THE TOWN OF MAMARONECK, HELD NOVEMBER 15th, 1961,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.

The Supervisor called the meeting to order at 8.15 p.m.

APPROVAL OF MINUTES
On motion duly made and seconded, the minutes of the regular
meeting of September 5th, 1961 were approved as submitted,
PRESENTATION OF PRELIMINARY BUDGET, 1962
The Supervisor presented the preliminary budget for 1962,
prepared by the Board from the requisitions submitted by
each department, together with a transmittal letter ex-
plaining in some detail the recommendations contained
therein.
Whereupon, following discussion, on motion by Councilman
Brush and seconded by Councilwoman Helwig, it was unani-
mously
RESOLVED, that this Town Board does hereby pre-
pare and approve as the preliminary budget of this
Town for the fiscal year beginning on the 1st day of
January, 1962, the itemized statement of estimated
revenues and expenditures hereto attached andmade
a part of this resolution;
and be it

FURTHER RESOLVED, that such preliminary budget
shall be filed in the office of the Town Clerk, where
it shall be available for inspection by any interested
person at all reasonable hours;
and be it
FURTHER RESOLVED, that this Board shall meet
at 8;15 p.m. on the 6th day of December, 1961, for
the purpose of holding a public hearing upon such
--- preliminary budget;
and be it
FURTHER RESOLVED, that the Town Clerk give
notice of such public hearing in the manner provided
in Section 113 of the Town Law, and that such notice
be published and posted in substantially the following
form:
Public Notice
Notice is hereby given, that the Prelim-
inary Budget of the Town of Mamaroneck, New York,
consisting of the estimated revenues and expenditures
for the year 1962, has been completed and filed inthe
office of the Town Clerk of said Town, where the
same may be examined by any person interested
therein, and that a public hearing thereon will beheld
by and before the Town Board of said Town on Wed-
nesday, December 6th, 1961, at 8.15 p.m. in the
Council Room of the Weaver Street Firehouse, Wea-
ver Street, Town of Mamaroneck, New York, at
which time and place all those who appear and are in-
terested will be given an opportunity to be heardwith
respect to said Preliminary Budget or any part or
item thereof.
Please take further notice that the pro-
posed salaries of the members of the Town Board
are as follows: Supervisor - $7500. , Town Council-
men (4) - $2400, each: that the proposed salary of
the Town Clerk is $8471. ; that the proposed salary
of the Town Superintendent of Highways is $8250, :
that the proposed salary of the Town Attorney is
$9011. : that the proposed salary of the Town En-
gineer is $8800. : and that the Preliminary Budget
is as follows:

FURTHER RESOLVED, that such notice shall be pub-
lished twice in the following newspaper having general
circulation within the Town: The Mamaroneck Daily
Times, the first publication to be on or before the 25th
day of November, 1961, and the second publication on
any day subsequent thereto and before the day of such
hearing,
a) Resolution Deleting "Publicity Fund" Item
Since there was no "Publicity Fund" item included in the
1962 budget and the Attorney advised that deletion of
same was subject to permissive referendum, on motion
by Councilman Kane and seconded by Councilman Brush,
it was unanimously
RESOLVED, that the appropriation for the "Pub-
licity Fund" pursuant to Section 64, subdivision 14
of the Town Law, be and it hereby is deleted from
the 1962 budget;
and be it
FURTHER RESOLVED, that this resolution is
adopted subject to permissive referendum in accor-
dance with Town Law;
and be it
FURTHER RESOLVED, that in accordance with law,
the Clerk be and he hereby is authorized to publish
in the official newspaper of the Town of Mamaroneck,
The Daily Times, notice of the adoption of the fore-
going resolution, subject to permissive referendum
in accordance with Town Law,
OLD BUSINESS
1. Report - Larchmont Acres and Larchmont Gardens
The Clerk presented a written report submitted by the En-
gineer and Building Inspector under today's date stating that
the violations had been corrected at Larchmont Acres and
that progress was being made at Larchmont Gardens but
required constant checking, which was ordered received and
filed.
The Board directed the Building Inspector and Engineer to
continue their inspections and report thereon at each meet-
ing of the Board.
NEW BUSINESS (Not on Agenda)
1. Petition - (Laurel Avenue Area)
The Clerk presented a petition, signed by residents of the
area bordered by Laurel Avenue, Thompson Street, Cabot
Road and Myrtle Boulevard, requesting that an open ditch
be enclosed, and that two street lights and a fire hydrant
be installed in this area, which was ordered received and
filed herewith.
The Clerk also presented a memorandum from the En-
gineer submitting an approximate cost estimate of $8, 300.
for the requested ditch enclosure, recommending referral
of the request for street lights to the Superintendent of
Highways and Police Chief, and recommending that a fire
hydrant to be removed from Bruce Road, where it was not
needed, be installed in this area as requested.
Whereupon, following discussion and in accordance with
the recommendation of the Fire Chief and Engineer, on
motion by Councilman Cook, seconded by Councilman
Brush, it was unanimously
RESOLVED, that the removal of fire hydrant No. 2262
presently located at the end of Bruce Road and instal-
lation of said hydrant at the end of the paved area of
Laurel Avenue, as shown on map prepared by the En-
gineer and filed herewith, at a cost not to exceed the
sum of $200. 00, is hereby authorized.
2. Mrs. Ruth Green --
Mrs. Green, whom the Supervisor recognized at this time, ad-
dressed the Board speaking as a resident of the community, to
suggest that the Town give consideration to planting trees in
memory of the late Rod and Lottie Dillon, who for almost a
life-time, had served our community so devotedly and so well.
The Board, following discussion, expressed its sincere appre-
ciation to Mrs. Green for her suggestion, and requested Coun-
cilwoman Helwig, Council liaison to the Park Commission, to
convey the suggestion to that body for its study and consider-
ation.
3. Mr. Leonard Liptonand Mr. Robert Allensworth
Mr. Lipton and Mr. Allensworth, members of the Sailing
Instruction Program, whom Councilwoman Helwig presented
to the Board, expressed the group's appreciation of this pro-
gram and requested that additional equipment necessary for
advanced sailing be provided for next year's program.
The Supervisor, replying for the Board, thanked the boys
for coming to the meeting and for their courteous presenta-
tion, and requested that they submit this request to the Rec-
reation Commission for its consideration at their earliest
convenience.
4. Mr. Harold Bozell
Mr. Bozell, Chairman of the Traffic Commission of the Vil-
lage of Larchmont, whom the Supervisor recognized at this
time, presented a lengthy written memorandum regarding
salaries for the Supervisor and Councilmen, which, follow-
ing discussion, was ordered received and filed.
COMMUNICATIONS
. Letter from New York Fire Insurance Rating Organization
The Clerk presented a letter from Mr. Donald Herbstman,
Public Protection Department of the New York Fire Insur-
ance Rating Organization, dated October 30th, 1961, ad-
vising that the requested complete reinspection of the Town
of Mamaroneck would be made as soon as a definite date
could be set, which was ordered received and filed.
2. Snow Removal - County Roads
The Clerk presented an agreement with the County for snow
removal on County roads in the Town for the 1961-1962
season at a flat rate of $200. 00 per mile, and requested
that the Supervisor be authorized to sign the said agreement
if such were the pleasure of the Board.
Whereupon, on motion by Councilman Kane and seconded by
Councilman Brush, it was unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized to sign the agreement with the County of
Westchester for the removal of snow and ice on
County roads within the unincorporated area of the
Town of Mamaroneck at a flat rate of $200. 00 per
mile for the 1961-1962 winter season.
3. Notice of Public Hearing - Board of Trustees, Village of Mamaroneck
The Clerk presented a notice of hearing before the Board of Trus-
tees of the Village of Mamaroneck on November 27th, 1961, to
consider further amendment of the Zoning Ordinance of the Vil-
lage of Mamaroneck, which was referred to the Town Attorney.
4. Notice of Hearing - Board of Trustees
Village of Larchmont
The Clerk presented a notice of public hearing before the Board
of Trustees of the Village-of Larchmont on November 20th, 1961
to consider applications for sign variances, which was referred
to the Town Attorney.

The Clerk presented the following reports which were ordered
received and filed*
Report of the Town Clerk for the month of October, 1961,
Report of the Westchester Shore Humane Society for the
month of October, 1961.
Report of the Building Inspector for the month of October,
1961.
The Supervisor --
The Supervisor stated that he had no report at this time.
Councilwoman Helwig --
1. 300th Anniversary Committee - Mosier Safe File
In accordance with Councilwoman Helwig's request for the
Board's advice regarding donation of a Mosier Safe File to
the Town by the 300th Anniversary Committee for the safe
storing and preservation of valuable old records and docu-
ments, on motion by her and seconded by Councilman
Brush, it was unanimously
RESOLVED, that this Board accepts with thanks the
donation of a Mosier Safe File by the 300th Anniver-
sary Committee for the safe storing and preserva-
tion of valuable old records and documents pertaining
to the Town of Mamaroneck, subject to the approval
of the Town Clerk.
2. Showing of 300th Anniversary Celebration Slides
Councilwoman Helwig announced the showing of 300th Anniver-
sary slides, obtainable if desired, at the Mamaroneck Junior
High School on December '2nd, 1961.
She also mentioned that there were Journals still available -
in connection with which Councilman Brush suggested that
there be a display and sale on the evening of the showing,
3, Proclamation - Adult Education Day
In accord with a request from Robert E. White, former mem-
ber of the Board of Education and Chairman of this year's an-
nual Community Institute, on motion by Councilwoman Helwig
and seconded by Councilman Brush, the following resolution
was adopted unanimously.
WHEREAS, the annual Community Institute, to be held
this year on November 29th at the Mamaroneck Junior
High School, will be devoted to the subject of adult
education in this community;
NOW, THEREFORE, BE IT
RESOLVED, that this Board hereby proclaims and de-
clares Wednesday, the 29th day of November in the
year 1961, as Adult Education Day in the
Town of Mamaroneck, and urges all residents to at-
tend the Community Institute to be held that evening
at the Mamaroneck Junior High School,
4, Tour - County Lands
Councilwoman Helwig announced that a second conducted tour
of a portion of the Gross County Parkway lands will be spon-
sored by the Mamaroneck-Larchmont Junior Chamber of
Commerce on Saturday, November 18th, by Gordon P. Reif-
snider, Projects Chairman, She further stated that all in-
terested citizens were invited to meet at 2 p.m. in the lot
next to Carl's Restaurant on Myrtle Boulevard, where cars
may be parked, and that if it rained on Saturday, the tour
would take place at the same time on Sunday,
Councilman Kane --
1. Weinraub Certiorari Proceedings
Following report by Barney Epstein, expert real estate ap-
praiser engaged by this Board by resolution on July 5th,
1961, to appraise the Weinraub property on Premium Point
in connection with the certiorari proceedings pending there-
on, and in accordance with the Town Attorney's recommen-
dation that said proceedings be settled at $60, 000. , on mo-
tion by Councilman Kane and seconded by Councilman Brush,
the following resolution, upon a roll call vote, was adopted
unanimously:
WHEREAS, heretofore writs of certiorari were ob-
tained by Israel Weinraub, owner of property known
and described as Block 510, Parcel 100 on the Tax
Assessment Map and Assessment Roll of the Town
of Mamaroneck for the following years. 1955 for
taxes of 1956, 1956 for taxes of 1957, 1957 for
taxes of 1958, 1958 for taxes of 1959, 1959 for
taxes of 1960, 1960 for taxes of 1961, and 1961 for
taxes of 1962;
and
WHEREAS, the Town Attorney recommends to this
Board that the proceedings be settled and discon-
tinued upon the reduction of certain of these assess-
ments:
NOW, THEREFORE, BE IT
RESOLVED, that the assessments:. for the years 1955
for taxes of 1956, 1956 for taxes of 1957, 1957 for
taxes of 1958, 1958 for taxes of 1959, 1959 for taxes
of 1960, 1960 for taxes of 1961, and 1961 for taxes
of 1962 upon property owned by Israel Weinraub and
described upon the Assessment Map and Assessment
Roll of the Town of Mamaroneck as Block 510, Par-

provided the certiorari proceedings now pending in the
name of Israel Weinraub for the years 1955 for taxes
of 1956 through 1961 for taxes of 1962 inclusive, be
discontinued without costs as against either party;
and be it
FURTHER RESOLVED, that all refunds of taxes due
by reason of such reductions be paid without interest;
and be it
FURTHER RESOLVED, that the Town Attorney is
hereby authorized and directed to sign the necessary
stipulations to obtain an order of the Supreme Court
providing for such reductions,
Z. Award for Property (Thruway)
Councilman Kane, in the Attorney's absence, presented cer-
tain papers forwarded to the Attorney by the State of New
York, Department of Law (Real Property Bureau) in connec-
tion with the $2, 000. 00 award for certain property taken by
the New York State Thruway, New England Section, and re-
quested that the Supervisor be authorized to execute and re-
turn same in accordance with the Attorney's direction.
Whereupon, on his motion which was seconded by Council-
woman Helwig, it was unanimously
RESOLVED, that the Supervisor be and he hereby is
authorized and directed to sign the release, the af-
fidavit of title and the voucher in triplicate, for the
payment of the award made by the New York State
Thruway, New England Section, for parcel 1052,
map 1052, and forward these documents to the At-
torm ey General of the State.
Councilman Brush --
Councilman Brush stated that he had no report at this time.
Councilman Cook --
Councilman Cook stated that he had no report to present.
The Town Attorney
The Supervisor advised that the Attorney was absent due to
illness - but was on the mend and hoped to be back in his
office very soon.
OTHER BUSINESS
1. Mrs, John Devlin --
Mrs. Devlin inquired the Supervisor's position on the County
Board with regard to the Sewerage Disposal Plant, and was
advised by the Supervisor that he would take no definite po-
sition until all reports from the County were in for study -
but that he would be opposed to anything which would inter-
fere with recreation on Harbor Island.
Z. Mr. Rene Simone --
Mr. Simone addressed the Board with respect to the need
for a street light on Taylor Place, the location of his new
home.
Since this request had been before the Board previously, the
Engineer, Superintendent of Highways and Police Chief were
directed to restudy the matter and report thereon.
ADJOURNMENT
There being no further business to come before the meeting,
on motion duly made and seconded, it was declared ad-
journed at 9:25 plm. , to reconvene on December 6th, 1961.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was con-
vened immediately upon adjournment of the Town Board
meeting.
1. Claims
Commissioner Brush presented the following Fire Depart-
ment claims, which had been audited by the Comptroller
and approved by the Fire Chief, and on motion by him and
seconded by Commissioner Kane, it was unanimously
RESOLVED, that the following claims be and they
hereby are approved, and the Supervisor and
Comptroller be and they hereby are authorized to
pay the same out of the budget for the Fire De-
partment:
