CALL TO ORDER The Supervisor called the meeting to order at 8;15 p.m. ROLL CALL Presents Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Cook Absent; None Also Presents Mr, Delius - Town Attorney Mr, Orsino - Receiver of Taxes Mr, Kellogg - Town Engineer Mr, Altieri - Town Accountant Mr, Fischer - Supt, of Highways Mr, Paonessa - Building Inspector Mr, Yerick - Chief of Police Mrs. Brewer - Secretary OLD BUSINESS 1, Report - Bids for Recreation Station Bus In accordance with the recommendation of the Recreation Commission presented by Councilwoman Helwig and here- with ordered received and filed, it was, on her motion which was seconded by Councilman Kane, unanimously RESOLVED, that in accordance with the Recrea- tion Commission's recommendation, this Board hereby accepts the low bid, to-wit the bid of Flinn Motor Corp„ for furnishing to the Town of Mamaroneck, one (,1} eight-passenger station bus type vehicle, equipped in accordance with the specifications set forth in the bid proposal, for the net price of $2, 034. 71, 2, Progress Report -Larchmont Gardens Apartments A progress report reciting the status of the correction of violations on the subject premises, submitted by the En- - gineer under todayts date, was presented and ordered re- ceived and filed with direction that inspections be con- tinued and further report presented at the next meeting, NEW BUSINESS R9 1, Annual Meeting, Association of Towns Upon presentation of the notice of the annual meeting of the Association of Towns of the State of New York with request for designation of the Town's voting delegate and alternate, on motion by Councilman Brush and seconded by Council- man Kane, it was unanimously RESOLVED, that Supervisor Burchell, Councilmen Kane, Brush, Helwig, Town Attorney Delius, Town Clerk :Gronberg, Town Accountant Altieri, Justice of the Peace Baxter, and Lt. Waterbury of the Po- lice Department, be and they hereby are authorized to attend the annual meeting of the Association of Towns of the State of New York, to be held in Buf- falo, New York, on February 14th, 15th, and 16th, 1962; and be it FURTHER RESOLVED, that Town Attorney Delius is hereby designated delegate of the Town of Ma- maroneck for the purpose of voting, and Council- woman Helwig, as alternate; and be it FURTHER RESOLVED, that the Comptroller be and he hereby is authorized to audit their claims for ex- penses, said expenses to be paid from the proper items in the 1962 budget, 2. Petition for Change of Name (Rosalea Road to Pheasant Run) Following presentation of a petition, signed by the residents of Rosalea Road, requesting the name of said street to be changed to Pheasant Run, since no objection was voiced to the proposed change, on motion by Councilman Brush and seconded by Councilman Kane, it was unanimously RESOLVED, that this Board hereby authorizes that the name of the street now known as Rosalea Road be changed to Pheasant Run; and be it FURTHER RESOLVED, that said change of name be shown on the official map of the Town of Mamar- oneck; and be it FURTHER RESOLVED, that the Police, Fire, and High- way Departments, and the postal authorities of the City of New Rochelle and the Village of Larchmont be noti- fied to this effect. 3. Highway Agreement for 1962 Upon request for the Board's approval of the Highway Agree- ment as presented, on motion by Councilman Kane and sec- onded by Councilman Cook, it was unanimously RESOLVED, that this Board hereby approves the Highway Agreement as presented for the year 1962, 4. Application for Special Permit Winged Foot Golf Club An application was presented for the construction of a swim- ming pool and adjunct facilities at Winged Foot Golf Club, together with a letter from David L. Eggers, Architect, and memorandum from the Building Inspector pertaining there- to, which were ordered received and filed for the record, The Supervisor then recognized Lee P. Gagliardi, attorney, appearing for the applicant, who stressed the need for early approval of this application and inquired whether, if nec- essary, special meetings of this Board and the Planning Board could be held so as to expedite procedure, The Supervisor outlined the procedure and time schedule in- volved, and following discussion of the effects of possible increased membership, traffic increase, and provision of adequate parking facilities, and after hearing J. W. Ather- ton, 3 Poccia Circle, Town, speak in opposition both as a member of the Club and resident of the area, on motion by Councilman Kane and seconded by Councilman Brush, the following resolution was adopted unanimously RESOLVED, that in accordance with Section 432 of the Zoning Ordinance of the Town of Mamaroneck, the application of Winged Foot Golf Club for the construction of swimming facilities, alteration of the present Caddy and Help=s Quarters, and erec- tion of a new building to house caddy facilities and cart storage, on property known as Section 3, Block 347, Parcel 1, be and it hereby is referred to the Planning Board of the Town of Mamaroneck _ for study and report to this Board; and be it FURTHER RESOLVED, that this Board hereby re- quests, pursuant to Section 274 of the Town Law, that the Planning Board submit such report to this Board prior to its next meeting on Wednesday evening, February 7th, 1962, Mr. Gagliardi expressed his thanks to the Board and requested the Supervisor to advise the Chairman of the Planning Board that he stood ready to give that Board any information or as- sistance which might be helpful to it in making its study. COMMUNICATIONS 1. Water Main, Oak Lane and Cove Road A memorandum from the Engineer, dated January 10, 1962, recommending authorization of a water main installation in Oak Lane and Cove Road, at joint cost to the Town, the Village of Mamaroneck, and Hampshire Country Club in proportion to benefit of each, together with copy of reso- lution adopted by the Village of Mamaroneck authorizing such installation, were presented and filed for the record, The Supervisor then explained in detail the benefits of such an installation to the Town, and thereupon, follow- ing further discussion, on motion by Councilman Brush and seconded by Councilman Cook, the following reso- lution was adopted unanimously. WHEREAS, it is necessary to install a 6" water main between the dead ends in Oak Lane and Cove Road in order to improve the water service in certain areas of the Town and Village of Ma- maroneck; and WHEREAS, the total cost of installing such main has been fixed at $7, 377,94 by letter of the West- chester Joint Water Works No, 1 under date of October 6, 1961; and WHEREAS, by reason of the benefits to be derived by it, the Hampshire Country Club has contributed the sum of $2, 750, 00 toward the cost of such in- stallation, leaving a balance of $4, 627, 94 to be paid by the Town and Village of Mamaroneck; and WHEREAS, it is deemed to be in the best interest of the Town that such 6" main be installed; NOW THEREFORE BE IT RESOLVED, that upon receipt of necessary ease- , ments to facilitate the installation of such main, a six inch (6") water main be installed between the ends of Oak Lane and Cove Road, and the West- chester Joint Water Works No, 1 be and it hereby is authorized to install such main at the estimated cost of $7, 377, 94, to be divided as follows. Hampshire Country Club - $2, 750,00; the Village of Mamaroneck - $2, 712.43; and the Town of Ma- maroneck - $1, 915. 51, representing the esti- mating benefits accruing to the respective muniei- palitie s; and be it FURTHER RESOLVED, that the sum of $1, 915. 51 covering the Town's share of the cost of said in- stallation be paid to the Westchester Joint Water Works No. 1, and charged to the line item - - Capital Costs - in the 1962 Water District No. 1 budget. For the record, it is noted that in accordance with resolution adopted by the Village of Mamaroneck on November 27, 1961 the Village Treasurer of that Village was authorized to turn over to the Westchester Joint Water Works No, 1, the check '95 in the sum of $2, 750,00 received by the Village from the Hamp- shire Country Club to cover the cost of its share of the instal- ! lation, 2. Installation of Street Lights - Murdock Woods A memorandum, dated January 8th and signed by the En- gineer, Police Chief and Supt, of Highways, was presented recommending that the installation of three street lights requested by the Murdock Woods Association be authorized and advising that funds were available therefor in the 1962 budget, In reply to question by Councilman Cook, Councilman Kane stated that it had not been planned to use the new type of lights as recently installed at Colonial and Murray Ave- nues and Weaver Street and Forrest Avenue, However, he said, it might be possible and since the cost factor was about the same, it was directed that the Engineer consult with the Murdock Woods Association to determine which type would be preferable in the area. Whereupon, on motion by Councilman Kane and seconded by Councilman Cook, it was unanimously RESOLVED, that this Board hereby authorizes the in- stallation of three (3) street lights to be located as listed below. Pole No, A22-KA - Murdock Road Pole No, A22-MA - Murdock Road Pole Nb, A22-RA - Split Tree Road at Salem Drive 3, Work Permits within County Road Area Upon presentation of notice from the County Department of Public Works requesting adoption of the resolution con- , tained therein pertaining to permits for work within the County Road area, on motion by Councilman Cook and sec- onded by Councilwoman Helwig, the following resolution was adopted unanimously: WHEREAS, pursuant to the provisions of Chapter 605 of the Laws of 1941, revised as of June 5, 1961, the Commissioner of Public Works of Westchester County with the approval of the Board of Supervisors and the County Executive of Westchester, has prescribed rules, regulations, safequards, specifications and conditions for the protection, reconstruction, main- tenance, or restoration of any County Road or por- tion thereof, and for the protection and safety of the travelling public thereon during any operations of -- reconstruction, maintenance, or restoration of such County Road or portion thereof, and WHEREAS, the said rules and regulations require any person, firm, corporation, improvement district, or municipality doing any work upon any County Road to obtain a written permit from the Commissioner of Pub- lic Works and to deposit a certified check made pay- able to the order of the County of Westchester in an amount computed by the extent of the proposed work, and WHEREAS, the said rules and regulations provide that any city, village, town, public improvement district, or other municipality may, in lieu of making the said mentioned deposit, file with the Commissioner of Public Works a certified copy of a resolution duly adopted by the Governing Board of such municipality guaranteeing faithful performance by the said munici- pality of all the terms, covenants and conditions as set forth in the permit, which resolution shall be ef- fective for permits issued during the remainder of the calendar year after adoption, and WHEREAS, the Town of Mamaroneck, from time to time, is required to do work within the County Road area for which a written permit from the Commis, sioner of Public Works of Westchester County is re- quired, and for which a certified check deposit is re- quired, NOW THEREFORE BE IT RESOLVED, that the Town of Mamaroneck does here- by guarantee faithful performance of all the terms, agreements, covenants and conditions of each and every written permit as referred to herein issued by the Commissioner of Public Works of Westchester County and that this guarantee of faithful perfor- mance of all the terms, agreements, covenants and conditions of each and every written permit as re- ferred to herein issued by the Commissioner of Public Works of Westchester County and that this guarantee of faithful performance shall be appli- cable to all such written permits issued during the present calendar year. 4. Public Notices The following public notices were presented., ordered received and filed and referred to the attention of the Town Attorneys (a) Notice of meeting of the Board of Appeals, Village of Scarsdale, on application of Quaker Ridge Golf Club. (b) Notice of meeting of the Board of Trustees of the Vil- lage of Mamaroneck on further amendment and change of Zoning Ordinance. (Public Hearing) (c) Notice of meeting (Public Hearing) of the Board of Trustees of the Village of Mamaroneck on further amendment and change of Zoning Ordinance. (Not on Agenda) 1 Petition - "Harry Davis School of Music" A petition, signed by residents of Bruce Road and submitted in protest to conduct of the "Harry Davis School of Profes- sional Music, Inc." at 1040 Old White Plains Road, with Circular describing school thereto attached, was presented, ordered received and filed, and referred to the Town At- torney for report at the next meeting, REPORTS The following reports were presented and ordered received and filed: Report of the Building Inspector for the month of De- cember, 1961, Report of the Westchester Shore Humane Society, Inc, for the month of December, 1961, The Supervisor The Supervisor advised the Board that the Clerk was absent due to illness, and at the Board's request, stated that he would convey its sympathy and best wishes for a quick re- covery to the Clerk, 1, Smoke Control The Supervisor presented a detailed report on - Smoke Con- trol Inspections and Permits for 1961-1962 Heating Season— submitted by the Town Engineer under today's date, which was ordered received and filed for the record, Councilwoman Helwig -- 1. Thruway Noise Abatement Committee Councilwoman Helwig reported that the Committee had com- pleted preparation of the standards for "noise" legislation which had been forwarded to Senator Meighan for bill- drafting purposes and that the bill, when returned, would be sent to the Board of Supervisors to obtain County-wide backing and support, Councilman Kane - Councilman Kane stated that he had no report at this time, Councilman Brush -- 1, Inspection of Fire Protection Facilities For the record, Councilman Brush reported that the inspec- tion of fire protection facilities by the New York Fire In- surance Rating Organization, which the Town had re- quested, was now underway. Letter from Fire Department (Election of Company Officers) Commissioner Brush presented a letter reporting the officers elected at the Company's annual meeting on January 15th, and requesting the Commission's ap- proval thereof. Whereupon, on motion by him and seconded by Com- missioner Kane, it was unanimously RESOLVED, that this Commission hereby ap- proves the election of the following members of the Town of Mamaroneck Fire Department to the following offices for the year 196Z- Engine Company #1 Eugene J.
