THE TOWN OF MAMARONECK, HELD ON OCTOBER 4th, 1961,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

PRESENTATION OF RECREATION SURVEY
The Supervisor presented Dr, Sal J. Prezioso, Director of the
Westchester County Recreation Commission, who presented to
the Town the "Comprehensive Recreation Survey" of the Town
of Mamaroneck, the Village of Larchmont, and the Village of
Mamaroneck, prepared by the Westchester County Recreation
Commission, the Westchester County Department of Planning
and the Westchester County Park Commission, compiled un-
der his direction during the past two years,
The Supervisor, on behalf of the Town and both Villages, and
in the absence of Mayors Coffinberry and Dalfonso but speak-
ing for their representatives, Mr. Edward L. Johansen,
Trustee of the Village of Larchmont, and Mr. B. J. Santoro,
Village Manager of the Village of Mamaroneck, who were
present, accepted the report, thanking Dr. Prezioso and all
members of the County staffs for the time and effort they had
devoted to this over-all comprehensive study,
OLD BUSINESS
There was no old business to come before the meeting.
NEW BUSINESS
1> Application for Swimming Pool Permit
(Valerioa Pasqua - 77 Cooper Lane, Town)
Upon presentation of the above application together with memo-
randum from the Building Inspector stating that the plans and
specifications for said pool conform in all respects with the
Building Code and Zoning Ordinance of the Town of Mamaro-
neck, on a motion offered by Councilman Cook and seconded
by Councilman Brush, the following resolution was adopted
- -- unanimously.
WHEREAS, Valerioa Pasqua heretofore presented an
application for a permit to construct a swimming pool
and appurtenances on premises located at 77 Cooper
Lane, Town, and known as Block 217, Parcel 580 on
the Tax Assessment Map of the Town of Mamaroneck;
and
WHEREAS, the Building Inspector of the Town of Ma-
maroneck has examined the plans and specifications
for the proposed pool;
and
WHEREAS, the Building Inspector finds that the plans
and specifications for the said pool conform in all re-
spects with the requirements of the Swimming Pool
Ordinance (Article 23 of the Building Code), and
therefore recommends that the application be
approved;
NOW, THEREFORE,, BE IT
RESOLVED, that the application of Valerioa Pasqua
for a permit to construct a swimming pool on his
premises, located at 77 Cooper Lane, Town, and
known as Block 217, Parcel 580 on the Tax Assess-
' ment Map of the Town of Mamaroneck, is hereby
approved, and the Building Inspector is hereby au-
thorized to issue a permit for same provided the
pool is constructed in conformance with the plans
and specifications submitted and filed with the ap-
plication.
2. Application for Special Permit - Garage, 385 Post Road
(Owner - Ruth Silver)
In connection with this application previously before the Board,
the Clerk presented a memorandum from the Building In-
spector suggesting that the Board, before taking any action, re-
quest the applicant to submit a plan complying with the Zoning
Ordinance, which the applicant agreed to do.
Whereupon, on the Attorney's advice that a public hearing was
required, it was on motion by Councilwoman Helwig and sec-
onded by Councilman Brush, unanimously
RESOLVED, that in accordance with law, the Town Clerk
be and he hereby is authorized to publish in the official
newspaper of the Town of Mamaroneck, The Daily Times,
notice of public hearing at a regular meeting of this
Board, to be held on October 18th, 1961, at 8;15 p.m. in
the Council Room of the Weaver Street Firehouse, to
consider the request of Ruth Silver for a special permit
pursuant to Sections 410, 432 and 449 to construct or re-
construct a gasoline service station on premises at 385
Boston Post Road and known as Block 505, Parcel 415
on the Tax Assessment Map of the Town of Mamaroneck.

FURTHER RESOLVED, that this notice be published
once at least ten days before date of hearing and that a
copy thereof be mailed to the City Clerk of the City of
New Rochelle and the County Planning Board of West-
chester County.
3. Request of Building Inspector for Expenditure of Funds
(Boiler Inspection - Larchmont Acres and Larchmont Gardens
In connection with the matter of violations at the above apart-
ments, the Clerk presented a memorandum from the Building
Inspector requesting authorization to expend the sum of $150.
for payment for the services of a qualified Boiler Inspector.
Whereupon, on motion by Councilman Cook and seconded by
Councilman Brush, and following question from the floor by
Peter G. Moore as to why the Town was inspecting boilers,
answered by the Supervisor, it was unanimously
RESOLVED, that expenditure of the sum of $150. 00
for payment for services of a qualified Boiler In-
spector at Larchmont Gardens and Larchmont Acres
Apartments, is hereby authorized; said sum to be
paid from the proper item in the budget of the
Building Inspector for 1961.
4. Authorization of Publication of Registration Notice
Upon the Clerk's request, on motion by Councilman Cook and
seconded by Councilwoman Helwig, it was unanimously
RESOLVED, that in accordance with the provisions of
Section 76 of the Election Law, a notice be published
in the official newspaper of the Town of Mamaroneck,
The Daily Times, on October 6th and 13th, 1961,
listing the places of registration, stating the days and
hours of registration, and describing briefly each reg-
istration district in the Town of Mamaroneck.
COMMUNICATIONS
1. Renewal of Permit for Tummy's Delight gNot on Agenda)
In order to avoid detaining further a group of persons present,
by common consent the Board requested the Clerk to present
a communication requesting renewal of the Special Permit for
Tummy's Delight, received from the owner, George T. Gri-
gor, Jr„ too late for inclusion on the prepared agenda.
Following review by the Building Inspector and Attorney and
a lengthy discussion during which the applicant spoke on his
own behalf and Mr. and Mrs, W. F. McCarty and Hugh
Keiser were heard representing a group of residents of Rock
Ridge Road strongly opposed to renewal of this permit, it
was, on motion by Councilman Brush and seconded by Coun-
cilwoman Helwig, unanimously
RESOLVED, that the application for renewal of the
Special Permit granted to Tummy's Delight, located
at 1317 Boston Post Road on property known as
Block 412, Parcel 288 on the Tax Assessment Map
of the Town of Mamaroneck, and which expired on
October 1st, 1961, be and it hereby is denied.
1. Request for Town Acceptance of Country Road
Following presentation of a request from Joseph W. Gleicher
Go. , Inc. that the Town take over Country Road from Feni-
more Road to the beginning of the strip owned by the County
of Westchester and in accordance with memorandum from
the Town Engineer and Highway Superintendent, received
and filed herewith, acceptance was deferred pending com-
pletion of certain repairs as stated in said memorandum.
2. Request for Acceptance of Robins Nest Lane
In connection with this request, although the improvements
were approved as per memorandum from Town Engineer and
Superintendent of Highways received and filed herewith, on
report by the Attorney of some legal difficulty concerning
the fee of the bed of the street, action on this request was
deferred pending further report by the Attorney.
3. Petition and Communication from Otto Scheuble
Installation of New Sewer Line for Cook's Restaurant
In connection with a letter addressed to the Board by Otto
Scheuble under date of August 21st, requesting the installa-
tion of a new sewer line in the Post Road for Cook's Res-
taurant, the Clerk presented a memorandum from the En-
gineer approximating the cost of such a line at $4, 800. 00,
together with a petition signed by eleven residents of Rock
Ridge Road and presented in support of Mr. Scheuble's re-
quest, which were ordered received and filed herewith.
Following discussion, the Supervisor, Town Engineer, and
Town Attorney were directed to confer with Mr. Cook and
his attorney and report further after such meeting.
4. Request for Authorization of Police Chief's Expenses
(Board of Police Commissioners)
In accordance with a request from the Police Commission
for authorization of the Chief's expenses at the meeting of
the International Association of Chiefs of Police presented
and filed herewith, on motion by Councilman Brush and
seconded by Councilwoman Helwig, it was unanimously
- RESOLVED, that this Board hereby authorizes pay-
went of a sum not to exceed $165. 00, to cover the
expenses of Police Chief Paul A. Yerick at the
meeting of the International Association of Chiefs of
Police, to be held in Montreal from October 1st to
5th, 1961; said item to be paid from the Police De-
partment budget for 1961.
5. Letter from Senator Hunter Meighan - Petition re
Thruway Noise
The Clerk presented a letter from State Senator Hunter
Meighan, dated September 13, 1961, enclosing reply from
Mr. R. Burdell Bixby, Chairman of the Thruway Authority,
to the petition which he had forwarded to Mr. Bixby at re-
quest of this Board.
Councilwoman Helwig reviewed the points made in the peti-
tion and Mr. Bixby's reply to each, and advised the Board
that a conference would be arranged with Mr. Bixby, after
which she would report further to the Board.
6. Request of Police Commission - Authorization for Salary
of Newly-appointed Police Patrolman
In accordance with the Police Commission's request for au-
thorization of salary for the new Patrolman, on motion by
Councilman Brush and seconded by Councilman Cook, it was
unanimously
RESOLVED, that this Board hereby authorizes that
Peter Diamond, Police Patrolman (Probationary ap-
pointment) be compensated at the rate of $5, 266. 00
per annum, beginning as of October 5th, 1961.
?. Public Notice - Meeting of Zoning Board of Appeals
Village of Larchmont
The Clerk presented a notice of a meeting of the Zoning Board
of Appeals of the Village of Larchmont, which, following the
Attorney's report to the effect that the matters containedthere-
in were not of concern to the Town, was ordered received and
filed.

1. Letter from Planning Board (Request of Nardy Builders)
In connection with Nardy Builders' request that the zoning of
Block 401, Parcel 150 be changed from R-15 to R-6, the
Clerk presented a communication from the Planning Board
recommending that no change be made in the zoning of this
property, in view of which, the Board took no further ac-
tion at this time,

1, Report on Land Auction
- The Supervisor reported that the Town-owned property known
as Block 125, Parcel 372 on the Tax Assessment Map of the
Town of Mamaroneck, had been sold at auction immediately
preceding this meeting to Mr. Anthony N. Librandi, the only
bidder, at the upset price of $3, 500. 00,
Whereupon, on motion by Councilman Brush and seconded by
Councilwoman Helwig, the following resolution was adopted
unanimously:
WHEREAS, the Town of Mamaroneck, through the in-
stitution of actions in the County Court of Westchester
County pursuant to Article VII-A, Title 3 of the Tax
Law, has become and now is the owner of a number of
parcels of real estate situate in the unincorporated
section of the Town of Mamaroneck;
and
WHEREAS, the Town of Mamaroneck advertised for
bids and held a public auction on October 4th, 1961,
and received bids on certain parcels of real estate now
owned by the Town of Mamaroneck;
and
WHEREAS, since the receipt of said bids, this Board
has given careful consideration thereto, after due de-
liberation, it is
RESOLVED, that the bid hereinafter listed be accepted
at the price and terms therein set forth;

FURTHER RESOLVED, that the Supervisor is au-
thorized and directed to execute and deliver the
deed to this parcel in accordance with the terms
and contract of sale, and the Town Attorney is
authorized to take all steps necessary to com-
plete the sale transfer of this parcel,
2. Compensation, Thruway Property
The Supervisor reported receipt of $81, 500. 00, com-
pensation to the Town for property taken by the New
York State Thruway - New England Section.
3. Violations, Larchmont Gardens Apartments
The Supervisor presented a memorandum from the En-
gineer, Building Inspector, and Fire Chief reporting in
detail the status of violations at Larchmont Gardens
Apartments and recommending that the Attorney be au-
thorized to take such legal action as permitted under
items 2 and 3 thereof in order to effectuate correction
of violations.
It was directed that this memorandum be filed for the
record and thereupon, in accordance with recommen-
dation contained therein, on motion by Councilman
Brush and seconded by Councilman Cook, it was
unanimously
RESOLVED, that the Town Attorney be and he
hereby is authorized and directed to take such
legal action as necessary in connection with
correction of violations at Larchmont Gardens
Apartments.
4. Meeting, County Officers Association
The Supervisor reported in some detail on the three-
day conference of the County Officers Association
held at Grossingers on October lst, 2nd, and 3rd.
Councilwoman Helwig --
1. 300th Anniversary
Councilwoman Helwig suggested that a resolution be adopted
and spread upon the minutes of this meeting in order to for-
mally express this Board's thanks and appreciation of the
outstanding work performed by the 300th Anniversary Exec-
utive Committee in planning and carrying out the various
programs and ceremonies celebrating the 300th Anniversary
of the Purchase of Mamaroneck during the week of Septem-
her 17th through 23rd, 1961,
_ Whereupon, on motion offered by her and unanimously sec-
onded, the following resolution was adopted to be spread up-
on the minutes of this meeting and forwarded to the Chair-
man and members of the said Committee;
Whereas , the Executive Committee, appointed by
this Board, has given unstintingly of
time, talent, and effort over a period
of 16 months in planning the celebra-
tion of the 300th Anniversary of the
Purchase of Mamaroneck;
and
Whereas , the Chairman and Committees, ap-
pointed by that Executive Committee,
have devoted untiring effort and limit-
less time to carrying out effectivelythe
plans and programs for this celebra-
tion;
and
Whereas , the week of celebration with its many
and varied events most fittingly and ap-
propriately memorialized our appre-
ciation of the past - our gratitude for
the present - and our hope for the
future;
Now , Therefore ,

Resolved , that the Town Board of the Town of Ma-
maroneck hereby heartily congratulates
this Executive Committee for its sig-
nificant contribution to the Town, and
expresses its deep appreciation and
gratitude for the work of each of those
persons whose enthusiasm and effort
produced an occasion which will long be
remembered by all who are a part of
this community,

Further, in connection with the 300th Anniversary, Council-
woman Helwig suggested that a resolution be adopted and
spread upon the minutes of this meeting in appreciation to
The Mamaroneck Daily Times for the vital role it played in
memorializing this historic event through its full and com-
plete daily coverage and the publication of the outstanding
"Hometown Souvenir Edition, "
Whereupon, on her motion, which was seconded by Council-
man Cook, the following resolution was adopted unanimously*.
Whereas , The Mamaroneck Daily Times has gone
far beyond the call of duty and of normal
public service in covering the events,
programs, and special features of the
300th Anniversary Celebration of the
Town of Mamaroneck;
and
Whereas , The Daily Times has made a particularly
significant contribution to the Celebration
in the Hometown Souvenir Edition - re-
cording for this generation and for pos-
terity many events of the History of our
Town;
Now, Therefore ,
Be It
Resolved , that the T own B oar of the T own of Mamar-
oneck hereby expresses its appreciation of
the distinguished service The Daily Times
has rendered to the Town and all of its
residents in commemorating the 300th An-
niversary of the Purchase of the Town of
Mamaroneck, and commends the Editor and
staff for their splendid contribution to the
success of this significant historic occasion,
3. Tercentenary Journals
Upon presentation of a letter from the Chairman of the 300th
Anniversary Committee informing the Board that additional
copies of the Tercentenary Journals could be ordered at
$1. 00 per copy, which was ordered received and filed here-
with, following discussion, on motion by Councilwoman Hel-
wig and seconded by Councilman Cook, it was unanimously
RESOLVED, that the expenditure of the sum of $100, 00
to cover the cost of 100 additional copies of the Tercen-
tenary Journal is hereby authorized; said expenditure
to be paid from General Town Contingency Fund in the
1961 budget,

Councilman Brush stated that he had no report other than

Councilman Cook --
1, Death of James A. Gillies
Councilman Cook spoke of the great loss Mamaroneck had
suffered in the death of James A. Gillies - an outstanding
citizen whose many services to his community needed no
further words being known well to all who lived here, and
offered in memoriam the following resolution which was
unanimously seconded and adopted to be spread upon the
minutes of this meeting and forwarded to the family of
Mr. Gillies with deepest sympathy and regret,

Mamaroneck herewith expresses its
deep sorrow at the death of
James A . Gillies
and its recognition and appreciation
of the great contribution he made to
the community he served so many
years with tremendous ability, un-

2, Civil Defense
Councilman Cook announced that a Civil Defense Information
Center would be open at the Weaver Street Firehouse under
the direction of the Deputy Director, Mr. Hartley, who
would be assisted by members of the Fire Department staff,
A telephone (Te, 4-4021) would be available with 24-hour
service, literature delivered and questions answered, and
it was planned to hold two meetings a month.
Councilman Cook also informed the Board that a film would
be shown on November 2nd concerning fall-out shelters and
that within the next ten days, a State fall-out shelter expert
would be in Town to inspect the buildings, schools, etc,
3, Apportionments
Councilman Cook presented the following petitions received
from the Assessor for the correction of the assessmentroll
so as to permit the apportionment of taxes, and on motion
by him and seconded by Councilman Brush, the following
resolution was adopted unanimously.
WHEREAS, the Assessor has presented petitions for
the correction of the assessment roll for certain
years, pursuant to the provisions of Section 557,
Article 16 of the Westchester County Administra-
tive Code, known as the Westchester County Tax
Law;
and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petitions for the
correction of said assessment roll.
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1960,
school taxes of 1961, and the assessment roll of
1961, taxes of 1962, which show property now ap-

The Town Attorney --
1. Zoning Violation - Nursery, Leonard Tenner
The Attorney reviewed in some detail the history of the nur-
sery operation on property owned by Leonard Tenner in vio-
lation of the Zoning Ordinance and presented Mr. Jesse
Rothman of 16 Doris Road, who represented a group of resi-
dents of the area protesting this operation, and Mr. Harry
B. Kurzrok, attorney for the owner.
Following a lengthy discussion during which the Board heard
both Mr. Rothman and Mr. Kurzrok, the matter was put over
pending report by the Town Attorney after conferring with
the parties concerned.
Z. Letter from Police Commission - Re Bowling Alleys
The Attorney presented a letter from the Police Commission
requesting an ordinance to control operation of bowling alleys
and inquired the Board's pleasure in the matter.
The Board, after discussing the subject with the Attorney, re-
quested him to prepare a draft of such an ordinance to be sub-
mitted to the Board for consideration.
3. Meeting of National Association of Municipal Law Officers
The Attorney reported that he had attended the meeting of
the National Association of Municipal Law Officers in
New Yark City, and requested authorization for payment
of his expenses in the amount of $10. 00.
Whereupon, on motion by Councilman Brush and seconded by
Councilman Cook, it was unanimously
RESOLVED, that this Board hereby authorizes pay-
ment of a sum not to exceed the amount of $10. 00
to the Town Attorney to cover expenses incurred in
attending the annual meeting of the National Asso-
ciation of Municipal Law Officers In New York
City, New York, said expenses to be paid from
the proper item in the Law Department budget.
OTHER BUSINESS
1. Tummy's Delight
In connection with denial of renewal of special permit for
Tummy's Delight, Councilman Cook requested that this
matter be referred to the Attorney for reconsideration of
application, which the Board so directed.
2. Peter G. Moore
In response to Mr. Moore, who questioned the Board on
the use of the 10-foot strip of property at 65 Palmer
Avenue (apartment house being constructed), the Board
after some discussion, referred the matter to the Town
Attorney for investigation and report thereon.
3, Otto Scheuble
In connection with Mr. Scheuble's application for exten-
sion of permit, he was advised that the matter was under
the jurisdiction of the Zoning Board of Appeals and there-
fore that he must appear before that body.
ADJOURNMENT
There being no further business to come before the meeting, it
was declared adjourned at 10.25 p.m. , to reconvene on Octo-
ber 18th, 1961.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.
1. Claims
Commissioner Brush presented the following Fire Department
claims, which had been audited by the Comptroller and ap-
proved by the Fire Chief, and on his motion, which was
seconded by Commissioner Cook, it was unanimously
RESOLVED, that the following claims be and they
hereby are approved, and the Supervisor and
Comptroller be and they hereby are authorized to
pay the same out of the budget for the Fire De-

Z. Reports
Commissioner Brush presented the Fire Report for the
month of September, 1961, which was ordered received
and filed.
3. Inspection - Rating Purposes
Commissioner Brush presented a proposed resolution re-
questing the Rating Bureau of the National Board of Fire
Underwriters to conduct an inspection of the Town of Ma-
maroneck to see if a higher rating could not be secured
since the last inspection was made in 1937.
And thereupon, on his motion, which was seconded by
Councilwoman Helwig, the following resolution was unani-
mously adopted and the Clerk directed to forward a certi-
fied copy of same to the Bureau.
WHEREAS, the last inspection of the Town of Ma-
maroneck for rating purposes was made in 1937;
and
WHEREAS, the new rules adopted on September
18th, 1961, changed without an inspection the
rating of the Village of Mamaroneck to a higher
rating than the Town of Mamaroneck, which, ac-
cording to the "Standard Schedule for Grading

is unfair to the Town of Mamaroneck;
and
WHEREAS, the present rating is a disservice to the
Town of Mamaroneck taxpayers inasmuch as there
have been many improvements in the last two dec-
ades, including the connection of our water supply
with shaft ZZ of the Delaware Aqueduct in Yonkers;
NOW, THEREFORE, BE IT
RESOLVED, that the Fire Commission hereby re-
quests the Rating Bureau to conduct another inspec-
tion of the Town of Mamaroneck at the earliest pos-
sible date.
4. Death of John C. Forrar
Commissioner Brush spoke of the passing of John C. Forrar,
a loyal and devoted public servant, and suggested that this
meeting adjourn this evening in honor of his memory as a
member and one of the founders of the Town of Mamaroneck
Fire Department with a resolution in memoriam spread up-
on the minutes of this meeting and forwarded to the family
of Mr. Forrar with deepest sympathy.
Whereupon, on motion by him, the following resolution was
unanimously seconded and adopted.
In Memoriam
Resolved , that in recognition of the long and faith-
ful services of John C . Forrar
as a founder and member of the Town of
Mamaroneck Fire Department, as Dog
Enumerator, and as an Election Assis-
tant, this Board, convened in regular
session this 4th day of October, 1961,
wishes to express its grief and sense of
personal loss in the death of
John C . Forrar
and its recognition and appreciation of
his loyal and able service to the resi-
dents of this community;
and be it
Further
Resolved , that this expression of appreciation be
sent to the family of Mr. Forrar and
spread upon the minutes of this meeting.

There being no further business to come before the meeting,
on motion duly made and seconded, it was declared ad-
journed in honor of the memory of J o h n C . Forrar
at 10;35 p.m. , to reconvene on October 18th, 1961.
