THE TOWN OF MAMARONECK, HELD JULY 5th, 1961, IN THE
COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEA-
VER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

APPROVAL OF MINUTES
The minutes of the regular meeting of May 17th, 1961 were ap-
proved as corrected.
PUBLIC HEARING--Ordinance to Control Water Courses of
Streams and Rivers
On motion by Councilman Kane and seconded by Councilman Brush,
it was unanimously
RESOLVED, that the hearing be and it hereby is
declared open,
The Clerk presented the affidavit of publication of the notice of
hearing for the record, and the Supervisor and Attorney briefly
outlined the proposed ordinance.
The Supervisor then inquired whether anyone present wished to
address the Board either in favor of or in opposition to the pro-
posed ordinance, whereupon Mr.,C. W. Martin of 12 Bonnie
Way was heard.
Mr. Martin stated that he was in favor of this ordinance, but
that he would like at this time to call the Board's attention to the
flooding condition occurring in the Bonnie Way area whenever one
of the gates of the Larchmont Reservoir is opened. He explained
that the water does not drain off at all but remains standing, be-
coming stagnant and thus creating a condition that constitutes a
health menace% and he strongly urged that the Board take steps
to see that something was done to relieve this situation.
Following some further discussion, the Supervisor referred this
matter to the Engineers attention, directing him to confer with
the officials of the Village of Larchmont and the Larchmont
Water Company if necessary in order to effectuate relief to this
present condition.
Whereupon, since no one else wished to speak and there was no
question of the proposed ordinance, on motion by Councilman
Kane and seconded by Councilman Brush, it was unanimously
RESOLVED, that this hearing be and it hereby is
declared closed.
And, thereupon, on motion offered by Councilman Kane and sec-
onded by Councilwoman Helwig, the following resolution was
adopted unanimously:
RESOLVED, that this Board in pursuance of Section
64, subdivision 10-a of the Town Law, hereby
adopts the following resolution:-
1. That no person shall fill or divert any stream
or water course from its natural course ex-
cept when authorized by the State or Federal
Agency, without securing a permit from the
Town Board.
2. That application for such permit shall be in
writing addressed to the Town Board and ac-
companied by a survey that has been prepared
by a licensed professional engineer and which
has been approved by the Town Engineer.
3. That the survey accompanying the application
shall show, in connection with the proposed
work, the location, size and cross-section
area of upstream and downstream existing
culverts or bridges, together with their esti-
mated capacities sufficient to show that the
proposed new work is approximately consis-
tent in size with the size of adjacent water-
way openings in the existing structures, pro-
vided that such existing structures are suffi-
cient in capacity to carry the design runoff
described in paragraph 5 below.
4. That the filling of streams or water courses
shall include the construction or installation
of culverts, pipes or pipe drains of any na-
ture or description.
5. The application for the proposed work shall in-
clude a runoff computation using the rational
method, the upstream water shed area and a
rainfall intensity of not less than a ten year re-
turn frequency along with appropriate runoff co-
efficients to determine the size of any channel
sections, pipes or waterway openings asso-
ciated with such proposed diversions, fillings
or installations of structures.
6. That the Town Board after receiving such ap-
plication, may, in its discretion, deny the is-
suance of a permit if it determines that the
proposed filling or diversion is detrimental to
the drainage or general welfare of the Town.
7. That nothing contained in the resolution or or-
dinance shall supersede the provisions of the
Conservation Law of the State of New York re-
garding the protection against damage and dis-
turbances of streams and the requirements for
a permit for placing any structures in any
stream; or of the provisions of the Westches-
ter County Stream Control Law, which is
known as Title D, Article 9 of the Westches-
ter County Administrative Code, but shall be
considered to be in addition thereto.
8. That this resolution or ordinance shall not ap-
ply to work shown on construction drawings of
subdivisions duly approved by the Planning
Board of the Town.

FURTHER RESOLVED, that the Town Clerk be and
he hereby is authorized to publish and post the fore-
going resolution in accordance with law.
OLD BUSINESS
1. Report on Proposed Sign Ordinance
The Supervisor reported that the Planning Board was continu-
ing its study of the proposed ordinance and was not yet ready
to report thereon to this Board.
2. Report--Thruway Noise Abatement Committee
Councilwoman Helwig, in accordance with the consultant's re-
port to the Thruway Noise Abatement Committee, which was
presented at the last meeting of the Board and circulated to
each member of the Board for study, presented a request for
authorization of the expenditure of the sum of $740. 00 as the
Town's share of the total cost of the consultant's services in
the amount of $6, 600. 00 to be shared equally by the 9 munie-
ipalities composing this Committee.
Following discussion of the several phases of the proposed pro-
gram and particularly of what the proposed expenditure would
cover, a petition supporting the proposed program was pre-
sented and ordered received and filed.
This petition, carrying the signatures of some 83 residents of
the Harmon Drive--Revere Road area of the Town, requested
in general (1) reduction of truck speed, (2) black-topping of the
road-bed through the Town, (3) compliance with muffler regu-
lations, and (4) a study of the construction of walls as sound
barriers.
After some further discussion, during which it was directed
that copies of the petition be forwarded to our State legisla-
tors, Senator Hunter Meighan and Assemblyman Anthony
Giof£re, Councilman Kane recommended that the Board au-
thorize the expenditure ($740. 00) as requested by the Thru-
way Noise Abatement Committee so that the Town of Mamaro-
neck would be the first of the member municipalities to ap-
prove the request, and thereupon, on motion offered by Coun-
cilwoman Helwig and seconded by Councilman Kane, the.fol-
lowing resolution was adopted unanimously:
WHEREAS, this Board has been advised that the Com-
mittee on Noise Abatement on the New York Thruway,
New England Division, proposes to retain the services
of Stannard M. Potter, an expert in the field of ac-
coustical engineering, to advise it in the matter of
noise abatement on the New England Thruway;
and
WHEREAS, the cost of said services would be $6, 66o. ,
or $740, for each of the nine member municipalities of
the said Committee;
and
WHEREAS, after due consideration, it is deemed to be
in the best interest of the health and welfare of a sub-
stantial number of our inhabitants living in close
proximity of the Thruway;
NOW, THEREFORE, BE IT
RESOLVED that, (if the Town of Pelham, the Village
of Pelham Manor, the City of New Rochelle, the Village
of Larchmont, the Village of Mamaroneck, the Town of
Harrison, the City of Rye, and the Village of Port
Chester adopt similar resolutions), the Town of Ma-
maroneck hereby appropriates the sum of $740, as its
share of the total cost of expert services in the matter
of noise abatement on the New England Thruway; said
sum to be appropriated from General Town Surplus in
the 1961 budget. (Line item - Contingency Fund)
NEW BUSINESS
There was no new business scheduled on the prepared agenda
for this meeting. However, at this time the Supervisor rec-
ognized Mrs. Ruth Green and Mr. Richard Friedman, who

addressed the Board in reference to the following matters.
Mrs. Ruth Green - 4th of July Celebration
Mrs, Green stated that she was present to express her sin-
cere and grateful thanks to all those whose hard work and
devoted service had made possible the most successful 4th
of July celebration ever held.
She especially commended the extraordinary performance
of the men of the Town of Mamaroneck Fire Department,
thanking each individually in his own name, along with
the Superintendent of Recreation, Mr. Kronenberger,
Mrs. Donna Comstock, and others of the Town staff who
had given so generously of their time and effort.
The Supervisor thanked Mrs. Green and expressed the
community's appreciation of the time and effort she had
given as Chairman of the Committee responsible for this
well-run, highly successful affair.
Mr. Richard Friedman - Larchmont Acres and Larchmont
Gardens Apartments
Mr. Friedman, who was present at the request of the Acres
and Gardens Tenant Associations, presented a prepared
statement addressed to the Town Council of the Town of Ma-
maroneck and Village Board of Mamaroneck regarding cer-
tain problems and conditions affecting apartment residents
of the Town and Village of Mamaroneck, which the Board
ordered be received and filed with copy to the Board of
Trustees of the Village of Mamaroneck.
The Supervisor thanked Mr. Friedman, advising that the
various matters called to attention would be thoroughly
studied and taken under consideration.
COMMUNICATIONS
1. Letter from Marguerite Kean - House Number, Assessment
The Clerk presented a letter addressed to the Board by
Marguerite Kean of 30 Pryer Manor Road under date of
June 6th, 1961, objecting to the number of her house
and protesting her assessment, which was ordered re-
ceived and filed.
For the Board's information, the Engineer reported
that the matter of the house number had been taken
care of to Miss Kean's satisfaction, and Councilman
- Kane reported that the assessment protest was before
the Board of Review and presently under study.
2. Memorandum from Chief Yerick (Not on Agenda)
In accordance with a memorandum from Chief Yerick,
dated June 20th, 1961 requesting approval of the trans-
fer of Anthony J. Lifrieri from the Greenburgh Police
Department to the Town of Mamaroneck Police Depart-
ment, which was presented and herewith ordered re-
ceived and filed for the record, on motion by Council-
man Brush and seconded by Councilman Cook, it was
unanimously
RESOLVED that in accordance with the recom-
mendation of the Board of Police Commis-
sioners, this Board hereby approves the trans-
fer of Anthony J. Lifrieri from the Town of
Greenburgh Police Department to the Town of
Mamaroneck Police Department as Patrolman,
to be effective as of July 10th, 1961, and to be
compensated beginning as of that date and for
the remainder of the current year at the rate of
$6, 130, 00 per annum,

The Clerk presented the following reports which were ordered re-

The Supervisor--
1. Death of Hugh Pomeroy
The Supervisor called to the Board's attention the great loss suf-
fered by the County of Westchester and our Town in the sudden
untimely death of Hugh R. Pomeroy, Commissioner of Planning
of the County, and stated that he felt it only appropriate that a
resolution be adopted and forwarded to his family at this time
in expression of the deep sorrow felt in this community.
Whereupon, by unanimous motion of the Board, the following
resolution was adopted in memoriam to Mr. Pomeroy, a public
servant of national and international repute.

found sorrow expresses its deep sense
of personal loss in the sudden and un-

tion and appreciation of his outstanding ser-
vice to this County, and through it, to the
Town of Mamaroneck, during all the years of

of planning, where his contributions to sound
planning were of world renown;

Resolved , that this expression of deepest sympathy and
respect be sent to the family of Mr. Pomeroy
and spread upon the minutes of this meeting.
2. New Flag for Town Offices
The Supervisor reported the purchase of a new 50-star
flag for the Town Offices.
3. Report of Missle Trip
The Supervisor presented a written account of the U.S. Army
"Operation Understanding" trip, in which he was privileged
to participate, which was ordered received and filed.
4. New Haven Railroad
The Supervisor called attention to President Kennedy's re-
quest with reference to the government loan to the New
Haven, decision on which was expected tomorrow.
Councilwoman Helwig --
1. Authorization, Summer Recreation Personnel
In accordance with a request of the Recreation Commission
presented and filed herewith, on motion by Councilwoman
Helwig and seconded by Councilman Brush, it was unan-
imously
RESOLVED, that this Board hereby authorizes the
following salary expenditures to the persons listed
below, for the term of employment and at the rate
of compensation specified for each.

2. Opening of Summer Recreation Program
Councilwoman Helwig reported on the opening of the
Summer Recreation Playgrounds - Pre School - Music
and Sailing Instruction Programs.
3. American Legion Booklet
Councilwoman Helwig called to the Board's attention the
American Legion Booklet carrying the Proclamation of
the 300th Anniversary of the Purchase of Mamaroneck.
Councilman Kane
Councilman Kane stated that he had no report at this time.
Councilman Brush --
1. Authorization of Expense
In accordance with the request of the Police Commission
presented and filed herewith, on motion by Councilman
Brush and seconded by Councilman Cook, it was
unanimously
RESOLVED, that this Board hereby authorizes the
expenditure of not to exceed $125. 00 to cover the
expenses of Police Chief Paul A. Yerick while at-
tending the New York State Chiefs of Police Asso-
ciation Conference in Glens Falls, New York,
July 24th - 27th, 1961; said expenses to be paid
from the proper item in the 1961 Police Depart-
', ment budget.
Councilman Cook--
1. Appointment to Planning Board (G. Norman Blair)
Councilman Cook advised the Board that Mr. Blair, whose
term of office as a member of the Planning Board wouldex-
pire on July 6th, was willing to continue to serve and rec-
ommended his reappointment with great pleasure and high
praise of his past service.
Whereupon, on his motion, which was seconded by Coun-
cilman Kane, it was unanimously
RESOLVED, that G. Norman Blair is hereby reap-
-- pointed a member of the Planning Board of the Town
of Mamaroneck, to serve for a term of five years
effective as of July 7th, 1961 and terminating on
July 6th, 1966,
It was directed that Mr. Blair be notified of his reappoint-
ment and the Planning Board also notified to this effect.
2. Apportionments
Councilman Cook presented the following petitions received
from the Assessor for the correction of the assessmentroll
so as to permit the apportionment of taxes, and on his mo-
tion, which was seconded by Councilman.Kane, the following
resolution was adopted unanimously
WHEREAS, the Assessor has presented the following
petitions for the correction of the assessment roll
for:certain years pursuant to the provisions of Sec-
tion 557, Article 16 of the Westchester County Ad-
ministrative Code, known as the Westchester County
Tax Law; and
WHEREAS, after due consideration, this Boardfinds
it desirable to grant said petitions for the correction
of said assessment roll.
NOW, THEREFORE, BE IT

The Town Attorney --
1. Certiorari - Weinraub Property
In connection with the certiorari on the Weinraub property
located on Premium Point, the Attorney recommended
that the services of an expert appraiser be engaged , and
thereupon on motion by Councilman Kane and seconded by
Councilman Brush, it was unanimously
RESOLVED, that this Board hereby authorizes the
Town Attorney to engage the services of an expert
real estate appraiser to appraise the Weinraub
property, located on Premium Point in the Town
of Mamaroneck, at a fee not to exceed the sum of
$300. 00.
2. Dog Control
The Attorney reported that he would attend a conference to
- be held by the Assistant Commissioner of the Bureau of
Agriculture and Markets in Albany on July 17th for the pur-
pose of discussing various questions in connection with the
matter of dog control.
3. Soundview Woods
The Attorney reported that it looked as though negotiations
between the bonding company and the new owners of Sound-
view Woods were about to be concluded providing certain
features of the original subdivision plans were deleted.
He further reported that the plans of the new subdivision
were being prepared and would be submitted to the Plan-
ning Board for approval immediately upon completion.
The Planning Board, he further stated, would meet in
special session as soon as the plans were ready so that
all road improvements could be completed before frost.
Upon query, Mr. Winard, who was present at the meet-
ing and a resident of the area concerned, was assurred
that the street in front of his property would be given
top priority upon the Planning Board's approval of the
plans and the actual beginning of the road improvement
work.
ADJOURNMENT
There being no further business to come before the meeting, it
was declared adjourned at 9=35 p.m. , to reconvene on August
2nd, 1961.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately following the adjournment of the Town Board meet-
ing.
1. Claims
Commissioner Brush presented the following Fire Depart-
ment claims, which had been audited by the Comptroller
and approved by the Fire Chief, and on his motion, which
was seconded by Commissioner Kane, it was unanimously
RESOLVED, that the following claims be and they
hereby are approved, and the Supervisor and
Comptroller be and they hereby are authorized to
pay the same out of the budget for the Fire De-
partment:

2. Reports
Commissioner Brush presented the Fire Department Re-
port for June, 1961, which was ordered received andfiled.

There were no communications to be presented.
4. Other Business
1. Authorization - Publication of Notice for Bids for
Purchase of New Fire Engine
Upon Commissioner Brush's advice that the specifica-
tions for the new fire engine were ready and his re-
quest that the Clerk be authorized to advertise forbids
on same, to be returnable at the next meeting, on his
motion, which was seconded by Councilwoman Helwig,
it was unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to publish in the official newspaper of
the Town of Mamaroneck, The Daily Times, notice
for sealed bids, to be opened and read aloud at the
August 2nd meeting, for furnishing one (1) 1000
GPM s Stage High Pressure Pumping Engine con-
forming with all details set forth in the specifica-
tions therefor.
5. Adjournment
There being no further business to come before the meeting, it
was declared adjourned at 9:45 p.m. , to reconvene August 2nd,
1961.
