MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD APRIL 21, 1965,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
The minutes of the regular meeting of March 17, 1965 and
of the special meeting of March 25, 1965, were presented,
and on motion duly made and seconded, approved as submitted.
OLD BUSINESS
There was no old business to come before the meeting.
NEW BUSINESS
1. Investment of Surplus Funds
The Clerk presented a memorandum addressed to the
Board by the Comptroller under date of April 20, 1965,
reporting on the investment of surplus funds to date,
which was herewith ordered received and filed for the
record.
2. Application for Water Main Extension
Garit Estates Inc.
Upon presentation of application by Garit Estates Inc.
for the extension of water mains and installation of a
hydrant herewith ordered received and filed, on motion
by Councilman Kane, seconded by Councilman Brush,
it was unanimously
RESOLVED, that this Board hereby authorizes the

installation of water mains and hydrant as set forth
in said application in Garit Lane, which property
is located at 191 Palmer Avenue and known as Sec-
tion 4, Block 402, Parcel 43 on the Tax Assessment
Map of the Town of Mamaroneck, said mains and
hydrant to be installed by the applicant, Garit Es-
tates Inc. , at no cost to the Town of Mamaroneck
and to be in conformity with the drawings approved
by the Planning Board of the Town of Mamaroneck
and the requirements of the Westchester Joint Wa-
ter Works and subject to the applicant furnishing
all easements required to the satisfaction of the
Town Attorney.
3. Application for Recreation Project
State Aid
Upon presentation of the Recreation Project Applica-
tion to the New York State Youth Commission for State
Aid for approval, on motion by Councilwoman Helwig,
seconded by Councilman Kane, it was unanimously
RESOLVED, that this Board hereby approves the
Recreation Project Application to the New York
State Youth Commission, requesting State Aid
in the amount of $2, 517. 50 for the period from
June 1, 1965 to May 31, 1966.
COMMUNICATIONS
1. Board of Education - Use of Voting Machines
Upon presentation of Board of Education request here-
with ordered received and filed, on motion by Councilman
Kane and seconded by Councilman Brush, it was unani-
mously
RESOLVED, that this Board hereby grants the
request of the Board of Education to use three
(3) voting machines for the school elections
at the Junior High School on Tuesday, May
4, 1965.
2. Noise Control Resolution
Larchmont Chamber of Commerce
A copy of a resolution adopted by the Larchmont Cham-
ber of Commerce at its April 8 meeting urging passage
of the Thruway Noise Control Bill was presented and or-
dered received and filed.
3. Public Notice - Zoning Board Meeting,
Village of Larchmont
The Clerk presented a notice of meeting of the Zoning
Board of Appeals of the Village of Larchmont, which had

been referred to the Attorney and upon his report that it
was informational only requiring no action on the part of
the Board, was ordered received and filed.
4. Notice of Public Hearing - New Rochelle Council
Proposed Amendment to Zoning Ordinance
The Clerk presented notice of hearing before the City
Council of New Rochelle, which upon the Attorney's ad-
- vice that it would be to our benefit if adopted as it would
be more restrictive, was ordered received and filed.
5. Notice of Meeting - Board of Appeals
Village of Scarsdale
The Clerk presented a notice of meeting of the Zoning
Board of Appeals of the Village of Scarsdale which was
referred to the attention of the Town Attorney.
6. Letter from Jerome N. Wanshel
Condition of Larchmont Harbor Waters
The Clerk presented a letter from Jerome N. Wanshel,
resident of the Larchmont shore front, dated April 19,
1965, with reference to the condition of the waters of
Larchmont Harbor.
A lengthy discussion followed during which the Engineer
advised the Board that in response to his call, the Army
Corps of Engineers had made an inspection of the area
of concern today, recommending the immediate installation
of an 8-foot chain link fence as an emergency corrective
measure, and further advising that he was already ob-
taining prices on such fencing, its installation, etc.
The Supervisor pointed out that this problem was that
of the Incinerator Commission, which was jointly oper-
ated by the Town and Village, and therefore requested a
statement from the Engineering Corps as authority for the
Commission's expenditure.

There were no reports to be submitted at this meeting.
The Supervisor --
1. Resolution Favoring Noise Bill
Board of Supervisors
The Supervisor reported that the County Board of Su-
pervisors had adopted a resolution to be forwarded to

Albany in strong support of the proposed noise control
legislation.
Councilwoman Helwig expressed her appreciation
to the Supervisor.
2. New Haven Railroad
The Supervisor advised the Board that he would testify
at the I. C. C. hearings on the New Haven Railroad's ap-
plication to curtail service and cut-off stations, attempt-
ing to show the impact thereof on the Larchmont station,
and invited any comments or suggestions anyone might
care to offer, stating that both Mr. Moore and he would
find them most welcome.
3. Board of Education Proposal
(Middle School - Hommocks Area)
At the Supervisor's request, the Clerk read the follow-
ing letter, signed by Eugene M. Parter, President, on
behalf of the Board of Education, Union Free School Dis-
trict No. 1, addressed to the Town Board and submitted
for its consideration as of this date with the request that
the Board authorize the Supervisor to affix his signature
thereto on behalf of the Town of Mamaroneck if this be
the Board's pleasure.
"Contingent upon your obtaining permission by Act of
the State Legislature to convey the subject property,
and subject to your being granted by the State of New
York an appropriate land grant affecting the Hom-
mocks property, and further subject to the terms of
an agreement to be entered into by and between the
Town of Mamaroneck and the School District which
will more fully provide for the joint use and main-
tenance of certain facilities to be erected on the sub-
' ject property; and contingent upon our obtaining the
approval of the qualified voters of the School Dis-
trict of a Middle School which includes a community
swimming facility, the School District offers to pur-
chase from the Town of Mamaroneck a portion of the
land to be acquired for a new Middle School site con-
taining 5. 427 acres and located on the southwesterly
side of Hommocks Road according to the survey of
Ward Carpenter Engineers, Inc. , dated February 1,
1965, entitled, "Map of Part of Hommocks Road
Site, Mamaroneck School District".
The School District proposes to acquire also certain
lands of Novak, Hoffmann and Hampshire Country
Club as a part of the project and to construct through
the latter parcels a new section of Hommocks Road
in conformity with the Town's highway regulations
and as close to the northeasterly boundary of the
school lands as such regulations may permit.

Upon completion and acceptance thereof by the Town
authorities, the Town of Mamaroneck will convey to
the School District such additional lands as the Town
may at that time own within the existing portion of
Hommocks Road lying adjacent to the school site.
The School District in exchange therefor will convey
to the Town of Mamaroneck the new and substituted
portion of said highway.
The Town of Mamaroneck will construct over its ex-
- isting lands a new Hommocks Road section from the
Boston Post Road at Weaver Street to connect with
the proposed school site.
For these conveyances, the School District shall
pay to the Town of Mamaroneck the sum of Fifty-
five Thousand Dollars ($55, 000. 00).
Said conveyances shall be made subject to all ease-
ments, utility agreements, and rights of third par-
- ties if there be any. "
The Supervisor then voiced Mr. Quadrine's request that
this matter be held until after the Board met with the Incin-
erator engineering experts later this evening in view of
certain operation cost figures for the proposed expanded
Incinerator plant just learned tonight, whereupon the Board
directed that the matter be tabled pending results of the
above-referred to discussion.
Councilwoman Helwig --
1. Installation of Lights
Memorial Park
Councilwoman Helwig advised the Board of a question
raised by the Board of Park Commissioners as to assign-
ment of costs for street light installations in public parks.
After some discussion of this matter, it was referred
to the Attorney for investigation and report at the next
meeting.
2. Request for Authorizationto
Advertise for Bids for Purchase
of Sail Boats
Pursuant to Councilwoman Helwig's request and on mo-
tion by her , seconded by Councilman Kane, it was unan-
imously
RESOLVED, that the Town Clerk be and he hereby
is authorized, in accordance with law, to publish
in the official newspaper of the Town of Mamaro-
neck, The Daily Times, a notice for bids for fur-
nishing to the Town of Mamaroneck Recreation

Commission for its sailing program two (2) New
Fiberglass Sail Boats in conformance with the
details set forth in the specifications therefor;
said bids to be returnable May 5, 1965 and
opened and read aloud at a regular meeting of
this Board at 8:15 p. m. on that date in the
Council Room of the Weaver Street Firehouse,
Weaver Street, Town of Mamaroneck.
Councilwoman Helwig called to the Board's attention the
-- fact that this was the second notice for bids for sail boats
since no bids had been received in response to the first
notice, and the Commission had then changed the type and
size of boat to be purchased.
3. Proposed Noise Bill
Councilwoman Helwig, as Chairman of and on behalf of
the Thruway Noise Abatement Committee, expressed that
Committee's thanks to the Supervisor for the hearty sup-
port given the bill by the County Board of Supervisors in
the resolution adopted by that body and forwarded to Al-
bany in behalf of the bill.
She further reported that the bill had had a nice boost
from the New York State Association of Police Chiefs -
and that to date all of the people contacted had been fav-
orable to passage of the proposed legislation this year.
Councilman Kane --
1. Larchmont, Gables Apartments
Rodent Control
With regard to this matter, Councilman Kane reported
that the County Health Department advised that all steps
for rodent-proofing the building had been taken with gar-
bage removal by a private cartage firm.
He further advised that the owner had done a good job
and it was hoped that the problems had now been solved.
Councilman Brush --
Councilman Brush stated that he had no report other than
Fire matters.
Councilman Quadrine --
1. Request of Planning Board
Re Sewage Hook-up to County Sewer in Village
of Mamaroneck for Baldwin Hills Subdivision
Councilman Quadrine presented the Planning Board's

request that this Board request the Board of Trustees of
the Village of Mamaroneck to grant permission for the
sanitary sewers in the proposed Baldwin Hills subdivi-
sion to discharge into the main trunk sewer line situated
in Baldwin Place in said Village in view of the County's
advice that said line was adequate to accommodate the
increased load, and thereupon on his motion, seconded
by Councilman Kane, the following resolution was adop-
ted by unanimous vote, to be forwarded to the Mamar-
oneck Village Board of Trustees:
WHEREAS, Jason-McKenna, Inc. is the owner of
a proposed subdivision known as "Baldwin Hills"
located on property known as Block 207, Parcel
56 and Block 206, Parcel 38 on the Assessment
Map of the Town of Mamaroneck,
and
WHEREAS, the said developer proposes to erect
approximately thirty-four (34) houses in the sub-
ject subdivision which are to be serviced by sani-
tary sewers,
and
WHEREAS, the nearest main trunk sewer that
could serve this proposed subdivision is situated
in Baldwin Place in the Village of Mamaroneck,
and
WHEREAS, this trunk sewer discharges into the
Fenimore Road Pumping Station which is owned
and operated by the Westchester County Sewer
- Department,
and
WHEREAS, the County of Westchester Sewer De-
partment in a letter addressed to the Town Engin-
eer of the Town of Mamaroneck under date of
April 13, 1965, recites that "the proposed devel-
opment will not cause undue strain on the existing
facilities of the Fenimore Road Pumping Station!';
NOW, THEREFORE, BE IT
RESOLVED, that this Board respectfully requests
of the Honorable Board of Trustees of the Village
of Mamaroneck that the development known as
"Baldwin Hills" be allowed to connect with and
discharge into the existing 8-inch sewer in Bald-
win Place, Village of Mamaroneck.
The Town Attorney --
The Attorney stated that he had no report at this time.
ADJOURNMENT
There being no further business to come before the Board,

on motion duly made and seconded, the meeting was declared
adjourned at 9:00 p. m. , to reconvene on May 5, 1965.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was
convened immediately upon adjournment of the Town Board
meeting.
1. Claims
Upon Commissioner Brush's presentation of the Fire
claims for approval and authorization of payment, on
motion by him and seconded by Commissioner Kane, it
was unanimously
RESOLVED, that the following Fire Department
claims, which had been audited by the Comp-
troller and approved by the Fire Chief, are ap-
proved, and the Supervisor and Comptroller be
and they hereby are authorized to pay the same
out of the budget for the Fire Department for
the year 1965:

4. Other Business
1. Insurance

A question referring to two proposals for insurance
and a possible transfer from Continental to Hartford
was referred to the Fire Council with request that a
written memorandum thereon be submitted to this
Commis sion.
2. Question on Section 39
Fire Prevention Ordinance
--- A question regarding Section 39 of the Fire Preven-
tion Ordinance and request for clarification on be-
half of enforcement raised by the Chief was referred
to the Attorney for discussion with the Chief.
3. Invitation to Firemens Dance
The Supervisor commended the Chief on behalf of the
Department for its splendid public relations displayed
by the letter of invitation to this year's dance.
He particularly commented on the singed edges of the
letterhead -- and requested the Chief to convey his con-
gratulations and commendation to the men of the De-
partment.
5. Adjournment
There being no further business to come before the
meeting, on motion duly made and seconded, it was
declared adjourned at 9:05 p. m. , to reconvene on
May 5, 1965.
