CALL TO ORDER The Supervisor called the meeting to order at 5:15 p.m. ROLL CALL Present: Supervisor Burchell Councilwoman Helwig Councilman Kane Councilman Brush Absent. Councilman Cook Also Present: Mr. Gronberg - Town Clerk Mr, Delius - Town Attorney Mr. Orsino - Receiver of Taxes Mr. Kellogg - Town Engineer Mr. Altieri - Town Accountant Mrs. Brewer - Secretary WELCOME TO GIRL SCOUTS The Supervisor, on behalf of the Board, extended cordial greet- ings to a group of 16 Girl Scouts, who were attending the meet- ing as part of a merit badge project together with their Leaders, Mrs. Peter Sullivan, Mrs. David DeSanto and Mrs. Howard Studd, and Mrs. Harry Jackson, Commissioner. PUBLIC HEARING--ADDITION TO GIRL SCOUT HOUSE On motion by Councilman Kane and seconded by Councilman Brush, it was unanimously RESOLVED that the public hearing be and it hereby is declared open. The Clerk then presented the application, the affidavits of publi- cation of the notice of hearing and mailing of copy of same to the County Planning Department, and report of the Planning Board approving the plans for the addition to the Girl Scout House as presented, and suggesting"that the Girl Scout Organization no- tify the police when there would be an excessive number of cars parked at the House, or days when the traffic would be excep- tionally heavy." Whereupon, since in response to the Supervisor's inquiry, there was no one present who wished to be heard, either in favor of or in opposition to the application, on motion by councilman Kane and seconded by Councilman Brush, it was unanimously RESOLVED that the hearing be and it hereby is declared closed. And thereupon, on a motion offered by Councilman Kane and sec- onded by Councilwoman Helwig, the following resolution was adopted unanimously and the Clerk directed to forward certified copies thereof to the applicant and Building Inspector'. WHEREAS, LARCHMONT GIRL SCOUTS, INC. , as owner, has submitted an application and plans for the construction of an extension or alteration to the existing Girl Scout House, which is now on premi- ses known as Block 215, Parcel 1 on the Assess- ment Map of the Town of Mamaroneck, which ex- tension is 32 x 25 feet and is a one-story building; and WHEREAS, said application was denied by the Build- ing Inspector on the grounds that the plans were subject to a special permit to be granted pursuant to Section 432 of the Zoning Ordinance insofar as the proposed building or structure is an extension or ad- dition to a non-conforming use as set forth in Sec- tion 449 of the Zoning Ordinance; and WHEREAS, the applicant has applied to this Board for a special permit as provided in Section 432 of the Zoning Ordinance, and which application this Board has referred to the Planning Board for re- port, which, as received, approves the application; and WHEREAS, a public hearing was duly called before this Board for this meeting pursuant to Section 432 of the Zoning Ordinance; and WHEREAS, the Board has examined the plans and finds that the conditions and standards required by subdivision 43Z. 1, 43Z. Z, 432. 3 and 43204 of the Zoning Ordinance have been met; NOW, THEREFORE, BE IT RESOLVED, that the application of the LARCHMONT GIRL SCOUTS, INC. , is granted, and the Building In- spector is authorized to issue a special permit for the construction of a building or structure covered by the plans filed with him, provided that said application complies in all other respects with the Building Code and Zoning Ordinance of the Town of Mamaroneck; and be it FURTHER RESOLVED, that this permit is granted upon the following condition: That the Girl Scout Organization notify the Police Department of the Town of Mamar- oneck on any occation when there will be an excessive number of cars parked at the Girl Scout House, or days when the traffic will be exceptionally heavy, OLD BUSINESS There was no old business to be presented at this meeting. -- NEW BUSINESS There was no new business to be presented at this meeting. COMMUNICATIONS 1, Letter from Police Commission--Request for Authorization of Expense, Sergeant Smith Upon presentation of the Police Commission's request, on motionby Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the expenditure of a sum not to exceed $85.00, to cover the expenses of Sergeant Chauncey Smith of the Town of Mamaroneck Police Department while at- tending the Tri-State Identification Conference to be held in Groton, Conn„ May 22nd - 24th, 1961, said expenditure to be paid from the proper item in the 1961 Police Department budget, Z. Letter from Recreation Commission--Purchase of Sail Boats Upon Councilwoman Helwig's presentation of a letter from the Recreation Commission, dated May 9th, 1961, request- ing this Board to advertise for bids for the purchase of 6 sail boats to be used for the Sailing Instruction Program in accordance with the resolution set forth in said letter and filed herewith for the record, it was, on her motion, which was seconded by Councilman Brush, unanimously RESOLVED, that in accordance with law, the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for bids for the purchase of 6 sail boats pursuant to specifications prepared by the Superintendent of Recreation and on file in the office of the Town Clerk; said bids to be pub- - licly opened and read aloud at a special meeting of this Board, to be held at 8. 0-0 p.m. on Wednesday evening, May 24th, 1961, in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, 3, Notice of Zoning Board Meeting, Village of Larchmont Upon report by the Attorney, a notice of a meeting of the Zoning Board of Appeals of the Village of Larchmont con- cerning applications which would not affect the Town, was ordered received and filed. REPORTS The Town Clerk The Clerk presented the following reports which were ordered received and filed; Report of the Westchester Shore Humane Society, Inc. for the month of April, 1961. Report of Receipts & Disbursements, Town of Mamaro- neck, for the period from January 1, 1961 through March 31, 1961, Affidavit of Publication of the Annual Report of the Supervisor for the year 1960. The Supervisor -- 1. Authorization of Special Meeting At the Supervisor's request, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that a special meeting of this Board,be held at 8.00 p.m. on Wednesday evening, May 24th, 1961, in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, for the purpose of opening bids for the purchase of six sail boats and considering such other matters as may come before the Board. 2. Absence of Councilman Cook The Supervisor stated that Councilman Cook was combatting a virus infection, and on behalf of the Board, expressed best wishes for a quick and complete recovery. 3. County-owned Surplus Properties Upon the Supervisor's request pursuant to letter addressed to him by Charles E. Pound under date of May 10th, 1961, for the County of Westchester Board of Supervisors' Com- mittee on Budget and Appropriations, which was ordered re- ceived and filed herewith for the record, on motion by Coun- cilwoman Helwig and seconded by Councilman Kane, it was unanimously RESOLVED, that the Supervisor is hereby authorized and directed to present a formal request from this Board to the Budget and Appropriations Committee of the Board of Supervisors, to transfer the following parcels of property, representing so-called surplus County-owned real property located in the Town of Mamaroneck, to the Town of Mamaroneck for the purposes herewith specified as follows: Schedu_leA_ (Property located in the unincorporated area of the Town of Mamaroneck) 1. Parcel A on sheet #8 for use by the Larchmont- Mamaroneck Joint Garbage Disposal Commis- -- Sion in conjunction with the maintenance and operation of the Incinerator located immediately adjacent to this parcel. 2. Parcel D on sheet #8 for joint use of park and recreation development, 3. Parcels H and L on sheet #9-R for joint use of park and recreation development, 4, Parcel I on sheet #9-R for the continuance of its present use as a motor vehicle parking area for New Haven Rialroad commuters, including those residing in the City of New Rochelle, Town of Scarsdale, and City of White Plains, 5, Parcel N on sheet #10 for use as a neighborhood park, which is its present use, and on which the Town has planted shrubbery and trees with the County°s. permission. 6. Parcel GG or sheet #12 for continuation of its present use as a neighborhood garden and park spot at the entrance to the Town from the west. 7. Parcels BB and FF on sheet #12, Parcel HH on sheet #13, Parcels JJ, KK and LL on sheet #14 for future us.e as park and recreation develop- ment and for present open space area. Schedule B_ (Property located in the Village of Mamaroneck within the Town of Mamaroneck) 1. Parcel 0 on sheet #10 for use for flood control, recreation and park facilities. 2. Parcels P and R on sheet #10-A for use for flood control; Parcels T and U on sheet #10-A for use for highway widening purposes and neighborhood playgrounds; Parcel R on sheet #10-A for use for flood control and parking area; Parcel V on sheet #10-A for use for open space and recreationarea; Parcel W on sheet #10-A for use for flood control and parking area; Parcel Z on sheet #10-A for use as a neighborhood park; and Parcel CC on sheet #10-A for use as an open space area and park. 3. Parcels PP and QQ on 1st Map Supplementary to sheets #2 and 3, Westchester County Park Commission, for use to facilitate traffic on ac- -- count of steep grades and for open areas. and be it FURTHER RESOLVED, that the Supervisor also is directed to request this Committee that Parcels B and C on sheet #8 continue to be held by the County pending the development under Town control of ad- jacent privately-owned land until the Town Board notifies the County. and be it FURTHER RESOLVED, that the Supervisor also is directed to request this Committee to transfer to the Town of Mamaroneck for recreational use the building formerly used as a pumping station by the Mamaroneck Valley Sewer District of the County of Westchester and located on property known as Block 504, Parcel 478 on the Tax Assessment Map of the Town of Mamaroneck. 4, Garage Bill The Supervisor informed the Board that the Attorney and he would go to Albany next Tuesday to confer with officials of the State Department of Audit and Control and the Associa- tion of Towns on the reasons for the Governor's veto of this bill. Councilman Brush urged that the Town's urgent need for adequate storage space for its highway equipment be stres- sed, suggesting that perhaps a letter be written to the As- sociation of Towns. The Supervisor advised that the Attorney had already so written, and stated that he would report further to the Board following Tuesday's conferences. - - Councilwoman Helwig -- 1. Thruway Noise Abatement Committee Councilwoman Helwig reported that the Committee had met Friday evening and that Mr. Potter, the _-onsu3t-�ufengaged by the Committee as Consultant, would submit Iris recommenda- tions plus costs, on June 16th. 2, Land and Outdoor Recreation Facility Study Councilwoman Helwig reported that the County survey team has submitted certain tentative recommendations which Dr. Prezioso has presented to the Advisory Committee for its study and consideration preceding the target date for presentation of the final report on September 1st, Councilman Kane -- 1, Apportionment Councilman Kane, in Councilman Cook's absence, presented the following petition, received from the Assessor for the correction of the assessment roll so as to permit the appor- tionment of taxes, and on his motion, which was seconded by Councilman Brush, the following resolution was adopted unanimously WHEREAS, the Assessor has presented the following petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Adminis- trative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petition for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1960, taxes of 1961, which shows property now appearing on the roll as follows; Block Parcel Name Land Imp Total 823 288 Hlamys Holding Corp $ 6, 000 $ 27, 500 $33, 500 be corrected as follows in accordance with the provi- sions of subdivision 5 of Section 557; Block Parcel Name Land Imp Total 823 288 Lillian Siegel 5, 900 27, 500 33, 400 823 1000 Aristodeme J. Claim--Harrison Structural Iron Works Councilman Kane presented the claim of the Harrison Struc- tural Iron Works in the amount of $4, 950,80 for construction of the stairway at the station. A previous payment of the sum of $3, 000,00 on this claim left a balance of $1, 950, 80 to be paid, which, since the work was now completed, he recommended be authorized, At this time and before any authorization for such payment, Councilman Brush stated that he would like to question the paint job, which was peeling badly, and upon the Engineer's confirmation of this condition, authorization for payment of the balance due on this claim was deferred to the next meet- ing pending repair and rectification of the existing paint job, 3. Incident at New Haven Railroad Station In connection with the near tragic accident at the station previously reported by Councilman Kane in some detail, Councilman Kane reported to the Board that a meeting with officials concerned therewith had been held last Saturday in Larchmont, and that while the railroad claimed no negli- gence in the incident, hereafter for a week, a man would be stationed at the station each morning to observe conditions and particularly watch the situation while students were boarding the 8-.10 a.m. train. It was further reported that it had been suggested that the schools be alerted to warn the students of the danger and request their cooperation in safely boarding and alighting from trains. Councilwoman Helwig also reported with reference to a railing in front of the station building, that under Interstate Commerce regulations, no impediment could be erected within a certain number of feet of the tracks which would preclude any guard rail or fence in this instance. C,ouncilman_Brush -- 1. Meeting--U.S. Chamber of Commerce Group Councilman Brush reported that he had attended a meeting of a U. S. Chamber of Commerce group informing them- selves about local government as the representative of this Board. ,In connection with government study, the Supervisor, at this time, called attention to the recent "Go-See" tours conducted for 7th grade students at the municipal offices, Incinerators, and Water Works. The Town Attorney -- 1. Deferment of Payment of Railroad Taxes In the matter of the railroad's request for deferment of pay- ment of taxes in accordance with 1961 legislation, which had been presented at the April 19th meeting and referred to the Attorney, following his report that the other communities af- fected were taking such action and that there seemed little choice in the matter, on motion by Councilman Kane and sec- onded by Countilman Brush, it was unanimously RESOLVED, that this Board hereby authorizes the New York, New Haven and Hartford Railroad Com- pany to postpone payment of the 1961 State, County and Town taxes in the amount of $14, 040,02, (cov- ering property known on the Tax Assessment Map of the Town of Mamaroneck as Block 216, Parcel 783 - $4, 188, 02, Block 603, Parcel 509 - $3, 242, 21, and Block 905, Parcel 303 - $6, 609. 79), due on April 30th, 1961 to December 30th, 1961, at 416 interest, pursuant to Section 9 of Chapter 199 of the Laws of 1961 of the State of New York, OTHER BUSINESS 1, Mr, Arthur Winard (Soundview Woods Subdivision) In response to the Supervisor's inquiry as to whether there was any other business to come before the Board, Mr, Arthur Winard, owner of a house on Ridgeway Road in the unfinished Soundview Woods subdivision, requested the Board to take action in connection with his house as well as other persons on that street, so that certificates of occupancy could be issued. He was followed by Mr. Hyman Pedowitz, attorney for Harold Lane, who urged the Board to cancel the bond to complete the subdivision upon which the Continental Casualty Company is the surety. After some discussion with the Supervisor and the Town Attorney, no action was taken but the matter was postponed until after a conference which is to be held in New York City, on Friday, May 19th, at the office of Andrew Ecker of 120 Broadway. ADJOURNMENT There being no further business to come before the meeting, it was declared adjourned at 9;20 p.m. , to reconvene on June 7th, 1961. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened im- mediately following the adjournment of the Town Board meeting. 1. Claims Commissioner Brush presented the following Fire Department claims, which had been audited by the Comptroller and ap- proved by the Fire Chief, and on his motion, which was sec- onded by Commissioner Kane, it was unanimously RESOLVED, that the following claims be and they hereby are approved, and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the budget for the Fire De- partments American LaFrance $ 15. 22 Chatsworth Oil Co. 75. 94 Con Edison Co. 5. 00 Con Edison Co. 48. 15 G. Communications There were no communications to be presented. 4. Other Business 1. Termites First Deputy Chief Librandi reported that there were termites in the building and that the condition was presently under "spot" treatment. He requested, how- ever, that next year's budget contain an appropriation in accordance with estimate of cost to be submitted for permanent correction of this condition, 5. Memorandum from Town Clerk Pursuant to memorandum addressed to the Supervisor by the Town Clerk under date of May 22nd, 1961, and herewith or- dered received and filed, it was, on motion by Councilman Brush and seconded by Councilwoman Helwig, unanimously RESOLVED, that Councilman Peter F. Kane, Jr, be and he hereby is appointed a member of the Examining Board of Plumbers of the Town of Ma- maroneck, to fill the vacancy created by the res- ignation of former Councilman B. J. Santoro, and to serve for the balance of Councilman Santoro's unexpired term of office, or until December 31st, 1963, Z. Letter from Reuben Sirlin (Soundview Woods) The Clerk presented a letter addressed to the Town Board by Reuben Sirlin as counsel for Investors Collateral in reference to the Soundview Woods property, dated May 24th, 1961, re- questing the Board to defer taking any action on the bond of the bonding company pending report by the Town Attorney and himself, which was ordered received and filed herewith. Following a brief report of negotiations to date by the Super- visor and Attorney and some discussion with two residents of the area, Mr. Winard and Mr. Lane, who were present, the matter was put over to the next meeting for further report at that time. 3. Request of Fire Chief (Attendance of Convention) Upon presentation of a written request from the Fire Chief, ordered received and filed herewith for the record, and on motion by Councilman Brush and seconded by Council- woman Helwig, it was unanimously RESOLVED, that Fire Chief Hans Schmidt and Dep- uty Chiefs Philip Librandi and Anthony Loiaconi are hereby authorized to attend the annual New York State Fire Chief's Convention, to be held in Lido Beach, Long Island, from June 4th to 7th, 1961, with expenses in an amount not to exceed the sum of $300. 00 paid from the item for such purpose in the 1961 Fire Department budget. OTHER MATTERS For the Board's information, the Supervisor reported briefly on the following matters; 1. Acquisition of Thruway access ramp property That the Thruway Authority would be advised, in reply to an inquiry received today, that the Town still desired to acquire the access ramp property bounded by North Chatsworth Avenue, Madison Avenue, Garfield Street, and Jefferson Street, and would wait the Authority's ad- vice as to the next step to be taken in the matter, 2. Amendment of Highway Law (Garage Bill) That the Attorney and he would confer with officials of the State Department of Audit and Control and the Asso- ciation of Towns, with a view toward drafting new legisla- tion amending the Highway Law so as to allow construc- tion of a Town highway garage without charge to villages, which would meet the objections raised to the legislation vetoed this year, 3. Claim for Park District Property That claims amounting to $83, 000,00 had been filed for re- dress for the Park District property taken for the New England Thruway by the Thruway Authority, ADJOURNMENT There being no further business to come before the meeting, it was declared adjourned at 8-25 p.m. Y a 4' To CL k
