HomeMy WebLinkAbout1965_02_03 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD FEBRUARY 3rd, 1965, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER In the absence of the Supervisor, Deputy Supervisor Kane called the meeting to order at 8:15 p, m. ROLL CALL Present: Deputy Supervisor Kane Councilman Brush Councilwoman Helwig Councilman Quadrine - Absent: Supervisor Burchell Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Deputy Clerk Mr. Altieri - Comptroller Mr. Kellogg - Town Engineer APPROVAL OF MINUTES On motion duly made and seconded, the minutes of the regular meeting of January 6, 1965, were approved as submitted. OLD BUSINESS a) Renumbering of Palmer Avenue The Clerk presented a memorandum addressed to the Board by the Engineer under date of January 21, 1965, enclosing a plan for the proposed renumbering of that part of Palmer Avenue lying within the unincorporated area and a list of the residents thereof, which was here- with ordered received and filed for the record. The Board, following discussion and review of the plan, inquired whether an ordinance was required to implement the proposed changes, and upon the Attorney's reply in the negative, directed that a letter be addressed to each resident of the area explaining the proposal and requesting his comments thereon prior to taking action at a subsequent meeting. NEW BUSINESS a) Authorization of Lease for Town Offices -1- Upon presentation of the lease for the Town Offices, on motion by Councilwoman Helwig, seconded by Coun- cilman Brush, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute the lease for the rental of the premises used for the Town of Mamaroneck Offices at 158 West Boston Post Road in the Vil- lage of Mamaroneck, said lease being in the amount of $11, 400. 00 for the years of 1965 and 1966. b) Authorization of Contract - Larchmont Public Library Upon presentation of agreement between the Town of Mamaroneck, Village of Larchmont and the Larchmont Public Library covering the appropriation by the Town to the Library for the year 1965, it was on motion by Councilman Brush, seconded by Councilwoman Helwig, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute the contract for 1965 be- tween the Town of Mamaroneck, the Village of Larchmont and the Larchmont Public Library in the amount of $38, 839. 00 as provided in the an- nual budget or estimate for the year 1965. COMMUNICATIONS a) Acknowledgment of Designation First Westchester National Bank The Clerk presented a letter addressed to him by Henry A. Gruse, Assistant Vice President, Mamaro- neck Office of The First Westchester National Bank, under date of January 21, 1965, acknowledging with thanks the Town's designation of said bank as a de- pository for Town funds for the year 1965, which was herewith ordered received and filed. b) Letter from Police Commission - Re: Speed Limits within the Town For the Board's information, the Clerk presented a letter addressed to the Board by the Police Commission under date of January 26, 1965, pertaining to speed limits for the Town of Mamaroneck and recommending that same be maintained at 30 miles per hour, which, it was directed be carried over for presentation at the February 17 public hearing on the adoption of Local Law No. 1 for the year 1965 establishing the maximum speed - limit on County and Town roads within the unincorporated area. -2- c} Letters from Larchmont Chamber of Commerce re: Use of Vacant Stores, New Haven Resolution and Proposed State Sales Tax The Clerk presented letters addressed to the Board by the Chamber of Commerce of Larchmont on the above- mentioned subjects, on which the Board took the follow- ' ing action: Reference of letter and statute with regard to use of stores by temporary tenants to Planning Board for report and recommendation to this Board; New Haven resolution ordered received and filed in the light of continuing proceedings; Resolution opposing adoption of the Governor- recommended sales tax as a means of raising rev- enue in the State taken under advisement. The Clerk was directed to so advise the Chamber of Commerce. REPORTS The Town Clerk -- The Clerk presented the following reports which were or- dered received and filed: Town Clerk's report for the month of January, 1965. Report of the Building and Plumbing Inspector for the month of January, 1965. Report of the Receiver of Taxes and Assessments for the month of January, 1965. The Deputy Supervisor -- 1. New Haven Railroad The Deputy Supervisor commented briefly on the meet- ing concerning the New Haven which Councilman Quadrine and he had attended on the Town's behalf, stating that he would not go into detail since they had been so fully covered in the press. He further reported that he had attended Monday's meeting of the Board of Supervisors but had "only the right to be silent since no provision in the law allowed a Deputy Supervisor to voice the thinking of the citizens of the township he represented. " This shortcoming in the law was dramatically illus- trated Monday, he said, because the Town did not have a vote on the important issue of the New Haven Railroad op- -3- erations. There was no question, however, of a ''de- ciding vote'', he pointed out, since the Supervisors were overwhelmingly in favor of the $400, 000. 00 con- tribution by the County. Councilwoman Helwig suggested that the question of a Deputy Supervisor being empowered to vote on the Board of Supervisors in the Supervisor's absence be referred to the Association of Towns at the forthcoming Annual Meeting, with which the Board unanimously concurred. 2. Honorary Boy Scout Official Day The Deputy Supervisor called to the Board's attention that Saturday, February 6, would be Boy Scout Official Day in the Town and that those concerned would meet in the Supervisor's Office at 9 a. m. 3. Letter from Association of Towns Acknowledgment of Dues The Deputy Supervisor advised the Board of his re- ceipt of a letter addressed to him by William K. Sanford, Executive Secretary of the Association of Towns, thank- ing the Town for the 1965 dues and expressing the Asso- ciation's appreciation of the Town's continued interest and support, which was ordered received and filed. 4. Letter Commending Members of Highway Staff For the Board's information, the Deputy Supervisor presented a letter addressed to the Supervisor by Mrs. Mary G. Murphy of 27 Edgewood Avenue under date of January 29, 1965, commending two members of the Highway staff for their courtesy and kindness in volun- tarily assisting her when stuck during the last snow storm. The Board directed that the letter be acknowledged with appreciation and copy thereof forwarded to the Superintendent of Highways for posting on the Town Garage bulletin board. Councilwoman Helwig -- 1. Appointment to Association of Towns Resolution Committee For the Board's information, Councilwoman Helwig presented a letter addressed to her under date of January 29, 1965, by William K. Sanford, Executive Secretary of the Association of Towns, advising her of her appointment to the Resolutions Committee of the Association. The Board expressed its hearty congratulations to -4- Councilwoman Helwig with the Deputy Supervisor re- marking that to the best of his knowledge, this was the first time that a member of this Board had been so honored. Councilwoman expressed her appreciation and as- surred the Board that she would serve to the best of her ability. - 2. Hommocks Study Committee Councilwoman Helwig advised the Board that the Hom- mocks Study Committee had met weekly since its estab- lishment and would be ready to submit its Interim Report following its next meeting. She highly commended the work this Committee had done, calling particular diligence of its members and the contribution they had made in performing this ser- vice for the community. Councilman Kane -- 1. Smoke Conditions - Alden House Apartments Councilman Kane presented for the Board's infor- mation, a memorandum addressed to the Supervisor and Attorney by the Engineer under date of January 12, 1965, enclosing letter addressed to him under date of January 11, 1965, by Mrs. R. H. Hemmerich of 14 Alden Road, complaining of smoke conditions from the Alden House Apartments, together with a memorandum - under date of January 8, 1965, entitled, "Alden House Violation of Smoke Ordinance", which were ordered received and filed. Also presented and ordered received and filed, was copy of a letter addressed to the Building Inspector un- der date of January 21, 1965 by John J. Sack, Manager of the subject premises, explaining what had been done and was being done at the premises with regard to this matter. Following a discussion of some length by the Board, it was directed that this matter be referred to the En- gineer and Attorney for report at the next meeting. Councilman Brush -- 1. Appointment - Police Patrolman Pursuant to memorandum of the Police Chief, dated February 1, 1965, herewith presented and filed for the record, on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously -5- RESOLVED, that this Board hereby approves the probationary appointment of James B. Herbst, Larchmont Acres, Larchmont, New York, as a Police Patrolman of the Town of Mamaroneck, and authorizes payment of compensation at the rate of $6, 040. 00 per annum beginning as of February 4, 1965. Councilman Quadrine -- 1. Notice State Board of Equalization and Assessment Councilman Quadrine reported receipt of notice of the State Board of Equalization and Assessment establishing the tentative state equalization rate for the Town of Ma- maroneck at 47 for 1964 and fixing the date of hearing thereon for February 18, 1965, at 10 a. m. , at 155 Washington Avenue, Albany, N. Y. 2. Insurance Coverage for Planning Board Councilman Quadrine requested that a written report be obtained from the insurance agent with reference to the question of insurance coverage for members of the Planning Board when engaged in Town business which had been raised by that Board, which the Board directed be so obtained. The Town Attorney -- 1. Insurance Claims - Bertha Baer and Dominic T. Martino Pursuant to the Attorney's recommendation, on motion by Councilman Brush, seconded by Councilwoman Helwig, L it was unanimously RESOLVED, that this Board hereby authorizes pay- ment of the claims of Bertha Baer and Dominic T. Martino v, the Town of Mamaroneck, in the amounts of $50. 00 and $45. 00 respectively, under the Town's policy containing a $50. 00 deductible property darn- age clause. OTHER BUSINESS 1. Mr. Carl Tortorella, Jr. In reply to an inquiry by Mr. Tortorella as to the require- ments of the Town for the clearance of sidewalks following snow storms, the Attorney recited the provisions of the Or- dinance applicable thereto. -6- ADJOURNMENT There being no further business to come before the Board, on motion duly made and seconded, the meeting was declared adjourned at 9:05 p. m. , to reconvene on February 17, 1965. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was - convened immediately upon the adjournment of the ' 'own Board meeting. 1. Claims Commissioner Brush presented for approval the Fire Department claims and upon his motion, which was sec- onded by Commissioner Helwig, it was unanimously RESOLVED, that the following Fire Department claims be and they hereby are approved, and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the proper item in the Fire Department budget for 1965: R.
