MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD JUNE 2, 1965, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

PUBLIC HEARING - Application for Special Permit
Bonnie Briar Country Club
On motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED, that the hearing be and it hereby is
declared open.
The Clerk presented the affidavit of publication of the No-
tice of Hearing for the record, and the Supervisor inquired
whether anyone wished to be heard either in favor of or in
opposition to the application.
Mr. Edward Roberts, Manager of the Club, appeared on
behalf of the applicant - and since no one else wished to be
heard, on a motion by Councilman Kane, seconded by Coun-
cilman Brush, it was unanimously
RESOLVED, that the hearing be and it hereby is
declared closed.
And thereupon, since the Board signified that it was ready
for the question, on a motion by Councilman Kane, seconded
by Councilman Quadrine, the following resolution was offered:
WHEREAS, the Bonnie Briar Country Club has sub-
mitted an application and plans for the construction
of a 14' x 14' x 7' 1-story pump house to contain
pumps and controls for a new underground irriga-
tion system installed for the golf course, to be

located approximately 450 feet east of Weaver
Street, just north of the dirt service road to the
storage building, on premises located on Wea-
ver Street and known as Block 225, Parcel 1 on
the Tax Assessment Map of the Town of Mamar-
oneck;
and
WHEREAS, said application was denied by the
Building Inspector on the grounds that the plans
were subject to a special permit to be granted
pursuant to Sections 410, 432 and 449 of the
Zoning Ordinance;
and
WHEREAS, a public hearing was duly called be-
fore this Board for this meeting pursuant to Sec-
tion 432 of the Zoning Ordinance;
and
WHEREAS, the Board has examined the plans
and finds that the conditions and standards re-
quired by subdivisions 432. 1, 432. 2, 432. 3 and
432. 4 of the Zoning Ordinance have been met;
NOW, THEREFORE, BE IT
RESOLVED, that the application of the Bonnie
Briar Country Club is granted, and the Building
Inspector is authorized to issue a special permit
for the construction of a building or structure as
covered by the plans filed with him provided that
said application complies in all other respects
with the Building Code and Zoning Ordinance of
the Town of Mamaroneck.
Upon roll call, the vote on the foregoing resolution was as
follows:

- Councilman Brush abstained from voting because he is
a member of Bonnie Briar.
The resolution was therefore declared duly adopted and the
Clerk directed to forward a certified copy thereof to the ap-
plicant and Building Inspector.
OPENING OF BIDS - Truck for
- Fire Department
At the Supervisor's direction, this was put over until the
Fire Commission meeting following the close of this meeting.
OLD BUSINESS

1. Application for Swimming Pool Permit
Mr. & Mrs. G. P. Murphy - 37 Cooper Lane
Pursuant to direction at the last meeting, notification
of the subject application was sent to the following prop-
erty owners in the area of the proposed pool with replies
as noted herebelow and filed for the record:

6 or 8 feet at least".

And thereupon, since each of the members of the Board
had personally viewed the site and had no objections, pur-
suant to memorandum of the Building Inspector, dated
May 17, 1965, previously presented and filed with the ap-
plication, on motion by Councilman Kane, seconded by
Councilman Brush, the following resolution was adopted
unanimously with direction that a certified copy thereof be
forwarded to the applicant and Building Inspector:
WHEREAS, Mr. and Mrs. G. P. Murphy have pre-
sented an application for a permit to construct a
- swimming pool and appurtenances on premises lo-
cated at 37 Cooper Lane, Town, and known as
Block 217, Parcel 540 on the Assessment Map of
the Town of Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of
Mamaroneck has examined the plans and specifica-
tions for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supple-
mented to include certain recommended conditions
conform in all respects with the requirements of
the swimming pool ordinance (Article 23 of the
Building Code), and therefore recommends that the
application be approved:
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. and Mrs.
G. P. Murphy for a permit to construct a swim-
ming pool on their premises located at 37 Cooper
Lane, Town, and known as Block 217, Parcel 540
on the Assessment Map of the Town of Mamaro-
neck, is hereby approved, and the Building In-
spector is hereby authorized to issue a permit for

same provided the pool is constructed in confor-
mance with the plans and specifications sub-
mitted and filed with the application as amended
and supplemented to show compliance with the
following conditions:
1) That a lattice screen be built along the north-
erly side of the raised deck at least 5 feet high
to shield any activity on this deck from the
rear property.
2) That any contemplated above ground lighting
should be shielded and directed away from
neighboring property.
3) That no temporary or portable cabanas or
awnings be placed on the property.
and be it further
RESOLVED, that all work must be completed and
the owner obtain a certificate of occupancy from
the Building Inspector before the pool is used.
2. Larchmont Harbor Waters
For the Board's information, the Clerk presented a letter
addressed to the Engineer by F. R. Ulrich, Major, Military
Police Corps, Assistant Supervisor of New York Harbor,
U. S . Army Corps of Engineers, under date of May 12, 1965
with reference to the inspection of the Larchmont Harbor wa-
ters made by that office on May 11, 1965, which was here-
with ordered received and filed for the record.
NEW BUSINESS
There was no new business to come before the meeting.
COMMUNICATIONS
1. Letter from Carl J. Noe, Commissioner
of Elections, County Board of Elections
The Clerk presented a letter addressed to the Board by
Carl J. Noe, Commissioner of Elections, County Board of
Elections, dated May 25, 1965, announcing that he would
retire on June 30 of this year after well over thirty years
of service and expressing his appreciation and thanks for
the efficient cooperation extended to him by the Town
Board and the Town Clerk, which was herewith ordered
received and filed.
The Board expressed its regret at losing Mr. Noe, its
appreciation of his long and faithful service and directed
that its thanks and best wishes be forwarded to him.

2. Notice of Meeting, Zoning Board of Appeals
City of New Rochelle
The Clerk presented notice of a hearing to be held by
the Zoning Board of Appeals of the City of New Rochelle
on June 8, 1965, concerning the application of Cesare A.
Pavese, which was herewith ordered received and filed.
The Board requested the Attorney to attend this hear-
ing on its behalf since the property involved touches the
Town line and to report to the Board following the hear-
ing.

The Supervisor advised the Board that this bill which
requested legislation required to enable the Town to
convey a parcel of park land to the Board of Education
for educational purposes, was a 10-day bill presently
before the Governor for signature,
Councilwoman Helwig
1. Authorization of Summer Recreation Payroll
Pursuant to memorandum herewith presented by
Councilwoman Helwig and filed for the record, on mo-
tion by her and seconded by Councilman Kane, the fol-
lowing resolution was adopted by unanimous vote:
RESOLVED, that this Board hereby authorizes the
following salary expenditures to the persons listed
below for the term of employment and at the rate

2. Noise Bill
Councilwoman Helwig reported that the noise bill was not
yet dead in spite of the objections raised by New York City
and the upstate Grange, and added that an attempt would be
made for an amended bill if it was not possible to get the
bill as proposed through without exempting New York City.
3. Community Action Program
Councilwoman Helwig reported that she had represented
the Board at the meeting called by the Mamaroneck and
Larchmont League of Women Voters for the purpose of es-
tablishing a Community Action Committee in Mamaroneck
and Larchmont since the Supervisor was representing the
Town of Mamaroneck at Westchester County Day at the
World's Fair.
The Committee, she advised, would study the need for
and use of funds now available for such Anti-poverty pro-
grams under Federal legislation.
4. Summer Hours - Town Office
Councilwoman Helwig stated that she would like to sug-
gest that the Town Offices close at 4 p. m. during the
months of July and August based on and in accordance with
the policy of neighboring municipalities.
Following discussion during which several questions were
raised by various members of the Board, the matter was de-
ferred pending further detailed study.

5. Letter from Mrs. Louise Cherrot
Councilwoman Helwig informed the Board of the re-
ceipt of a letter addressed to her by Mrs. Cherrot of
3 East Avenue, complimenting the Town on the beauty
of the plantings at Memorial Park.
The Board suggested that the Park Commission and
Park Department be sent copies of this commendation.
Councilman Kane
1. Request of Mr. Rudy Novak
Councilman Kane advised the Board that Mr. Novak
would like to rent from the Town the strip of land to
the westerly side of his property (formerly rented to
Bose & Parker) for $50.00 per month.
The Supervisor pointed out that there was a Town
easement going through a part of Mr. Novak's prop-
erty which should be given some consideration in this
matter, and following some further discussion, the
Board directed the Supervisor and Attorney to nego-
tiate a license with Mr. Novak at a sum of $500. 00
per year.
Councilman Brush
Councilman Brush stated that he had no report other
than Fire matters.
Councilman Quadrine
1. Report on Assessment Roll
Councilman Quadrine presented a written statement
submitted by the Assessor under date of June 1, 1965,
showing a tentative increase in assessment of approx-
imately $3, 000, 000 (New construction - 2, 000, 000
Added to old roll - 1, 000, 000), which was herewith or-
dered received and filed as a part of the record of this
meeting.
2. Apportionments
Councilman Quadrine presented the following petitions
submitted by the Assessor requesting correction of the
assessment roll so as to permit the apportionment of
taxes, and thereupon on his motion, seconded by Coun-
cilman Kane, the following resolution was adopted by
unanimous vote of the Board:
WHEREAS, the Assessor has presented the follow-
ing petitions for the correction of the assessment

roll for certain years pursuant to the provisions
of Section 557, Article 16 of the Westchester
County Administrative Code, known as the West-
chester County Tax Law; and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petitions for the
correction of said assessment roll:

1. Settlement of Insurance Claims

Pursuant to the Attorney's recommendation and
communications addressed to the Town by Hartford
Accident and Indemnity Company herewith presented
and ordered received and filed for the record, on mo-
tion by Councilman Brush, seconded by Councilwoman
Helwig, it was unanimously
RESOLVED, that this Board hereby authorizes

reimbursement of the sum of $100. 00 to the
Hartford Accident and Indemnity Company for
settlement of the claims of Guiseppe Petruzzo
v. Town of Mamaroneck and William Sims, Jr.
v. Town of Mamaroneck under the Town policy
containing a $50.00 deductible property damage
clause on each claim.
ADJOURNMENT
There being no further business to come before the meeting,
on motion duly made and seconded, it was declared adjourned
at 9:10 p. m. , to reconvene on July 7, 1965.
BOARD OF FIRE COMMISSIONERS
- The meeting of the Board of Fire Commissioners was con-
vened immediately upon the adjournment of the Town Board
meeting.
1. OPENING OF BIDS - 3/4-Ton Pick-up Truck
The Clerk advised the Board that no bids had been sub-
mitted and thereupon following some discussion between
Commissioner Brush and the Fire Chief, it was directed
that the Chief, Attorney and Comptroller review and re-
vise the specifications for readvertisement.
2. Claims
Commissioner Brush presented for approval and auth-
orization of payment the following Fire Department
claims, and thereupon on his motion, seconded by Com-
missioner Kane, it was unanimously
RESOLVED, that the Fire Department claims, which
have been audited by the Comptroller and approved by
the Fire Chief, are hereby approved, and the Super-
visor and Comptroller authorized to pay the same out
of the budget for the Fire Department:

3. Reports

Commissioner Brush presented the following re-
port which was ordered received and filed for the
record:
Fire Report for the month of May, 1965.
4. Communications
Commissioner Brush reported that there were no
communications to come before the meeting.
5. Other Business
1. Fire Hydrant - 2 Dudley Lane
In connection with the matter of the fire hydrant
at 2 Dudley Lane which was obscured from view
by foliage planted on Town-owned property, the
Chief suggested that the Town have a ruling pro-
hibiting hydrants to be obscured from the road
by plantings.
The Supervisor requested the Attorney to check
into the matter, definitely ascertaining whether
the hydrant in question was on Town-owned prop-
erty, and if so, to address a Registered - Re-
turn Receipt Requested communication to the ow-
ner requesting removal of the said plantings
within a reasonable time and outlining the steps
to be taken were the request not complied with.
6. Adjournment
There being no further business to come before the
meeting, on motion duly made and seconded, it was de-
clared adjourned at 9:15 p. m. , to reconvene on July 7,
1965.
