laws of 196z, does hereby authorize the Receiver of Taxes of the Town of Mamaroneck to accept from any taxpayer two partial payments in equal installments for, or on account of, school taxes and apply such payments on account thereof, and that he shall accept payment of said school taxes in full at the discretion of the taxpayer or as stated in two partial payments, with the first in- stallment being due and payable in the month of Septem- ber and the second being due and payable in the month of -z- January following, provided that no installment may be paid unless the first installment of current schooltaxes, including interest and penalty, shall have been paid or is paid at the same time. If the second partial payment is received during the month of January, no interest or penalty shall be charged against the second partial pay- ment; and be it FURTHER RESOLVED, that as provided in said statute, unless the first partial payment is received during the month of September and the second partial payment is received during the month of January, the penalty pro- vided for payment of school taxes, as set forth in Sec- tion 542, shall be applicable as follows' First Installment September - No penalty October - 2% November - 5% December & January - 7% February & March - 10% April & thereafter up to date of sale - 12% Second Installment February & March - 10% April to date of sale - 12% and be it FURTHER RESOLVED, that the first installment shall be due and payable and become a lien on the taxable property of the school district on September 1st, 1962, and the second installment on January lst, 1962; and be it FURTHER RESOLVED, that the Town Clerk, the Comp- troller, the Receiver of Taxes, and the Assessor shall prepare a suitable form of tax receipt, to be prepared at the expense of the Town; and be it FURTHER RESOLVED, that pursuant to Section 551 of Chapter 386 of the Laws of 1962, a statement concern- ing the tax information be printed, and the Receiver of Taxes shall mail with each receipt for taxes a printed copy of such statement; and be it FURTHER RESOLVED, that the schedule of penalties be as follows' -3- Penalty Schedule lst half 2nd half September No penalty --- October 2% --- November 510 --- December & January 710 --- February & March 1010 1010 April to date of sale 1210 1210 and be it FURTHER RESOLVED, that this resolution shall take effect immediately, ce Requests for Water Main Installations 1, Application of Adam Sumetz (For Park Hill Lane) Following presentation of an application by Adam Sumetz for the installation of a water main in Park Hill Lane at the ap- plicant's expense, together with memorandum from the Town Engineer, dated June 27th, 1962 recommending ap- proval of such installation, and cost estimate from the West- chester Joint Water Works under date of July 9th last, here- with received and filed for the record, on motion by Council- man Brush and seconded by Councilman Cook, the following resolution was adopted by unanimous vote. RESOLVED, that the Town Board of the Town of Ma- maroneck hereby approves the installation of approx- imately 250 linear feet of C,I, water main in accor- dance with approved plan in Park Hill Lane at a cost of $l, 051, 16 not including excavation, backfill and pavement restoration; and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Adam Sumetz, paying the en- tire cost of said installation, depositing the sum of $1, 051, 16 with the Westchester Joint Water Works No. 1 for material and labor costs, and paying all costs for excavation, backfill and pavement restora- tion; and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Adam Sumetz, furnishing the Town with any easements required, such easements to be subject to the approval of the Town Attorney and delivered to him prior to installation; -- and be it FURTHER RESOLVED, that unless the installation of the foregoing main is completed within a period of one (1) year from the date of this resolution, or not later than July 11th, 1963, this authorization shall become null and void, -4- 2, Application of Warren Lewin (For Nancy Lane) Following presentation of the application of Warren Lewin for the installation of a water main in Nancy Lane at the applicant's expense, together with memorandum from the Town Engineer, dated June 27th, 1962 recommending ap- proval of the installation, and cost estimate from the Westchester Joint Water Works under date of April 24th, _- 1962, herewith received and filed for the record, on mo- tion by Councilman Kane, seconded by Councilman Brush, the following resolution was adopted by unanimous vote* RESOLVED, that the Town Board of the Town of Ma- maroneck hereby approves the installation of approx- imately 220 linear feet of water main in accordance with approved plan in Nancy Lane from Palmer Ave- nue to the end of cul-de-sac, at a cost of $1, 595, 06 not including excavation and backfill; and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Warren Lewin, paying the entire cost of said installation, depositing the sum of $1, 895, 06 with the Westchester Joint Water Works No, 1 for material and labor costs, and paying all costs for excavation and backfill; and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Warren Lewin, furnishing the Town with any easements required, such ease- ments to be subject to the approval of the Town At- torney and delivered to him prior to installation; and be it FURTHER RESOLVED, that unless the installation of the foregoing main is completed within a period of one (1) year from the date of this resolution, or not later than July 11th, 1963, this authorization shall become null and void. 3. Application for Water Main (Not on Agenda) (For Lakewood Lane) Following presentation of an application by Protano, Inc, for the installation of a water main in Lakewood Lane from Wea- ver Street to the end of the cul-de-sac at the applicant's ex- pense, together with memorandum from the Town Engineer, dated July 11th, 1962, herewith received and filed for the record, on motion by Councilman Brush and seconded by Councilman Kane, the following resolution was adopted by unanimous vote* RESOLVED, that the Town Board of the Town of Ma- maroneck hereby approves the installation of approx- imately 220 linear feet of 2" water main in accord- ance with approved plan in Lakewood Lane at a cost of $626.46; -5- and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Protano, Inc. , paying the entire cost of said installation and depositing the sum of $626.46 with the Westchester Joint Water Works No. 1 for material and labor costs together with the cost of excavation and backfill as included in the estimate; - and be it FURTHER RESOLVED, that this approval is contin- gent upon the applicant, Protano, Inc. , furnishing the Town with any easements required, such ease- ments to be subject to the approval of the Town At- torney and delivered to him prior to installation; and be it FURTHER RESOLVED, that unless the installation of the foregoing main is completed within a period of one (1) year from the date of this resolution, or not later than July 11th, 1963, this authorization shall become null and void. d. Transfer of Funds within Park District No. 1 Budget In accordance with the request of the Comptroller, herewith presented and filed, on motion by Councilwoman Helwig and seconded by Councilman Cook, it was unanimously RESOLVED, that the transfer of the sum of $1, 000. 00 from Park District No. 1 Surplus Funds to Park Dis- trict, line item - "supplies & other expenses" - in the 1962 budget, be and it hereby is authorized. -7- G OMMUNICATIONS 1, Permits for Sewer Extensions (State Health Department) For the Board's information, the Clerk presented communi- cations from the State Health Department, dated June i2th and 15th, enclosing permits for sewer extensions in Park Hill Lane and Nancy Lane respectively, which were herewith - ordered received and filed, (Not on Agenda) 1. Request for Rezoning (Novak Property) The Clerk presented a communication dated July 10th, 1962 addressed to the Supervisor by Edward Tanenbaum, attorney for Rudolph Novak, requesting rezoning of the second 200 feet in the rear of Mr. Novak's property situated at the cor- ner of Hommocks Road and Boston Post Road, from resi- dence to business use. Whereupon, on motion by Councilman Kane, seconded by Councilman Brush; it was unanimously RESOLVED, that the request of Rudolph Novak for re- zoning of the second 200 feet in the rear of his prop- erty located on the corner of Hommocks Road and Bos- ton Post Road in the Town, from "residence" to "bus- iness" use, be and it hereby is referred to the Town of Mamaroneck Planning Board for study and recom- mendation to this Board. The Board directed that the applicant be so notified. Z. Communication - County Board of Elections The Clerk presented a communication from the County Board of Elections, dated July 10th, 1962, requesting that voting machines be used for the Primary election in the 26th Con- gressional District, Following discussion as to the additional costs involved and the number of properly equipped machines available in the Town, the Board directed that action on the request be de- ferred pending further information following the next meet- ing of the Board of Supervisors, Mrs, Betty Kaufman At this time, the Chair recognized Mrs. Kaufman, attending the meeting representing the League of Women Voters, who called attention to a letter addressed to the Board of Super- visors by the League proposing as an economy measure, the consolidation of those election districts located in one polling place for registration purposes, which she requested the Board to support, -8- In discussing the proposal, certain questions which had been raised by the Board of Elections pertaining to possible in- crease of errors and the effect eliminating experienced per- sonnel might have on elections, were pointed out, and inview of this, it was directed that the matter be held over pending the Supervisor's report on the Board of Supervisor's action thereon at its next meeting, 3. Communication from William A. Gunn (Request to Erect Dam) The Clerk presented a communication from William A. Gunn requesting permission to construct a small dam across a stream flowing through his property located on Old White Plains Road, north of the Town-Village line, and enclosing a detailed drawing for the proposed dam, which was ap- proved by the Town Engineer under date of July 9th, 1962, Whereupon, on motion by Councilman Kane, seconded by Councilman Brush, the following resolution was adopted by unanimous vote- WHEREAS, William A. Gunn, owner of property lo- cated on the west side of Old White Plains Road about 400 feet north of the Town of Mamaroneck- Village of Mamaroneck line and known as Block 315, Parcel 167 on the Tax Assessment Map of the Town of Mamaroneck, has applied for permission to con- struct a dam across a small stream flowing through his premises; -- and WHEREAS, the Town Engineer has approved the construction of said dam in accordance with the de- tail drawing submitted and filed with the application; NOW, THEREFORE, BE IT RESOLVED, that pursuant to the provisions of the resolution adopted by this Board on July 5th, 1961 regarding Stream Control pursuant to Section 64, subdivision 10a of the Town Law, this Board ap- proves the request of William A. Gunn and hereby grants permission for the construction of the dam provided it conforms in all respects with the de- tail drawing submitted by the applicant and ap- proved by the Town Engineer and with the Stream Control Ordinance, The Clerk was directed to notify Mr. Gunn of the approval of his request and forward to him a certified copy of the fore- going resolution, REPORTS The Town Clerk -- The Clerk presented the following reports, which were ordered -9- received and filed: Report of the Receiver of Taxes and Assessments for the month of June, 1962, Report of the Building Inspector for the month of June, 1962. Town Clerk's report for the month of June, 1962, Report of the Westchester Shore Humane Society, Inc, for the month of May, 1962, Report of the Westchester Shore Humane Society, Inc, for the month of June, 1962, Report of Receipts and Disbursements, Town of Ma- maroneck, for the period from January 1 - May 31, 1962, Councilwoman Helwig -- 1; Myrtle Boulevard Park and Playground (Request to Advertise for Bids) Councilwoman Helwig presented the plans for the proposed construction of Myrtle Boulevard Park and Playground as prepared by the Town Engineer, stating that it was hoped that the specifications would be completed shortly. She described in some detail the layout for the park and play- ground areas, calling attention to the facilities offered, and to that part of the work to be performed by Town de- partments She spoke of the intensive work and study that had gone in- to the preliminary planning, highly commending the Park and Recreation Commissions on their excellent coopera- tion during this entire period, and explained that authori- zation to advertise for bids for this proposed construction, to be returnable September 5th, was requested at this time so as to avoid any delay in publication upon completion of the specifications since time was of primary importance to the completion of any part of the project by the spring of '63. Therefore, in accordance with the Engineer's request and on motion by her and seconded by Councilman Kane, it was unanimously RESOLVED, that in accordance with law, the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for bids for the proposed construction of Myrtle Boulevard Park and Play- ground, said bids to be returnable September 5th, 1962 and to be in accordance with the plans and spec- ifications set forth in the notice, -10- u"sLh�x 2. Recreation Commission a) Summer Recreation Program (Enrollment) Councilwoman Helwig reported an enrollment of 852 in the Summer Recreation Program on July 9th, stating that this was the highest enrollment reached as of that date since the Town had taken over the administration of this program, b) Dillon Park (New Playground Program) Councilwoman Helwig reported on the new playground program to be conducted daily from 1 to 4 p.m, un- der supervision at Dillon Park, presenting for the record, a copy of the "Notice" giving the details of the program, which had been issued by the Recrea- tion Commission and distributed to all property ow- ners in the area. c) 4th of July Program (Flint Park) Councilwoman Helwig reported briefly on the 4th of July celebration program at Flint Park, describing this year's program as being particularly outstand- ing and successful. She highly commended Mrs, Ruth Green, who served as Chairman of the event, along with all of her fellow- committee members, and paid particular tribute to the members of the Town Fire Department, without whose cooperation and unstinting effort, the day-long program could not have enjoyed the success it had, Councilman Kane -- 1. Presentation of Communications Addressed to the Highway Department Councilman Kane, as liaison to the Highway Department, called to the Board's attention three letters which had been addressed to that department in high commendation of its work. The communications, which were read and ordered re- ceived and filed for the record, were from -- 1) The Garden Club of Larchmont 2) The Larchmont Gardens Civic Association 3) Mr. W. R. Kuntz on behalf of the Board of Directors, Bonnie Briar Country Club -11- �.; Councilman Brush -- Councilman Brush stated that he had no report other than Fire matters, Councilman Cook -- 1, Reappointment to Planning Board (Mr, D. B. Follansbee) Councilman Cook informed the Board of the expiration of Mr. Follansbee's term of office as a member of the Plan- ning Board and recommended his reappointment thereto after highly commending his service on this Board and ad- vising that Mr. Follansbee was willing to continue in this service. Whereupon, on his motion, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that Dudley B. Follansbee be and he hereby is reappointed a member of the Planning Board of the Town of Mamaroneck, to serve for a term of office for five (5) years, effective as of July 7th, 1962 and terminating on July 6th, 1967, The Clerk was directed to so notify Mr. Follansbee, ex- pressing the Board's appreciation of his past service and its pleasure that he was willing to continue to serve the Town in this office, 2, Apportionment Councilman Cook presented the following petition received from the Assessor for the correction of the assessmentroll so as to permit the apportionment of taxes, and on his mo- tion, which was seconded by Councilman Brush, the follow- ing resolution was adopted unanimously: WHEREAS, the Assessor has presented the following petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Adminis- trative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petition for the correction of said assessment roll: -- NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1961, School Taxes of 1962, and the assessment roll of 1962, taxes of 1963, which shows property now appearing on the roll as follows: -12- 94 Block Parcel Name Land Imp Total 607 721 Carlton H. Sumetz 2, 000 2, 000 607 886 John P. White & W 2, 000 10, 500 12, 500 The Town Attorney -- 1. Annexation Petition The Attorney presented a petition filed with the Supervisor by George E. Baldwin Inc. through Meighan & Necarsulmer, At- torneys, for the annexation to the Village of Mamaroneck of certain territory adjoining said village, reviewing and ex- plaining the procedure mandatory to be followed pursuant to law in such instances, and advising that since, upon examin- ation, the petition had been found to be in order, a public hear- ing thereon must be held on the subject property with notice thereof duly published and posted in accordance with law. Following discussion, during which the matter of a former request for lower zoning of the said property, which had been withdrawn, was reviewed and the question of the possible use of this property for a school site called to attention, Council- man Cook suggested that the Supervisor use all possible means to prevail upon the Village Board of Trustees to set-up zoning complying with that of the Town for said property should it consider taking same and further, so advise the applicant. Whereupon, after further discussion, it was ordered that the hearing be held on the evening of July 24th, at 7.30 p.m. , and thereupon, on motion by Councilman Brush, seconded by Coun- cilman Kane, it was unanimously RESOLVED, that the Town Clerk be and he hereby is authorized to publish and post the following notice set forth under the signature of the Supervisor of the Town of Mamaroneck in accordance with law, and to mail to each signer of the subject petition, a copy of such notice- ----------------------------- x Notice of Hearing on Proposition to Annex Territory to the Village of Mamaroneck, New York, ----------------------------- x NOTICE IS HEREBY GIVEN, in pursuance to section 348 of the Village Law, that a petition by GEO. E. BALDWIN INC. for the annexation to the Village of Mamaroneck of certain territory adjoining saidvillage -13- has been received by the Supervisor of the Town of Mamaroneck, being the town in which saidter- ritory and part of said village are located, and that on July 24, 1962, at 7.30 p.m. on that day, at 307 Rockland Avenue, Mamaroneck, New York, which is situated in said territory, a hearing will be had upon said application and in the matter of giving written consent thereto by the members of the Town Board of such town qualified to execute such consent. The members of the Town Board qualified to sign such consent will meet at the time and place above specified and will hear any objections which may be presented against such proposition for annexa- tion upon any of the following grounds. a) That a person signing the petition is not qual- ified therefor, or b) That the persons signing such petition do not constitute a majority of the persons residing within such territory qualified to vote for town officers, or c) That the persons signing such petition do not represent the owners of a majority in value of the property within such territory as- sessed upon the last preceding town assess- ment roll, or d) That the petition does not otherwise sub- ; stantially comply in form or content with the provisions of Section 348 of the Village Law of the State of New York, All objections must be in writing and signed by one or more resident taxpayers of the town in whichthe territory proposed to be annexed is situated, Dated. Burchell Supervisor of the Town of Mamaroneck 2, Dog Control Ordinance The Attorney presented the proposed new Section 4 of Chap- ter V of the General Ordinance, requesting that a public hearing, necessary for the adoption thereof, be held at the Board's next regular meeting and that the Clerk be author- ized to publish notice thereof. Whereupon, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that pursuant to law the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice of public hearing to be -14- held by this Board at its next regular meeting on August 1st, 1962, at 8:15 p, me in the evening of that day, for the purpose of considering the adoption of a new Section 4 of Chapter V of the General Ordinance as set forth in said notice, OTHER BUSINESS 1, Rental of Third Floor, Town Offices The Supervisor called to the Board's attention the matter of add- ing to the Town Offices, the 3rd floor space which was now avail- able at an additional monthly rental of $100, 00, such space to be cleaned and decorated by the landlord. He called attention to the present crowded conditions in the office space and the urgent need for additional storage facilities and recommended the rental of the additional space in order to alleviate present conditions.
