HomeMy WebLinkAbout1961_09_05 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON SEPTEMBER 5th, 1961, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Cook Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Orsino - Receiver of Taxes Mr. Kellogg - Town Engineer Mr. Altieri Town Accountant Mr. Fischer - Supt. of Highways Mrs. Brewer - Secretary PUBLIC HEARING - Ordinance, Dutch Elm Disease The Supervisor declared the hearing now in order, and there- upon, on motion by Councilman Kane, which was seconded by Councilman Brush, it was unanimously RESOLVED, that the hearing be and it now is declared open. The Clerk then presented the affidavit of publication of the notice of hearing, together with a letter addressed to the Council by Mrs. William G. Hunter, Co-chairman of the Conservation Committee of The Garden Club of Larchmont, which were ordered received and filed. For the Board's information, the Attorney advised that he had no further information regarding recuperation of charges, but that he nevertheless recommended adoption of the ordinance at this time subject to State Law. Whereupon, since no one wished to be heard either in favor of or in opposition to the proposed ordinance, on motion by Coun- cilman Kane, seconded by Councilman Brush, it was unani- mously RESOLVED, that the hearing be and it now is de- clared closed. And thereupon, on motion by Councilwoman Helwig following pre- sentation of a report which approximated the number and removal costs of elm trees (diseased) on Town streets, and sec- onded by Councilman Cook, the following resolution was adopted unanimously: AN ORDINANCE RELATING TO THE POWERS AND IM- MUNITIES GRANTED BY THE AGRICULTURE AND MARKETS LAW IN REGARD TO THE DUTCH ELM DI- SEASE$ PURSUANT TO THE PROVISIONS OF SEC- TION 169 OF ARTICLE 14 OF THE AGRICULTURE AND MARKETS LAW OF THE STATE OF NEW YORK. Section 1. Powers and immunities in regard to dutch elm disease. The Town Board of the Town of Mamaroneck hereby elects to ex- ercise and enjoy by its appropriate officers and employees the powers and immunities prescribed and granted in Sections 164, 165 and 167 of Ar- ticle 14 of the Agriculture and Markets Law with respect and in regard to the dutch elm disease within the limits of said Town, outside of villages. Section Z. This ordinance shall be effective only upon the approval of the Commis- sioner of Agriculture and Markets and under his direction or that of his representatives. OLD BUSINESS There was no old business to come before the meeting. NEW BUSINESS 1. Application for Special Permit - Garage, 385 Post Road This application was withdrawn at the request of the applicant. COMMUNICATIONS 1. Appraisal - Block 125, Parcel 372 Upon presentation of appraisal by Burbank Associates, Inc. which was ordered received and filed, on motion by Coun- cilman Kane and seconded by Councilman Cook, it was unanimously RESOLVED, that the Clerk be and he hereby is au- thorized to publish notice of Land Auction, to be held at 8 p.m, on Wednesday evening, October 4, 1961, in the Council Room of the Weaver Street Firehouse, for the sale of Town-owned property known as Block 125, Parcel 372 on the Tax As- sessment Map of the Town of Mamaroneck and lo- cated between Thompson Street and Cabot Road, at the upset price of $3500. 00, in accordance with appraisal by Burbank Associates, Inc. Z. Request for Rezoning, Block 401 - Parcel 150 (hardy Builders, Inc. Following the Clerk's presentation of a communication from Edwin M. Freeman, Attorney for Nardy Builders, Inc„ re- questing a change of zoning from R-15 to R-6 for the afore- described property, on motion by Councilman Cook and sec- onded by Councilman Kane, it was unanimously RESOLVED, that the request of Nardy Builders, Inc, for change of zoning from R-15 to R-6 of the prop- erty known as Block 401, Parcel 150 on the Tax As- sessment Map of the Town of Mamaroneck, be andit hereby is referred to the Planning Board of the Town of Mamaroneck for study and report to this Board. The Clerk was directed to acknowledge Mr. Freeman's com- munication, advising him of the Board's action in the matter, 3. Letter re. Noise and Distrubance, Bonnie Briar Country Club The Clerk presented a letter from Mr, and Mrs, Lee H. Whitestone protesting noise and disturbance caused by the Bonnie Briar Country Club, Following discussion, this matter was referred to the Po- lice Department for investigation, and the Supervisor was requested to discuss the matter with the President of the Club with a view to planning the coming year's program in such a way as to possibly alleviate the conditions com- plained about in the Whitestone's letter, The Supervisor was requested to reply to Mr, and Mrs. Whitestone, advising them of the Board's action in the matter. 4, Letter re. Increasing Pensions for Police Officers' Widows The Clerk presented a letter from Thomas Abrahamsen re- questing that consideration be given to increasing to in- creasing the pensions for widows of Police Officers in the preparation of the 1962 budget, which was referred to the Police Department and Police Commission for study and report. 5. Letter Re- Installation of New Sewer Line For Cook's Restaurant - (Otto Scheuble) Withdrawn at request of the writer. 6. Notices a) Public Service Commission - Wilder Transportation, Inc. The Clerk presented a notice of Order rescinding Certifi- cate for the temporary operation of an omnibus line over routes including streets in the Villages of Bronxville and Tarrytown, which was ordered received and filed, b, Zoning Board of Appeals, Village of Larchmont Following the Attorney's report that the matters referred to in this notice were not of concern to the Town, the notice was ordered received and filed, (Not on Agenda) 1, Letter from Larchmont Gardens Apartments The Supervisor presented a letter from Larchmont Gardens Apartments stating that the existing violations were 8510 corrected and requesting an extension of time for the cor- rection of the remaining violations. Following discussion, this matter was referred to the Building Inspector and Engineer for consideration, with dir- ection that weekly inspections be continued and that the Town work closely with the Village of Mamaroneck on this matter. REPORTS The Town Clerk The Clerk presented the following reports which were or- dered received and filed; Report of the Receiver of Taxes and Assessments for the month of August, 1961, Reports of the Westchester Shore Humane Society, Inc, for the months of July and August, 1961, Reports of the Building Inspector for the months of July and August, 1961. Report of Receipts and Disbursements, Town of Ma- maroneck, for the period from January 1st through July 31st, 1961, The Supervisor -- 1, 300th Anniversary a, Display of Flags and "Clean-up" In connection with the coming 300th Anniversary celebra- tion, upon the Supervisor's presentation of a letter from the Chairman of the Committee requesting all residents to display flags during celebration week, and Councilwoman Helwig's suggestion that a general "clean-up" be re- quested throughout the Town, on her motion, which was seconded by Councilman Kane, the following resolution was adopted unanimously. WHEREAS, the week of September 16th to 24th, 1961, is set aside for ceremonies to celebrate the 300th Anniversary of the Purchase of Ma- maroneck; - and _._ WHEREAS, during this week of celebration many distinguished guests will visit the Town; and WHEREAS, all departments of the Town govern- ment are devoting every effort to improving the appearance of our Town for this celebration; NOW, THEREFORE, 1, George D. Burchell, Supervisor of the Town of Mamaroneck, call on all residents to mark this week of celebration with a display of flags, a general clean-up, and all other appropriate measures to insure a gala appearance of our entire Town for this great and significant occasion. b. Sale of Historical Journal The Supervisor presented for the Board's information, a let- ter requesting approval of the plans for the sale of the His- torical Journal as outlined therein, together with reply ap- proving request, which were ordered received and filed. Z. Acquisition of County Lands The Supervisor reported that through action of the Board of Supervisors, the Town of Mamaroneck would acquire 64 acres of County land lying within the Town for park and rec- reational use. Councilwoman Helwig, speaking for all of the members of the Board, thanked the Supervisor for his untiring work and ef- fort on behalf of the Town in connection with the acquisition of these lands during the past two years, and on a motion of- fered by her and unanimously seconded, it was RESOLVED, that on behalf of the Town of Mamaroneck, this Board hereby expresses its sincere thanks and ap- preciation to -- Supervisor George D. Burchell for his untiring work and effort in the matter of acquir- ing for the Town of Mamaroneck those lands owned by the County of Westchester which lie within the borders of this Town; and be it FURTHER RESOLVED, that this expression of appre- ciation and gratitude be a matter of public record and spread upon the minutes of this meeting. � 7 Councilwoman Helwig -- 1. County Recreation Survey Councilwoman Helwig advised the Board that the Comprehen- sive Recreation Survey report would be ready by September 25th and in connection therewith stated that Dr. Prezioso, Superintendent of Recreation in the County, would like to know the Board's pleasure in ordering additional copies to the 50 which would be supplied to the Town in accordance with the specifications approved in the authorization for the study on December 2nd, 1959. Whereupon, following some discussion, on motion by Coun- cilwoman Helwig and seconded by Councilman Kane, it was unanimously RESOLVED, that this Board hereby approves the expen- diture of the sum of $100, 00 to cover printing costs for supplying to the Town of Mamaroneck 100 copies of the Comprehensive Recreation Survey report in addition to the 50 copies to be furnished for the sum of $300, 00 in accordance with the original specifications approvedby resolution adopted on December 2nd, 1959 authorizing the survey; and be it FURTHER RESOLVED, that these expenditures be paid as follows. the original sum of $300. 00 to be ap- propriated from the General Town Contingency Fund in the 1961 budget, and the additional $100. 00 to be paid from the 1961 Recreation Department budget, 2. Publicity -- Sailing Instruction Program Councilwoman called to attention the article describing the Town's sailing program which appeared in the "Today's Living" section of the August 27th (Sunday) edition of the New York Herald Tribune, which was ordered received and filed. Councilman Kane -- 1. Lighting Survey Councilman Kane presented a letter from Broadway Mainten- ance Corp. concerning the lighting survey presently being made for the unincorporated area, which was ordered re- ceived and filed. He further advised Mr, Joseph Mehr, President of the Mur- dock Woods Association, who was present, that one of the new-type lights referred to in said letter would be used in the Murdock Woods area where residents were suffering some distress from street light reflection. Mr. Mehr thanked Councilman Kane and the Board for the attention given this matter. Councilman Brush -- Councilman Brush stated that he had no report other than Fire matters, Councilman Cook -- 1. Sign Ordin ance Councilman Cook reported that Mr. Paonessa and Mr. Kel- logg were still working on the proposed new ordinance. 2. Apportionments Councilman Cook presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes, and on his mo- tion, which was seconded by Councilman Kane, the following resolution was adopted unanimously WHEREAS, the Assessor has presented the following petitions for the correction of the assessment roll for certain years pursuant to the provisions of Sec- tion 557, Article 16 of the Westchester County Ad- ministrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1960, school taxes of 1961, and the assessment roll of 1961, taxes of 1962, which show property now appearing on the rolls as follows. Payment for Station Park Property {Thruway) The Town Attorney presented a letter from the State of New York, Department of Law (Real Property Bureau), dated August 17, 1961, which was signed by Edward R. Amend, Assistant Attorney General, in which was enclosed release; affidavit of title and voucher in triplicate in connection with the payment of the sum of $81, 500. 00 for the property in the station park taken by the New York State Thruway for the ramp, which release he requested the Supervisor be au- thorized to execute. Whereupon, on motion by Councilwoman Helwig and seconded by Councilman Kane, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized and directed to sign the release, the affi- davit of title and the voucher in triplicate for the pay- ment of the award made by the New York State Thru- way, New England Section, for parcel 1049, map 1049-R-1, and forward these documents to the At- torney General of the State. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 8;50 p.m. , to reconvene on October 4th, 1961. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1, Claims Commissioner Brush presented the following claims of the Fire - Department, which had been audited by the Comptroller and ap- proved by the Fire Chief, and on his motion, which was sec- onded by Commissioner Kane, it was unanimously RESOLVED, that the following claims be and they hereby are approved, and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the bud- get for the Fire Department. Reports Commissioner Brush presented the Fire Report for the month of August, 1961, which was ordered received and filed. 3. Communications Commissioner Brush presented a letter from The Seagrave Corporation pertaining to bidding for the new Fire Truck, which was ordered received and filed. And thereupon, since only one bid was submitted for the pur- chase of the new truck by Ward LaFrance and reported to be in order, it was, on motion by Commissioner Brush and sec- onded by Commissioner Kane, unanimously RESOLVED, that the bid of Ward LaFrance, the only bid submitted, for furnishing a new 1000 GPMs Stage High Pressure Pumping Engine to the Town of Mamar- oneck Fire Department, is hereby accepted in the amount of $24, 749. 56; said Engine to be in confor- mance with the bid proposal submitted therefor. 4.
