Pursuant to Section 62 of the Town Law, I hereby call a special meeting of the Town Board, to be held in the office of the Supervisor, Town of Ma- maroneck Offices, 158 West Boston Post Road, Village of Mamaroneck, New York, at 8:00 p.m. on Monday evening, February 20th, 1961, for the purpose of creating the position of Town Ac- countant of the Town of Mamaroneck and ap- pointing an Accountant. PRESENT: Supervisor Burchell Councilman Santoro Councilman Kane Councilwoman Helwig ABSENT: Councilman Brush ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mrs. Brewer - Secretary CALL TO ORDER The Supervisor called the meeting to order at 8:00 p.m. in accordance with the notice of meeting and waiver of notice hereto appended for the record. He then stated that the meeting had been called for the pur- pose of creating the position of Town Accountant and ap- pointing an Accountant, and inquired as to the Board's pleasure in these matters. Whereupon, on motion by Councilman Santoro and seconded by Councilman Kane, it was unanimously RESOLVED that the Town Board of the Town of Mamaroneck hereby authorizes as of this date, the creation of the posi- tion of Town Accountant in the Town of Mamaroneck. And thereupon, following discussion and review of the applica- tions submitted for this position, on motion by Councilman Kane and seconded by Councilwoman Helwig, it was unanimously RESOLVED that this Board hereby au- thorizes the provisional appointment of Joseph Altieri as Town Accountant of the Town of Mamaroneck, to be effec- tive as of February 23rd, 1961, and to be compensated at the rate of $8, 271. per annum beginning on that date. ADJOURNMENT There being no further business to come before this meeting, it was declared adjourned at 8:30 p.m. T 47 d 11r k 7.9 MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD MARCH 1st, 1961 IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE- HOUSE, WEAVER STREET, TOWN OF MAMARONECK. PRESENT: Supervisor Burchell Councilman Santoro C ouncilman Kane - Councilman Brush Councilwoman Helwig ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr, Delius - Town Attorney Mr. Orsino - Comptroller, Receiver of Taxes Mr, Fischer - Supt, of Highways Mr. Kellogg - Town Engineer CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. WELCOME TO GUESTS Councilwoman Helwig, advising the Board that it was 'host to a — group of distinguished guests this evening, introduced a group of five young persons, who were attending the meeting repre- senting the 8th grade Civic Club of Sts. John and Paul School, and presented Mrs. George Ashley who introduced three young ladies visiting our country from Ghana, Jordan and Finland. The Supervisor cordially welcomed the guests on behalf of all of the members of the Board and spoke briefly on democracy in action as witnessed in this meeting, inviting questions on the proceedings at any time during the conduct of the meeting. APPROVAL OF MINUTES The minutes of the regular meeting of January 18th, 1961 were approved as submitted. OLD BUSINESS There was no old business to come before the meeting. i NEW BUSINESS 1. Authorization for Collection of State, County and Town Taxes Upon the Supervisor's request that the Board authorize the 7 Receiver of Taxes to collect the 1961 State, County and Town taxes in two installments and publish and post the necessary notice therefor, on motion offered by Coun- cilman Santoro and seconded by Councilman Kane, it was unanimously RESOLVED that pursuant to Section 1514 of the Real Property Tax Law, the Receiver of Taxes and As- sessments of the Town of Mamaroneck is authorized to collect the 1961 State, County, Town, and Dis- trict taxes and water rents, which become a lien on January 1, 1961, in two (2) partial payments, each amounting to fifty per cent (5014) of the total of said taxes and water rents; and be it FURTHER RESOLVED that the Receiver of Taxes and Assessments is authorized and empowered to receive such partial payments or installments of taxes and water rents at any time prior to the sale of tax liens but subject to the same penalties as are specified and provided in Section 542 of the West- chester County Administrative Code for the neglect to pay the total amount of said taxes and water rents; and be it FURTHER RESOLVED that the acceptance of any such partial payments or installments of the 1961 taxes and water rents shall not be deemed to affect in any man- ner any right of the Town of Mamaroneck under any general or specific law to enforce collection of any unpaid balance of such taxes and water rents as may remain due and owing to the Town of Mamaroneck, but such rights and powers shall remain in full force and effect to enforce the collection of the unpaidbal- ances of such taxes and water rents together with in- terest, penalties, and other lawful charges, and be it FURTHER RESOLVED that in accordance with the provisions of Section 550 of the Westchester County Administrative Code, "The Daily Times", the official newspaper published in the Village and Town of Ma- maroneck, be and it hereby is designated as the news- paper in which the Receiver of Taxes and Assessments shall publish the "Notice of the Collection of State, County, Town, and District Taxes and Water Rents"; and be it FURTHER RESOLVED that said publication shall be on March 21st, 1961 in The Daily Times and shall be posted thereafter in accordance with law; and be it FURTHER RESOLVED that in accordance with the pro- visions of Section 550 of the Westchester County Ad- ministrative Code, the Town Board does hereby direct the Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge, COMMUNICATIONS 1, Requests for Use of Election Equipment (Villages of Larchmont and Mamaroneck) Upon presentation of a request from the Village of Larch- mont and the Village of Mamaroneck for the use of voting equipment, it was on motion offered by Councilwoman Helwig and seconded by Councilman Brush, unanimously RESOLVED that the request of the Village of Larch- mont and the Village of Mamaroneck for the use of voting equipment for registration and election pur- poses in each village is hereby granted, REPORTS The Clerk presented the following report which was ordered re- ceived and placed on file* Report of the Receiver of Taxes and Assessments for the month of February, 1961. The Supervisor -- 1. Sale of Property (Block 410 - Parcel 38) The Supervisor reported that the Town had received two of- fers to purchase the property located on Winthrop Streetand known as Block 410, Parcel 38 on the Assessment Map, and inquired as to the Board's pleasure in this matter. Following discussion, it was suggested that the property be sold at public auction in accordance with the usual procedure followed by the Town since it was felt that the Town had no need or use for this property, and thereupon, on a motion offered by Councilman Santoro and s.econdedby Councilman Kane, it was unanimously RESOLVED that the Town of Mamaroneck will hold a land auction on the evening of March 15th, 1961, at 8 o'clock, and the Town Clerk is hereby author- ized to publish the following notice thereof in the official newspaper of the Town of Mamaroneck, The Daily Times* Public Notice Please take notice that the Town of Mamar- oneck will hold a land auction in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, at 8*00 o'clock in the even- ing on March 15, 1961 on the following property as described on the Assessment Map of the Town of Mamaroneck. Block 410 - Parcel 38 Minimum Bid - $ 1200 . Detailed description of the above property may be obtained at the office of the Supervisor, 158 West Post Road, Mamaroneck, N.Y. The Town of Mamaroneck reserves the right to reject any and all bids, George D . Burchell Supervisor Dated; March 4, 1961 2, Noise on Thruway The Supervisor reported that a meeting would be held at 10 o'clock on Saturday morning, March 11th, in the Mu- nicipal Building in Larchmont, to discuss the problem of noise caused by trucks on the Thruway. He further stated that this meeting came about as the re- sult of long study of the problem by Larchmont Village Trustee William G. Ball and would be attended by two consultant engineers, who were experts in this field, Senator Meighan, Assemblyman Gioffre, and officials representing all of the municipalities along the New Eng- land Thruway, Councilman Santoro -- 1, Contracts for Highway materials For informational purposes, Councilman Santoro pre- sented a written report from the Superintendent of High- ways, dated February 27th, 1961, listing bids received and contracts awarded for furnishing various materials to the Highway Department, which was received and filed, 2, Snow Removal Councilman Santoro stated that he would defer to the next meeting a report of the cost of snow removal this winter in view of last night's snow and uncertain weather, 3, Garbage Truck Councilman Santoro requested that the Clerk be authorized to advertise for bids on the Garbage Truck to be purchased for the Sanitation Department, to be opened at the next meeting of the Board, and on his motion, which was sec- onded by Councilman Kane, it was unanimously RESOLVED that the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for bids, to be publicly opened and read aloud at a regular meeting of the Town Board in 747 the Council Room of the Weaver Street Fire House, Weaver Street, Town of Mamaroneck, at 8.15 p.m. on March 15th, 1961, for furnishing one (1) Latest Model Loader or Packer type Garbage Truckhaving a gross vehicle weight of not less than 29, 000 pounds and conforming with all other details set forth in the specifications on file in the office of the Town Clerk, 4, Street Lighting Councilman Santoro informed the Board that Council- man Kane, Police Chief Yerick, representatives of the Broadway Maintenance Company, and he spent 3 1/2 hours Monday evening inspecting and studying street lighting throughout the unincorporated area and that a detailed report thereon would be submitted in the very near future, Councilman Kane -- 1, Dog Licenses Councilman Kane again called the matter of dog licenses to the Board's attention, which, with his consent, was deferred pending a memorandum to be presented by the Attorney at the time of his report to the Board. Councilman Brush -- Councilman Brush stated that he had no report at this time. Councilwoman Helwig -- 1, Park Department Truck Councilwoman Helwig requested that bids be obtained, to be returnable at the next meeting, for the purchase of the new Park Department truck, and on her motion, which was sec- onded by Councilman Brush, it was unanimously RESOLVED that the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, a notice for bids, to be publicly opened and read aloud at a regular meeting of the Town Board in the Council Room of the Weaver Street Fire House, Weaver Street, Town of Mamaroneck, at 8;15 p.m, on March 15th, 1961, for furnishing one (1) Latest Model Dump-Body Truck having a gross vehicle weight of not less than 19, 000 pounds and conform- ing with all other details set forth in the specifica- tions on file in the office of the Town Clerk, �4 2, Petition - Preservation of Recreational Areas Councilwoman Helwig presented a petition signed by 10 families having 35 children on Hillcrest and Edgewood Avenues, en- closed in a letter addressed to her by Mrs. William J. Gerety under date of February 24th, which read as follows and which was received and filed. "We, the undersigned, are interested in preserving land for recreational purposes. for example "Rockland Ave Woods - Part of Parking Area near Carls Tavern" for a ball field. The need for safe playgrounds is imperative in this growing community. " In connection with this matter, the Supervisor stated that he and a subcommittee of the Budget Committee of the County Board of Supervisors recently went over all county-owned properties, including those turned back by the Thruway, in the Town and Village of Mamaroneck. He further advised that he had indicated, speaking on behalf of both the Town and Village, that the Town wanted all prop- erties, but that action must wait receipt of specific lots upon which must be indicated proposed use. The Supervisor concluded his remarks by saying that this was a step forward in the Town's efforts to preserve these lands for recreational purposes. The Town Attorney -- 1. Bill--Larchmont-Mamaroneck Joint Incinerator The Town Attorney stated that a letter had been received from Senator Meighan, the introducer of a Bill (Senate Intro 1935, print 2983, which amends the Larchmont-Mamaroneck Joint Incinerator Act (Chapter 430 of the Laws of 1938) making cer- tain changes recommended by the Department of Audit and Control in connection with last year's examination of the In- cinerator Commission. The Bill authorizes the Commission to appoint a Secretary- Treasurer with power to receive and deposit funds and counter- sign checks, and permits the Commission to require a bond for the faithful performance of his duties and there are other minor changes regarding the fiscal year and the preparation of the an- nual account or statement. The Town Attorney stated that Senator Meighan's letter re- quested a Home Rule Message from the Village of Larchmont and the Town of Mamaroneck, and while Home Rule would not apply to towns in this State, he recommended that this Board adopt a resolution requesting the passage of this Bill and its signature by the Governor. Whereupon, on motion of Councilman Kane, seconded by Coun- cilman Brush, the following resolution was adopted. WHEREAS, Senator Meighan has introduced a Bill, known as Senate Intro, 1935, Print 2983, (Com- panion Bill, Assembly Intro, 2828, Print 2937, Gioffrej amending certain sections of Chapter 430 of the Laws of 1938 in connection with the Larch- mont-Town of Mamaroneck Joint Incinerator Com- mission; and WHEREAS, it is deemed desirable for the Townof Mamaroneck to secure the passage of such amend- ment; NOW, THEREFORE, BE IT RESOLVED, that this Board approves the Bill known as Senate Intro, 1935, Print 2983, and the Companion Bill,=known as Assembly Intro. 2828, Print 2937, introduced in the Assembly by Assem- blyman Gioffre; and it is FURTHER RESOLVED, that this Board urges and requests Senator Meighan and Assemblyman Gioffre to use all honorable means to secure the passage of this Bill so that the same may be enacted into law; and it is FURTHER RESOLVED, that the Board, acting for the Town of Mamaroneck, hereby consents to and requests the Governor to approve and sign this Bill so that it may become law; and it is FURTHER RESOLVED, that the Clerk send certi- fied copies of this resolution to Senator Meighan and Assemblyman Gioffre and to the Governor or his Secretary, as requested, 2. Notice from City of New Rochelle The Attorney presented a notice of hearing on amendments to the Zoning Ordinance of the City of New Rochelle, which had been referred to him and which was ordered received and filed, 3, Memorandum--Dog Licensing and Control The Attorney presented a written memorandum , dated Feb- ruary 27th, 1961, defining the provisions of the state and local laws for licensing and controlling dogs, reviewing the present situation, and describing five bills presently before --- the legislature, which the Board ordered received and filed. Following a lengthy discussion, the Supervisor stated that the Attorney, the two Judges, the Police Chief, the Presi- dent of the Humane Society, and he would meet to discuss bringing the local ordinances up to date following the close of the legislative session and disposition of pending bills. 7.N.1 2. Amendment of Education Law (Library Contracts) With reference to the proposed amendment of the Educa- tion Law in relation to appropriations for library con- tracts submitted to the Board by the Board of Trustees of the Village of Larchmont, the Supervisor and Attorney re- ported that the revisions proposed by the Town would be considered further at the time the bill was redrafted for presentation at the next session of the legislature, QUESTION PERIOD There followed at this time a question-and-answer period for the guests present at this evening's meeting, and the Clerk was directed to forward a copy of the minutes and memoran- dum presented by the Attorney to Miss Margaret McCarthy. ADJOURNMENT There being no further business to come before the meeting, it was declared adjourned at 9.10 p.m. , to reconvene on March 15th, 1961. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1, Claims Commissioner Brush presented the following Fire Depart- ment claims, which had been audited by the Comptroller and approved by the Fire Chief, and on his motion, which was seconded by Commissioner Helwig, it was unanimously RESOLVED that the following claims be and they hereby are approved and the Supervisor and Comptroller be and they hereby are authorized to pay the same out of the budget for the Fire Department. Communications 1, Election of Officers Commissioner Brush presented a letter from the Fire Department, dated February 20th, 1961, re- questing approval of the election of officers for the year 1961, and on his motion, which was sec- onded by Commissioner Santoro, it was unani- mously RESOLVED that this Commission hereby approves the election of the following of- ficers for the Town of Mamaroneck Fire Department for the year 19610 Hans Schmidt, Chief Philip V. Librandi, First Deputy Chief Anthony Loiaconi, Second Deputy Chief Arthur M. Brown, Secretary Leonard W. Ericson, Financial Secretary Augustus R. Other Matters 1, Change of Classification (Civil Service) Fire Truck Driver to Fireman The Supervisor advised the Commission that the Civil Service Classification "Fire Truck Driver" had been changed to "Fireman", following public hearing before the County Personnel Department, 2, Appointment of Fire Inspector Upon Commissioner Brush's request that the newly- appointed Fire Chief be appointed Fire Inspector of the Town of Mamaroneck for the.year 1961 in accordance with the recommendation of the Fire Council, on mo- tion by him and seconded by Commissioner Santoro, it was unanimously - RESOLVED that Fire Chief Hans Schmidt be and he hereby is appointed Fire Inspector of the Town of Mamaroneck Fire Department for the year 1961, to be compensated at the rate of $960. 00 per annum. 7.;7 3. Bids for Purchase of Fire Whistle and Control Cabinet Commissioner Brush informed the Commission that the Clerk was advertising for bids for the Fire Whistle and Control Cabinet to be opened at the March 15th meeting as authorized at the last meeting of the Board, 4, Adjournment There being no further business to come before the meeting, it was declared adjourned at 9=20 p.m., to reconvene on March 15th, 1961, Tow Cl k
