THE TOWN OF MAMARONECK, HELD JANUARY 18th, 1961, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE,
WEAVER STREET, TOWN OF MAMARONECK.

CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.
TRIBUTE TO MAURICE FRIEDLANDER
The Supervisor, before proceeding with the regular order of bus-
iness, cordially welcomed Mr. and Mrs. Maurice Friedlander on
behalf of the Town's entire staff. He explained that this was the
Board's first opportunity to pay Mr. Friedlander, who had re-
tired as the Town Engineer and Superintendent of Highways on De-
cember 31st, the tribute he so richly deserved and stated that
this meeting of the Town Board convened this evening in honor of
Maurice Friedlander.
In greeting Mr. Friedlander, the Supervisor stated that he had
come to the Town five years ago in its hour of need on the thres-
hold of the construction of the New England Thruway and that
through his engineering knowledge and long background of work
with State and County officials, he had succeeded in making the
impact of that construction on this community considerably less
than it might have been.
Although Mr. Friedlander came to us a'complete stranger only
five years ago, the Supervisor continued, he has contributed more
to the Town than many who have lived here for many years and
endeared himself not only to the official family and your fellow
employees but to every resident of the Town.
Following the Supervisor's tribute, Councilman Santoro, who
was perhaps Mr. Friedlander's closest associate , presented to
him and Omega watch given to him by the officials, his fellow
employees and his associates in the Town government in appre-
ciation of his service.
.Supervisor Burchell then, remarking that "behind the good work
of every man there is a good woman", called Mrs. Friedlander
to the Council table and presented her an orchid with the Town's
sincere thanks and appreciation for her patience and under-
standing whenever her husband's services were needed,
Mrs. Friedlander expressed her heart-felt thanks to the Super-
visor, the Councilmen, and all with whom her husband had ser-
ved, and Mr. Friedlander his along with his congratulations and
best wishes to his successor, Fred F. Kellogg, Jr„ following
which the Supervisor read a resolution, offered on motion by
Councilman Santoro, seconded by Councilman Brush and unani-
mously adopted as follows.
WHEREAS , Maurice Friedlander retired as the
Town Engineer and Superintendent of Highways of
the Town of Mamaroneck on December 31st, 1960;
and
WHEREAS , Mr, Friedlander, a dedicated and
devoted public servant, served the Town both as its
Engineer and Superintendent of Highways over a
period of years;
and
W H E R E A S s during his entire term of office, he
was a loyal, reliable and most competent official,
thoughtful of the welfare of the Town and all of its
residents at all times;
and
WHEREAS , he was untiring in the performance
of his duties and in his efforts on behalf of the
Town, most particularly using his knowledge and
ability in furthering and promoting the best in-
terests of the Town;
NOW, TH-EREFORE,,, BE IT
RESOLVED that the Town of Mamaroneck here-
by expresses its deep regret at the termination of
his service and the loss of an official held in high
esteem and greatly respected by all who served
with him, and its sincere and grateful apprecia-
tion of his able and faithful service to this com-
munity.

FURTHER RESOLVED that a copy of this
resolution be forwarded to Mr. Friedlander and
- spread upon the minutes of this meeting,

PUBLIC HEARING--Application of Wilder Transportation, Inc,
On motion by Councilman Brush and seconded by Councilman
Kane, it was unanimously
RESOLVED that the hearing be and it is declared
open.
Following presentation of the affidavit of publication of the notice
of hearing for the record, the Attorney briefly reviewed the ap-
plication explaining that Wilder was applying for the Town's con-
sent to operate a bus line on the Boston Post Road through the
unincorporated section of the Town as a part of the route from
Port Chester to LaGuardia and Idlewild Airports, with no stops
in the Town,
The Supervisor inquired whether anyone wished to address the
Board in connection with this application, whereupon the follow-
ing persons were heard:
Mr, Edward Leon --
Mr, Leon, operator of Leon's Taxi, Westchester Limousine
Service and Larchmont Rapid Taxi, requested that the mat-
ter be tabled until acted upon by the two villages, in each
of which stops were scheduled and which had reserved de-
cision on the application,
Mr, Roy Callahan --
Mr. Callahan, president of Round Hill Bus Company which
was presently taking over the Wilder operation, stated that
Wilder had been granted a temporary permit by the Public
Service Commission which enabled the line to operate for
six months. This permit, he explained, was granted sub-
ject to the company obtaining a consent to operate from
each municipality through which the route passed prior to
the granting of permanent franchise by the Public Service
Commission and he therefore requested the Board's favor-
able consideration of this application.
Following a lengthy discussion, the Board, with the exception of
Councilman Kane, felt that decision on the application should be
reserved since this would not affect the petitioner in any way.
It was Councilman Kane's feeling, however, that there was no
reason to reserve decision since there were no stops in the un-
incorporated area and passage through the Town could not be
denied as Wilder had already been issued a temporary permit.
Whereupon, on motion by Councilman Brush and seconded by
Councilman Santoro, it was
RESOLVEDthat decision on the application of
Wilder Transportation, Inc, be and it hereby
- - is reserved.
The vote, upon roll call, on the foregoing resolution was as
follows.

Councilwoman Helwig -- Absent (no vote
Councilman Kane requested that the reason for his "no" vote
as stated hereabove be recorded in the minutes of this meeting,
OLD BUSINESS
1, Mrs, Marguerite Kean--Water Condition on Property
Mrs, Kean, who had requested an audience at this meeting, ad-
dressed the Board with reference to her letter of December 14,
1960, addressed to this Board, concerning water conditions on
her property, "Willow Acres", located at 30 Pryer Manor Road,
which had been referred to the Town Engineer for study and re-
port,
The Engineer presented a written report addressed to the Su-
pervisor under date of January 16th, which was ordered re-
ceived and filed, and following discussion during which Mrs.
Kean advised that this matter was also before the Village of
Larchmont Board of Trustees, it was put over pending further
study by the Engineers of the two municipalities upon receipt of
a report to be submitted by professional engineers engaged by
Mrs, Kean,
NEW BUSINESS
1, Annual Meeting of Association of Towns
(Authorization for Attendance)
The Clerk presented a notice of the Annual Meeting of the As-
sociation of Towns of the State of New York, to be held in
Buffalo, New York, February 6th - 8th, 1961, and requesting
designation by resolution of the Town's voting delegate and
alternate at this meeting.
Whereupon, on motion by Councilman Santoro and secondedby
Councilman Kane, it was unanimously
RESOLVED that Supervisor Burchell, Councilmen Kane,
Brush, Santoro, Helwig, Town Attorney Delius and Lt.
Waterbury of the Police Department, be and they here-
by are authorized to attend the Annual Meeting of theAs-
sociation of Towns of the State of New York, to be held
in Buffalo, New York, February 6th - 8th, 1961;
and be it
FURTHER RESOLVED that Town Attorney Delius be
designated delegate of the Town of Mamaroneck for the
purpose of voting and Councilwoman Christine K. Hel-
wig be designated alternate;
and be it
FURTHER RESOLVED that the Comptroller be and he
hereby is authorized to audit their claims for expenses,
said expenses to be paid from the proper items in
the 1961 budget,
Z. Authorization of Rates for Private Equipment Rental
(Highway Department)
Councilman Santoro presented a memorandum from the Super-
intendent of Highways, dated January 10, 1961, requesting au-
thorization of the rates for private equipment rental listed
therein, and on his motion, which was seconded by Councilman
Kane, it was unanimously
RESOLVED that pursuant to Section 143 of the Highway
Law and as fixed by the New York State Department of
Public Works and listed as County Rates on January 2,
1957, this Board hereby authorizes the following max-
imum rates for the rental of privately-owned equipment.

COMMUNICATIONS
1. Invitation--United States Army Air Defense Command
The Clerk presented an invitation extended to the Supervisor
and all officials of the Town by Brigadier General J. H. Daly;;
Commanding General of the 52D Artillery Brigade (Air De-
femse), to attend the opening of "Nike Goes to School' on
Monday, January 23rd, in the auditorium of the Mamaroneck
Junior High School.
The Clerk further advised that a copy of this letter had been
forwarded to all members of the Board and all officials and
that tickets were available to all who wished to attend this
performance.
COMMUNICATIONS (Not on Agenda)
- -- 1. Letter from State Board of Equalization and Assessment
The Clerk presented a letter from Arthur L. Bergren, Director
of Equalization of the State Board of Equalization and Assess-
ment, advising that a conference was scheduled to be held by
that Board with Town and Village Assessors re 1959 Survey at
the Town of Mamaroneck Offices on Tuesday, January 31st, at
10.00 o'clock a.m.

REPORTS
Town Clerk --
The Clerk presented the following reports which were ordered
received and filed;
Annual Report of the Building Inspector for the year 1960.
Report of the Westchester Shore Humane Society for the
month of December, 1960,
Report of Examination of the Accounts and Fiscal affairs
of the Town of Mamaroneck for the period from January 1,
1957 to December 31, 1959 by the State of New York De-
partment of Audit and Control, (This report also included
the Police Pension Fund,
Supervisor Burchell --
1, Comptroller Position
The Supervisor stated that the Board was interviewing ap-
plicants for Mr. Finson's position at this time but had
reached no decision as of this date,
Councilman Santoro --
- 1, Purchase of Town Car
Upon Councilman Santoro's request that the Clerk be authorized
to advertise for bids for the purchase of a Town car as provided
for in the 1961 budget and on his motion, which was seconded by
Councilman Kane, it was unanimously
RESOLVED that in accordance with law, the Town Clerk
be and he hereby is authorized to publish in the official
newspaper of the Town of Mamaroneck, The Daily Times,
a notice for sealed bids to be opened at the regular meet-
ing of this Board on February 1st, 1961, for furnishingto
the Town of Mamaroneck one (1) 2-door compact passen-
ger car in accordance with the specifications therefor and
available at the office of the Town Clerk,
2. Highway Department
Councilman Santoro spoke of the excellent functioning of the High-
way Department during the recent snows and freezing weather
conditions and commended the Superintendent, Mr. Fischer, on
his handling of the department and its staff.
3. Soundview Woods, Inc.
Councilman Santoro reported that construction on the culvert

under York Road in Soundview Woods would resume as soon
as weather conditions permitted. He further advised that
Mr. Kellogg, the Town Engineer, would make periodic in-
spections of this construction until its completion.
Councilman Kane --
1. Appointment of Architectural Board of Review
Councilman Kane with great pleasure recommended the ap-
pointment of Messrs. A. G. Bogardus, C. Woodford Dayton,
and Paul Gifford Lips as members of the Architectural Board
of Review of the Town of Mamaroneck in accordance with the
provisions of the new Zoning Ordinance, and following his
presentation of a short resume of the qualifications of each of
these gentlemen, on motion offered by him and seconded by
Councilman Brush, it was unanimously
RESOLVED that the following persons be and they
hereby are appointed members of the Architectural
Board of Review of the Town of Mamaroneck, to
serve at the pleasure of the Board;

C. Woodford Dayton 1Z Lafayette Road Town
Paul Gifford Lips Z9 Briarcliff Road Town
The Board directed the Clerk to notify each of these persons
of his appointment, welcoming him to the Town's official
family and expressing the Board's appreciation of his willing-
ness to so serve the Town.
Z. Transportation (Commuters)
In view of the New Haven Railroad strike, Councilman Kane
at this time suggested that this Board alert all radio stations
of the bus, taxi and private car arrangements made to trans-
port commuters to and from the city during the strike.
The Board unanimously agreed with this suggestion and re-
quested Councilmen Kane and Brush to handle this matter.
Councilman Brush --
No report other than fire matters.
Councilwoman Helwig --
The Supervisor explained that Councilwoman Helwig was ab-
sent due to illness and stated there was no report this even-
ing on her departments.
The Board conveyed its best wishes to her for a fast recovery.

The Town Attorney --
1, Authorization--New York State Bar Association Annual Meeting
The Attorney requested authorization to attend the annual
meeting of the municipal section of the New York State
Bar Association at the Town's expense, and thereupon, on
motion by Councilman Kane and seconded by Councilman
Brush, it was unanimously
RESOLVED that the Town Attorney be and he hereby
is authorized to attend the annual meeting of the mu-
nicipal section of the New York State Bar Associa-
tion, to be held in New York City on January 26th,
27th, and 28th, 1961, and that his expenses for at-
tending such meeting be paid out of the item in the
1961 budget for traveling expenses.
2. Appraisal--50-foot Town-owned strip of Property on Bonnie Way
The Attorney reported that an expert appraisor had been en-
gaged to appraise the Town-owned 50-foot strip of property
at the foot of Bonnie Way in accordance with resolution of
this Board and that he would report thereon at the nextmeet-
ing of the Board.
OTHER BUSINESS
1. Commendation of Mrs. Ruth Dammann
The Supervisor and members of the Board took this occasion to
commend publicly Mrs. Ruth Dammann, who had worked with
Mr. Finson, the Comptroller, and who was present at this
meeting, on the excellent job she was doing in carrying-on dur-
ing this period following Mr. Finson's sudden and tragic death
on December 26th.
ADJOURNMENT
There being no further business to come before the meeting, it was
declared adjourned in honor of Maurice Friedlander, retired Town
Engineer, at 9:15 p.m. , to reconvene on February 1st, 1961,
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened im-
mediately following the adjournment of the Town Board meeting.
1. Communications
-- Commissioner Brush presented a letter from the Fire Department
under date of January 16th, 1961, requesting approval of
the officers named therein for 1961, and thereupon on mo-
tion offered by him and seconded by Councilman Kane, it
was unanimously
RESOLVED that this Commission hereby approves
the election of the following members of the Town
of Mamaroneck Fire Department to the following
offices for the year 1961;

Commissioner Brush presented the Report of Examination
of the Accounts and Fiscal Affairs of the Fire District No,
1 of the Town of Mamaroneck covering the period from
January 1, 1957 to December 31, 1959, as submitted by
the State of New York Department of Audit and Control,
which was ordered received and placed on file,
3, Claims
Commissioner Brush presented the following Fire Depart-
ment claims, which had been audited by the Comptroller
and approved by the Fire Chief, and on motion by him and
seconded by Commissioner Kane, it was unanimously
RESOLVED that the following claims be and they
hereby are approved and the Supervisor and
Comptroller be and they hereby are authorized
to pay the same out of the budget for the Fire De-
partment.

4. Other Business
1. Larchmont Acres--False Alarms
In connection with the matter of the occurrence of false
alarms on the Larchmont Acres Apartment premises,
which has long been before the Commission, Commis-
sioner Brush reported that the Fire Council and the
Larchmont Acres Tenants Association had agreed to
recommend that all boxes be eliminated and he re-
quested that the Commission authorize the Town At-
torney to write the owner of the premises, Mr. S.
Goldstein, advising him of this action and requesting
the disconnection of all boxes.
Whereupon on motion offered by him and seconded by
Commissioner Santoro, it was unanimously
RESOLVED that the Town Attorney be and he
hereby is authorized to write to S. Goldstein,
President of the Sixty-Third Realty Corp. , as
owner and manager of the Larchmont Acres
Apartments premises, requesting the discon-
nection of all fire boxes in all buildings on the
said premises in accordance with the recom-
mendation of the Town of Mamaroneck Fire
Council and the Larchmont Acres Tenants
Association.
5. Adjournment
There being no further business to come before this meeting,
it was declared adjourned at 9.25 p.m. , to reconvene on
February 1st, 1961.
