OF THE TOWN OF MAMARONECK, HELD JULY 1, 1964, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

OPENING OF BIDS - Memorial Park Area
The Clerk presented the affidavit of publication of the
Notice of Bids for the record, and opened and read aloud
the following bids:

Because of the urgency of timing in this instance in ac-
cord with Councilwoman Helwig's request, at the Board's
direction the Attorney and Engineer were requested to
check the bids immediately so that the contract could be
awarded this evening if the bids were found to be in order.
OLD BUSINESS
1. Report of Highway Superintendent
(Bids for Highway Dump Truck)
Pursuant to recommendation of the Highway Superin-
tendent addressed to the Board under date of June 22,

1964, in memorandum herewith presented and filed for
the record, on motion by Councilman Kane, seconded
by Councilwoman Helwig, it was unanimously
RESOLVED, that this Board, with the approval of
the Town and County Highway Superintendents,
hereby accepts the low bid, to-wit the bid of Flinn
Motor Corp. , for furnishing to the Town of Ma-
maroneck Highway Department, one (1) new latest
model Highway Dump Truck in accordance with the
specifications set forth in the Notice for Bids as
published and filed in the Office of the Town Clerk,
for a gross delivered price of $4, 296. 50 -- less
trade-in allowance of $250. 00 -- or a net delivered
price of $4, 046. 50;
and be it further
RESOLVED, that the Town Superintendent of High-
ways is hereby authorized, subject to the approval
of the County Superintendent of Highways, to sur-
render to the above named vendor, one (1) 1948
Brockway Dump Truck -- (Truck #8).
2. Application for Special Permit to Construct
Swimming Pool - Mr. and Mrs. William Speyer
(Carried over from June 3 Meeting)
The Clerk presented the application of Mr. and Mrs.
Speyer of 1 Dundee Road as amended, together with a
memorandum, addressed to the Board by the Building
Inspector under today's date and filed with the applica-
tion, recommending that the permit be granted subject
to the conditions listed therein.
Whereupon, on motion by Councilwoman Helwig, sec-
, onded by Councilman Kane, offered following a statement
of no objection by Mr. John F. Williams of 4 Dundee
Road, who, as a neighboring property owner, had ques-
tioned the pool's location , the following resolution was
adopted unanimously with direction that certified copies
thereof be forwarded to the Building Inspector and ap-
plicant:
WHEREAS, Mr. and Mrs. William Speyer have pre-
sented an application for a permit to construct a
swimming pool and appurtenances on premises lo-
cated at 1 Dundee Road, Town, and known as Block
211 - Parcel 386 on the Assessment Map of the
Town of Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of Ma-
maroneck has examined the plans and specifications
for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supplemen-
ted to include certain recommended conditions con-

form in all respects with the requirements of the
swimming pool ordinance (Article 23 of the Build-
ing Code), and therefore recommends that the ap-
plication be approved;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr, and Mrs.
William Speyer for a permit to construct a swim-
ming pool on their premises located at 1 Dundee
Road, Town, and known as Block 211, Parcel 386
on the Assessment Map of the Town of Mamaro-
neck, is hereby approved, and the Building In-
spector is hereby authorized to issue a permit for
same provided the pool is constructed in confor-
mance with the plans and specifications submitted
and filed with the application as amended and sup-
plemented to show compliance with the following
conditions:
1) That the filter equipment be located below
ground between the easterly end of the pool
and the proposed stone retaining wall.
2) That 4-foot high evergreens be placed along
the bottom of the proposed retaining wall,
and that a solid wood picket fence at least
5 feet high be placed along the pool side of
the proposed retaining wall.
3) That 4-foot high evergreens be placed be-
tween the southerly end of the pool and the
- southerly property line.
4) That the pool terrace which surrounds the
pool be not higher than elevation ninety-nine,
which would eliminate the elevated platform
from which the diving board is attached.
5) That any contemplated above-the-ground
lighting should be shielded and directed
away from neighboring property and streets.
6) That no temporary or portable cabanas or
awnings be placed on the property.

RESOLVED, that all work must be completed
and the owner obtain a certificate of occupancy
from the Building Inspector before the pool is
used.
3. Application for Special Permit to Construct
Swimming Pool - Mr, and Mrs. J. W. Herz
(Carried over from June 3d Meeting)
The Clerk presented the application of Mr. and Mrs.

J. W. Herz of 325 Weaver Street, Town, as amended,
together with a memorandum addressed to the Board
by the Building Inspector under today's date and filed
with the application, recommending that the permit be
granted subject to the conditions listed therein.
Whereupon, following the applicant's agreement to
shift the pool 5 feet easterly from the amended location
in response to the request of Mr. George E. Peterson,
Jr. of 4 Colonial Lane, on motion by Councilman Kane,
seconded by Councilman Quadrine, the following reso-
lution was adopted unanimously with direction that a
certified copy thereof be forwarded to the Building In-
spector and applicant:
WHEREAS, Mr. and Mrs. J. W. Herz have pre-
sented an application for a permit to construct a
swimming pool and appurtenances on premises
located at 325 Weaver Street, Town, and known
as Block 120, Parcel 158 on the Assessment
Map of the Town of Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of
Mamaroneck has examined the plans and specifi-
cations for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supple-
mented to include certain recommended condi-
tions conform in all respects with the require-
-- ments of the swimming pool ordinance (Article 23
of the Building Code), and therefore recommends
that the application be approved;
NOW,° THEREFORE, BE IT
RESOLVED, that the application of Mr, and Mrs.
J. W. Herz for a permit to construct a swimming
pool on their premises located at 325 Weaver
Street, Town, and known as Block 120, Parcel
158 on the Assessment Map of the Town of Mamar-
oneck, is hereby approved, and the Building In-
spector is hereby authorized to issue a permit for
same provided the pool is constructed in confor-
mance with the plans and specifications submitted
and filed with the application as amended and sup-
plemented to show compliance with the following
conditions:
_ 1) That the pool be located approximately 5 feet
easterly toward Weaver Street, thus locating
the proposed pool 23-1/2 feet from the prop-
', erty line between Peterson and Herz rather
than 18-1/2 feet.
2) That the proposed shrubbery be placed in the
5-foot strip outside the fence enclosing the

pool and the property line between Peterson
and Herz.
3) That no part of the pool be higher than 1 foot
above the existing ground elevation.
4) That any contemplated above-the-ground light-
ing be shielded and directed away from neigh-
boring property and streets.
5) That no temporary or portable cabanas or
awnings be placed upon the property.

RESOLVED, that all work must be completed
and the owner obtain a certificate of occupancy
from the Building Inspector before the pool is
used.
4, Petition - Stonewall-Prince Willows
(Proposed Sewer Extension)
The Supervisor informed the Board that Mr. Ekizian,
President of the Prince Willows Association, had called
this afternoon to request the Board to defer this matter
pending disposition of certain unresolved questions con-
cerning engineering and easement matters.
Mr. Morton Levin, a resident of Prince Willows, and
Mr. Dolph Rotfeld, engineer for the petitioners, upon
recognition, expressed surprise at Mr. Ekizian's re-
quest but acceded thereto, only inquiring whether it was
possible to obtain the form of easement from the Town.
The Supervisor assurred Mr. Levin that this was
possible and further stated that the Town staff stood
ready to render any assistance possible to the peti-
tioners - and that the matter would be placed on the
agenda for the next meeting.
NEW BUSINESS
1. Application for Special Permit to Construct
Swimming Pool - Mr. and Mrs. M. Karmel
The Clerk presented the application of Mr. and Mrs.
M. Karmel of Old White Plains Road, Town, for a per-
', mit to construct a swimming pool on their premises, to-
gether with a memorandum from the Building Inspector,
dated July 1, 1964, recommending that the application
be granted subject to the conditions listed therein since
no objections were received from contiguous property
owners, all of whom had been notified of the application.
Whereupon, on motion by Councilman Kane, seconded
by Councilwoman Helwig, the following resolution was

adopted unanimously with direction that a certified copy
thereof be forwarded to the Building Inspector and ap-
plicant:
WHEREAS, Mr. and Mrs. M. Karmel have pre-
sented an application for a permit to construct a
swimming pool and appurtenances on premises
located on Old White Plains Road, Town, and
known as Block 345, Parcel 1 on the Assessment
Map of the Town of Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of
Mamaroneck has examined the plans and specifi-
cations for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supple-
mented to include certain recommended condi-
tions conform in all respects with the require-
', ments of the swimming pool ordinance (Article 23
of the Building Code), and therefore recommends
that the application be approved;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. and Mrs.
M. Karmel for a permit to construct a swimming
pool on their premises located on Old White Plains
Road, Town, and known as Block 345, Parcel 1 on
the Assessment Map of the Town of Mamaroneck,
-- is hereby approved, and the Building Inspector is
hereby authorized to issue a permit for same pro-
vided the pool is constructed in conformance with
the plans and specifications submitted and filed
with the application as amended and supplemented
to show compliance with the following conditions:
1) That the pool be fenced with a 4-foot high
fence with self-locking gate independent of
the property fencing.
2) That any contemplated above-the-ground light-
ing should be shielded and directed away from
neighboring property and streets.
3) That no temporary or portable cabanas or awn-
ings be placed on the property.
and be it further
RESOLVED, that all work must be completed and
the owner obtain a certificate of occupancy from
the Building Inspector before the pool is used.

2. Application for Special Permit to Construct
Swimming Pool - Mr. Patsy Giacomo
The Clerk presented the application of Mr. Patsy
Giacomo of 93 Madison Avenue, Town, for a permit
to construct a swimming pool on his premises, to-
gether with a memorandum from the Building In-
spector, dated July 1, 1964, recommending that the
application be granted subject to the conditions listed
therein since no objections were received from con-
tiguous property owners, all of whom had been noti-
fied of the application.
Whereupon, on motion by Councilman Kane, sec-
onded by Councilwoman Helwig, the following resolu-
tion was adopted unanimously with direction that a
certified copy thereof be forwarded to the Building In-
spector and applicant:
WHEREAS, Mr. Patsy Giacomo has presented an
application for a permit to construct a swimming
pool and appurtenances on premises located at 93
Madison Avenue, Town, and known as Block 132,
Parcels 103 & 126 on the Assessment Map of the
Town of Mamaroneck;
and
WHEREAS , the Building Inspector of the Town of
Mamaroneck has examined the plans and specifica-
tions for the proposed pool;
and
- WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supple-
_ mented to include certain recommended conditions
conform in all respects with the requirements of
the swimming pool ordinance (Article 23 of the
Building Code), and therefore recommends that the
application be approved;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. Patsy
Giacomo for a permit to construct a swimming pool
on his premises located at 93 Madison Avenue, Town,
and known as Block 132, Parcels 103 & 126 on the
Assessment Map of the Town of Mamaroneck, is here-
by approved, and the Building Inspector is hereby au-
thorized to issue a permit for same provided the pool
is constructed in conformance with the plans and spec-
ifications submitted and filed with the application as
amended and supplemented to show compliance with
the following conditions:
1) That any contemplated above-the-ground lighting
be shielded and directed away from neighboring
property and streets.
2) That no temporary or portable cabanas or awn-
ings be placed on the property.

3. Application for Special Permit to Construct
Swimming Pool - Mr. Wm. J. McCoy, Jr.
(Portable Type Pool)
The Clerk presented the application of Mr. Wm. J. Mc-
Coy, Jr. of 91 Laurel Avenue, Town, for a permit to con-
struct a swimming pool on his premises, together with a
memorandum from the Building Inspector, dated July 1,
1964, recommending that the application be granted sub-
ject to the conditions listed therein since no objections
were received from contiguous property owners, all of
whom had been notified of the application.
Whereupon, on motion by Councilwoman Helwig, sec-
onded by Councilman Quadrine, the following resolutio
was adopted unanimously with direction that a certified
copy thereof be forwarded to the Building Inspector and
applicant:
WHEREAS, Mr, Wm. J. McCoy, Jr. has presented
- an application for a permit to construct a swimming
pool and appurtenances on premises located at 91
Laurel Avenue, Town, and known as Block 124, Par-
cel 475 on the Assessment Map of the Town of Ma-
maroneck;

WHEREAS, the Building Inspector of the Town of Ma-
maroneck has examined the plans and specifications
for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supplemen-
ted to include certain recommended conditions con-
form in all respects with the requirements of the
swimming pool ordinance (Article 23 of the Building
Code), and therefore recommends that the applica-
tion be approved;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr. Wm, J. Mc-
Coy, Jr. for a permit to construct a swimming pool
on his premises located at 91 Laurel Avenue, Town,
and known as Block 124, Parcel 475 on the Assess-
ment Map of the Town of Mamaroneck, is hereby ap-
proved, and the Building Inspector is hereby au-
thorized to issue a permit for same provided the pool
is constructed in conformance with the plans and
specifications submitted and filed with the application
as amended and supplemented to show compliance
with the following conditions:

1) That the pool be enclosed completely by a fence
with self-locking gate; said fence to be 4-feet
in height excepting along the rear property line
where it shall be 3-feet in height.
2) That any contemplated above-the-ground light-
ing shall be shielded and directed away from
neighboring property and streets.
3) That no temporary or portable cabanas or awn-
-- ings be placed on the property.
and be it further
RESOLVED, that all work must be completed and the
owner obtain a certificate of occupancy from the
Building Inspector before the pool is used.
4. Application for Special Permit to Construct
Swimming Pool - Mr. & Mrs. R. Mannela
(Portable Type Pool)
The Clerk presented the application of Mr. and Mrs. R.
Mannela of 27 Rockridge Road, Town, for a permit to con-
struct a swimming pool on their premises, together with a
memorandum from the Building Inspector, dated July 1,
1964, recommending that the application be granted sub-
ject to the conditions listed therein since no objections
were received from contiguous property owners, all of
whom had been notified of the application.
Whereupon, on motion by Councilman Quadrine, sec-
' onded by Councilman Kane, the following resolution was
adopted unanimously with direction that a certified copy
thereof be forwarded to the Building Inspector and ap-
plicant:
WHEREAS, Mr. & Mrs. R. Mannela have presented
an application for a permit to construct a swimming
pool and appurtenances on premises located at 27
Rockridge Road, Town, and known as Block 412,
Parcel 411 on the Assessment Map of the Town of
Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of
Mamaroneck has examined the plans and specifica-
tions for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications as amended and supple-
mented to include certain recommended conditions
conform in all respects with the requirements of
the swimming pool ordinance (Article 23 of the
Building Code), and therefore recommends that the
application be approved;

NOW, THEREFORE, BE IT
RESOLVED, that the application of Mr, and Mrs.
R. Mannela for a permit to construct a swimming
pool on their premises located at 27 Rockridge
Road, Town, and known as Block 412, Parcel 411
on the Assessment Map of the Town of Mamaro-
neck, is hereby approved, and the Building In-
spector is hereby authorized to issue a permit for
same provided the pool is constructed in confor-
mance with the plans and specifications submitted
and filed with the application as amended and sup-
plemented to show compliance with the following
conditions:
1) That any contemplated above-the-ground
lighting shall be shielded and directed away
from neighboring property and streets.
2) That no temporary or portable cabanas or
awnings be placed on the property.
3) That the pool be connected to the house
drainage system at times of pool drainage.

RESOLVED, that all work must be completed and
the owner obtain a certificate of occupance from the
Building Inspector before the pool is used.
5. Application for Special Permit to Construct
Swimming Pool - Mrs. I. Weinraub
The Clerk presented the application of Mrs. I. Wein-
raub of Premium Point, Town, for a permit to construct
a swimming pool on her premises, together with a memo-
randum from the Building Inspector, dated July 1, 1964
recommending that the application be granted subject to
the conditions listed therein since no objections were
received from the one contiguous property owner, who
was notified of the application.
Whereupon, on motion by Councilwoman Helwig, sec-
onded by Councilman Quadrine, the following resolution
was adopted unanimously with direction that a certified
copy thereof be forwarded to the Building Inspector and
applicant:
WHEREAS, Mrs. I. Weinraub has presented an ap-
plication for a permit to construct a swimming pool
and appurtenances on premises located on Premium
Point, Town, and known as Block 510, Parcel 100
on the Assessment Map of the Town of Mamaroneck;
and

WHEREAS, the Building Inspector of the Town of
Mamaroneck has examined the plans and specifi-
cations for the proposed pool;
and
WHEREAS, the Building Inspector finds that the
plans and specifications conform in all respects
with the requirements of the swimming pool or-
dinance (Article 23 of the Building Code), and
therefore recommends that the application be ap-
proved;
NOW, THEREFORE, BE IT
RESOLVED, that the application of Mrs. I. Wein-
raub for a permit to construct a swimming pool on
her premises located on Premium Point, Town,
and known as Block 510, Parcel 100 on the Assess-
ment Map of the Town of Mamaroneck; is hereby
approved, and the Building Inspector is hereby au-
thorized to issue a permit for same provided the
pool is constructed in conformance with the plans
and specifications submitted and filed with the ap-
plication and to show compliance with the follow-
ing two conditions:
1) That any contemplated above-the-ground light-
ing shall be shielded and directed away from
neighboring property and streets.
2) That no temporary or portable cabanas or
awnings be placed on the property.

RESOLVED, that all work must be completed and
the owner obtain a certificate of occupancy from
the Building Inspector before the pool is used.
COMMUNICATIONS
1. Letter from Round Hill Building Corp.
Re: Sewer Connection
Pursuant to letter addressed to the Board by Round
Hill Building Corp. under date of June 23, 1964, and
memorandum pertaining thereto addressed to the Board
by the Engineer and Building Inspector under date of
June 29, 1964, which were herewith presented and or-
dered received and filed for the record, on motion by
Councilwoman Helwig, seconded by Councilman Quad-
rive, the following resolution was adopted by unani-
mous vote of the Board with all members present and
voting except Councilman Brush who was absent, to be
forwarded to the Board of Trustees of the Village of
Mamaroneck provided Round Hill Building Corp. agreed
to comply with the conditions set forth therein:

WHEREAS, Round Hill Building Corp. is the owner
of a building plot known as #26 Revere Road in the
Town of Mamaroneck, which is Block 215 - Parcel
476 on the Assessment Map of the Town of Mamar-
oneck;
and
WHEREAS, said owner now wishes to erect a house
on this parcel which is to be serviced by a sanitary
sewer;
and
WHEREAS, the nearest main sewer in Revere Road
that could be connected thereto is located in the
Town but discharges into the Village of Mamaroneck
sewer system;
NOW, THEREFORE, BE IT
RESOLVED, that this honorable Board respectfully
requests of the Board of Trustees of the Village of
Mamaroneck that Round Hill Building Corp. be al-
lowed to hook into the main sewer of the Village of
Mamaroneck subject to the following terms and
conditions:
1. That any sewer connection from the subject lot
requires a pump on the lot and that such pump
and, sewer connection shall be privately owned
and forever privately maintained because it
will serve only one (1) dwelling unit.
2. That such pump be "dual acting"; i. e. that it
has a standby power unit. Connecting piping
shall be 4" cast iron pipe.
2. Request of Police Commission for
Expense Authorization
Pursuant to the Police Commission's request for au-
thorization of expense herewith presented and ordered
received and filed for the record, on motion by Council-
man Kane, seconded by Councilman Quadrine, it was
unanimously
RESOLVED, that this Board hereby authorizes
the expenditure of not to exceed $50. 00 from the
proper item in the 1964 Police Department bud-
get to cover the expenses of the Police Chief's
attendance of the annual meeting of the New York
State Chiefs of Police Conference in New York
City, June 20 to 23, 1964.
3. Report of Highway Supt. - Purchase of
Bituminous Materials
For the Board's information, the Clerk presented a

report, addressed to the Board by the Superintendent of
Highways, listing the bids received for furnishing liquid
bituminous materials and stating that the contract was
awarded to Westchester Asphalt Dist. Corp., which was
ordered received and filed.
4. Notice of Hearing - Board of Appeals, City of New Rochelle
(Application for Pool - 1 Pryer Manor Road)
A notice of hearing before the New Rochelle Board of
Appeals on the application for a swimming pool at 1
Pryer Manor Road, was presented and referred to the
Attorney for investigation with direction to communicate
with the Clerk if any action were warranted by the Town.
5. Communications re - Establishment of County
Conservation District
The Clerk presented copy of a resolution adopted by the
Common Council of the City of Rye on May 17, 1964, and
letter addressed to the Supervisor by Mayor Everett H.
Smith of the Village of Mamaroneck under date of June 16,
1964, each requesting, that the Board of Supervisors of
the County of Westchester create a County Soil and Water
Conservation District which, following a report of County
action in this matter by the Supervisor and a strong state-
ment of endorsement by Councilman Quadrine, were or-
dered received and filed.

Report of the Receiver of Taxes and Assessments for

Summary of Receipts & Disbursements of the Town of
Mamaroneck for the period from January 1 - April 30, 1964.
Affidavit of publication of the notice of the adoption of a
resolution, subject to permissive referendum, providing
for the extension of Sewer District No. 1 in the Town of
Mamaroneck to include Section "Q".
Affidavit of publication of notice of examination by the Ex-
amining Board of Plumbers.

The Supervisor --
1. New Haven Railroad
The Supervisor briefly reviewed the New Haven situation.
with respect to County action on Dr. Ronan's proposal,
stating that a major question had been raised on the Board
of Supervisors as to the County being called on for a
$400, 000. contribution while New York City was not called
on for any. He also called attention to the fact that the
$450, 000. contribution called for from Connecticut was on
a state-wide basis, while the problem here was was local
since only part of New York State was serviced by the New
Haven. Further, he stated, there was considerable ques-
tion on the County Board as to whether, were the County
to contribute the $400, 000. , this should be a general
County charge or a charge levied only against those mu-
nicipalities serviced by the New Haven.
Councilwoman Helwig raised a question at this time as
to whether it might be possible for the Town to follow
Pelham's procedure with respect to station maintenance,
which would be doubtful in this instance, it was brought
out, since the Village of Larchmont as well as the Town
was involved.

1. Award of Contract for Fencing for
Various Park Properties
-- Councilwoman Helwig presented for the Board's informa-

awarded to the Hudson Steel Company, the low bidder, in
the amount of $1, 395. 00, which was herewith ordered

Whereupon, on her motion, seconded by Councilman
Quadrine, it was unanimously
RESOLVED, that this Board hereby approves the
resolution adopted by the Board of Park Commis-
sioners on June 4, 1964, awarding contract for
fencing for various park properties to the low
bidder, Hudson Steel Company, in the amount of

Z. Report on Bids for Steps, Memorial Park
Councilwoman Helwig reported that the only bid received
for the steps had been rejected because it was too high and
that the Park Commission had directed that the specifica-
tions be modified and bids readvertised for to be return-
', able at its July 30th meeting.

3. Award of Paving Bid
Councilwoman Helwig, in accordance with the recom-
mendation just given her by the Attorney and Engineer,
offered the following resolution for the award of the bid
for the paving work at Memorial Park, which was sec-
onded by Councilman Kane and adopted by unanimous
vote of the Board:
RESOLVED, that this Board hereby accepts the bid
of Lawrence Labriola, the low bidder, in the amount
of $3, 126. 11, for paving work beneath and adjacent
to the Murray Avenue Bridge, Town of Mamaroneck,
in accordance with the specifications published in
the notice for bids and filed in the Office of the Town
Clerk, provided that the said Lawrence Labriola
furnishes to the Town Attorney the required insur-
ance certificates;
and be it further
RESOLVED, that the Town Clerk be and he hereby is
authorized to return the bid checks to all bidders ex-
cept the successful bidder.
4. Engagement of Planning Consultant
Nature Center Project
Pursuant to the recommendation of the National Audu-
bon Society report and in accord with the Town's agree-
ment with the County to commence the development of
those lands given the Town for park and recreation use,
Councilwoman Helwig presented the name of Mr. Clif-
ford B. Emanuelson to be engaged as part-time Plan-
ning Consultant for the Nature Center project.
For the Board's information, she presented a resume
of Mr. Emanuelson's qualifications and experience, to-
gether with an outline showing the scope of work that
would be accomplished, explaining that Mr. Harry Simon
and Mr. Sheldon Levine, teachers, would be engaged by
the Board of Education to work with Mr. Emanuelson.
She further explained that funds in addition to the fee
to be paid to Mr. Emanuelson in the amount of $150. 00
would be needed for miscellaneous expenses in connec-
tion with this work, thereupon offering the following reso-
lution, which was seconded by Councilman Quadrine and
adopted by unanimous vote:
RESOLVED, that this Board hereby authorizes that
Clifford B. Emanuelson be employed as part-time
Planning Consultant for the Nature Center project,
to be employed during the months of July and Aug-
ust and to be compensated in an amount not to
exceed the sum of $1, 000. 00 as provided in the
1964 budget;

RESOLVED, that this Board hereby authorizes the
expenditure of not to exceed the sum of $150. 00
for miscellaneous expenses in connection with the
foregoing project as also provided in the 1964
budget.

Pursuant to communication addressed to the Superinten-
dent of Highways by C. J. Wells, New York State Depart-
, ment of Public Works Engineer for Town and County
Roads, herewith presented by Councilman Kane and or-
dered received and filed, on his motion, seconded by
Councilwoman Helwig, the following resolution was
adopted by unanimous vote of the Board and the Clerk was
directed to forward three (3) copies thereof to the State
in accordance with the request contained in Mr. Wells'
letter:
WHEREAS, the New York State Department of Public
Works, assisted by the Town Superintendent of High-
', ways, has made an inventory of the Town Highway
System in the Town of Mamaroneck, County of
Westchester; and has provided the Town with a map
and a listing of said highways stating the name and
length of each, being a total length of 33. 89 miles
on Dec. 31, 1963, and
WHEREAS, the Town Superintendent of Highways
did recommend approval of said map and said listing,

RESOLVED, that the Town of Mamaroneck, at a
meeting held on July 1, 1964, accepts and approves

2. Memo from Engineer - Smoke Complaint
Councilman Kane presented a memo from the Engineer
submitting a letter received from the Los Angeles County
Air Pollution Control Authority in reply to his inquiry to
said company forwarded in accordance with Mrs. Hem-
merich's suggestion in her letter of complaint about the
Alden House Apartments addressed to the Board and re-
ferred to the Engineer, which was herewith ordered re-
ceived and filed.

3. Authorization of Cargill Road Water Main
Pursuant to memorandum of the Engineer, dated July 1
1964, requesting that the Clerk be authorized to adver-
tise for bids for the installation of a 12-inch water main
in Cargill Road, on motion by Councilman Kane, sec-
onded by Councilwoman Helwig, it was unanimously
RESOLVED, that the Town Clerk be and he hereby is
authorized to publish in the official newspaper of the
Town of Mamaroneck, The Daily Times, a notice for
sealed bids, to be returned, opened and read aloud
at a regular meeting of this Board on September 2,
1964, for the construction of a 12-inch water main
in Cargill Road in accordance with the plans and
specifications prepared by the Town Engineer and
filed in the Office of the Town Clerk.

2. Reappointment to Planning Board
Mr. Joseph Rigano
On recommendation by Councilman Quadrine and all mem-
bers of the Board who expressed high commendation of Mr.
Rigano's service on the Planning Board and great pleasure
at his willingness to continue to serve, on his motion, the
following resolution was unanimously seconded and adopted:
RESOLVED, that this Board reappoints Joseph J.
Rigano a member of the Planning Board of the
Town of Mamaroneck, to serve for a five-year
term of office, effective July 7, 1964 and term-
inating July 6, 1969•
The Clerk was directed to so notify Mr. Rigano convey-
ing the Board's compliments to him and its pleasure that
he was willing to continue this service to the community.

1. Report of Meeting of Commission on Human Rights
Councilman Quadrine reported that the Supervisor and
he had met with the newly-established Commission on
Human Rights for the Town of Mamaroneck, stating that
the Chairman, Kalman Druck, had asserted that the three
Commissions, that of the Village of Larchmont, the Vil-
lage of Mamaroneck, and the Town would cooperate and
coordinate their efforts insofar as possible in serving
the entire community.
The Town Attorney --
1. Town of Mamaroneck against Westchester
Joint Water Works No. 1
The Attorney recommended that an appeal be taken
from the Order rendered by Mr. Justice Donohue on
May 19, 1964 in the proceeding Town of Mamaroneck
against Westchester Joint Water Works No. 1, and
accordingly after some discussion of the pros and cons
of the matter, on motion by Councilman Kane, seconded
by Councilwoman Helwig, upon roll call, the following
resolution was adopted by majority vote -- Councilman
Brush being absent and therefor not voting and Council-
man Quadrine abstaining due to his affiliation with the
Village of Mamaroneck, a respondent in the said pro-
ceeding:
RESOLVED, that John L. Delius, Attorney at Law,
retained to represent this Board as petitioners in
the proceeding, Town of Mamaroneck against
Westchester Joint Water Works No. 1, be and he
hereby is authorized to appeal to the Appelate Divi-
sion of the Second Department, the Order rendered

May 19, 1964 by Mr. Justice Donohue in the proceed-
' ing entitled, "In the Matter of the Application of the
Town of Mamaroneck, George D. Burchell et al Con-
stituting the Town Board of the Town of Mamaroneck,
and as such Commissioners of Water Supply District
#1 of the Town of Mamaroneck, Petitioners against
Westchester Joint Water Works No. 1 et al, Re-
spondents".
Z. Urban Planning Assistance Program
(Master Plan)
In accordance with a letter addressed to the Supervisor
by Mr. Keith S. McHugh, Commissioner of the New York
State Department of Commerce, the Attorney recom-
mended the adoption of a resolution appropriating monies
for the proposed project and authorizing the Supervisor to
execute the Project Grant Agreement on behalf of the Town
as requested in the above referred to communication.
The Supervisor then briefly recapitulated the history of
the proposed project, reciting for the record the following
telegram received from Harold P. Kaulfuss, Principal Ur-
ban Planner, on July 1, 1964:
"In response to your request, the Department of Com-
merce Urban Planning Program is intended to pro-
vide guidance for the future development of the Town
of Mamaroneck. The Town is free to adopt, modify
or reject any of the recommendations to be pre-
pared. The Urban Planning Program does not com-
mit the Town of Mamaroneck to Urban Renewal. "
He also presented for the record at this time, a letter
addressed to the Board, registered mail, by Mrs. Stephen
Haviland and Mrs. Frederick Sunderman requesting an
open discussion of this plan at this meeting, in reply to
which he invited Mrs. Haviland, Mrs. Sunderman, or any
one else present and concerned with this matter to address
the Board.
Whereupon, at the conclusion of a rather lengthy dis-
cussion during which the necessity and advisability of this
project for the Town was strongly questioned from the
floor notwithstanding Mr. Kauffuss' assurance that an Ur-
ban Planning Assistance Program was not a commitment
for Urban Renewal, on a motion offered by Councilman
Kane and seconded by Councilwoman Helwig, upon roll
call, the following resolution was adopted by unanimous
vote of the Board, Councilman Brush being absent and not
voting:
— WHEREAS, the Town of Mamaroneck has heretofore
applied to the New York State Department of Com-
merce jointly with the Village of Larchmont for Fed-
eral and State aid in an urban planning assistance
project under the provisions of the Federal Housing
Act of 1954, as amended, and Subdivision 27 of Sec-

tion 100 of the Commerce Law of the State of New
York, and such application is being processed for
approval and acceptance by the Urban Renewal Ad-
ministration and the Commissioner of Commerce
of the State of New York, and
WHEREAS, in order to secure the benefits of said
urban planning assistance program it is necessary
for the Town of Mamaroneck to contribute a sum
not to exceed seventeen per centum ( 17%) of the
total cost of said project attributable to the Town
of Mamaroneck and to enter into a Project Agreement
Grant with the New York State Department of Commerce,
now be it
RESOLVED, that the Town of Mamaroneck hereby appro-
priates the sum of three thousand, five hundred
eleven and no/100 Dollars ($3,511.00) or so much
thereof as may be necessary to contribute a sum
_ not to exceed seventeen per centum (17%) of the
total cost of said project attributable to the
Town of Mamaroneck, to be paid to the State of New
York, on condition that the above mentioned applica-
tion is approved by both the Urban Renewal Adminis-
tration and the Commissioner of Commerce of the
State of New York, and be it further
RESOLVED, that the Supervisor be and he hereby is
authorized and directed to execute on behalf of
the Town of Mamaroneck the Project Grant Agreement
to carry the foregoing into effect.
The Supervisor then called to the Board' s attention
the fact that Councilman Cook' s resignation from the
Board last December 31st had created a vacancy on the
Ad Hoc Committee appointed in connection with this pro-
ject, recommending that Councilman Quadrine be appointed
to succeed former Councilman Cook in this post, and there-
upon on motion by Councilman Kane, seconded by Council-
woman Helwig, it was unanimously
RESOLVED, that Councilman Anthony G. Quadrine be
and he hereby is appointed a member of the Ad Hoc
Committee duly appointed by this Board on January
16, 1963 to fill the vacancy created by the resig-
nation of former Councilman Joseph W. Cook, December
31, 1963.

A petition in this matter for the extension of
Sewer District No. 1 of the Town of Mamaroneck, having
been duly presented to the Town Board, together with the
necessary map and plan attached thereto, and an order
having been duly adopted by the Town Board on February
19, 1964, for the hearing of all persons interested in
the matter on the 18th day of March, 1964, and at such
adjourned times as ordered by said Board, at 8:15 o'clock
in the P. M. , at the Council room at the Weaver Street
Fire House, corner of Weaver Street and Edgewood Avenue
in said Town, and a hearing by the said Board having been
duly held at such place, at an adjourned day of May 6,
1964, and it having been duly resolved and determined
following such hearing that the petition herein was sign-
ed and acknowledged or proved as required by law and other-
wise sufficient, that all the property and property owners
within the proposed district were benefited thereby, that
all property and property owners benefited were included
within the limits of the proposed district, and that it
was in public interest to grant in whole the relief sought
and it having been then and there further duly resolved
that the extension of such sewer district as proposed be
approved, and application having been thereafter and on
May 14, 1964 duly made in duplicate to the State Depart-
ment of Audit and Control at Albany, New York, for per-
mission to extend such district as more fully provided
for by Town Law 194, and the State Comptroller having ,
duly made an order in duplicate dated June 25 , 1964,
granting permission for the extension of the district in
all respects as petitioned for and approved by the Town
Board as aforesaid; and one copy of such order having
been duly filed in the office of the State Department of
Audit and Control at Albany, New York, and the other in
the office of the Town Clerk of this Town, and the Town
Clerk having duly presented such order to this Board at
this meeting, being its first meeting held after the
said order was filed with him; it is hereby
ORDERED, that an extension of Sewer District
No. 1 be established in the said Town of Mamaroneck,
Westchester County, New York, as described in the order

The meeting of the Board of Fire Commissioners
was convened immediately upon the adjournment of the
Town Board meeting.

In the absence of Commissioner Brush, Commissioner
Kane presented for approval and authorization of pay-
ment the following claims, which had been audited by
the Comptroller and approved by the Fire Chief, and
thereupon on his motion, which was seconded by Com-
missioner 4uadrine, it was unanimously
RESOLVED, that the following Fire Depart-
ment claims be and they hereby are approv-
ed, and the Supervisor and Comptroller be
and they hereby are authorized to pay the
same out of the 1964 Fire Department budget:
