MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK, HELD AUGUST 3rd, 1960, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE,
WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

PUBLIC HEARING--Amendments to Plumbing Code
For the record, the Clerk presented the affidavit of publication of
the notice of hearing in The Daily Times, the official newspaper
of the Town of Mamaroneck, on July 22nd, 1960, and on motionby
Councilman Kane, seconded by Councilman Brush, it was unani-
mously
RESOLVED that the hearing be and it now is
declared open.
The Supervisor then inquired whether there was anyone present
who wished to be heard either in favor of or in opposition to the
proposed amendments, and since there was no one, then inquired
whether any member of the Board had any question.
Councilwoman Helwig inquired about reciprocity which was ans-
wered by the Town Attorney, and thereupon, there being no fur-
ther question, on motion by Councilman Kane and seconded by
Councilman Brush, it was unanimously
RESOLVED that the hearing be and it now is
declared closed.
Whereupon, on motion offered by Councilman Santoro and seconded
by Councilman Kane, the following resolution was adopted by unan-
imous vote:
RESOLVED, that
Article II, Section 18 of the Plumbing Code of the Town
of Mamaroneck adopted June 16, 1938 is hereby amended
to read as follows:
Before an applicant shall be admitted to an exam-
ination, he shall file his application therefore, in
writing with the Town Clerk at least ten days be-
fore the examination day and shall pay the Town
Clerk the required examination fee. The names
and addresses of applicants shall be forwardedby
the Town Clerk to the Board. He shall have ser-
___ ved at least five years as a journeyman and fur-
nish satisfactory proof of such service.
Article III, Section 37 of the Plumbing Code of the Town of
Mamaroneck adopted June 16, 1938 is hereby amended to
read as follows-
A fee of twenty-five ($25) dollars shall be charged
for the issuance of a Master Plumber's License and
a fee of five ($5) dollars shall be charged for the re-
newal thereof. Unless application for renewal is
made, fee paid and bond furnished as hereinafter
provided, before the expiration of license, no re-
newal shall be issued, but the applicant must apply
for a new license as herein provided. The Town
Clerk shall, upon payment of a fee of $1, issue a
certified copy of said license for filing in other mu-
nicipalities.
Article IV, Section 65 of the Plumbing Code of the Town of
Mamaroneck adopted June 16, 1938 is hereby amended to
read as follows.
All house sewers between the building and the
street line shall be laid by a licensed plumber un-
der the specifications hereinafter set forth. This
work shall be inspected once by the Inspector, up-
on notification by the plumber that the entire line is
complete and ready for inspection.
A fee of ten ($10) dollars shall be collected by the
Inspector for this inspection at the time the plans
are filed.
All fees collected by the Inspector as herein pro-
vided, shall be turned over to the Supervisor.

FURTHER RESOLVED, that
Article III, Section 32 of the Plumbing Code of the
Town of Mamaroneck adopted June 16, 1938 is
hereby repealed.
REPORT -- Bids for Construction of Steel Stairway
Councilman Santoro reported that the Engineer and he had exam-
ined the bids submitted for the construction of steel stairway and
appurtenances connecting Town of Mamaroneck Parking Lots with
Parking Plaza over the New England Thruway and recommended
acceptance of the low bid submitted by Harrison Structural Iron
Works in the amount of $5252.00 and that the Clerk return the
certified checks accompanying bids to all bidders except the suc-
cessful bidder.
Whereupon, on his motion which was seconded by Councilwoman
Helwig, it was unanimously
RESOLVED that this Board hereby accepts the
low bid, to wit the bid of Harrison Structural
Iron Works in the amount of $5252.00, for the
construction of steel stairway and appurten-
ances connecting Town of Mamaroneck parking
lots with parking plaza over the New England
Thruway, Town of Mamaroneck, in accordance
with the specifications and proposal for such
construction filed in the Office of the Town
Clerk;
and be it
FURTHER RESOLVED that the Town Clerk be
and he hereby is authorized to return the certi-
fied checks called for in the bid specifications
to all bidders except the successful bidder.
and be it
FURTHER RESOLVED that this Board hereby
authorizes the expenditure of the sum of
$95.45 for printing the specifications and pro-
posal for the construction of the said stairway
and appurtenances.
OLD BUSINESS
1. Swimming Pool--251 Murray Avenue, Town
At this time and in connection with a swimming pool on the prem-
ises of Jack Novack at 251 Murray Avenue, Town, which had been
before the Board at its last meeting, the Supervisor recognized
Mr. Novack, who addressed the Board at length on the matter of
obtaining a permit for this particular pool and its conformance
with the regulations specified in the Town's swimming pool or-
dinance.
Following a lengthy discussion, during which Mr. Novack, Coun-
cilman-Santoro, the Attorney, the Engineer and Mr. William
Fernschild, who spoke from the floor, discussed various health
and safety factors involved with this type of pool, the matter was
put over to the next meeting pending further report following a
second inspection of the pool and its condition by Councilman San-
toro, the Engineer and Building Inspector.
NEW BUSINESS
L Authorization--Collection of School Taxes for 1960
Upon request of the Comptroller, on motion by Councilman
Brush and seconded by Councilwoman Helwig, the Board
adopted unanimously the following resolution authorizing
the Receives of Taxes to accept payment of school taxes
for the year 1960:
WHEREAS, Section 96A of the Tax Law as amended
by Chapter 635 of the Session Law of 1957 empowers
a Town Board in the County of Westchester by reso-
lution to authorize the Receiver of Taxes to accept
partial payments for or on account of taxes with
provision for the reduction of penalties not below 2%
on installments subsequent to the first (lst) in-
stallment;
NOWO THEREFORE2 BE IT
RESOLVED that pursuant to the provisions of Section
96A of the Tax Law as so amended, the Receiver of
Taxes is hereby authorized and directed to accept
from any taxpayer partial payments for or on account
of the 1960 school tax in two installments in the man-
" ner set forth below and to apply such installment pay-
ments on account of said school tax;
1) One-half of the 1960 school tax during the
month of September, 1960;
2) The remaining one-half of the 1960 school
tax during the month of January, 1961,
when such installment shall become due;
and be it
FURTHER RESOLVED that the Schedule of Penalties
for the non-payment of the first (1st) and second (2nd)
installments shall be as follows:

and be it
FURTHER RESOLVED that notwithstanding any pro-
visions of this resolution, the Receiver of Taxes of
the Town of Mamaroneck may accept the payment of
the second (2nd) installment of school taxes at the
option of the taxpayer during the months of October,
November, and December with a penalty of 2%;
and be it
FURTHER RESOLVED that notwithstanding any pro-
visions of this resolution, the Receiver of Taxes of
the Town of Mamaroneck may accept the payment of
the total amount of school taxes at the option of the
taxpayer during the month of September without
penalty;
and be it
FURTHER RESOLVED that the acceptance of any
such partial or installment payment of the 1960 school
taxes for Union Free School District No. 1 in the Town
of Mamaroneck, and School District No, 2, Town of
Scarsdale, New York, shall not be deemed to affect in
any manner, any right of the Town of Mamaroneck un-
der any general or special act, to enforce collection
of the unpaid balances of such taxes as may remain
due and owing to the said Town, but rights and powers
shall remain in full force and effect to enforce col-
lection of the unpaid balance of such school taxes, to-
gether with interest, penalties, and other lawful
charges,
Z. Authorization--Borrowing, Althea Lane Sewer Construction
Upon CouncilmanSantorors presentation of a memorandum from
the Town Accountant under date of August 3rd, 1960, submitting
a cost estimate of $2, 020. 00 for the construction of the Althea
Lane sewer, and requesting that the Supervisor be authorized to
sell a capital note dated August 15, 1960 and maturing January
15, 1961, interest rate and purchaser to be determined by the
Supervisor, which the Board ordered be received and filed, the
Attorney presented a resolution prepared by him for such pur-
pose with the recommendation that it be adopted at this time.
Whereupon, on motion offered by Councilman Santoro and sec-
onded by Councilman Brush, the following resolution was unani-
mously adopted:
RESOLUTION AUTHORIZING CAPITAL NOTE FOR THE
CONSTRUCTION OF LATERAL SEWER ON ALTHEA
LANE IN SEWER DISTRICT NO. 1, TOWN OF MAMAR-
ONECK, NEW YORK.
dated August 3, 1960
WHEREAS, the Town Board of the Town of Mamaroneck,
New York, by resolution duly adopted on April 6, 1960
and May 4, 1960 and August 3, 1960, authorized the con-
struction of a sewer in the street known as Althea Lane

in Sewer District No. 1, at a total cost of $2,452. 00,
and provided that such cost was to be paid from the
proceeds of obligations to be issued pursuant to the
Local Finance Law, Sewer District No. 1 of the Town
of Mamaroneck.
NOW, THEREFORE, BE IT RESOLVED.
1. That the specific object or purpose for which
the obligation is to be issued pursuant to this
resolution is to finance the cost of the con-
struction of a sewer in Althea Lane, Sewer
District No. 1 in the Town of Mamaroneck.
2. The maximum cost of such construction is
$2, 020. 00, and the plan of financing such
cost is as follows;
By the issuance of a capital note in the
amount of $2, 020. 00 pursuant to this
resolution.
3. The following determinations are hereby made.
(a) Subdivision 4 of paragraph of Sec-
tion 11.00 of the Local Finance Law
applies to the construction of said
sewer and the period of probably
usefulness thereof is 2 10 years.
(b) The proposed maturity of the obliga-
tion authorized by this resolution
will not be in excess of 2 years.
4. The Town of Mamaroneck hereby authorizes the
issuance of its capital note in the amount of
$2, 020. 00; such note shall be dated approxi-
mately August 15, 1960 and the power to fix and
determine the exact date of such note is hereby
delegated to the Supervisor.
5. Such capital note shall be numbered "C A - 1"
and shall mature on January 15, 1961. The note
shall be issued in bearer form, shall not contain
a power to convert to registered form, and shall
bear interest at a rate not exceeding six percen-
turn (6%) per annum, payable at maturity.
6. The Supervisor is hereby authorized to determine
the interest rate and all other matters in connec-
tion herewith not determined by this or subsequent
resolution and his signature upon said note shallbe
conclusive as to such determination. The note is-
sued hereunder shall be substantially in the form
of "Model Form of Note Payable to Borrower" set
forth in Schedule B of the Local Finance Law of
the State of New York and shall be signed by the
Supervisor and countersigned by the Town Clerk
and shall have the seal of the Town affixed thereto.
7, The faith and credit of the Town of Mamaroneck
are hereby pledged for the punctual payment of
the principal of and interest on said note and un-
less otherwise paid or payment provided for,
taxes shall be levied on all of the taxable prop-
erty in said Town in an amount sufficient to pay
said principal and interest,
8. The amounts required to pay principal and in-
terest of said note shall be assessed, levied
and collected from the several lots and parcels
of land within Sewer District No, 1 in the Town
of Mamaroneck,
3, Authorization--Installation of Water Main, Robins Nest
Upon Councilman Santoro2s presentation of a request from
Jody Dwellings, Inc, for the installation of a water main
in a new subdivision known as Robins Nest, together with
cost estimate for such installation prepared and submitted
by the Superintendent of the Westchester Joint Water Works
under date of July 12, 1960, it was, on his motion, which
was seconded by Councilman Kane, unanimously
RESOLVED that the Town Board of the Town of
Mamaroneck hereby approves the installation
of 200 feet of 411 transits, water main in Robins
Nest Lane, from Harrison Drive to the dead
end of said street, at a total cost of $527, 28;
- and be it
FURTHER RESOLVED that this approval is
contingent upon the applicant, Jody Dwellings,
Inc. , paying the total cost of said installation
in the amount of $527.28 to be deposited with
the Westchester Joint Water Works No, 1;
that the excavation and backfill of the trench
be paid by the applicant and that the applicant
furnish the Town with an easement for said
pipe to be approved by the Town Attorney;
and be it
FURTHER RESOLVED that unless the instal-
lation of the above-mentioned water main is
completed within a period of one (1) year from
the date of this resolution, or not later than
August 3rd, 1961, this authorization shall be-
come null and void.
COMMUNICATIONS
1, Public Service Commission--Notice of Hearing
A notice from the Public Service Commission of postponement
of hearing on petition for approval of the merger of The New
York, Westchester and Connecticut Traction Company into
Westchester Street Transportation Company, Inc„ was pre-
sented and ordered received and filed,
2. M. R. Thieberger--Hidden Driveway
A communication addressed to the Town Board by M. R.
Thieberger of 124 North Chatsworth Avenue, Town, un-
der date of July 18th, 1960, concerning the hidden drive-
way at his property, together with report submitted by
.the Town Engineer and Police Chief, were presented and
ordered received and filed.
Following some discussion, this matter was referred to
Councilman Santoro for further study with the Engineer
and Police Chief and the Supervisor directed to reply to
Mr. Thieberger, advising him to this effect.
3. Rockwell Manufacturing Company--Contract for Rental of
Voting Machines
Upon the Clerks request that the Supervisor be authorized
to sign a contract with the Rockwell Manufacturing Com-
pany for the rental of four additional voting machines for
the coming November election, on motion by Councilman
Brush and seconded by Councilwoman Helwig, it was
unanimously
RESOLVED that the Supervisor be and he here-
by is authorized to execute the contract with
the Automatic Voting Machine Division of the
Rockwell Manufacturing Company for the rental
of four (4) voting machines for the Town of Ma-
maroneck, at a rental price of $150. 00 per
machine f.o.b. , Jame stown, New York.
COMMUNICATIONS (Not on Agenda)
1, Designation of Polling Places--1960, 1961
The Clerk presented a list of polling places for the purpose
of designating a place in each election district in the Town
in which meeting for the registration of voters, election,
and primaries shall be held in the year following the en-
suing first day of October, and on motion by Councilwoman
Helwig and seconded by Councilman Brush, it was unani-
mously
RESOLVED that in accordance with the provi-
sions of Section 66 of the Election Law, being
Chapter 17 of the Consolidated Laws of the
State of New York as amended, the Town
Board of the Town of Mamaroneck hereby des-
ignates a place for each election district inthe
Town, at which a meeting for the registration
of voters, election, and primaries shall be
held in the year following the ensuing first

REPORTS
The Clerk presented the following reports which were ordered
received and filed.
Report of the Town Clerk for the month of July, 1960..
Report of the Receiver of Taxies and Assessments for
the month of July, 1960.
Report of Receipts and Disbursements, Town of Ma-
maroneck, for the period from January 1st - June
30th, 1960.
REPORT OF THE SUPERVISOR
1. Reinvestment of $150, 000. 00 Certificate of Deposit
The Supervisor presented a memorandum from the Town
Accountant advising the Board of the maturing on August
10th, 1960 of a Certificate of Deposit in the amount of
$150, 000. 00, and requested authorization to reinvest
this sum for a period of 60 days in either a certificate
of deposit or U.S. Treasury notes.
Whereupon, on motion by Councilman Santoro and sec-
onded by Councilman Brush, it was unanimously
RESOLVED that the Supervisor be and he
hereby is authorized to invest the sum of
$150, 000. 00 for a period of 60 days in a
certificate of deposit or U.S. Treasury
notes.
2. Extension of Sewage Disposal Facilities
The Supervisor brought to the Board's attention the report on
the proposed extension of the sewage disposal facilities in the
Mamaroneck Valley Sewer District presented to the Board of
Supervisors by James G. Harding, Commissioner of the De-
partment of Public Works of Westchester County, and nowbe-
fore the Committee on Budget and Appropriations, describing
briefly the proposed plan for the enlargement of the present
treatment plant on the Post Road in Mamaroneck and its al-
ternate, the erection of an entirely new plant on Hen Island.
Following a lengthy discussion of this matter, the Board was
unanimous in feeling that a resolution should be adopted and

forwarded to the Board of Supervisors and the Committee
on Budget and Appropriations urging that action in this
matter be withheld until the Village of Mamaroneck had
such time as needed to complete its study and evaluation
of the two proposals.
Whereupon, on motion by Councilman Santoro and seconded
by Councilman Kane, it was unanimously
RESOLVED that this Board urges the Board of
Supervisors of Westchester County and the
Committee on Budget and Appropriations of
that Board to postpone action on the proposed
extension of the sewage disposal facilities in
the Mamaroneck Valley Sewer District until
the officials of the Village of Mamaroneck have
an opportunity to make further studies and ob-
tain engineering advice concerning the relative
merits of extending the present treatment plant
located in the Village of Mamaroneck or erect-
ing a new plant on Hen Island;
and be it
FURTHER RESOLVED that a copy of this reso-
lution be forwarded to the Clerk of the Board of
Supervisors of Westchester County and to the
Chairman of the Committee on Budget and Ap-
propriations.
REPORTS OF THE COUNCILMEN
Councilman Santoro --
1. Installation of Drain on Semenza Property, Post Road
Councilman Santoro reported that the 481° pipe installed
on the Semenza property had carried the water satis-
factorily during last Saturday's heavy rain and that the
Town would complete its work on this project following
cleaning of the culvert by the State.
2. Flooding Condition -- York Road and Cabot Road
Councilman Santoro reported on the flooding conditions
last Saturday on York Road and on the Thruway in the
Cabot Road area.
Following a detailed and lengthy discussion of the condi-
tions and after hearing Vincent J. Ciardullo of 4 Cabot
Road who spoke at some length of the considerable dam-
age caused to his home and property by the Thruway con-
dition, the Board directed the Supervisor, Councilman
Santoro and the Engineer to contact the Thruway officials
on this matter.
3, Sewer and Water Extensions--Winged Foot Drive
Councilman Santoro reported that the Engineer had com-
pleted the plans and specifications for extending the se-
wer and water lines in Winged Foot Drive and recom-
mended, if the proposed plans met with the Boards ap-
proval, that the Board hold a special meeting on Au-
gust 24th and that the Clerk be authorized to advertise
for bids for this construction to be returnable as of
that date
Whereupon, since the plans met with the Board's ap-
proval and it was agreeable to hold a meeting on the
24th, on motion by Councilwoman Helwig, seconded by
Councilman Brush, it was unanimously
RESOLVED that this Board hold a special
meeting in the Council Room of the Wea-
ver Street Firehouse, Weaver Street,
Town of Mamaroneck, at 8:15 p.m. on
Wednesday evening, August 24th, 1960,
And thereupon, on motion offered by Councilman San-
toro and seconded by Councilman Kane, it was unani-
mously
RESOLVED that the Town Clerk be and he
hereby is authorized to publish in the of-
ficial newspaper of the Town of Mamaro-
neck, The Daily Times, the following
notice:
NOTICE TO BIDDERS
Notice is hereby given that sealed bids will be received by the
Town Board of the Town of Mamaroneck, Westchester County,
New York, until 5:00 o'clock P.M. D.S. T. on Wednesday, Au-
gust 24, 1960 at the office of the Town Clerk, 158 W. BostonPost
Road in the Village of Mamaroneck, New York, and opened and
read aloud at a regular meeting of the Town.Board to be held at
8:15 P. M. D.S. T. on Wednesday, /August 24, 1960 in the Council
Room of the Weaver Street Fire House, corner of Weaver Street
and Edgewood Avenue in the Town of Mamaroneck for the con-
struction of sanitary sewer and water extensions and appurten-
ances in Winged Foot Drive in the Town of Mamaroneck, West-
chester County, New York, in accordance with plans and speci-
fications drawn and prepared by Maurice Friedlander, Town En-
gineer, and now on file in the Office of the Town Clerk,
Copies of the plans, specifications and proposals for the work
proposed may be obtained at the Town Clerk's office upon de-
posit of $5. 00, which deposit will be refunded when plans and
specifications are returned in good condition within thirty days
after the award or rejection of the bids.
The Town of Mamaroneck reserves the right to waive any in-
formalities in the bids or reject any bid which does not comply
with the specifications. No bidder may withdraw his bid within
forty-five days after the actual date of the opening thereof dated.

The Town of Mamaroneck may make such investigation as it
deems necessary to determine the ability of the bidder to per-
form the work, and the bidder shall furnish all such informa-
tion and data for this purpose as may be requested. The Town
of Mamaroneck reserves the right to reject any bid, if, the
evidence submitted by, or the investigation of such bidder fails
to satisfy the Town of Mamaroneck that such bidder is properly
qualified to carry out the obligation of the contract and to com-
plete the work contemplated therein.

1. Thruway Reply to Request for Signs
Councilman Kane presented a letter addressed to the Super-
visor by Arnold G. Finch, Traffic and Safety Engineer of
the Thruway Authority, in reply to the Townes request for
the erection of signs indicating Larchmont at appropriate
exits from the Thruway, which was ordered received and
filed.
After discussion of the several points raised in Mr. Finches
letter, the Board still feeling that the signs which had been
requested were needed, directed the Supervisor to write
Mr. Finch and again request the erection of such signs.
2. Commendation of Fire Chief
Councilman Kane commended the Fire Chief on the excellent
help he had given in the Cabot Road area pumping during the
heavy rains last Saturday.
Councilman Brush --
Councilman Brush stated that he had no report other than Fire
matters.
Councilwoman Helwig --
1. Summer Music School
Councilwoman Helwig called attention to the excellent publicity
the Summer Music School had in the New York Times, The
Daily Times and on the Voice of America.
2. The Rockingstone

Councilwoman Helwig reported on the fine job performed
by the group of students who had volunteered their efforts
to restore the rockingstone to its natural condition and
was requested by the Board to write the President of the
General Association on behalf of the Board expressing its
thanks and appreciation to this group.
3. Dillon Park Play Area
Councilwoman Helwig reported that the Department of
Public Works had started to clear this area and expressed
the Recreation Commission`s thanks to the department.
REPORT OF THE TOWN ATTORNEY
1. Air Pollution
The Attorney reported that the Engineer had received a com-
munication from Mrs. R. Hemmerich of 14 Alden Road re-
garding contamination of the air in that area by the incinera-
tors of Larchmont Gables Apartments.
He reported that in connection with the matter of air pollu-
tion, he was preparing a draft of a new ordinance for smoke
control which would be ready to present to the Board at the
next meeting.
Z. Alleged Zoning Violation--Richard Depierro, Joseph J. Lore
The Attorney reported that as directed by the Board, he had
brought an action against Richard Depierro and Joseph J.
Lore in the matter of a zoning violation on property on Har-
rison Drive, Town.
3. Proceeding against Zoning Board-- Rudy Novak
The Attorney reported on a proceeding brought against the
Zoning Board by Rudy Novak to grant a variance, which was
returnable September 6th.
ADJOURNMENT
There being no further business to come before the meeting, it was
declared adjourned at 9055 p. m. , to reconvene on August 24th, 1960.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened im-
mediately upon the adjournment of the Town Board meeting.

Commissioner Brush stated there were no communications,

Commissioner Brush presented the Fire Report for the
month of July, 1960, which was ordered received and
filed,
3, Claims
Commissioner Brush presented the following claims of the
Fire Department, which had been audited by the Comptrol-
ler and approved by the Fire Chief, and on his motion,
seconded by Commissioner Kane, it was unanimously
RESOLVED that the following claims be and they here-
by are approved, and the Supervisor and Comptroller
be and they hereby are authorized to pay the same out
of the budget for the Fire Department:

4, Other Business
1. False Alarms--Larchmont Acres
The Fire Chief reported that there had been 6 false
alarms at Larchmont Acres in the past 5 months and
advised that although cooperation had been promised
at a meeting with the owners of the Acres at that
time, no gongs had been installed over the alarms.
Following discussion, on Commissioner Brushts sug-
gestion, the Chief was directed to notify the Acres
that the department would cancel their special alarm
and so notify the insurance carriers unless thesegongs
were installed by the end of August,
Z. House Numbers
In reply to a question by Deputy Chief Schmidt, the At-
torney advised that there was no legal requirement for
house numbers.
5. Adjournment
