Pursuant to Section 62 of the Town Law, I hereby call a special meeting of the Town Board, to be held in the office of the Su- pervisor at the Town Offices, 158 West Boston Post Road, Village of Mamaroneck, at 10:00 a. m. on Sunday morning, April 25, 1965, for the purpose of considering the Board of Education proposal to pur- chase certain Town-owned property in the Hommocks area. This meeting was called by the Supervisor at the April 21, 1965 regular Town Board meeting. George D. CL 1 �u Dated: April 25, 1965 MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD APRIL 25, 1965, IN THE OFFICE OF THE ASSESSOR, TOWN OF MAMARO- NECK OFFICES, 158 WEST BOSTON POST ROAD, VILLAGE OF MAMARONECK, NEW YORK, AT 10:00 A. M. CALL TO ORDER The Supervisor called the meeting to order at 10:00 a. m. , presenting for the record, the Notice of Meeting and Waiver thereof, which were herewith ordered received and filed. ROLL CALL Present: Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig - Councilman Quadrine Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Deputy Clerk Mr. Altieri - Comptroller SCHOOL DISTRICT PROPOSAL The Supervisor presented for the Board's consideration, a letter addressed to him under date of April 21, 1965, by Eugene M. Parter, President of the Board of Education, submitting for approval the School District's proposal for the acquisition of certain Town-owned property in the Horn- mocks area to be used for a Middle School site, which read as follows and was ordered received and filed as a part of the record of this meeting: "Contingent upon your obtaining permission by Act of the State Legislature to convey the subject property, and subject to your being granted by the State of New York an appropriate land grant affecting the Hom- mocks property, and further subject to the terms of an agreement to be entered into by and between the Town of Mamaroneck and the School District which will more fully provide for the joint use and main- tenance of certain facilities to be erected on the sub- ject property; and contingent upon our obtaining the approval of the qualified voters of the School District of a Middle School which includes a community swim- ming facility, the School District offers to purchase -- from the Town of Mamaroneck a portion of the land to be acquired for a new Middle School site containing 5. 427 acres and located on the southwesterly side of Hommocks Road according to the survey of Ward Carpenter Engineers, Inc. , dated February 1, 1965, -1- entitled, "Map of Part of Hommocks Road Site, Ma- maroneck School District". The School District proposes to acquire also certain lands of Novak, Hoffmann and Hampshire Country Club as a part of the project and to construct through the latter parcels a new section of Hommocks Road in conformity with the Town's highway regulations and as close to the northeasterly boundary of the school lands as such regulations may permit. Upon completion and acceptance thereof by the Town authorities, the Town of Mamaroneck will convey to the School District such additional lands as the Town may at that time own within the existing portion of Hommocks Road lying adjacent to the school site. The School District in exchange therefor will convey to the Town of Mamaroneck the new and substituted portion of said highway. The Town of Mamaroneck will construct over its ex- isting lands a new Hommocks Road section from the Boston Post Road at Weaver Street to connect with the proposed school site. For these conveyances, the School District shall pay to the Town of Mamaroneck the sum of Fifty-five Thousand Dollars ($55, 000. 00). Said conveyances shall be made subject to all ease- ments, utility agreements, and rights of third par- ties if there txe any. We shall appreciate your signifying your acceptance of this offer and your furnishing therewith a copy of the resolution authorizing it, certified by the Town Clerk. " The Supervisor noted that this letter and the attached "Memorandum of Intent for Mutual Agreement between the School District and the Town of Mamaroneck relating to the acquisition of Town lands on Hommocks Road for a School Site", embodied all of the matters discussed in de- tail by the Town Board and the Board of Education at the conference meeting held on April 10, 1965. He further noted that the letter and "Memorandum of Intent" drawn pursuant to that meeting and received from Mr. Curren April 19th had been fully reviewed by the Recreation Corn- mission at its regular meeting on the evening of the 19th of April, and that certain revisions in the original letter and memo requested by members of the Town Board, the Town Attorney, and Recreation Commission, had been approved by Dr. Haake and Mr. Curren in conference with Mr. Johnston and Mrs. Helwig and were incorporated in the proposal received from Mr. Parter under date of April 21, 1965, now before the Board for action. The Su- pervisor further noted that full details of the Agreement now embodied in the "Memorandum of Intent" would be worked out before the contract is executed and would be -2- appended thereto as had been the case with the Agreement on the use of the Cargill site. Following this and a lengthy discussion by the members of the Board of many technical details and questions of costs to the Town, the amount of fill to be furnished to the Town, the time-table for completion of the filling, grading, etc. of certain property by the Town, etc. , since the Board was ready for the question, on motion by Council- woman Helwig, seconded by Councilman Brush, the follow- ing resolution was offered: RESOLVED, that the Supervisor be and he here- ' by is authorized to sign on behalf of the Town of Mamaroneck as of this date, April 25, 1965, the letter addressed to the Town Board of the Town of Mamaroneck by the Board of Education, Union Free School District No. 1, Mamaroneck, New York, dated April 21, 1965, as hereinabove set forth and duly signed on behalf of the said Board of Education by the President thereof, Eugene M. Parter. Upon roll call, the vote on the foregoing resolution was as follows: Supervisor Burchell . . . . VOTING. . . . Aye Councilman Kane . . . . . . . VOTING . . . Aye Councilman Brush . . . . . . VOTING. . . . Aye Councilwoman Helwig. . . VOTING. . . . Aye Councilman Quadrine . . . VOTING. . . . Abstaining - -- and the resolution was therefore declared duly adop- ted by a majority vote of four (4) ayes and one (1) ab- stention. Councilman Quadrine requested that the record show his reasons for abstaining as follows: 1) Lack of sufficiently definite information regarding costs of certain phases of proposal (filling of cer- tain land, grading, top-soil, etc. ) to the Town. 2) Lack of definite time-table for Town's completion of certain phases of proposal. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 11 :30 a. m. AN14.J To Cle -3-
