The Supervisor called the meeting to order at 8:15 p. m.

ORGANIZATION MATTERS
The Supervisor presented the organization matters for
1965, which, following due consideration on motions duly
made and seconded, were authorized by unanimous adop-
tion of the following resolutions:
1. Salaries as provided in 1965 budget for:
a) Elected Officials
RESOLVED, that the salaries of all elected
officials of the Town of Mamaroneck for the
year 1965 are to be the salaries stated and
appropriated in the annual budget or esti-
mate for that year as follows:

or estimate for that year, or so much thereof

retary to the Supervisor be and it hereby is
fixed in the amount of $6700. 00 per annum be-
ginning as of January 1, 1965.
e) Secretary to Attorney

RESOLVED, that the compensation of the
Secretary to the Town Attorney be and it
hereby is fixed in the amount of $2. 50 per
hour as provided in the 1965 budget.
Z. Bi-weekly Payroll
RESOLVED, that the salaries of all officials
and employees of the Town of Mamaroneck be
paid on a bi-weekly basis, effective as of
January 1, 1965.
3. Appointments
a) Deputy Tax Receiver

RESOLVED, that in accordance with the Tax
Receiver's request, this Board hereby ap-
proves the appointment of Mrs. Donna Com-
stock, Intermediate Account Clerk, as
Deputy Receiver of Taxes, authorized to re-
ceive tax money, give proper receipt there-
for in her name, enter such payments upon
the records, and deposit tax money in the
bank for the year ending December 31, 1965.
b) Person Authorized to Receive Tax Money
RESOLVED, that in accordance with the Tax
Receiver's request, this Board hereby ap-
proves the appointment of William Kirtland,
Intermediate Clerk, as a person authorized
to receive tax money, give proper receipt
therefor in his name, enter such payments
upon the records, and deposit tax money in
the bank for the year ending December 31,
1965.
c) Deputy Town Clerks
RESOLVED, that in accordance with the
Town Clerk's certificate, the appointment of
Mrs. Donna Comstock and Mrs. Lavenia
Brewer as Deputy Town Clerks of the Town
of Mamaroneck for the year 1965 be and it
hereby is approved.
d) Constables
RESOLVED, that the following persons be and
they hereby are appointed Civil Officers of the
Town of Mamaroneck with the powers and
duties of Constables in civil actions and pro-
ceedings only as provided in Section 20, 1 (a)
offtb-e Town Law; said persons to serve with-
out salary for a term of one (1) year, starting
January 1, 1965 and terminating December
31, 1965:

RESOLVED, that Town Councilman C. Benjamin

for a term of one (1) year, beginning January 1,
1965 and terminating December 31 of that year.

f) Auditors
RESOLVED, that the firm of Glick-Freedman,
C. P. A. , 271 North Avenue, New Rochelle,
New York, be and it hereby is appointed to
audit the records of the Town of Mamaroneck
for the year 1965; such service to be rendered
for a fee of $2700. 00 as appropriated in the
annual budget or estimate for the year 1965.
4. Bond Approval
RESOLVED, that pursuant to Town Law, a
bond is required for the faithful performance
of the duties of each of the appointed officials
and employees listed below, and is authorized
as follows in the amount stated with sufficient
surety to be approved by this Board and the
form to be approved by the Town Attorney:

5. Approval of Supervisor's Appointment
Member-Examining Board of Plumbers
RESOLVED, that this Board hereby approves the
-- Supervisor's appointment of Mr. Victor J. Kriss
as a member of the Examining Board of Plumbers
of the Town of Mamaroneck, to serve for a term
of one (1) year terminating December 31, 1965.
6. Designations
a) Town Board Meeting Dates
RESOLVED, that regular meetings of this Board
be held at 8:15 p. m. in the Council Room of the
Weaver Street Firehouse, Weaver Street, Town
of Mamaroneck, on the first and third Wednes-
day of each month with the exception of the
months of June, July, August and September
when the Board shall sit only on the first Wed-
nesday of the month.
b) Official Newspaper
RESOLVED, that "The Mamaroneck Daily
Times" be and it hereby is designated as the
official newspaper of the Town of Mamaro-

neck for the purpose of publishing notices.
c) Depositories of Funds
RESOLVED, that the following Banks and Trust
Companies are hereby designated as deposi-
tories for funds of the Town of Mamaroneck for
the year 1965, and that the escrow agreements
between these banks and the Town of Mamaro-
` neck presently in effect shall be continued:

Joseph Altieri, Comptroller.
On the foregoing resolution, Councilman Kane raised a
question as to the designation of The First National Bank
of Mount Vernon for the reason of its merging with
Chemical of New York, stating that in his view only local
banks should be designated, whereupon on roll call, the
vote was as follows which Councilman Kane requested be
recorded in the minutes of this meeting:

OLD BUSINESS
a) Petition for Revocation of
Swimming Pool Permit
Dr. V. Pasqua - 77 Cooper Lane
The Supervisor reviewed the petition in some detail
and inquired, in view of its long and careful consider-
ation, whether it was the Board's pleasure to act
thereon at this time.
Whereupon, since the Board indicated that it was
ready to act, based on the recommendation and report
of the Building Inspector and Attorney and following a
discussion, during which it was pointed out that the
pool conformed in all respects with the Swimming Pool
Ordinance and the Zoning Ordinance and that the only
violation which existed was that the cabana, an accessory
structure, did not conform with the side yard set back
requirements of the Zoning Ordinance, the following res-
olution was offered on motion by Councilman Kane and
seconded by Councilman Brush, to-wit:
RESOLVED, that the petition to rescind the swim-
ming pool permit issued to Dr. Valerioa Pasqua,
77 Cooper Lane, Town, be granted.
Upon roll call, the vote on the foregoing resolution
was as follows:

The resolution was therefor defeated and the petition
denied by unanimous vote and the Building Inspector
directed to serve proper notice of violation upon Dr.

NEW BUSINESS
There was no new business to come before the meeting.
COMMUNICATIONS
a) Acknowledgements of Resolution
For the Board's information, the Clerk presented
acknowledgements of certified copies of the resolu-
tion adopted by this Board on December 9, 1964 in
— protest to the proposed "SA" classification of certain
off-shore Long Island Sound waters from Alexander
-- Aldrich, Executive Assistant to Governor Rockefeller,
Senator Meighan, Assemblyman Gioffre, and Irving
Grossman, Chief, Water Pollution Control Section of
the New York State Department of Health.

b) Notice of Annual Meeting - Association
of Towns of the State of New York
For the Board's information, the Clerk presented the
notice of the Annual Meeting of the Association of Towns
to be held in the Commodore, Biltmore and Roosevelt
Hotels in New York City, February 8 - 10, 1965, which
was ordered received and filed, and in compliance with
the request contained in said notice, the following reso-
lution was adopted by unanimous vote of the Board on
motion offered by Councilman Kane and seconded by
Councilman Quadrine, to-wit:
RESOLVED, that Councilwoman Christine K. Hel-
wig and Councilman C. Benjamin Brush, Jr. be
and they hereby are designated as Delegate and
Alternate respectively for the purpose of voting at
the 1965 Annual Meeting of the Association of
Towns;
and be it further
RESOLVED, that all officials and members of
the Town staff are hereby authorized to attend
any sessions of said Annual Meeting at Town ex-
pense;
and be it further
RESOLVED, that the Comptroller is hereby au--
thorized to audit the claims for expenses of those
persons who attend the said Annual Meeting, said
expenses to be paid from the proper items in the
1965 budget.
c) Letter from Mayor Ryan, Village of Larchmont
(Re: Town-Village Boundary Line, Hommocks Area)
The Clerk presented the following letter addressed to
the Supervisor by Mayor Ryan of the Village of Larch-
mont under date of December 8, 1964:
"We have received a letter from Fred Kellogg
relative to the boundary line between the Unin-
corporated Town area and the Village in the
Hommocks' area. His letter inquired as to
whether we would be receptive to some agree-
ment relative to the line.
This is to advise you that the Board has ex-
pressed its approval of the general idea and if
you will appoint a committee, we shall do like-
wise to take care of the situation. "
And thereupon, on motion by Councilman Brush, sec-
! onded by Counwilwoman Helwig, it was unanimously
RESOLVED, that Councilman Kane and the Town

Engineer be and they hereby are appointed as a
Committee to consult with the Village of Larch-
, mont regarding the boundary line between the
unincorporated area and the Village in the Horn-
mocks area.

The Clerk presented the following reports which were or-

The Supervisor --
1. Water Works Case
For the Board's information, the Supervisor briefly
reviewed the Appelate Court decision in favor of the
Town in the action of the Westchester Joint Water
Works vs. the Town of Mamaroneck, stating that he,
of course, would oppose any further appeal.
2. Blossom Terrace
Drain Problem
With reference to a letter addressed to the Supervisor
by Commissioner Harding of the County Department of
Public Works under date of October 14, 1964, mandating
the Town to remedy a violation of the State Sanitary Code
concerning the discharge of storm water drainage into
a sanitary sewer, the Supervisor stated that the Town At-
torney would negogiate with certain property owners in
an effort to obtain easements necessary for the installa-
tion of the drain required for the correction of the above
described condition.
He further stated that should it not be possible to ob-
tain the necessary easements through negotiation, the
Attorney would so report and then request authorization
to commence the necessary condemnation proceedings.

3. Invitation - Pelham Men's Club
The Supervisor presented an invitation addressed to him
by the Men's Club of Pelham to attend a meeting on the
subject of "The New New Haven", to be held at the Pelham
Memorial High School on the evening of January 12th.
He stated that it would not be possible for him to be
present and inquired whether Councilman Brush and Coun-
cilman Quadrine could represent the Town. Both of the
Councilmen stated that they would attend the meeting and
report thereon.
Councilwoman Helwig --
1. Recreation
Salary Authorization - Richard Perry
Pursuant to memorandum of the Comptroller herewith
presented and filed, on motion by Councilwoman Helwig
and seconded by Councilman Kane, it was unanimously
RESOLVED, that this Board hereby authorizes
that Richard Perry, employed as a full-time
Recreation Attendant, be compensated at the
rate of $3, 150. 00 per annum, effective as of
January 4, 1965.
2. Park Department
Resignation of John Oliver, Chairman
Board of Park Commissioners
Councilwoman Helwig advised the Board that the time
of Mr. Oliver's departure to Fairfield was at hand and
that she felt it only fitting and proper that recognition of
his dedicated service was recorded in the minutes of
this Board at this time.
She spoke of the close cooperation of the Park and
Recreation Departments in the development of Memorial
Park achieved under his leadership and guidance, of his
great interest in and knowledge of rare and unusual
plants which had increased the beauty of the Town's parks
and, in effect, created in them a miniature 'Botanical
Garden.
She also stated that while his contributions through
the many years of his service were too numerous to
enumerate, she felt that although his move to Fairfield
deprived the Town of an invaluable Commissioner, it was
left as his legacy a real and living memorial which would
ever increase in beauty and value through the years --
and thereupon, on her motion, which was unanimously
seconded, the following resolution was adopted to be
spread upon the minutes of this meeting in tribute to
Mr. Oliver and forwarded to him in grateful appreciation.

WHEREAS, John W. Oliver has been a dedicated
member of the Board of Park Commissioners of
Park District No. 1 of the Town of Mamaroneck
since April of 1955,
and
WHEREAS, Mr. Oliver served with great dis-
tinction as Chairman of that Board from January
of 1962 until December of 1964,
and
WHEREAS, Mr. Oliver has, through his spec-
ialized skill and knowledge significantly contrib-
uted to the beauty and variety of the plantings in
our parks,
and
WHEREAS, under his leadership in the past sev-
eral years, new areas and facilities have been
added to our parks which greatly enhance their
recreational uses for the benefit and pleasure of
our residents,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Board of the Town of
Mamaroneck, on its own behalf and in behalf of
the residents thereof, expresses its deep appre-
ciation of the distinguished contributions that
Mr. Oliver has made to our Park District; and
further records its conviction that the ever in-
creasing beauty and usefulness of our parks will
constitute a lasting and permanent memorial to
Mr. Oliver's devoted service to his community.
3. Receipt of Gift for
Conservation Project
Councilwoman Helwig reported that the Larchmont
Lions Club had given a $200. 00 check to the Town for
its conservation project, and the Board, after verbally
expressing its thanks and appreciation, directed the
Supervisor to formally thank the Lions Club on its
behalf.
Councilman Kane --
1. Salary Authorization - Senior
Engineering Aid
Pursuant to memorandum of the Comptroller, dated
January 6, 1965, herewith presented and filed, on mo-
tion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED, that this Board hereby authorizes

that Ronald C. Schmidt, employed on a probation-
ary appointment as Senior Engineering Aid of the
Town of Mamaroneck, be compensated at the
rate of $5, 800. 00, effective as of January 4, 1965.
Councilman Brush --
1. Salary Authorization - Fireman
Pursuant to memorandum of the Comptroller, dated
January 6, 1965, herewith presented and filed, on
motion by Councilman Brush, seconded by Councilman
Kane, it was unanimously
RESOLVED, that this Board hereby authorizes
that Santo G. Garofalo, employed as a Town of
Mamaroneck Fireman, be compensated at the
rate of $5, 910. 00 per annum, effective as of
January 1, 1965; said appointment is a pro-
bationary appointment.
2. Housekeeping Matters
a) Tunnel
Councilman Brush called attention to the very poor
condition of the tunnel, requesting that the matter
be directed to the attention of the proper department.
It was pointed out that this was the responsibility
of the Village of Larchmont and the Supervisor re-
quested the Engineer to get in touch with Mr.
O'Reilly, the Village Engineer, regarding this
matter.
b) Guadagnola Property
In the line of housekeeping, Councilman Kane
brought up the matter of the appearance of the
Guadagnola property and the 50' fenced-in vacant

1. Request for Assessor to Attend
Annual Assessor's Convention
Pursuant to memorandum of the Assessor, dated Jan-
uary 6, 1965, herewith presented and filed, on motion
by Councilman Quadrine, seconded by Councilman Kane,

it was unanimously
RESOLVED, that this Board hereby authorizes the
Assessor to attend the Annual Assessors Conven-
tion of New York State, to be held in Buffalo, N. Y.
January 17-21, 1965, with expenses paid by the
Town in an amount not to exceed the sum of
$125. 00.
2. Apportionment
Councilman Quadrine presented for approval the fol-
lowing petition from the Assessor requesting correc-
tion of the assessment roll so as to permit the appor-
tionment of taxes, and thereupon on his motion, sec-
onded by Councilman Brush, the following resolution
was adopted by unanimous vote of the Board:
WHEREAS, the Assessor has presented the follow-
ing petition for the correction of the assessment
roll for certain years pursuant to the provisions
of Section 557, Article 16 of the Westchester
County Administrative Code, known as the West-
chester County Tax Law; and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petition for the
correction of said assessment roll:
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1964,
taxes of 1965, which shows property now ap-
pearing on the roll as follows:

BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was
convened immediately upon the adjournment of the Town
Board meeting.

Upon presentation by Commissioner Brush, on motion
by him and seconded by Commissioner Kane, it was

claims be and they hereby are approved, and the

a) Insurance
Mr. Vincent Ciardullo
With reference to the matter of providing insur-
ance with increased disability benefits for fire-
men in case of accident, Mr. Ciardullo, Insurance
Representative for the Fire Council, reported on

a policy outlined by the Coughlin-Larchmont Agency
which would provide such benefits.
This matter was referred to the Attorney for further
investigation and detailed report to the Commission
at the next meeting.
