Pursuant to Section 62 of the Town Law, I hereby call a special meeting of the Town Board, to be held in the office of the Su- pervisor at the Town Offices, 158 West Boston Post Road, Village of Mamaroneck, at 8:00 p. m. on Wednesday evening, March 10, 1965, for the purpose of dis- cussing the New Haven Railroad situation. CALL TO ORDER -- The Supervisor called the meeting to order at 8:00 p. m. , presenting for the record a notice of meeting and waiver thereof, which were herewith ordered received and filed. ROLL CALL Present: Supervisor Burchell Councilman Brush Councilwoman Helwig Councilman Quadrine Absent: Councilman Kane Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Deputy Clerk Mr. Altieri - Comptroller and Mr. Thomas F. Moore, Jr. - Member of Police Commission NEW HAVEN RAILROAD For the Board's information, the Supervisor presented the following letter addressed to him under date of March 9, 1965, by the Board of Police Commissioners following its March 6 meeting, which was herewith ordered received and filed as part of the record of this meeting. "This will amplify our previous correspondence and our meeting of March 6 on the subject of commuter railroad service. It is the recommendation of this Board that the Town of Mamaroneck intervene in the proceedings before the Interstate Commerce Commission with regard to the - request of the New Haven Railroad for abandonment of service. Our specific concerns in this matter are the serious problems of parking and traffic control which would re- sult from the elimination of train service to New York from stations west of Larchmont. It is reasonable to assume that many residents of New Rochelle, as well as some from Pelham, would board trains at Larch- mont. Not only would this lead to a need for parking space greatly in excess of our present facilities, but -1- because the number of "rush hour" trains is being reduced, the peak traffic at each train would be increased to the point where additional Patrolmen would be necessary to cope with the volume of traffic. In view of the above, we respectfully submit that the Town Board consider intervention before the ICC for the purpose of making these facts known. " The Supervisor then stated that Commissioner Moore, whom he had requested to study the matter and advise the Board as to what steps it should take legally, had recommended that a peti- tion be filed with the Interstate Commerce Commission on be- half of the Town in protest to the New Haven's proposal. He explained that the Town, by so doing, would become an inter- vening party to the proceedings and as such would be entitled to receive copies of all documents and notifications pertinent thereto. He further stated that Mr. Moore had consented to serve the Town as Special Counsel in this matter, without compensation, filing such petition before the Interstate Commerce Commis- sion and representing the Town at all subsequent proceedings if this were the Board's pleasure. He added that while Mr. Moore had so generously offered to serve without compensa- tion, it was understood, of course, that all disbursements in- curred would be a General Town charge. Mr. Moore, whom the Supervisor then presented, reviewed the proposed petition, copy of which was given to each member of the Board, in detail, inviting comments and suggestions thereon. During the ensuing discussion, Mr. Moore pointed out that the Town, by filing such petition, not only became an interven- ing party to the proceedings entitled thereby to receive copies of all documents and notifications pertinent thereto, but also evidenced to the community its earnest and grave concern in this matter. Councilman Quadrine inquired whether this action would be taken on behalf of the entire Town or just the unincorporated area. The Supervisor replied that the action would be taken for the whole Town but that it in no way pre-empted the vil- lages which, he hoped, would join the Town. Councilman Brush then stated that in speaking for himself and he was certain for all members of the Board, he would like to commend Mr. Moore on the "terrific job" he had done in the preparation of this petition and on his tremendous con- tribution to the citizenry of the Town in volunteering to serve as its Special Counsel in this matter. Whereupon, since there were no further questions, on a motion offered with great pleasure by Councilwoman Helwig, and seconded by Councilman Brush, it was unanimously -2- RESOLVED, that Mr. Thomas F. Moore, Jr. be and he hereby is appointed to serve as Special Counsel to the Town of Mamaroneck, without compensation, in the matter of the New Haven Railroad proceedings presently before the Interstate Commerce Commis- sion; and be it further RESOLVED, that Mr. Moore as Special Coun- sel be and he hereby is authorized to file with the Interstate Commerce Commission on be- half of the Town, a petition noting the Town's protest to the curtailment of commuter ser- vice now proposed by the New Haven Rail- road and to officially represent the Town at all subsequent proceedings before that Com- mission; and be it further RESOLVED, that all disbursements incurred by Mr. Moore in such service shall be a General Town charge in the 1965 budget. Mr. Moore expressed his appreciation of the Board's confidence and stated that he would proceed with the filing of the petition and subsequently take such action as was indicated on behalf of the Town, working in close collob- oration with Mr. Johnston, the Town Attorney, at all times. ADJOURNMENT There being no further business to come before the Board, on motion duly made and seconded, the meeting was declared adjourned at 8:40 p. m. J", Town//Clerk -3-
