HomeMy WebLinkAbout1964_01_22 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD JANUARY 22, 1964 IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE- HOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. ROLL CALL Present: Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Quadrine Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Secretary Mr. Altieri - Comptroller Mr. Kellogg - Town Engineer Presentation of Report - Cross County Lands Study Committee (and National Audubon Society Survey and Nature Center Plan) At the Supervisor's invitation, Mr. Lee Bloom, Chairman of the Cross County Lands Study Committee, presented the Committee report together with the National Audubon Society Nature Centers Division Survey and Nature Center Plan, which were ordered received for study with the thanks of this Board and the citizens of this community. Mr. Bloom stated that he would like to express his per- sonal thanks and that of the entire Committee to Council- woman Helwig for her work with the Committee. Councilwoman Helwig acknowledged Mr. Bloom's remarks and stated that it had been a pleasure to work with the Com- mittee, and upon her recommendation that the said Committee continue "as is" pending study of the Nature Center Plan, it was so directed by the Board. Mrs. Jerome Kaufman, President of the League of Women Voters of Larchmont, voiced her thanks and appreciation for the report on behalf of the League. OLD BUSINESS 1. Report - Possible Griffen Avenue Sewer -1- Following presentation of memoranda stating cost es- timates for the proposed sewer extension addressed to the Board by the Engineer under dates of January 15th and 22nd, 1964 herewith received and filed for the rec- ord, and following discussion during which Mr. William Shroder, petitioner for the requested extension in ac- cordance with recommendation of the Planning Board, was heard, the matter was deferred pending submis- sion to this Board of a formal petition for the exten- sion of Sewer District No. 1 to be prepared by the pe- titioner in accordance with law. 2. Report - Bonnie Way Petition In connection with the subject petition presented at the January 2nd meeting, Mr. Charles Martin of 30 Bonnie Way, addressed the Board at length, calling to attention the fact that there were three problems involved in this matter - sewage, drainage, and water table. Following a lengthy discussion of this matter by the members of the Board, Mr. Martin, Mr. Kellogg, and Messrs. Anthony and Lee Gagliardi, who were present, the Board thanked Mr. Martin for his presentation and directed that the Town Engineer work with the Larch- mont Village Engineer, Mr. O'Reilly, and that the mat- ter be kept on the agenda pending further report. NEW BUSINESS There was no new business to come before the meeting. COMMUNICATIONS 1. County Department of Public Works (Permits for Work within County Road Area) Pursuant to communication from the County Public Works Department, dated January 6, 1964, herewith presented by the Clerk and filed for the record, on motion by Councilman Kane, seconded by Councilman Brush, the following resolu- tion was adopted by unanimous vote: WHEREAS, pursuant to the provisions of Chapter 605 of the Laws of 1941, revised as of June 5, 1961, the Commissioner of Public Works of Westchester County with the approval of the Board of Supervisors and the County Executive of Westchester, has prescribed rules, regulations, safeguards, specifications and conditions for the protection, reconstruction, main- tenance, or restoration of any County Road or por- tion thereof, and for the protection and safety of the traveling public thereon during any operations of re- construction, maintenance or restoration of such County Road or portion thereof, and _2_ �I WHEREAS, the said rules and regulations require any person, firm, corporation, improvement dis- trict, or municipality doing any work upon any County Road to obtain a written permit from the Commissioner of Public Works and to deposit a certified check made payable to the order of the County of Westchester in an amount computed by the extent of the proposed work, and WHEREAS, the said rules and regulations provide that any city, village, town, public improvement district, or other municipality may, in lieu of making the said mentioned deposit, file with the Commissioner of Public Works a certified copyof a resolution duly adopted by the Governing Board of such municipality guaranteeing faithful perfor- mance by the said municipality of all the terms, covenants and conditions as set forth in the per- mit, which resolution shall be effective for per- mits issued during the remainder of the calendar year after adoption, and WHEREAS, the Town of Mamaroneck, from time to time, is required to do work within the County Road area for which a written permit from the Commissioner of Public Works of Westchester County is required, and for which a certified check deposit is required, NOW, THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck does hereby guarantee faithful performance of all the terms, agreements, covenants and conditions of each and every written permit as referred to herein issued by the Commissioner of Public Works of Westchester County and that this guar- antee of faithful performance shall be applicable to all such written permits issued during the present calendar year, January 1, 1964 to De- cember 31, 1964. 2. Acknowledgements of Resolution (Anti-noise Legislation) The Clerk presented letters from Senator Meighan and Assemblymen Gioffre and Feinberg acknowledging receipt of copies of resolution adopted January 2 urging the adop- tion of legislation to eliminate excessive and unnecessary traffic noises, which were ordered received and filed. 3. Communication from Than & Leshin (Transfer of Orients, Bus Lines, Inc. to Mamaroneck Bus Lines, Inc. ) The Clerk presented notification from Than & Leshin, Attorneys, of the cancellation of the requested transfer -3- of the Orients, Bus Lines, Inc. to Mamaroneck Bus Lines, Inc. , which was herewith ordered received and filed for the record. Not on Agenda 1. Authorization for Expense - Police Commission Pursuant to request of the Police Commission, dated January 20, 1964 herewith presented and filed, on mo- tion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes pay- ment of an amount not to exceed the sum of $15. 90 from the proper item in the 1964 Police Department budget for expenses of Chief Yerick and Sergeants Mancusi and Lovely at a meeting on the law of Search and Seizures to be conducted by the District Attorney's Office at Westchester Community Col- lege, Valhalla, New York, on January 27 and 28, 1964. Z. Memoranda from Comptroller a) Authorization for Salaries - (Marion Kolb and Dorothy DeFalco) Pursuant to memorandum addressed to the Board by the Comptroller under date of January 8, 1964, on mo- tion by Councilman Quadrine, seconded by Councilman Brush, it was unanimously RESOLVED, that this Board hereby authorizes that Marion M. Kolb, employed as Senior Ty- pist of the Town of Mamaroneck, be compen- sated at the rate of $4, 160. 00 per annum com- mencing January 6, 1964, and that Dorothy DeFalco, School Crossing Guard, at the rate of $8. 00 per day commencing on the same date, January 6, 1964. b) Authorization of Transfer of Funds Pursuant to memorandum of January 17, 1964 ad- dressed to the Board by the Comptroller and herewith presented and filed, on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED, that this Board hereby authorizes the following transfer of funds within the 1963 budget:for the Highway Department: From Item III $2500. To Item IV 2500. -4- c) Resolution Authorizing Issuance of $150, 000. Tax Anticipation Notes In accordance with the Comptroller's request that the Supervisor be authorized to borrow the sum of $150, 000 in Tax Anticipation Notes, to be payable April 15, 1964 and to be sold on February 14, 1964, on motion by Countilman Brush, seconded by Councilwoman Helwig, the following resolution was offered, and upon roll call, adopted by unanimous vote of the Board, all members being present and voting: TAX ANTICIPATION NOTE RESOLUTION DATED JANUARY 22, 1964. A resolution delegating the power to authorize the issuance of and to sell not exceeding $150, 000. Tax Anticipation Notes of the Town of Mamaro- neck, Westchester County, New York, in antici- pation of the collection of Town real estate taxes levied for the fiscal year commencing January 1, 1964. BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell not exceeding $150, 000. Tax Antici- pation Notes of the Town of Mamaroneck, West- chester County, New York, in anticipation of the collection of real estate taxes levied for Town purposes for the fiscal year of said Town, com- mencing January 1, 1964, is hereby delegated to the Supervisor of said Town, the chief fiscal of- ficer thereof. Such notes shall be of such terms, form, and contents, and shall be sold in such manner as may be prescribed by said Supervisor consistent with the provisions of the Local Fi- nance Law. Section 2. This resolution shall take effect immediately. REPORTS The Town Clerk -- The Clerk presented the following reports which were re- ceived and filed: Town Clerk's Report for the month of December, 1963. Report of the Building Inspector for the month of Novem- ber, 1963. -5- Report of the Building Inspector for the month of Decem- ber, 1963. Report of the Receiver of Taxes and Assessments for the month of December, 1963. Report of the Westchester Shore Humane Society, Inc. for the month of December, 1963. The Book of Remembrance from the 300th Anniversary Celebration of the Purchase of Mamaroneck. The Supervisor -- The Supervisor stated that he had no report at this time. Councilwoman Helwig -- 1. Thruway Noise Abatement Councilwoman Helwig reported on a consultation with Senators Speno and Meighan and Assemblyman Gioffre regarding the date for this year's bill (after February 13), stating that Senator Speno had been most helpful and had stated that he would see that the bill was in- troduced and reached the floor. She also presented for the record a report entitled, "UAC Report Number R6322 - Subjective Units for the Measurement of Truck Noise", together with a reprint from "Fleet Owner" Magazine, which were or- dered received and filed. Councilman Kane -- Councilman Kane stated that he had no report to present at this time. Councilman Brush -- Councilman Brush stated that he had no report to present at this meeting. Councilman Quadrine -- Councilman Quadrine stated that he had no report. The Town Attorney The Attorney reported that he had no matters to bring be- fore the Board at this time. 6 The Town Engineer -- 1. Proposed Highway Garage Pursuant to memorandum addressed to the Board by the Engineer under today's date and herewith presented and filed, on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously - RESOLVED, that the Town :Clerk be and he here- by is authorized in accordance with law to publish in the official newspaper of the Town of Mamaro- neck, The Daily Times, a notice for sealed bids, to be returnable as of February 19, 1964, and to be opened and read aloud at a regular meeting of this Board at 8:15 p. m. that evening, for furnish- ing to the Town of Mamaroneck proposals for the performance of all work in connection with the General Construction, electrical, plumbing, heat- ing, and site work, Contracts 1, 2, 3, 4 and 5, of the Mamaroneck Town Garage, Maxwell Avenue, as set forth in the specifications for bidders. 2. Extension of Water Main for Town Garage Pursuant to memorandum addressed to the Board by the Engineer under today's date , together with cost es- timate prepared and submitted by the Westchester Joint Water Works, herewith presented and filed for the rec- ord, on motion by Councilman Kane, seconded by Coun- cilman Brush, it was unanimously RESOLVED, that this Board hereby authorizes the Westchester Joint Water Works to extend the 6" water main from its present terminus near the end of Maxwell Avenue, for a distance of approximately 350 feet into lands upon which the proposed Town Garage is to be constructed, at a cost of $2, 131. 52, to be paid by the Town and charged to the "Town Garage Account". 3. Installation of Fire Hydrant at Town Garage Pursuant to memorandum addressed to the Board by the Engineer under today's date and cost estimate prepared by the Westchester Joint Water Works and appended there- to, herewith presented and filed for the record, on motion by Councilman Brush and seconded by Councilman Quadrine, it was unanimously, RESOLVED, that this Board hereby authorizes the Westchester Joint Water Works to install a fire hy- drant on the water main extension at a point in front of the proposed Town Garage, at a cost of $612. 52, to be paid by the Town and charged to the Water District budget for 1964. -7- 4. Authorization of Easement Agreements for Sewer Pumping Station and Force Main (Murdock Woods Subdivision) Pursuant to memoranda from the Town Engineer request- ing that the Supervisor be authorized to execute two ease- ment agreements for a sewer pumping station and force main in Murdock Woods Subdivision, Sections #1 and #5, herewith presented and filed for the record and following --- discussion and explanation by the Engineer, it was on mo- tion by Councilman Brush, seconded by Councilwoman Helwig, unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute two easement agreements which convey to the Town of Mamaroneck the rights to repair, service and maintain a sewer ejector station located at the southerly end of a street known as Kolbert Drive in Murdock Woods, Section 5 as shown on map filed in the County Clerk's Office as Map No. 13725, and the force main running from said ejector station through the side yards of sev- eral lots from Kolbser:t Drive to Salem Drive, Mur- dock Woods, Section 1 filed Map No. 12647. OTHER BUSINESS 1. Mr. John Atherton At this time the Supervisor recognized Mr. John Atherton member of the Northern Mamaroneck-Larchmont Associa- tion, who addressed the Board to express personally and on behalf of the Association thanks and appreciation for the splendid snow removal job performed by the Highway De- partment. 2. Mrs. Edward K. Price Mrs. Price addressed the Board to request that the Highway Department be directed to provide additional sand on Hillcrest Avenue at the time of snow and ice storms. The Supervisor directed that the Highway Superintendent be so directed, thanking Mrs. Price for calling the matter - to the attention of the Board. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:55 p. m. , to reconvene on February 5, 1964. -8- BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was con- vened immediately upon the adjournment of the Town Board meeting. 1. Claims Commissioner Brush presented for payment the Fire Department claims as audited by the Comptroller and approved by the Fire Chief, and thereupon on his mo- tion, seconded by Commissioner Kane, it was unan- imously RESOLVED, that the following Fire Department claims as audited by the Comptroller and ap- proved by the Fire Chief are approved, and the Supervisor and Comptroller are authorized to pay the same out of the Fire Department bud- get: Atlantic Service $ 75. 45 Con Edison 5. 00 William B. Communications Pursuant to letter dated January 20, 1964 addressed to Fire Commissioner Brush by Arthur M. Brown, Secre- tary to the Fire Department, herewith presented and filed for the record, on motion by him and seconded by Com- missioner Kane, it was unanimously RESOLVED, that this Commission hereby approves the election of the following members of the Town of Mamaroneck Fire Department to the following of- fices for the year 1964: Engine Company #1 Joseph L. Other Business 1. Fire Inspection - Knotty Knolls The Chief reported on three ladder violations at Knotty Knolls which were presently being corrected. 5.
