OF THE TOWN OF MAMARONECK, HELD FEBRUARY 17th,
1965, IN THE COUNCIL ROOM OF THE WEAVER STREET
FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
- On motion duly made and seconded, the minutes of the regu-
lar meeting of January 20, 1965, were approved as corrected.
PUBLIC HEARING - Adoption of Local Law Establishing
Speed Limits on County and Town highways within the
Town.
On motion by Councilman Brush, seconded by Council-
man Kane, it was unanimously
RESOLVED, that the hearing be and it hereby
is declared open.
The Clerk presented the affidavit of publication oft',ze
notice of hearing for the record, and at the Supervisor's
request, the Attorney reviewed the subject matter of
the hearing, recommending that the present maximum
speed limit of 30 miles per hour be adhered to.
At this time, he also presented a letter addressed to
the Board by Mr. A. C. Viebranz, Chairman of the Board
of Police Commissioners, in reference to this matter and
recommending that the area speed limit be maintained at
30 miles per hour for the reasons stated therein, which
was herewith ordered received and filed for the record.
The Supervisor then inquired whether anyone wished to
be heard either in favor of or opposed to this matter, and
thereupon since no one did, on motion by Councilman

Brush, seconded by Councilman Kane, it was unani-
mously
RESOLVED, that the hearing be and it hereby is
declared closed.
And thereupon, on motion by Councilman Kane, sec-
onded by Councilman Brush, the following local law es-
tablishing maximum speed limits on County Roads and
Town Highways in the Town of Mamaroneck was adopted
by unanimous vote of the Board:
Local Law No. 1 of the year 1965
Be it enacted by the Town Board of the Town of Ma-
maroneck as follows:
Section 1 - The speed at which vehicles may pro-
ceed on or along all County Roads and Town High-
ways in the entire area within the boundaries of
the Town of Mamaroneck, Westchester County,
exclusive of the areas within the incorporated
limits of the Villages of Larchmont and Mamar-
oneck is hereby restricted to 30 M. P. H.
This local law supersedes the Traffic Commission
Order, dated June 2, 1948, issued by the State
Traffic Commission of the State of New York pur-
suant to authority conferred by Section 95-C of
the Vehicle and Traffic Law of the State of New
York.
This law is to be effective upon its proper filing
as required bylaw.

NEW BUSINESS
a. Authorization to Advertise for Bids
Relighting Town Square
Pursuant to memorandum of the Engineer, dated Feb-
ruary 17, 1965 herewith presented and ordered received
and filed, on motion by Councilman Kane, seconded by
Councilman Brush, it was unanimously
RESOLVED, that the Town Clerk be and he here-
by is authorized to publish in the official news-
- paper of the Town of Mamaroneck, The Daily
Times, a notice for bids for Relighting Town
Square in accordance with the specifications
therefor, said bids to be returnable, opened
and read aloud at a regular meeting of this Board
on March 17, 1965, at 8:15 p. m. in the evening in
the Council Room of the Weaver Street Firehouse,
Weaver Street, Town of Mamaroneck.

b. Authorization to Advertise for Bids
Car for Supervisor
Pursuant to memorandum of the Comptroller, dated
February 15, 1965 herewith presented and filed for the
record, on motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to publish in the official newspaper
of the Town of Mamaroneck, The Daily Times, a
notice for bids for furnishing to the Supervisor of
the Town of Mamaroneck, one new passenger car
in accordance with the specifications therefor,
said bids to be returnable, opened and read aloud
at a regular meeting of this Board to be held on
Wednesday evening, April 7, 1965, at 8:15 p. m. ,
in the Council Room of the Weaver Street Fire-
house, Weaver Street, Town of Mamaroneck.
c. Authorization to Publish Annual Report
of the Supervisor for the Year 1964
Pursuant to memorandum of the Comptroller, dated
February 15, 1965 herewith presented and filed for the
record, on motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED, that authorization is hereby granted
to file the Annual Report of the Supervisor for
the year 1964, and publish same in the official
newspaper of the Town of Mamaroneck, The
Daily Times, in accordance with paragraph 29 of
the Town Law as amended by the addition of sub-
division 10 A.
d. Authorization for Salary Increments
Police Department Patrolmen
Pursuant to memorandum of the Comptroller, dated
February 11, 1965 herewith presented and filed for the
record, on motion by Councilman Brush, seconded by
Councilman Kane, it was unanimously
RESOLVED, that this Board hereby authorizes the
following salary increments in accordance with the
Compensation Plan of the Town of Mamaroneck for
the year 1965:

COMMUNICATIONS
-- a. Letter from Mrs. Floyd E. McGuire
The Clerk presented a letter addressed to the Supervisor
by Mrs. Floyd E. McGuire under date of February 8, 1965
in thanks and appreciation to the Town Board for the "In
Memoriam" resolution forwarded in tribute to Dr. Floyd E.
McGuire, which was herewith received and filed.
b. Letter from Mrs. Martin E. King
The Clerk presented a letter addressed to the Board by
Mrs. Martin E. King under date of February 8, 1965 in
appreciation of the sympathy and kindness extended to her
and the members of her family at the time of Judge King's
death, which was ordered received and filed.
c. Request of Village of Larchmont and
- Village of Mamaroneck - Use of Voting Equipment
Upon presentation of requests from the Villages of
Larchmont and Mamaroneck for the use of voting equip-
ment for the Annual Village Elections on March 16, 1965
and Registration on February 27, 1965 herewith pre-
sented and filed, on motion by Councilman Brush, sec-
onded by Councilman Kane, it was unanimously
RESOLVED, that the requests of the Villages of
Larchmont and Mamaroneck for the use of voting
equipment for registration and election purposes
in each Village, be and they hereby are granted.
d. Letter from Congressman Richard L. Ottinger
The Clerk presented a letter addressed to the Town
Council by Congressman Richard L. Ottinger under date
of February 6, 1965, pertaining to a bill introduced in
the House of Representatives known as H. R. 3401, which
was herewith ordered received and filed.
e. Acknowledgments of New Haven Resolution
The Clerk presented acknowledgments of receipt of
resolution regarding the New Haven, addressed to him
by Dr. William J. Ronan, Secretary to the Governor,
and Assemblyman Anthony B. Gioffre, which were or-
dered received and filed.

f. Notice of Hearing - Board of Appeals
Village of Larchmont
The Clerk presented a notice of hearing before the Board
of Appeals of the Village of Larchmont on February 17th,
1965, which had been referred to the Attorney and upon his
advice that no action was required, was hereby ordered re-
ceived and filed.
REPORTS
The Town Clerk --
The Clerk presented the following reports which were or-
dered received and filed:
Report of the Westchester Shore Humane Society, Inc.
for the month of January, 1965.
Municipal Dog Patrol Report for the month of January,
1965.
Affidavits of publication and posting of resolution
amending the Zoning Ordinance of the Town of Ma-
maroneck.
The Supervisor --
1. Act to Amend Westchester County Administrative
Code - School Taxes
The Supervisor reported briefly on an Act introduced in
the Legislature to amend the Westchester County Admin-
istrative Code in relation to the levy and collection of
school taxes in towns, copies of which had been furnished
to the Assessor and Receiver of Taxes for study and com-
ment. He further stated that such Act would require a
Home Rule resolution in each Town before it could go to
Albany.
Z. March 3 Albany Meeting
The Supervisor advised the Board that he would go to
Albany on March 3rd on County legislative matters.
3. Engagement of Special Counsel
Water Works Case Appeal
Upon the Supervisor's request for the Board's pleasure
in the matter of retention of Special Counsel for the Ap-
peal to be filed in the action of the Westchester Joint
Water Works v. Town of Mamaroneck, the Board directed
that John L. Delius be so retained and that an agreement
so providing at the rate of $25. 00 per hour not to exceed
the sum of $500. 00, be prepared for presentation to this
Board.

4. Recognition of Service
Mrs. Frances Riley
The Supervisor called to the Board's attention Mrs.
Frances Riley's completion of twenty-five years of
loyal service to the Town government in the Assessor's
Department as of last Sunday, February 14th.
The Board expressed its congratulations to Mrs. Ri-
ley, directing the Supervisor to express the Town's
thanks and appreciation to Mrs. Riley.
Councilwoman Helwig -- (Absent)
Councilman Kane reported for Councilwoman Helwig in
her absence as follows:
1, Letter of Chairman, Conservation Advisory
Committee, to Mrs. Harold Bloch - Girl Scout Advisor
For the Board's information, Councilman Kane pre-
sented a letter addressed to Mrs. Harold Bloch, Advisor
of Mariner Troop 72 of the Girl Scouts, replying to re-
quest to improve the Town-owned property between Re-
vere Road and the Thruway, which was ordered received
and filed.
2, Progress Report - Conservation Advisory Committee
In presenting this report, Councilman Kane read a
memorandum addressed to the Board by Councilwoman
Helwig, which particularly called to the Board's atten-
tion for its consideration and study, the Committee's
proposal to retain the services of Clifford B. Emanuel-
son as set forth therein, requesting that consideration
of said proposal be put on the agenda for the next
meeting, March 3rd, which was so ordered.
Councilman Kane --
1, Progress Report - East Creek Pollution Survey
At Councilman Kane's request, the Engineer read a
report addressed to the Board by him under date of
February 10, 1965, entitled " East Creek Pollution
Survey - Progress Report" - which was ordered re-
ceived and filed for the record.
2. Alden House Smoke Condition
Councilman Kane presented a memorandum addres-
sed to the Board under date of February 16, 1965, by
the Engineer and Building Inspector, which was here-
with ordered received and filed.
He further briefly reviewed the proceedings in this

matter occurring at the last meeting in the Supervisor's
absence, and thereupon following some discussion by
the members of the Board and after hearing Mr. Sack,
Managing Agent of the Alden House, who was present,
it was directed that action be deferred at this time
but that a constant check of conditions be maintained by
the Building Inspector and the Engineer.
The Supervisor advised Mr. Sack that this constant
check would be maintained and that if violations oc-
curred at the Alden House, action would be taken.
Councilman Brush --
1. Report on Association of Towns
Annual Meeting
In Councilwoman Helwig's absence, Councilman Brush
as Alternate Delegate, reported briefly on the Annual
Meeting of the Association of Towns, stating that the
attendance was excellent and the sessions good.
Councilman Quadrine -- (Absent)
In Councilman Quadrine's absence, Councilman Brush
reported for him as follows:
1. Reappointment to Zoning Board of Appeals
Sydney D. Bierman, Chairman
Following presentation of a resume of Mr. Bierman's
qualifications and past service to the Town, Councilman
Brush, with great pleasure, recommended his reappoint-
ment as a member and Chairman of the Zoning Board of
Appeals of the Town of Mamaroneck, and thereupon on
his motion, seconded by Councilman Kane, it was unan-
imously
RESOLVED, that Sydney D. Bierman be and he
hereby is reappointed a member and Chairman of
the Zoning Board of Appeals of the Town of Ma-
maroneck, to serve for a term of office of five
(5) years, effective immediately and terminating
February 19th, 1970.
The Chair recognized Mr. William Brill, Attorney,
who was present, and who addressed the Board to re-
quest that consideration be given to increasing the mem-
bership of the Zoning Board to seven members as per-
mitted by law in order to minimize the incidence of
hardship such as he had suffered due to the absence of
two members of said Board on more than one occasion.
The Supervisor assurred Mr. Brill that the Board
would take his suggestion under advisement.

2. Engineer's Week
In Councilman Quadrine's stead, Councilman Brush
called to the Board's attention that February 21st
through 27th, 1965, had been designated as Engineer's
Week by Governor Rockefeller, who stated in his
proclamation that the importance of the engineer "has
grown beyond measure with the years. "
The Board took due note of this occasion.
The Town Attorney --
1. New Haven Resolution
Upon presentation by the Attorney, on motion by
Councilman Brush, seconded by Councilman Kane, the
following resolution was adopted by unanimous vote of
the Board, to-wit:
RESOLUTION URGING THE MEMBERS OF
THE STATE LEGISLATURE TO SUPPORT
GOVERNOR NELSON A. ROCKEFELLER'S
PLAN FOR FINANCIAL ASSISTANCE TO
THE NEW YORK, NEW HAVEN AND HART-
FORD RAILROAD COMPANY AND SUP-
PORTING THE ACTION OF THE BOARD OF
SUPERVISORS OF WESTCHESTER COUNTY
RELATIVE TO REFUND OF TAX ABATE-
MENTS.
WHEREAS, there is imminent danger that the com-
muter service of the New York, New Haven and
Hartford Railroad Company may be discintinued,
and
WHEREAS, it is of the utmost urgency that Gov-
ernor Nelson A. Rockefeller's plan to assist the
Railroad be adopted immediately,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of
Mamaroneck does hereby urge its representatives
in the State Legislature to vigorously support
Governor Nelson A. Rockefeller's plan for finan-
cial aid and assistance to the New York, New Ha-
ven and Hartford Railroad Company,
and be it further
RESOLVED, that the Town Board of the Town of
Mamaroneck does hereby support the action taken
by the Westchester County Board of Supervisors
in waiving the refund by the State of New York of
the tax abatements granted and authorizing said re-
funds to be made to the New York, New Haven and
Hartford Railroad Company,

and be it further
RESOLVED, that a copy of this resolution be for-
warded to the County's representatives of the State
Legislature.
Z. Certiorari Proceedings
Orienta Garden Apartments
Upon the Attorney's advice of the Town and Villages's
need for engaging the services of an expert real estate
appraiser in connection with the subject certiorari pro-
ceedings with the cost thereof to be shared equally by
the two municipalities, on motion by Councilman Kane,
seconded by Councilman Brush, it was unanimously
RESOLVED, that the Town Attorney be and he here-
by is authorized to engage the services of an expert
real estate appraiser in connection with the
Orients, Gardens Apartments, said appraiser to be
engaged at a fee to be shared equally by the Village
of Mamaroneck and the Town of Mamaroneck.
ADJOURNMENT
There being no further business to come before the
meeting, on motion duly made and seconded, it was de-
clared adjourned at 9:10 p. m. , to reconvene on March
3, 1965.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was
convened immediately upon the adjournment of the Town
Board meeting.
1. Claims
Commissioner Brush presented the following claims
for authorization of payment, and thereupon on his mo-
tion, seconded by Commissioner Kane, it was unani-
mously
RESOLVED, that the following Fire Department
claims, which had been audited by the Comp-
troller and approved by the Fire Chief, are ap-- .
proved, and the Supervisor and Comptroller be
and they hereby are authorized to pay the same
out of the budget for the Fire Department for

Z. Reports
Commissioner Brush presented the Annual Report
of the Fire District -Treasurer of Fire District #1 in
the Town of Mamaroneck for the Year Ending Decem-
ber 31, 1964, which was herewith ordered received
and filed.
3. Communications
Commissioner Brush presented a communication
from the Secretary of the Town of Mamaroneck Fire
Department, dated February 16, 1965, requesting ap-
proval of the election of officers for 1965 as stated
therein.
Whereupon, on his motion, seconded by Commis-
sioner Kane, it was unanimously
RESOLVED, that this Commission hereby ap-
proves the election of the following officers to
the following offices for the year 1965:

Thank-you to Fire Department
-- Commissioner Brush expressed the Board's thanks to
the Fire Department for its excellent assistance in
setting up the Auditorium for the Hommocks Committee
meeting held last Wednesday evening.
5. Adjournment
There being no further business to come before the
meeting, on motion duly made and seconded, it was de-
clared adjourned at 9:20 p. m. , to reconvene March 3, 1965.
