CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. ROLL CALL Present: Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Quadrine Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Secretary Mr. Altieri - Comptroller Mr. Kellogg - Town Engineer APPROVAL OF MINUTES The minutes of the regular meeting of October 21, 1964 were presented, and on motion duly made and seconded, ap- proved as submitted. OLD BUSINESS 1. Petition for Revocation of Swimming Pool Permit at 77 Cooper Lane, Town (Presentation of Statement by Attorney for Respondent) In the matter of the foregoing petition, a written State- ', ment submitted by Mr. William Brill, attorney for the Respondent, was herewith presented and ordered re- ceived and filed for the record. Consideration of this matter was deferred by com- mon consent of the Board, and a request presented by Jerome N. Wanshel, attorney for the Petitioners, for time to file a reply to Mr. Brill's Statement, which he had not seen until this evening, was granted. Z. Application of Ciro LaBarbera for Special Permit Presentation of Planning Board Report The Clerk presented a resolution adopted by the Plan- ning Board, to which the matter had been referred by this Board, at its regular meeting on November 2, 1964, recommending that, since in the opinion of that Board, -1- the application was properly under the jurisdiction of the Zoning Board of Appeals pursuant to Section 340 of the Zoning Ordinance, it be made to that Board. Whereupon the Board directed that the application be so referred pursuant to the Planning Board's rec- ommendation, and that the applicant be notified ac- cordingly. NEW BUSINESS 1. Request for Authorization to Advertise for Bids for Borings for Proposed Griffen Avenue Sewer Exten- sion, Section "R" Pursuant to memorandum of the Town Engineer, dated November 4, 1964, herewith presented and or- dered received and filed, on motion by Councilwoman Helwig, seconded by Councilman Kane, it was unan- imously RESOLVED, that in accordance with law, the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for sealed bids, returnable December 9, 1964 and to be opened and read aloud at a regular meeting of this Board at 8:15 p. m. that even- ing, for soil borings and associated work in connection with the proposed Griffen Avenue Sewer Extension, Section "R", said work to be in accordance with the specifications on file in the Office of the Town Clerk. 2. Authorization of Dates for Town Board Meetings November and December, 1964 In order to present the Preliminary Budget for 1965 and hold the public hearing thereon as required by law, on motion by Councilwoman Helwig, seconded by Councilman Kane, it was unanimously RESOLVED, that this Board hereby authorizes that the dates of the regular meetings of this Board in November and December, 1964, be changed as follows: That the regular meeting of November 18, 1964 be held on Thursday evening, November 12, in- stead of the 18th. That the regular meetings in December be held on Wednesday evening, December 9, and Wed- - nesday evening, December 23, instead of on December 2 and 16. -2- r and be it further RESOLVED, that the Clerk notify the Firehouse of the change in date for the three meetings hereinabove set forth. 3. Appointment of Dog Enumerator Pursuant to notice from the State of New York Depart- ment of Agriculture and Markets herewith presented and filed, in accordance with the recommendation of the Town Clerk, on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that pursuant to Section 108 of the Agri- culture and Markets Law, Eugene Agnessanto be and he hereby is appointed as Dog Enumerator in the un- incorporated area of the Town of Mamaroneck for the year 1965. 4. Authorization for Appointment of Intermediate Typist (P-T) and Salary Change, Senior Typist Pursuant to memorandum of the Comptroller, dated Oc- tober 30, 1964, on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes: (1) Employment of Mrs. LeEsta Davis as a part- time Intermediate Typist, to be compensated at the rate of $2. 50 per hour beginning as of - October 29, 1964, and transfer of the sum of $350. 00 from General Town Contingency to Town Offices for such payment. (Z) That effective as of October 29, 1964, Mrs. Frances Riley, Senior Typist, at her re- quest, be compensated at the rate of $5, 000. per annum rather than at the rate of $5, 005. , for income tax purposes. COMMUNICATIONS 1. Letter from Mr. Julian Bers The Clerk presented the following letter, addressed to the Supervisor and Town Council by Mr. Julian Bers of 9 Lafayette Road, under date of October 28, 1964: " With regard to continuance and upkeep of our New Haven Railroad, my family and I have every con- fidence that you are doing your utmost to try to find and suggest to other authorities ways and means to save this lifeline of our community. Your continuing efforts in this regard are greatly appreciated by all of us in our part of the Town. " -3- Z. Communications (2) from Office of Rent Administration re: Vacancy Rent Decontrol, unincorporated area For the Board's information, the Clerk presented two (2) communications, addressed to him by Mr. Robert E. Her- man, Assistant Commissioner, Office of Rent Administra- tion, Executive Department, Division of Housing and Com- munity Renewal, State of New York, the first of which un- der date of October 21, 1964, requested that an affidavit of publication of the public notice of the public hearing held by the Town Board prior to its adoption of the resolu- tion on the matter of vacancy decontrol be forwarded to than office in accordance with the requirements of the Emergency Housing Rent Control Law, and the second un- der date of October 30, 1964, enclosing copy of Decontrol Order Number 80, adopted on October 26, 1964, and ef- fective and operative February 1, 1965, which were here- with ordered received and filed for the record. 3. Communication - State Board of Equalization and Assessment For informational purposes, the Clerk presented a corn- munication of the State Board of Equalization and Assess- ment, dated October 16, 1964, advising that a conference would be held by that Board on Wednesday, December 2, at 10 a. m. , at the Town Hall, for the purpose of dis- cussing its 1963 Study of Market Values in the community, which was herewith ordered received and filed. REPORTS The Town Clerk -- The Clerk presented the following reports which were or- dered received and filed: Report of the Receiver of Taxes and Assessments for the month of October, 1964. Report of the Building Inspector for the month of Oc- tober, 1964. The Supervisor -- The Supervisor stated that he had no report to submit at this time. Councilwoman Helwig -- 1. Thruway Noise Abatement Committee Report of Truck Tire Noise Survey Councilwoman Helwig reported very briefly on the success of the Truck Tire Noise Survey conducted on -4- the New England Thruway during the week of October 26, 1964, particularly stressing the number of representa- tives of the tire manufacturers who had attended. The Board commended Mrs. Helwig on her efforts in connection with this program which had been arranged by the Rubber Manufacturers Association, and in concur- rence with her suggestion, unanimously adopted a reso- lution of appreciation , offered by her, seconded by all of the members of the Board, and reading as follows: WHEREAS, the Rubber Manufacturers' Association recently sponsored a program of Tire Noise Tests on the New England Thruway in an effort to identify truck tires that cause excessive or unnecessary noise, and WHEREAS, the sponsorship by this Association and the cooperation of the major tire manufacturers in this project demonstrate the sincere interest of the industry in solving tire noise problems arising from the operation of trucks on high speed thorough- fares, and WHEREAS, these new and vexing problems have seriously affected our residents and vitally concern their welfare and property values; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Ma- maroneck commends the Rubber Manufacturers' As- sociation for its vision in recognizing a problem that seriously affects all persons residing near such su- per highways and for its efforts to determine whether there are remedies that lie within the power of the industry to implement; and be it further RESOLVED, that the Town Board urges that the Rubber Manufacturers' Association will continue to exert its influence to resolve this problem in the general public interest. - 5 - Councilman Kane -- 1. Authorization for Street Light on Althea Lane Pursuant to memorandum of the Town Engineer, dated October 30, 1964, and herewith presented and ordered re- ceived and filed, after some discussion regarding the in- surance connected with replacement of this light as re- ferred to in the said memorandum, on motion by Council- man Kane, seconded by Councilman Brush, it was unan- imously RESOLVED, that this Board hereby authorizes the installation of a new pole and street light at the bend in Althea Lane, near the southwest corner of property of David L. Robbins, at a cost not to ex- ceed the sum of $375. 00. _. Councilman Brush -- Councilman Brush stated that he had only Fire matters to report on under the Fire Commission. Councilman Quadrine -- Councilman Quadrine stated that he had no report to present at this time. The Town Attorney -- The Attorney stated that he had no report at this time. ADJOURNMENT There being no further business to come before the meet- ing, on motion duly made and seconded, it was declared ad- journed at 8:45 p. m. , to reconvene on November 12, 1964. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims Commissioner Brush presented for approval and au- thorization of payment, the following claims which had been audited by the Comptroller and approved by the Fire Chief, and thereupon on his motion, which was seconded by Commissioner Helwig, it was unanimously RESOLVED, that the following Fire Department 6 claims be and they hereby are approved, and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the 1964 Fire Department budget: Bliss-Gamewell $ Z. 81 Con Edison 10. 00 Humble Oil & Refining Co. 235. 82 I & T Plumbing & Heating Co. 23. 00 Wm. Reports Commissioner Brush presented the following report which was ordered received and filed: Fire Report for the month of October, 1964. 3. Communications There were no communications to be presented. 4. Other Matters 1. Purchase of Generator The Fire Chief advised the Commission that prices on a new generator were presently being obtained and that the Comptroller upon receipt thereof, would ascertain from the Office of Civil Defense whether "matching funds" were available for such purchase. 2. Letter from New York Fire Insurance Rating Organization Following some discussion, Commissioner Brush was directed to ascertain, in reply to a question of the Fire Chief's, how and by whom the map of the Town referred to in the October 19 letter of the New York Fire Insurance Rating Organization with regard to the establishment of Fire Limits, had been fur- nished to that organization. -- 5.
