HomeMy WebLinkAbout1962_04_04 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD APRIL 4th, 1962, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEA- VER STREET, TOWN OF MAMARONECK. CALL TO ORDER In the Supervisor's absence, Councilman Brush called the meeting to order at 8.15 p. m. and offered the following mo- tion, which was seconded by Councilwoman Helwig, and adopted by unanimous vote of those present. RESOLVED, that Councilman Peter F. Kane, Jr. , senior member of the Board, be and he hereby is appointed to serve as temporary Chairman of the Board in the absence of the Chairman, Supervisor George D. Burchell. ROLL CALL Present. Mr, Gronberg - Town Clerk Mr, Delius - Town Attorney Mr. Altieri - Town Accountant Mr, Fischer - Supt. of Highways Mrs, Brewer - Secretary Mr, Kellogg - Town Engineer APPROVAL OF MINUTES On motion duly made and seconded, the minutes of the regular meeting of January 17th, 1962 were approved as corrected, and the minutes of the regular meetings of February 7th and 21st, 1962, as submitted, OLD BUSINESS 1, Report - Larchmont Gardens Apartments A progress report on the correction of violations at the Larch- mont Gardens Apartments, submitted by the Engineer and Building Inspector under today's date, was presented and or- dered received and filed for the record, with direction that the matter be continued on the agenda and further report sub- mitted at the next meeting of the Board, -1- FLOODING - MARCH 12th STORM Prior to proceeding with the regular order of business, the Chairman noted the large number of persons present and stated that the Chair would be glad to recognize anyone who wished to address the Board at this time in the interest of said persons' time and convenience. Whereupon, the persons listed below addressed the Board in vehement protest to the flooding which resulted from the storm on March 12th, claiming that much, if not all, of the flooding was due to the non-use of the Larchmont Reservoir for flood control and urging the Board to take whatever ac- tion necessary to effect such use of the reservoir. The lengthy discussion which followed concluded with Coun- cilman Kane assurring the group that a meeting with the Mayor and officials of the Village of Larchmont would be held before the end of the week, pending the meeting re- quested by the Supervisor in his letter to the Mayor-elect and referred to in the discussion, and directing that copies of the said letter, together with the article in tonight's lo- cal paper and memorandum from the Engineer following his meeting with the Village Administrator right after the storm, be forwarded to each of the persons present this evening. O'Keefe 5 Sheldrake Avenue Dr, George Rapp 482 Weaver Street NEW BUSINESS 1, Sewer Installation - Blossom Terrace In accordance with the recommendation contained in the -2- a, r ,a memorandum addressed to the Board by the Engineer with reference to a sewer problem in Blossom Terrace, here- with presented and filed for the record, on motion by Coun- cilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the in- stallation of an 8" sewer line in Blossom Terrace in accordance with the Town Engineer's direction, at a total cost not to exceed the sum of $1100. 00, 2. Request for Zoning Ordinances (Cross-County Lands Study Committee) In accordance with the request of the Cross-County Lands Study Committee, on motion by Councilwoman Helwig and seconded by Councilman Brush, it was unanimously RESOLVED, that the Town Clerk be and he hereby is authorized to supply a copy of the Zoning Ordinance of the Town of Mamaroneck to each member of the Cross-County Lands Study Committee, COMMUNICATIONS 1. Letters from Legislators The Clerk presented letters from Senators Hunter Meighan and E. Ogden Bush and Assemblymen Edwyn E. Mason and Anthony B. Gioffre acknowledging the receipt of resolu- tions urging the passage of certain bills, which were or- dered received and filed, 2. Letter from State Traffic Commission (Repeal of Order) The Clerk presented a communication from the State Traffic Commission, enclosing repeal of an order for cer- tain traffic signs, copy of which had been forwarded to the Chief of Police and which was ordered received and filed for the record, (Not on Agenda) 1. Request of Police Commission In accordance with the request of the Police Commission herewith presented and filed for the record, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the expenditure of the sum of $20. 00 to cover the ex- penses of three police officers at the Police Ad- ministration training school, to be conducted by -3- the F. B.1. in Rye, New York, on April 24th - 26th, and the sum of $10, 00 to cover the expenses of two officers at the Metropolitan Law Enforcement Con- ference session on gambling to be held at Manhattan College, New York, on Saturday, April 14th, 1962, said expenditures to be charged to the proper item in the 1962 Police Department budget, REPORTS The Town Clerk -- The Town Clerk presented the following reports which were ordered received and filed; Report of the Building Inspector for the month of March, 1962, Report of the Receiver of Taxes and Assessments for the month of March, 1962, Councilwoman Helwig -- 1, "Noise" Legislation Councilwoman Helwig reported that the proposed "noise" bill had been defeated in the Assembly, but in the Senate was referred back to the Motor Vehicles Committee for further study during the summer, which was at least of some encouragement. Councilman Kane, at this time, paid high tribute to Councilwoman Helwig and the Thruway Noise Abatement Committee for its hard work and effort this year in en- deavoring to obtain this legislation, 2, "Dillon Memorial Garden" Councilwoman Helwig presented a report outlining the plans for the planting of the new garden in memoriam to Mr, and Mrs, Henry R. Dillon, at the corner of Weaver Street and Palmer Avenue near the former Dillon residence, which was ordered received and filed. Pertinent thereto and in accordance with Councilwoman Helwig's request that the property to be used for this garden be transferred from General Town to the Park District, and on her motion, seconded by Councilman Brush, it was unanimously RESOLVED, that this Board hereby authorizes the transfer of the so-called "Weaver Street Chapel property", being an island at the inter- section of Weaver Street and Palmer Avenue, from General Town to Park District No, 1; -4- Councilwoman Helwig further requested that the press carry a notice to the effect that gifts to this memorial garden must be made prior to the middle of May in or- der to effect the planting schedule, 3, Doherty Property Councilwoman Helwig reported that the development of the Doherty property near Dillon Park was well under way. Councilman Brush -- 1, Attendance, Assessors Convention In accordance with a memorandum from the Assessor, herewith presented and filed, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that the Assessor be and he hereby is authorized to attend the Annual Meeting of the New York State Assessors Association, to be held in Rochester, New York, April 8th, 9th, 10th and llth, 1962, with expenses paid from the proper item in the 1962 Assessor's budget in an amount not to exceed the sum of $125, 00, 2, Widows Pension - Ruth E. Millheiser Councilman Brush presented an application for widow's pen- sion as submitted by Ruth E. Millheiser, widow of Phillip Millheiser, member of the Town of Mamaroneck Police De- partment who died on March 19th, 1962, together with cer- tified copy of resolution adopted by the Board of Trustees of the Police Pension Fund on March 27th, 1962, which were herewith ordered received and filed for the record. He requested that the application be granted and thereupon, in accordance with advice of the Attorney, on his motion which was seconded by Councilwoman Helwig, the follow- ing resolution was adopted by unanimous vote of those present, with direction that certified copy thereof be for- warded to the Treasurer of the Police Pension Fund: RESOLVED, that the resolution heretofore adopted on the 6th day of December, 1961, granting pen- sions to certain widows of retired policemen pursu- ant to Section 162 of the Retirement and Social Se- curity Laws of the State of New York as amendedby Chapter 265 of the Laws of 1960, is hereby amen- ded so as to include widows of deceased policemen who die subsequent to the date of said resolutionand file verified application for such pension on or be- fore December 31st, 1964; and be it -5- t ,z all FURTHER RESOLVED, that a pension of Six Hundred ($600, 00) Dollars per annum, to be payable monthly commencing on the 1st day of April, 1962 and contin- uing up to and including the last day of December, 1964, is hereby granted to Ruth E. Millheiser in ac- cordance with said resolution as amended, 3. Bill for Retirement Benefits for Policemen Councilman Brush advised the Board that the Police Commis- sion and Police Department had requested this Board to adopt a resolution urging the Governor to sign the bill proposing ad- ditional retirement benefits for policemen. Following some discussion and considerable question of this bill containing no limit of age of service, which point had been raised and questioned by the Supervisor and Town At- torney, on motion by Councilman Brush and seconded by Councilwoman Helwig, the following resolution was adopted by unanimous vote of those present, and the Clerk directed to forward certified copy thereof to the Counsel to the Gov- ernor, the Honorable Robert MacCratea WHEREAS, a bill to amend Chapter 791 of the laws of 1928 in relation to additional retirement benefits for policemen in certain towns was introduced in the Sen- ate by Senator Condon (SP 2645 - SI 2516) and has been approved by both the Senate and Assembly and is now before the Governor for action; and WHEREAS, it is deemed desirable for the Town of Mamaroneck to secure the passage of this bill; NOW, THEREFORE, BE IT RESOLVED, that this Board approves the bill knownas Senate Introductory 2516, Print No, 2645; and be it FURTHER RESOLVED, that the Board hereby re- quests the Governor to sign this bill so that it may become law; and be it FURTHER RESOLVED, that the Clerk send a certi- fied copy of this resolution to the Honorable Robert MacCrate, Counsel to the Governor of the State of New York, The Town Attorney -- 1, Notice of Meeting - Zoning Board of Appeals (City of New Rochelle) Upon the Attorney's report that none of the three applications (all within 500 feet of the Town boundary line) to be before -6- l the Zoning Board of Appeals of the City of New Rochelle on April 12th affected the Town, the communications were ordered received and filed, 2. Amendment of Highway Law (Garage Bill) The Attorney reported that on March 28th, the Governor had signed the bill amending the Highway Law so as to en- able towns to build garages for the housing of highway ma- chinery chargeable only againstthe unincorporated section of such towns. He further stated that with the passage of this bill, the Town had successfully effected another step in its contin- uing endeavor to eliminate through enactment of state leg- islation the inequities in charges against the villages for General Town improvements and services from which the villages receive no benefit, 3, Other Bills (Park Commission, Humane Society, Library) The Attorney also reported that there was no word as yet on the Park Commission, Humane Society, or Library bills, presently 30-day bills before the Governor for signature, The Engineer -- 1, Highway Garage The Engineer reported that plans and specifications for a highway garage were under preparation. Z. Area Adjacent to Carl's The Engineer reported that work was progressing on the preparation of the plans and specifications for the pro- posed development of the area on Myrtle Boulevard ad- jacent to Carl's Restaurant, ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared ad- journed at 9:20 P.m. , to reconvene on April 16th, 1962, BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was -7- convened 'immediately upon the adjournment of the Town Board meeting, 1. Claims Commissioner Brush presented the following Fire Depart- ment claims, which had been audited by the Comptroller and approved by the Fire Chief, requesting authorization for payment thereof. Whereupon, on motion by him and seconded by Commis- sioner Helwig, it was unanimously RESOLVED, that the following Fire Department claims be and they hereby are approved, and the Comptroller and Supervisor be and they hereby are authorized to pay the same out of the budget for the Fire Department: American LaFrance $ 24. 03 Carl Carpino 36. 00 Con Edison 50, 45 '' 5. 00 Barney Epstein, Inc, 644. 14 N. Reports Commissioner Brush presented the Fire Report for March, 1962, which was ordered received and filed, 3, Communications There were no communications to be presented at this time, 4. Other Business 1, Request for Signs for Dance Commissioner Brush advised the Fire Chief that the Department's request for the erection of two signs announcing the dance had been granted. 5, Adjournment There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:25 p.m. , to reconvene on April 16th, 1962.
