THE TOWN OF MAMARONECK, HELD AUGUST 2nd, 1961, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIRE HOUSE,
WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8.15 p.m.

THE SUPERVISOR
Before proceeding with the regular order of business, the Su-
pervisor stated that the Board would hear Mr, William G.
Fulcher and Miss Nancie Kaufman, who were present this
evening.
Mr. Fulcher presented a report on plans for the 300th An-
niversary celebration, displaying and describing in some
detail the 'Book of Remembrance", which he was pre-
senting to the Town of Mamaroneck in commemoration of
this historic event. He also called to attention the illumin-
ated glass reproduction of the Anniversary poster, made and
presented to the Town by the Recreation Superintendent, Mr.
Kronenberger.
The Supervisor thanked Mr. Fulcher and Mr. Kronenberger
on behalf of the Board, and introduced Miss Kaufman;:who,
along with three fellow-members of the Sailing Instruction
program, was present to express the class's thanks to the
Board for providing this program.
Following an expression of the Board's appreciation to Miss
Kaufman and her companions, the Supervisor stated that the
Board would now proceed with the regular order of business.
APPROVAL OF MINUTES
The minutes of the regular meeting of June 7th and special
meetings of May 24th and June 21st, 1961, were approved
as submitted.
OPENING OF BIDS - FIRE TRUCK
The Clerk presented the affidavit of publication of the notice
for bids, and opened and read aloud the following bid, which
was the only bid submitted:

Following discussion as to why this was the only bid sub-
mitted, it was referred to the Fire Chief, Town Attorney
and Engineer for study and report.
OLD BUSINESS
There was no old business to come before the meeting.
MR. JAMES RENSON - MR. WILLIAM RICHARDS
At this time, Mr. Renson and Mr. Richards, being recog-
nized by the Supervisor, addressed the Board on behalf of
the Tenants Associations of Larchmont Acres and Larch-
mont Gardens, calling attention to the unsatisfactory con-
ditions at both apartments.
The Supervisor informed Mr. Renson and Mr. Richards
that letters had been sent by the Town to the owners of the
apartments in question, reciting the existing violations at
each and requesting correction thereof by August 25th, Up-
on the request of Mr. Renson and Richards, it was directed
that copies of the said letters be forwarded to them,
The Supervisor also assurred Mr. Renson and Mr. Richards
that regular weekly inspections of both premises would be
made in following-through on the correction of all violations,
and that the Board would be glad to keep them advised in the
matter.
Mr. Renson and Mr. Richards thanked the Board and stated
they would greatly appreciate being kept under advice in this
matter.
NEW BUSINESS
1, Salary Authorization for Police Patrolman
In accordance with the request of the Police Commission
presented and filed herewith, on motion by Councilman
Brush and seconded by Councilwoman Helwig, it was
unanimously
RESOLVED, that this Board hereby authorizes that
John T. Costello, Police Patrolman (probationary
appointment) be compensated beginning on July 13,
1961, and for the remainder of the current year, at
the rate of $5, 266,00 per annum,
2. Proposed Ordinance - Dutch Elm Disease
The Attorney submitted a proposed ordinance with refer-
ence to Dutch Elm disease and recommended that if it
were the Board's pleasure, the Clerk be authorized to
publish notice of public hearing thereupon at the next
meeting of the Board.
Whereupon, on motion by Councilman Cook , seconded by
Councilwoman Helwig, and following discussion of re-
covery of charges for removal of affected trees on private
property under the Agriculture and Markets law, it was
unanimously
RESOLVED, that the Town Clerk be and he hereby is
authorized to publish in the official newspaper of the
Town of Mamaroneck, The Daily Times, notice of
public hearing to be held on September 6th, 1961, at
8.15 p.m. , in the Council Room of the Weaver Street
Firehouse, for the purpose of considering the adop-
tion of an ordinance pursuant to Article 14, Section
169 of the Agriculature and Markets Law of the State
of New York in regard to Dutch Elm disease, in ac-
cordance with law.
3. Change of Location - 22nd District Polling Place
In accordance with the Town Clerk's recommendation as
stated in memorandum presented and filed herewith, on
motion by Councilman Kane and seconded by Councilman
Cook, it was unanimously
RESOLVED, that the Polling Place for the 22nd Dis-
trict be changed as follows:
From - Central School, Boston Post Road,
Mamaroneck
To - Palmer Terrace Apartments, Pal-
mer Avenue, Mamaroneck
4. Designation of Polling Places, 1961-62
In accordance with the Clerk's recommendation designating
a place in each election district in the Town for 1961-62
registration, election, and primaries presented and filed
herewith, on motion by Councilman Brush and seconded by
Councilman Cook, it was unanimously
RESOLVED, that in accordance with the provisions of
Section 66 of the Election Law, being Chapter 17 of
the Consolidated Laws of the State of New York as
amended, the Town Board of the Town of Mamaroneck
hereby designates a place for each election district in
the Town at which a meeting for the registration of vo-
ters, election and primaries shall be held in the year
following the ensuing first (1st) day of October as
follows:

5. Authorization--Collection of 1961 School Taxes
In accordance with the Comptroller's request, on motion by
Councilman Kane and seconded by Councilman Brush, the
following resolution authorizing the Receiver of Taxes toac-
cept payment of school taxes for 1961 was adopted by unani-
mous vote, all members of the Board being present and
voting:
WHEREAS, Section 96A of the Tax Law as amended by
Chapter 635 of the Session Law of 1957 empowers a
Town Board in the County of Westchester by resolution
to authorize the Receiver of Taxes to accept partial
payments for or on account of taxes with provision for
the reduction of penalties not below 276 on installments
subsequent to the first (1st) installment;
NOW, THEREFORE$ BE IT
RESOLVED, that pursuant to the provisions of Section
96A of the Tax Law so amended, the Receiver of Taxes
is hereby authorized and directed to accept from any
taxpayer partial payments for or on account of the 1961
school tax in two installments in the manner set forth
below, and to apply such installment payments on ac-
count of said school tax.
1) One-half of the 1961 school tax during the
month of September, 1961;
2) The remaining one-half of the 1961 school
tax during the month of January, 1962,
when such installment shall become due;
and be it
FURTHER RESOLVED, that the Schedule of Penalties
for the non-payment of the first (1st) and second (2nd)
installments shall be as follows.

and be it
FURTHER RESOLVED, that notwithstanding any pro-
visions of this resolution, the Receiver of Taxes of
the Town of Mamaroneck may accept the payment of
the second (2nd) installment of school taxes at the op-
tion of the taxpayer during the months of October, No-
vember and December with a penalty of Zjo;
and be it
FURTHER RESOLVED, that notwithstanding any pro-
visions of this resolution, the Receiver of Taxes of
the Town of Mamaroneck may accept the payment of
the total amount of school taxes at the option of the
taxpayer during the month of September without pen-
alty;
and be it
FURTHER RESOLVED, that the acceptance of any such
partial or installment payment of the 1961 school taxes
for Union Free School District No, 1 in the Town of
Mamaroneck,. and School District No. 2, Town of
Scarsdale, New York, shall not be deemed to affect
in any manner, any right of the Town of Mamaro-
neck under any general or special act, to enforce
collection of the unpaid balances of such taxes as
may remain due and owing to the said Town, but
rights and powers shall remain in full force and ef-
fect to enforce collection of the unpaid balance of
such school taxes, together with interest, penalties,
and other lawful charges.
COMMUNICATIONS
1) Request to Purchase Town-owned Property, Block 125-Parcel 372
With reference to Mr. Anthony Librandi's request to pur-
chase the Town-owned property known as Block 125 Par-
cel 372 on the Tax Assessment Map of the Town of Mamar-
oneck and lying between Thompson Street and Cabot Road,
it was recommended that an expert appraiser be engaged
to determine the market value of the land and since the
Board was unanimous in feeling that the Town had no
present or foreseeable future use for the property, that it
then be offered for sale at the upset price fixed by such
appraisal.
Whereupon, on motion by Councilwoman Helwig and sec-
onded by Councilman Brush, it was unanimously
RESOLVED, that this Board hereby authorizes that
an expert real estate appraiser be engaged at a fee
not to exceed the sum of $50. 00, to appraise the
Town-owned property known as Block 125 - Parcel
372 on the Tax Assessment Map of the Town of
Mamaroneck and lying between Thompson Street
and Cabot Road in the Town.
2) Request for Appointment of Representative to the Citizens
Advisory Committee on Property and Building Needs
In accordance with the request contained in a letter from
the Chairman of the Board of Education appointed Citizens
Advisory Committee on Property and Building Needs, pre-
sented and filed herewith, upon the Supervisor's recom-
mendation and motion by Councilwoman Helwig and sec-
onded by Councilman Brush, it was unanimously
RESOLVED, that this Board hereby appoints
Councilman Joseph W. Cook, Jr, to serve as
liaison representative of this Board to the
Citizens Advisory Committee on Property and
Building Needs of the Mamaroneck School
District.
It was directed that the Supervisor so advise the Chairman of
this Committee, extending best wishes for success in this work.
3) Public Notices
a. Zoning Board of Appeals, Village of Larchmont
Upon the Attorney reporting that the matters contained
in this notice did not concern the Town, the notice was
ordered received and filed.
b. Amendment to Zoning Ordinance, City of New Rochelle
The Attorney, upon referral of notice to his attention,
stated that he would report thereon at the nextmeeting.

1. Dog Contracts
A report on Dog Contracts, prepared by Attorneys
Delius, Antinozzi and Sansone, was presented and or-
dered received and placed on file with copy thereof to
each member of the Board.
Z. Authorization of Salary Increments
In accordance with the Accountant's memorandum pre-
sented and filed herewith, on motion by Councilman
Brush and seconded by Councilman Kane, it was unan-
imously
RESOLVED, that the following salary increments
are hereby authorized in accordance with the Town
of Mamaroneck Compensation Plan for 1961.

3. Authorization, Attendance Firearms School
In accordance with request of Police Commission pre-
sented and filed herewith, on motion by Councilman
Brush and seconded by Councilman Cook, it was unan-
imously
RESOLVED, that expenditure of not to exceed
$30.00 for expenses of two police officers to
attend FBI Firearms Training School at Camp
Smith, New York, September 11th - 15th, 1961
is hereby authorized, and is to be paid from
the proper item in the Police Department budget
for 1961.

The Clerk presented the following reports which were ordered
received and filed.

month of June, 1961.

Report of the Building Inspector for the month of June,
1961.
Report of the Receiver of Taxes and Assessments for the
month of July, 1961.
Report of Receipts and Disbursements, Town of Mamaro-
neck, for the period from January 1st through June 30th,
1961.
Financial Report of the Town of Mamaroneck for the
year ended December 31st, 1960 by Glick-Freedman,
Certified Public Accountants.
Affidavits of publication and posting of ordinance adopted
to control the course of streams and waterways in accor-
dance with law.
The Supervisor --
1. Civil Defense
The Supervisor reported on a meeting with Civil Defense au-
thorities in the interest of activating the program in view of
the present international situation and President Kennedy's
remarks.
2. West Fordham Transportation Corporation
The Supervisor reported receipt of a letter from the Presi-
dent of West Fordham Transportation Corp. advising that
the Public Service Commission would conduct a hearing on
that company's application to extend the bus service to the
Port Authority Bus Terminal on August 16th,
Following discussion, the Attorney was directed to attend
this hearing and report thereon to the Board.
3. Letter from New York State Department of Public Works
The Supervisor reported that he had been advised by L.L.
Greer, Resident Engineer, New York State Department of
Public Works, that the resurfacing of Route US 1 in the Town
of Mamaroneck would be done within the next two years, and
the guide rail at the Route 125 - Murray Avenue intersection
removed within the next week.
Councilwoman Helwig --
1. Personnel - Summer Recreation Program
In compliance with memorandum from the Recreation Com-
mission presented by Councilwoman Helwig and filed here-
with, on motion by her and seconded by Councilman Brush,
it was unanimously
RESOLVED, that this Board hereby authorizes the fol-
lowing salary expenditures to the persons listed below
for the term of employment and at the rate of compen-
sation specified for each;

Councilwoman Helwig reported that six communities had
approved appropriation of funds to engage the accous-
tical expert with no word yet from New Rochelle and Rye.
She further reported that it was hoped that Port Chester,
which had disapproved the appropriation, would re-
consider its decision.
3. Park Commission
Councilwoman Helwig reported that benches had been
placed at the Gardens Lake,
Councilman Kane --
1. Lakeside Drive Bridge
Councilman Kane reported that the County had completed de-
molition of the bridge.
Z. Sewer Conference
Councilman Kane reported that the Engineer had attended the

first of a series of conferences to be held by the State in
the County Center with reference to sewer matters.
Councilman Brush --
Councilman Brush reported that he had nothing other than
Fire matters.
Councilman Cook -
1, Planning Board
Councilman Cook reported that the Planning Board would
meet in special session next Monday evening to consider
the new subdivision plans in connection with Soundview
Woods.
The Town Attorney --
1. Letter from Police Commission
The Attorney presented a letter from the Police Commission
in reference to hours of operation at the Loyal inn Bowl and
requesting that consideration be given to the adoption of leg-
islation for hours of operation of bowling alleys, which was
ordered received and filed.
Following discussion, the Board requested the Attorney, in
-- accordance with his suggestion, to discuss this matter of
the Loyal Inn Bowl with the Police Chief and owner of the
bowling alley, and further to study the need for an ordinance
as referred to in the Commission's letter.
Z. Duplicate Tax Lien
The Attorney presented a request for the issuance of a dup-
licate tax lien to Jennie Pascale, together with the neces-
sary Indemnity Agreement Affidavit and Satisfaction there-
for, and on his recommendation and motion offered by
Councilman Kane and seconded by Councilman Brush, it
was unanimously
RESOLVED, that a duplicate tax lien covering the
premises owned by Jennie Pascale and known as
Section 8, Block 829, Lot 10 (old 5) on the TaxAs-
sessment Map of the Town of Mamaroneck, soldat
the tax lien sale in 1937 and assigned by Susan Or
rico to Jennie Pascale on September 18, 1952, in
the sum of $22. 58, be issued to Jennie Pascale
pursuant to the provisions of Sections 556 and 582
of the Westchester County Administrative Code,
(Chapter 852 of the Laws of 1948), provided that
Jennie Pascale file with the Town of Mamaroneck
an Indemnification Agreement pursuant to Section
582 of the Westchester County Administrative Code
in the sum of $22. 58, to indemnify the Town
against any loss or claim resulting from the pro-
duction of the original lien, if found; such Indem-
nification Agreement to be in form satisfactory to
the Town Attorney.
3, Zoning Violation - Harold Fink, 29 Cornell Street
Following the Attorney's report of a violation, 6-foot fence,
on premises owned by Harold Fink and located at 29 Cor-
nell Street, on motion by Councilman Brush and seconded
by Councilman Cook, it was unanimously
RESOLVED, that the Town Attorney is hereby au-
thorized to take such action as necessary to effect
correction of zoning violation on premises owned
by Harold Fink and located at 29 Cornell Street,
Town of Mamaroneck.
4, Zoning Violation - Larchmont Diner
Following report to the effect that the Larchmont Diner had
not complied with certain conditions stipulated in variance,
on motion by Counsilman Brush and seconded by Councilman
Kane, it was unanimously
RESOLVED, that the Attorney is hereby authorized
to take such action as necessary to effect com-
pliance with conditions set forth in variance granted
the Larchmont Diner.
5. 65 Palmer Avenue
The Attorney reported that decision confirming that of the
lower court was handed down on July 12th, 1961.
6. Zoning Violation - Nursery, Weaver Street and Palmer Avenue
The Attorney reported that the trial had concluded and sum-
marized briefly the decree and conditions thereof.
7. Soundview Woods
The .Attorney reported that the construction drawings would
be ready on August 7th, and if approved by the Planning
Board, a bond would be taken out and presented to this
Board for approval. In the interest of time, he recom-
mended that a special meeting of this Board be held as soon
as possible after the bond was taken out so that the street
improvements could be completed before frost and cold
weather.
Following discussion, the date of August 23rd was suggested
for such meeting, to be called upon advice from the Attorney.
ADJOURNMENT
There being no further business to come before the meeting, it
was declared adjourned at 9.20 p.m. , to reconvene on Septem-
ber 6th, 1961.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.
1. Claims
Commissioner Brush presented the following Fire Department
claims, which had been audited by the Comptroller and ap-
proved by the Fire Chief, and on his motion, which was sec-
onded by Commissioner Kane, it was unanimously
RESOLVED, that the following claims be and they hereby
are approved, and the Supervisor and Comptroller be and
they hereby are authorized to pay the same out of the bud-
get for the Fire Department:

which was ordered received and filed.
3. Communications
Commissioner Brush reported that there were no communi-
cations to be presented at this time.
4. Adjournment
There being no further business to come before the meeting,
it was declared adjourned at 9:25 p.m. , to reconvene on
September 6th, 1961.
