MINUTES OF A REGULAR MEETING OF THE TOWN BOARD_
OF THE TOWN OF MAMARONECK, HELD ON MARCH 5th,
1964, IN THE COUNCIL ROOM OF THE WEAVER STREET
FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
On motion duly made and seconded, the minutes of the reg-
ular meetings of January 2 and 22, 1964 were approved as
submitted.
OLD BUSINESS
1. Report on Bids for Town Garage
(Not on Agenda)
The Engineer reported that the bids submitted on Febru-
ary 27th had been tabulated and checked for arithmetical
error and showed the following corrections:

He also requested that since the the three lowest bidders
had been determined although the bids were still under
study, the Town Clerk be authorized to return the bid checks
to all bidders except the three lowest upon request, and
thereupon, on motion by Councilman Kane, seconded by

Councilman Brush, it was unanimously
RESOLVED, that at the request of the bidder, the
Town Clerk be and he hereby is authorized to re-
turn the bid security checks to all bidders sub-
mitting bids on the Town Garage except the three
lowest bidders on each contract.

Z. Progress Report - Bonnie Way Petition
The Engineer reported that he was presently studying the
water shed in an effort to compile a list of properties which
might contribute roof water to the sanitary sewers, addi-
tional to those represented in the subject petition, as the
Board had requested in connection with conducting "dye
tests" in the area concerned.
NEW BUSINESS
1. Authorization to Collect 1964 State,
County and Town Taxes
At the Tax Receiver's request for authorization to col-
lect the 1964 State, County and Town taxes and to publish
and post the necessary notice therefor, on motion by
Councilman Brush, seconded by Councilwoman Helwig, it
was unanimously
RESOLVED, that this Board hereby authorizes the
- Receiver of Taxes of the Town of Mamaroneck to
collect the 1964 State, County, Town and District
taxes and water rents which become a lien on Jan-
uary 1st, 1964;
and be it further
RESOLVED, that in accordance with the provisions
of Section 550 of the Westchester County Adminis-
trative Code, "The Daily Times", the official news-
paper published in the Village and Town of Mamaro-
neck, be and it hereby is designated as the news-
paper in which the Receiver of Taxes and Assess-
ments shall publish the "Notice of the Collection of
State, County, Town and District Taxes and Water
Rents";
and be it further
RESOLVED, that said publication shall be on March
20th, 1964 in The Daily Times and shall be posted
thereafter in accordance with law;
and be it further
RESOLVED, that in accordance with the provisions
of Section 550 of the Westchester County Adminis-
trative Code, the Town Board does hereby direct
the Receiver of Taxes and Assessments to mail to
each taxpayer of the Town of Mamaroneck, whose
address is known to said Receiver of Taxes and As-

sessments, a tax bill for all taxes and water rents,
the expense thereof to be a Town charge.
2. Setting Date for Tax Lien Sale
Pursuant to memorandum addressed to the Supervisor by
the Receiver of Taxes herewith presented and filed, on mo-
tion by Councilman Kane, seconded by Councilman Brush,
it was unanimously
RESOLVED, that pursuant to Chapter 153 of the
Laws of 1957, this Board hereby designates the
date of May 21, 1964 as the date for the 1964 Tax
Lien Sale in the Town of Mamaroneck.
3. Approval of Highway Agreement
for 1964
(Not on Agenda)
Upon request for approval of the Highway Agreement as
presented, on motion by Councilman Kane, seconded by
Councilman Brush, it was unanimously
RESOLVED, that this Board hereby approves the
Highway Agreement as presented for the year
1964 pursuant to Section 284 of the Highway Law.
4. Application for Appeal from Denial
of Sign Application -- First Westchester
National Bank
The Supervisor presented an application of the First
Westchester National Bank for permit to erect a wall sign
on the northerly side of building, between the second floor
level and roof, on premises located on the Boston Post
Road and known as Block 410, Parcel 463 on the Tax As-
sessment Maps of the Town of Mamaroneck, together with
the Building Inspector's denial thereof due to non-con-
formity with Article 19 of the Building Code, and the ap-
plicant's appeal for reversal of denial.
Whereupon after considerable discussion and hearing
Mr. Charles B. Fischer, Executive Vice President, who
appeared for the applicant, upon the Attorney's advice
that a public hearing was required, the date of April 1st
was fixed for said hearing and on motion by Councilman
Kane, seconded by Councilman Brush, it was unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to publish the following notice in the
official newspaper of the Town of Mamaroneck,
The Daily Times, in accordance with law:
Public Notice
P l e a s e take n o t i c e , that a public hearing will

be held by the Town Board of the Town of Mamaro-
neck at a regular meeting to be held on April 1st,
1964, at 8:15 p. m. in the Council Room of the Wea-
ver Street Firehouse at Weaver Street and Edge-
wood Avenue in the Town of Mamaroneck, to hear
the appeal of the First Westchester National Bank
from the decision of the Building Inspector refusing
a permit for a business sign on the premises lo-
cated on the Boston Post Road in the Town of Ma-
maroneck and known as Block 410, Parcel 463.
This appeal is for a variance of the application of
the Ordinance of the Town of Mamaroneck duly
adopted on April 17, 1963 as Article 19 of the
Building Code and entitled, "Erection and Main-
tenance of Outdoor Advertising Signs" as pro-
vided in Section 12 of said Ordinance.
5. Request for Authorization to Advertise
for Tires and Tubes Bids
(Not on Agenda)
Pursuant to request of the Town Clerk, on motion by
Councilman Brush, seconded by Councilman Quadrine, it
was unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to publish in the official newspaper
of the Town of Mamaroneck, The Daily Times, a
notice for bids for the purchase of tires and tubes
for the Town of Mamaroneck for the year 1964 in
accordance with the specifications to be filed in
the Office of the Town Clerk;
and be it further
RESOLVED, that sealed bids will be received by
the Town Clerk at 158 West Boston Post Road un-
til 5 p. m. on March 18, 1964, which bids will be
publicly opened and read aloud at the Town Board
meeting at 8:15 p. m. that evening in the Council
Room of the Weaver Street Firehouse, Weaver
Street, Town of Mamaroneck.
COMMUNICATIONS
1. Highway Report - Purchase of Road Materials
For the Board's information, the Clerk presented a
communication addressed to the Board by the Highway
Superintendent under date of March 3, 1964 reporting the
contracts awarded on the bids for Highway road materials
for the year 1964-65, which was herewith ordered re-
ceived and filed for the record.

The Clerk presented the following reports which were or-
dered received and filed:

The Supervisor --
1. Memorandum in Support of
Westchester County P. B. A. Bill
The Supervisor presented a memorandum submitted by
James D. Knox, Secretary of the Policemen's Benevolent
Association of Westchester County, Inc. , in support of a
bill seeking to amend the Town Law so as to provide im-
munity to police officers as described therein and re-
questing the Town Board to adopt a resolution authorizing
the Supervisor to sign the forms submitted with said
memorandum approving passage of the bill if this were
the pleasure of the Board.
Whereupon, on motion by Councilman Brush, seconded
by Councilwoman Helwig, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to sign the forms submitted with the
Policemen's Benevolent Association of Westchester
County memorandum on behalf of this Board and
signifying this Board's approval of the bill known
as A. 1. 2271, P. 2282 introduced in the Assembly
by Assemblyman Gioffre, and S. I. 1061, P. 1061
introduced in the Senate by Senator Condon, and
sponsored by the Policemen's Benevolent Asso-
ciation of Westchester County, seeking to amend
the Town Law by adding thereto a new section to
be known as Section 159 to grant town policemen in
Westchester County, who while traveling their
posts necessarily pass through an adjoining Town
or Village to reach another part of their post, the
same privileges, benefits and immunity applied in
their own Town;
and be it further
RESOLVED, that the Town Clerk be and he hereby
is authorized to attest the Supervisor's signature
and to return said forms as requested to James D.
Knox, Secretary of the Policemen's Benevolent
Association of Westchester County, Inc.
2. Report on Trip to Albany
The Supervisor, as Chairman of the Legislation Committee
of the Board of Supervisors, reported briefly on the Com-

mittee's visit to the Legislature on Tuesday and Wednes-
day, stating that it was busy indeed in Albany with most
of the work concentrated mainly on the budget bills.
He further stated that there was no report on the bill
seeking to remove dog control charges from General
Town to Part Town - Outside of Villages.
Councilwoman Helwig --
1. Thruway Noise Abatement Committee
Joint Legislative Committee Hearing
March 4, 1964 - Albany, New York
Councilwoman Helwig submitted for the Board's informa-
tion and purposes of the record, a written statement en-
titled, "Noise Limits for Motor Vehicles", which she, as
Chairman of the Thruway Noise Abatement Committee, had
personally presented to the Joint Legislative Committee on
Motor Vehicles and Traffic Safety in Albany yesterday,
March 4, 1964, which the Board ordered be received and
filed as a part of the record of this meeting.
She also presented a letter from Alfred J. Worsdell, Jr. ,
Executive Director of the New York State Motor Truck As-
sociations, Inc. addressed to her as Chairman of the Com-
mittee under date of February 24, 1964, expressing the
Associations' appreciation of the reasonableness and ob-
jective attitude of the Committee and assurring the Com-
mittee of the Associations ' sincere dedication to solving
the problem of excessive noise from commercial motor
vehicles.
Councilman Kane --
1. "Dye Tests" - Bonnie Way Petition
Councilman Kane reported that replies had been re-
ceived from almost all residents to whom letters had been
sent - signatories of the subject petition. He further re-
ported that in agreement with a suggestion in one of the
replies, the scope of those contacted by letter would be
broadened based on an engineering concept to include all
those affected.
Councilman Brush --
1. Annual Report - Police Department
Councilman Brush requested that the minutes of this
meeting note the fact that each of the members of the
Board received a copy of the Annual Report of the Mamar-
oneck Town Police for 1963 and noted the comments in
the introduction thereto. The report, which was des-
cribed as excellent and very complete, was ordered re-
ceived and filed for the record.

Councilman Quadrine --
1. Apportionments
Councilman Quadrine presented for approval the follow-
ing petitions from the Assessor requesting correction of
the assessment roll so as to permit the apportionment of
taxes, and thereupon on his motion, seconded by Council-
man Kane, the following resolution was adopted by unani-
mous vote:
WHEREAS, the Assessor has presented the follow-
ing petitions for the correction of the assessment
roll for certain years pursuant to the provisions of
Section 557, Article 16 of the Westchester County
Administrative Code, known as the Westchester
County Tax Law; and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petitions for the
correction of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1963, taxes

The Town Attorney --
1. Payment of Insurance Claims
In accordance with the Attorney's recommendation for
settlement of the following insurance claims pursuant to
communications from Hartford Accident And Indemnity
Company under dates of January 8 and 20, 1964, re
Ruth & Herman Niederhaus vs. Town of Mamaroneck and
Rosie O. Echauarria vs. Town of Mamaroneck respec-
tively, and claim of Clotilde Palmer Baker, on motion by
Councilman Brush, seconded by Councilman Kane, it was
unanimously
RESOLVED, that this Board hereby authorizes pay-
ment of two (2) claims in the amounts of $50. 00 each
to Hartford Accident & Indemnity Company in con-
nection with its settlement of claims of Ruth & Her-
man Niederhaus in the amount of $342. 00 and Rosie
O. Echauarria in the amount of $85. 00 against the
Town of Mamaroneck under the Town policy con-
taining a $50. 00 deductible property damage clause;
and payment of claim in the amount of $45. 10 of
Clotilde Palmer Baker against the Town of Mamar-
oneck for damages to car caused by Town Payloader.
The Town Engineer --
The Engineer stated that he had no report at this time.
OTHER BUSINESS
1. Mr. H. L. Schwartz --
Mr. Schwartz asked the Supervisor whether he had any
information on the New Haven in view of the reports of the
threatened closing down of commuter service.
The Supervisor advised that he had no additional infor-
mation but that he had requested Senator Meighan to keep
us advised of developments.
ADJOURNMENT
There being no further business to come before the meet-
ing, on motion duly made and seconded, it was declared ad-
journed at 8:55 p. m. , to reconvene on March 18, 1964.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was con-
vened immediately upon the adjournment of the Town Board
meeting.
1. Claims

Commissioner Brush presented for payment the Fire
Department claims, which had been audited by the Comp-
troller and approved by the Fire Chief, and thereupon on
motion by him and seconded by Commissioner Helwig, it
was unanimously
RESOLVED, that the following Fire Department
claims as audited by the Comptroller and ap-
proved by the Fire Chief, are approved, and the
Supervisor and Comptroller are authorized to
pay the same out of the budget for the Fire De-
partment:

2. Reports
Commissioner Brush presented the Fire Report for
the month of February, 1964 which was ordered re-
ceived and filed.
The Town Clerk noted for the record that the Annual
Report of the Fire District Treasurer of Fire District
No. 1 in the Town of Mamaroneck, County of Westches-
ter, for the Year Ending December 31, 1963, had been
filed with his office on March 2, 1964.
3. Communications
1. Letter from Fire Council
Pursuant to letter addressed to the Commission by
the Secretary to the Fire Council under date of
March 5, 1964, on motion by Commissioner Brush,
seconded by Commissioner Helwig, it was unanimously
RESOLVED, that this Commission hereby ap-
proves the appointment of Chief Philip V. Li-
brandi as Fire Inspector of the Town of Ma-
maroneck for the year 1964, to be compen-
sated at the rate of $960. 00 per annun in ac-
cordance with the Compensation Plan of the
Town of Mamaroneck for the year 1964.
2. Letter to Mr. Steven J. Loiaconi
Re - Insurance, Volunteer Firemen
Mr. Loiaconi presented a letter addressed to him by
Continental National Insurance Group with regard to
his claim under policy for members of the Mamaro-
neck Fire District No. 1, which was ordered re-

ceived and filed and referred to the Town Attorney.
4. Other Business
1. The Fire Chief
The Fire Chief advised the Commission that the
board to hook up with the schools, Murray Avenue,
Sts. John and Paul, and the new Cargill Park
-- school, had been installed by the Gamewell Co.
5. Adjournment
There being no further business to come before the meet-
ing, on motion duly made and seconded, it was declared
adjourned at 9:05 p. m. , to reconvene on March 18, 1964.
