HomeMy WebLinkAbout2018_06_20 Town Board Minutes June 20, 2018 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON JUNE 20, 2018, BEGINNING AT 5:00PM, AT THE SENIOR CENTER/VFW, 1288 BOSTON POST ROAD, LARCHMONT, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00PM. Continued Discussion - Charitable Trust/Property Tax Credit Additionally Present: Town Comptroller Anthony Siligato As detailed by Mr. Maker in his memo dated June 15, there are two steps the Town Board will need to follow in order to move forward in approving the acceptance of Charitable Donations and Property Tax Credits. First the Town must adopt a resolution establishing a Charitable Gifts Reserve Fund and second granting a credit against real property taxes to those who contribute to the fund; the second step is done through a local law. The Town Board was provided a draft resolution and draft local law. The Town Board began by discussing the law establishing the Charitable Trust which requires the Town to acknowledge that no goods or services were provided for this donation. This statement is problematic. Supervisor Seligson thinks that as everyone realizes the hurdles, complications and lack of legality, it is becoming less popular. Mr. Altieri has had discussions with the Mamaroneck School Superintendent, Robert Shaps, adding that he thinks the school may move forward. The school would require the Town to facilitate the project on their behalf, as the school district has no mechanism for taking in funds. Mr. Siligato discussed the complicated implementation that will need to take place for the Town and or the School District. Mr. Altieri stated that he has not yet found an accountant who will allow their clients to submit a tax return using this deduction, because they do not feel it is legal under the IRS Code. The Town Board discussed timing, especially timing for the School District. The Town Board discussed what the incremental difference would be to the Town if it was already facilitating it for the School District. The Town Board will wait at least until the July 11 meeting to make a decision on whether to move forward. Supervisor Seligson will keep the Town Board apprised of what other municipalities are doing with respect to this. 2018 Road Resurfacing Project The Town Board reviewed a memo from Mr. Altieri dated June 18, 2018 detailing the Town’s road resurfacing program, as well as a memo explaining the mechanism for rating Town roads. Included was a schedule which included the ratings for all Town roads. The Town Board reviewed the 2018 list of roads scheduled for resurfacing which are Burton Road, Orchard Road, Clover Road and West Garden Road. Mr. Altieri noted that the Town will conduct a further road evaluation this summer to determine if there are any deviations from the previous rankings. ADDED ITEMS 1 June 20, 2018 Councilwoman Katz noted that she informed the Larchmont Gardens’ Civic Association about the Town’s decision not to move forward with the pathway around the Gardens Lake. Councilwoman Elkind Eney noted that the Town received approximately 500 Property Tax Grievances yesterday, a number much lower than past years. Update – Weaver Street Fire House The Town Board reviewed a memo from Rob Wasp the Town Engineer with a summary of construction charges/changes incurred for the Fire House Floor Reinforcement/Repair Project. The Town Board reviewed a table outlining the original construction contract, the costs of the changes and the final funding underage. Mr. Altieri gave details of the current issue concerning a leak in the basement. The Town Board discussed the timing for an additional referendum to cover the additional costs. Mr. Altieri will provide referendum paperwork at the July Town Board meeting. ADDED ITEM The Town Board discussed the date for their July meeting, with final determination of July 11. Approval of this will be added to the regular agenda for this evening. Update – Community Solar Project The Town Board reviewed a memo from Mr. Altieri dated June 14, 2018, detailing the Community Solar Project. The Board has previously discussed the development of a community solar project, specifically involving the Hommocks Park Apartments. The Town Board reviewed a Request for Proposals, which provides details and goals for the project. Request – Community Garden The Town Board reviewed a proposal from Elisabeth Radow for a Community Garden. The Town Board although not opposed to this proposal would like to defer further discussion until a more comprehensive review of that area is undertaken. Supervisor Seligson will respond to Ms. Radow with the Board’s decision. 2017 Financial Audit Additionally Present: Alan Kassay of O’Connor Davies Mr. Kassay presented the 2017 Financial Audit Report to the Town Board. Mr. Kassay also provided the Town Board, for the benefit of the new Town Board Members, a publication from his firm titled Report to Those Charged with Governance December 31, 2017, as well as providing a primer on municipal auditing. Mr. Kassay also provided a hard copy of his presentation to the public this evening. The Town Board asked Mr. Kassay a number of question regarding the Charitable Trusts. Mr. Kassay stated that the IRS has issued a preliminary statement that this would not be legal under IRS Code. Mr. Kassay reiterated what the Town Board had already discussed, with respect to the disclaimers residents will need to acknowledge. On motion of Councilwoman Katz, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss sale of Old Jefferson Street. EXECUTIVE SESSION Sale of Old Jefferson Street On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER - REGULAR MEETING 2 June 20, 2018 The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents are welcome to attend. PROCLAMATION - Burt Corwin Past Commander of the Veterans’ of Foreign Wars Post 1156 PROCLAMATION Commander Burt Corwin WHEREAS: Burt Corwin recently retired as the highly respected Commander of the Veterans of Foreign Wars David Potts Jr. Post 1156 in the Town of Mamaroneck after serving for 10 years, and has lived in the community for over 30 years, and Burt served as an officer in the US Army from 1969 to 1971, including one year in Vietnam; and WHEREAS: Burt also had an impressive 33 year career with IBM, retiring at the end of 2007. He then taught part-time in the MBA Programs of Fordham University and Iona College until the end of 2012; and WHEREAS: Commander Corwin has enriched the lives of veterans and community members by supporting veterans’ causes, working with the Commanders of American Legion Posts 90 and 347 to secure a tax exemption for veterans from the school district, hosting an annual picnic luncheon for veterans in Montrose; and WHEREAS: Commander Corwin worked to lease the VFW building at 1288 West Boston Post Road to the Town of Mamaroneck for community programs and events. Years later in 2016, he negotiated the sale of the property to the Town, ensuring the building will continue to be used by the community and veterans in the future. The proceeds of the sale were donated to local veterans’ charities; and WHEREAS: Burt Corwin refers to VFW David Potts Jr. Post 1156 as the “Little Engine That Could” because of its important impact on the lives of area veterans and the community as a whole. The community is lucky to have had Commander Burt Corwin, PhD as the conductor of this “Little Engine.” NOW, THEREFORE, BE IT RESOLVED, that I, Nancy Seligson, Supervisor of the Town of Mamaroneck, and the Town Board members honor and thank Commander Burt Corwin for his service to veterans and the community, and congratulate and wish him happiness upon his retirement from his position as Commander. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of th Mamaroneck to be affixed this 20 day of June 2018. Supervisor Seligson presented Mr. Corwin with the Proclamation. Mr. Corwin addressed the audience with remarks about his tenure as the Commander, then thanked the Town for this recognition. Supervisor Seligson asked if anyone in the audience would like to address the Board, on a topic other than the public hearings set for this evening, and there was not. PUBLIC HEARING – “Banning of Firearms within specified Town Buildings” Law The following Notice of Public Hearing is entered into the record as follows: 3 June 20, 2018 NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on June 6, 2018 Public Hearing will be held on June 20, 2018, at 8:00 PM or as soon thereafter as is possible at the VFW/Town Senior Center, 1288 Boston Post Road, Larchmont, New York to consider: “Banning of Firearms within specified Town Buildings” Law. Purpose The Town Board is aware of the country’s current plague of shootings of, and other types of attacks on, innocent persons in schools, in the workplace, in churches, in places of worship, in other public places, and in homes. The Town Board recognizes that it cannot solve this problem and is mindful of the right to bear arms given to the people by the Second Amendment to the United States Constitution and by New York Civil Rights Law § 4. Balanced against these rights is the Town’s objective of providing a safe work environment for Town employees and a safe place for visitors to Town buildings. Weighing these competing points, the Town Board finds that safety is paramount. Therefore this law bans possession of firearms within the Town Buildings identified in this local law by persons, other than those permitted to do so by this law. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: June 13, 2018 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously opened. Supervisor Seligson introduced the law by reading the Purpose of the Law as drafted my Mr. Maker. Supervisor Seligson stated that speakers will be limited to three minutes. Supervisor Seligson then asked Mr. Maker to further explain the law, of which he did in detail. James Vespi, current resident of Mamaroneck Avenue, former resident of Wendt Avenue. Mr. Vespi thinks this law is just common sense, he cannot see any reason why firearms would be needed in any Town building, certainly not in the conservation areas. Kenneth Carnes, 28 Concord Avenue, is in favor of the law, adding if anything it could be far broader. Jenny Grerr, 28 year resident of the Town, urges the Town to pass this law. Amy Robertson, of Henry Avenue, supports this law and thanked the Town Board for the research they did. Mario Muollo, Vice President of the Westchester County Firearm Owner’s Association, stated that if there is no intention of curbing gun violence, then he sees no purpose in the law. Mr. Muollo continued by reading a prepared statement. Robert DeVincenzo, a resident of Yonkers and a licensed real estate broker, read from a prepared statement that emphasized his belief that this law is creating soft targets. Mr. DiVincenzo is not in favor of the law. Gloria Strauss, stated that she would like the same protection the Vice President receives when he speaks at a private NRA event, in that there are no guns allowed in these events. Ms. Strauss thanked the Town Board for this law. George Talt, a resident, asked if the Sheldrake Trail was included in the law, and Mr. Maker stated no, just the building. 4 June 20, 2018 Eric Gross, of Valley Road, asked Mr. Maker if an individual’s rights or a homeowner’s right to protect its own property had legal precedence. Mr. Maker responded that he believes the person, in this instance the Town, has a right to regulate who comes onto their premises and for what purposes, assuming there is no discrimination. The Town Board asked Mr. Maker whether there was anything he heard from the audience to cause the Town Board not to vote on the law this evening. Mr. Maker stated that the Town Board may want him to review further the exemption for retired Police Officers as addressed by Mr. Muollo. The Town Board would like to review this further and will adjourn the public hearing until July. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby adjourn the Public Hearing on the “Banning of Firearms within specified Town Buildings” Law until July 11, 2018, at 8:00 PM or as soon thereafter as is possible, at 740 W Boston Post Road, Mamaroneck. Supervisor Seligson asked if anyone in the audience would like to address the Board regarding this public hearing. Arthur Wexler, a resident of Washington Square, asked why not a restriction on the entire length of North Chatsworth, and Mr. Altieri stated that this law addresses the current safety concern only. 5 June 20, 2018 Stuart Ault, a resident of Lafayette Road, stated that there is also an issue with a vehicle that parks on the section of North Chatsworth just south of the intersection with Lafayette Road, adding that this vehicle is also causing a safety concern. Mr. Altieri stated that the Town is addressing this, adding that the Town is currently determining if there is legislation in place and a sign is missing, or if a law is needed. Councilwoman Katz added that if legislation is needed, then a local law would need to be drafted and a public hearing would need to be set. Nadine Nee, 57 North Chatsworth Avenue, addressed the Town Board. Ms. Nee is concerned with the measurement from her driveway to the intersection, adding it was her understanding that for maximum visibility, it would be two car lengths. Mr. Altieri replied that yes, it was measured at two car lengths. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the public hearing was unanimously closed. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following local law was adopted: Local Law No. 4 - 2018 This local law shall be known as the “Restriction on Parking on a Portion of the West Side of North Chatsworth Avenue near its Intersections with Rochelle Road and Huguenot Drive” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The parking of automobiles on the west side of North Chatsworth Avenue near the corner formed by the intersection of the west side of North Chatsworth Avenue and the south side of Rochelle Road, and near the corner formed by the intersection of the west side of North Chatsworth Avenue and the north side of Huguenot Drive creates visual obstructions for automobiles attempting to enter North Chatsworth Avenue from Rochelle Road and Huguenot Drive. Preventing parking near those corners will improve safety for automobiles and pedestrians. Section 2 – Restriction on Parking on a Portion of the West Side of North Chatsworth Avenue near its Intersections with Rochelle Road and Huguenot Drive No motor vehicle shall be parked on the west side of North Chatsworth Avenue within forty (40) feet of its intersection with the southerly side of Rochelle Road. No motor vehicle shall be parked on the west side of North Chatsworth Avenue within sixty (60) feet of its intersection with the northerly side of Huguenot Drive. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of North Chatsworth Avenue indicating where and when parking is prohibited by this law. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye 6 June 20, 2018 PUBLIC HEARING – “Prohibited Overnight Parking on Garit Lane” Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING Adjourned until June 20, 2018 Adjourned until June 6, 2018 LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a motion of the Mamaroneck Town Board on June 6, 2018 this Public Hearing will be adjourned until Wednesday, June 20, 2018 at 8:00 PM or as soon thereafter as is possible at the VFW/Town Senior Center, 1288 Boston Post Road, Larchmont, New York to consider: “Prohibited Overnight Parking on Garit Lane” Law. Purpose On May 2, 1984, it was decided to allow parking between the hours of 3:00 am (prevailing time) and 6:00 am (prevailing time) on Garit Lane. Over the last thirty years circumstances have changed and therefore like most streets within the Town, overnight parking on Garit Lane should be prohibited. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Original Publication: April 27, 2018 Supervisor Seligson stated that this public hearing was held over from the last meeting because at that public hearing the Town Board heard from many residents that were not in favor of the law. Supervisor Seligson asked if there was any update from the Traffic Committee, and or if there was anyone in the audience who wished to speak. Kathy Bennet, addressed the Board also stating she wished to be updated on what was going on. Ms. Bennett stated that she nor any of her neighbors was asked by the Traffic Committee for feedback, nor were any neighbors of Garit Lane notified that the Traffic Committee met again. She was also not notified of this meeting. Councilwoman Katz responded that at the previous Traffic Committee meeting the resident in favor of restricting overnight parking was present. The Traffic Committee would like to send out notification to the residents of Garit Lane to receive their feedback. Councilwoman Katz stated that there seems to be three directions to move in, one to leave the overnight parking in place, two to restrict overnight parking, and put in place a one or two hour restriction on parking sometime during the day. The third option for a residential parking district is, which, based on the Town’s experience, not a viable option as the State is very likely not going to approve it. The Traffic Committee seems inclined to move in the direction of the second option, adding that unlike other streets that allow for overnight parking, residents of Garit Lane have driveways, and so would have a place to park during a one hour parking restriction, while also benefitting from cars not being warehoused. The Town Board would like to take this legislation, as written, off the table to allow the Traffic Committee to further review, as there seems to be the potential for a different law than what has been initially drafted. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the public hearing was unanimously closed with no further action to take place with respect to this local law. 7 June 20, 2018 CITIZEN’S COMMENTS George Roniger, representing the Larchmont Gardens’ Civic Association, addressed the Town Board. Mr. Roniger stated that it appears the Town may be willing to share in some of the costs of the repairs for the arches, adding that the current state of affairs is a safety issue. Supervisor Seligson responded that Town staff has advised that there is no danger, adding that cost estimates need to be negotiated. PRESENTATION – 2017 FINANCIAL AUDIT Alan Kassay of O’Connor Davies gave a visual presentation to the audience of the Town’s 2017 Financial Audit. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Adoption – 2019 Budget Calendar On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the 2019 Budget Calendar as presented. 9 June 20, 2018 2. Report of Bids – TA-18-01 Road Resurfacing On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved, WHEREAS, on May 16, 2018 the Town publically opened and read three (3) bids for Contract TA- 18-01 Road Resurfacing. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-18-01 – Road Resurfacing, to the lowest responsible bidder meeting all of the Town’s requirements, to ELQ Industries to provide road resurfacing services at a total cost of $251,762.00, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. Authorization – Amendment to Concession Agreement – Slap Shot Café On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the License Agreement between the Town of Mamaroneck and Slap Shot Cafe allowing Slap Shot Café to maintain a concession stand at the Hommocks Ice Rink located on Hommocks Road in the Town of Mamaroneck for the sale of food, beverages and related products for 44.5 months in exchange for payment of the following concession fees: $9,750 for the period from January 1, 2018 to June 30, 2018, $19,512 for the period from July 1, 2018 to June 30, 2019, $19,920 for the period from July 1, 2019 to June 30, 2020, and $25,085 for the period from July 1, 2020 to September 15, 2021 and performance of the services enumerated in the License Agreement, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement, subject to approval of the Town Attorney as to the form of the agreement, on behalf of the Town. APPROVAL OF MINUTES – April 18, 2018 and May 2, 2018 On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meetings of April 18, 2018 and May 2, 2018. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting. SUPERVISOR’S SUMMARY REPORT I have spent a lot of time the past two weeks in meetings with other Westchester chief elected officials and the County administration to discuss the opportunity and implications of the change in State tax law to allow local governments to accept charitable donations to offset taxes. The Town Board discussed it at length tonight during our work session. It is a complicated proposition because it has never been done before, therefore the software and municipal systems needed to collect such a donation and credit a resident for tax payments don’t exist. Further complicating the matter, the school district and County would have to collect the donations on their own unless they enter into an agreement with the Town. The school districts and County have never collected tax payments. The Town has always performed that function. We will continue to discuss it, but the Town Board expects to pass a resolution tonight to allow us to move forward to allow it. Most communities are moving forward if their school district is interested. I’m proud to report the Town, along with the Village of Larchmont, was honored with a 2018 Westchester Eco Award yesterday for launching the voluntary food scrap recycling program in 2017. County Executive George Latimer with County Legislator Catherine Parker presented us with the award at Kensico Dam Plaza. It was a very nice event. We were proud to have Steve Altieri, Sanitation Foreman and Deputy Forman Clarence Gaddis and Frank Giordano, superstar volunteers Karen Khor and Arlene Novich and the almost the entire board of the Village of Larchmont including Mayor Lorraine Walsh. Congratulations to Recreation Superintendent, Jill Fisher, who was awarded the prestigious Joseph E. Curtis Achievement Award from the Westchester Recreation and Parks Society. Vicky Laoutaris, Recreation Supervisor, was awarded the Dr. Sal Prezioso Professional Fellowship award and the Town was recognized for its Winter Festival. We had a wonderful Volunteer Appreciation BBQ for all members of the Town’s boards and commissions. We were lucky to have perfect weather that helped make it a lovely night. Again, thank you to our volunteers for their dedication, time commitment and hard work. There are two student events I want to mention. Firstly, Rye Neck High School students participating in the Action Research for Community Change program completed a water project about the community’s confidence level in our drinking water. They conducted a survey and 13 June 20, 2018 presented their findings in a very professional and mature manner. I think WJWW will follow up on some of their recommendations. Secondly, the Connie Green O’Donnell, Assistant Town Administrator worked with MHS art teachers to have the artwork of the students presented in the Town Center. We held a small ceremony for the artist and teachers this past Tuesday. Congratulations to those great student artists and thank you for adorning the walls of the Town Center with your artwork.
