CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. PRESENT: Supervisor Burchell Councilman Santoro Councilman Kane Councilman Brush Councilwoman Helwig ABSENT: None ALSO PRESENT: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Friedlander - Engineer & Supt, of Highways Mr. Orsino - Comptroller Mrs. Brewer - Secretary APPROVAL OF MINUTES The minutes of the regular meetings of December 16th, 1959, Janu- ary 5th and January 20th, 1960 were approved as corrected. PUBLIC HEARING--Application of William Gauthier for Consent to Operate Bus Line The Clerk presented the affidavit of publication of the notice of pub- lic hearing on the application of William Gauthier d/b/a Orienta Bus Company for consent to operate a bus in the unincorporated area of the Town in The Daily Times on February 19th, 1960, and the Supervisor declared the hearing open. The Supervisor inquired whether anyone present wished to be heard either in favor of or opposed to this application. There was no one who addressed the Board. At this time, Councilman Brush stated that at the Bus Committee meeting the previous evening, it had been recommended that de- cision on this application be reserved at this hearing and that he felt the applicant, Mr. Gauthier, had not appeared this evening for this reason. And in view of this, Councilman Brush recommended that the hearing be closed with decision reserved. Whereupon, on motion by Councilman Santoro and seconded by Councilman Kane, it was unanimously RESOLVED that the hearing be closed and decision reserved. L PUBLIC HEARING--Amendment of Chapter VII, Section 1 of the General Ordinances The Clerk presented the affidavit of publication in the Daily Times on February 19th, 1960, of the notice of hearing to amend Chapter VII, Section I of the General Ordinances and the Supervisor de- clared the hearing open. The Supervisor inquired whether anyone present wished to ad- dress the Board either in favor of or in opposition to the proposed amendment and since there was no one, on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that the hearing be and it is hereby declared closed. Whereupon, since all of the members of the Board were conver- sant with the provisions set forth in the proposed amendment, on motion by Councilman Santoro and seconded by Councilwoman Helwig, it was unanimously RESOLVED that Chapter VII, Section 1 of the General Ordinance of the Town of Mamaroneck as last amended October 20, 1954, be amended to read as follows; Section 1 - For the preservation of the health, peace and good order of the community, no per- son, firm, association or corporation shall col- lect, solicit, receive and/or transport any old paper, garbage, refuse, ashes, rubbish, used cans, dirt, cinders, building materials, usedor broken glass, tree stumps, branches and clip- pings, old and unused motor vehicles or machin- ery or parts thereof, or any other waste matter, within the Town of Mamaroneck outside of incor- porated villages and deposit same anywhere in the Town of Mamaroneck, except at a dump maintained by the Town for such purpose and then only upon obtaining a permit as herein pro- vided. Such permit shall be issued only to res- idents of the Town of Mamaroneck by the Su- perintendent of Highways upon application duly made upon forms provided by him for such pur- pose and upon payment to him of $10. 00 for each permit, which shall be valid until the 31st dayof December next succeeding the date of issue, The Superintendent of Highways shall adopt rules and regulations prohibiting the delivery of any items at any dump maintained by the Town of Mamaro- neck which are considered detrimental to the proper operation of the dump or the comfort and safety of the surrounding residents includingbut not limited to the following items which shall be prohibited; 1. Tree wood over 6" in diameter or over 41 long, including stumps and trunks of trees. Z. Loose brush, tree branches, unless pro- cessed through an approved brush grinder. nl ji 3. Railroad ties, telephone poles and dis- carded automobiles and trucks, 4. Used or discarded building materials such as lumber, plaster, etc„ discarded refrigera- tors, washing machines, boilers, wooden boxes and crates, cardboard, cartons, beds including mattresses and springs, chairs, couches and all furniture, 5. Inflammable or highly combustible materials such as cleaning establishment waste or other industrial wastes, found to be undesirable mater- ials containing varnish, paint thinners, etc. , refuse such as sawdust, explosives, ammunition, oil drums, cans or barrels containing combus- tible materials, rubber tires, rubber wastes, /battery cases, tar paper, roofing tar cans etc, (Section 2 - The dumping of any materials here- alll_'� '� ina 'ove enumerated within the Town of Mamaro- neck, outside of incorporated villages, without a permit is hereby prohibited, OLD BUSINESS 1. Report by Town Attorney--Bids for Town Car Following the Attorney's report that the bids for the purchase of a Town car submitted at the last meeting of the Board and referred to the Attorney at that time, were in order and his recommendation that the low bid for either the 6 or 8 cylinder model be accepted according to the Board's preference, and upon the Supervisor stating that he felt the 6 cylinder model would serve as well as the 8 cylinder model, on motion by Councilman Kane, seconded by Councilman Brush, it was unanimously RESOLVED that this Board hereby accepts the low bid, to wit the bid of Flinn Motor Corp. , for furnishing to the Town of Mamaroneck one (1) new 1960 Ford Fair- lane Tudor 6 cylinder model equipped in accordance with the specifications on file in the Office of the Town Clerk, for the net price of $1976, 00. NEW BUSINESS 1. Authorization for Collection of State, County and Town Taxes The Supervisor requested the usual resolution approving collec- tion of taxes by the Receiver of Taxes for the 1960 State, County and Town taxes in two installments, and on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED that pursuant to Section 1514 of the Real Property Tax Law, the Receiver of Taxes and As- sessments of the Town of Mamaroneck is authorized to collect the 1960 State, County, Town, and District taxes and water rents, which become a lien January 1, 1960, in two partial payments, each amounting to fifty per cent (50%) of the total of saidtaxes and water rents. and be it FURTHER RESOLVED that the Receiver of Taxes and As- sessments is authorized and empowered to receive such partial payments or installments of taxes and water rents at any time prior to the sale of tax liens but subject to the same penalties as are specified and provided in Section 542 of the Westchester County Administrative Code for the neglect to pay the total amount of said taxes and water rents. and be it FURTHER RESOLVED that the acceptance of any suchpar- tial payments or installments of the 1960 taxes and water rents shall not be deemed to affect in any manner any right of the Town of Mamaroneck under any general or specific law to enforce collection of any unpaid balance of such taxes and water rents as may remain due and owing to the Town of Mamaroneck, but such rights and powers shall remain in full force and effect to enforce the collec- tion of the unpaid balances of such taxes and water rents together with interest, penalties, and other lawful charges. And, on motion by Councilman Brush, seconded by Councilwoman Helwig, it was unanimously RESOLVED that in accordance with the provisions of Sec- -- tion 550 of the Westchester County Administrative Code, "The Daily Times, " the official newspaper published in the Village and Town of Mamaroneck, be and it hereby is designated as the newspaper in which the Receiver of Taxes and Assessments shall publish the Notice of the Collection of State, County, Town, and District Taxes and Water Rents; and it is FURTHER RESOLVED that said publication be made on March 17th, 1960 in The Daily Times; and it is FURTHER RESOLVED that in accordance with the provi- sions of Section 550 of the Westchester County Adminis- trative Code, the Town Board does hereby direct the Re- ceiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. 2. Appointment of School Crossing Guard Upon presentation of a memorandum addressed to the Supervisor by the Chief of Police under date of February 25th, 1960, re- questing appointment in accordance with the recommendation of the Police Commission, of Mrs. Anna Stock of 700 Forest Ave- nue, Town, as a School Guard to fill the vacancy created by the resignation of Mrs. Dorothy O'Keefe, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unani- mously RESOLVED that Mrs. Anna Stock of 700 Forest Avenue, Town, be and she hereby is appointed a School Guard in the Town of Mamaroneck, ef- fective as of February 23rd, 1960, and to be compensated at the rate of $7. 00 per day, COMMUNICATIONS The Clerk stated that there were no communications to be pre- sented at this meeting. REPORTS The Clerk presented the following reports which were received and filed: Report of the Acting Building Inspector for the month of February, 1960. Report of the Receiver of Taxes and Assessments for the month of February, 1960. Annual Report of Notices of Tort Claims for the fiscal year ending December 31st, 1959. REPORT OF THE SUPERVISOR 1. Bill--300th Anniversary of Founding of Town The Supervisor reported that this bill had been passed in the Assembly and now waited Senate action and signature by the Governor to become a law. Z. Request to Purchase Property--J. Rene Simon The Supervisor advised the Board and Mr. Simon, who was present, that he was trying to arrange a meeting at a mu- tually convenient time to all parties concerned to discuss any legal problems possibly involved in selling this particu- lar property. Mr. Simon thanked the Supervisor for his attention to this request and stated that he would make himself available to attend such meeting at any time it could be arranged. 3. Larchmont Station The Supervisor reported that he had received requests for the installation of a telephone booth at the kiosk where the canopy was being erected at the station and stated that, if it were the pleasure of the Board, he would investigate the possibility of having such a booth at this location. The Board directed the Supervisor to this effect. The Supervisor also stated that the matter of placing benches along the area under the canopy was presently un- der consideration. REPORTS OF THE COUNCILMEN Councilman Santoro -- 1. Claim of R. M. Leggette--Sewer Repair Councilman Santoro requested authorization for payment of the claim of R. M. Leggette of 34 Rockland Avenue, Town, for sewer repair, which matter had been before the Board previously, and on his motion which was seconded by Coun- cilman Kane, it was unanimously RESOLVED that R. M. Leggette be reimbursed in the amount of $439. 30 for expenditure for certain expenses incurred by the claimant in connection with locating sewer stoppage at above premises, said stoppage found to be existing in the bed of the street and repaired at claimant's expense. Councilman Kane -- 1. Lighting at Larchmont Bowling Center Councilman Kane reported that all lighting at the Bowling Center was now satisfactory. 2. Apportionments Councilman Kane presented the following petitions received from the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes, and on motionby him and seconded by Councilman Santoro, the following res- olution was unanimously adopted- WHEREAS the Assessor has presented petitions for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Ar- ticle 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petitions for the correction of said assessment roll: NOW, THEREFORE, BE IT RESOLVED that the assessment roll of 1959, taxes of 1960, which shows property now appearing on the roll as follows: Block Parcel Name Land only 320 648 Jos W. RR 337, 400 337, 200 674, 600 905 700 Robinson-Wagner Co 1, 800 1, 800 A Councilman Brush -- 1, Fingerprinting In reply to a question raised by Mrs. Smith who attends Board meetings representing the League of Women Voters, Council- man Brush advised that the Police Department would be gladto fingerprint any resident at any time upon call to the department for an appointment; in the case of groups desiring this service, the Councilman stated that the department felt it could be best handled by arranging a scheduling period, Mrs. Smith thanked the Board and Councilman Brush for the courtesy extended in this matter. 2. Bus Committee Councilman Brush reported that the first meeting of the Com- mittee had been held on the evening of March 1st and that the evening had been devoted to the formulation of plans to con- duct its studies. He stated that the next meeting would be on the evening of March 23rd and asked the Town Clerk if he would be good enough to mail a notice of such meeting to all civic associations, suggesting that this might be mailed with the agenda for the March 16th Town Board meeting. At this time, the Supervisor reported that he had talked with the President of the West Fordham Transportation Company about the bus strike again but that there was no further re- port other than that they were negotiating and attempting to arbitrate the matter. Councilman Santoro suggested that the Supervisor keep in touch with Mr. Rukin, which the Supervisor stated he would do. Councilwoman Helwig -- 1. Annual Recreation Report Councilwoman Helwig presented a copy of the Annual Report of the Recreation Commission for the year 1959 to each member of the Board, calling attention to the new format for this year's report and highly commending the Superintendent of Recreation on the work he had done in compiling, editing and publishing the report. The Commission, she reported, would appreciate any suggestions as to distribution of the report, which was received and filed at this time, REPORT OF THE TOWN ATTORNEY 1. Approval of Bond--Murdock Woods The Town Attorney presented a bond of the Peysam Developers, Inc, in the amount of $37, 550. 00 covering completion of street =It improvements and utilities in a portion of Murdock Road and Salem Drive in Murdock Woods with recommendation for approval of same pursuant to Section 277 of the Town Law. Whereupon, on motion by Councilman Kane and seconded by Councilman Santoro, it was unanimously RESOLVED that pursuant to Section 277 of the Town Law, this Board hereby approves as to sufficiency of surety and also as to form, bond No. 222043 of the Peysam Developers, Inc. , c/o S. M. Strausberg, 120 West 42nd Street, New York, N. Y. , as Princi- pal, covering completion of street improvements and utilities in a portion of Murdock Road and Salem Drive in Murdock Woods and known as Block 304, Parcels 443 and 774 on the Tax Assessment Map of the Town of Mamaroneck, with the Royal Indemnity Company of 150 William Street, New York, N. Y. , dated February 17th 1960, and to run for a term of three years or until February 17th, 1963, in the amount of $37, 550. 00 as fixes by the Planning Board of the Town of Mamaroneck pursuant to resolution adopted by that Board on April 6th, 1959; and be it FURTHER RESOLVED that the Town Clerk be and he hereby is authorized to endorse such approval upon the same. Z. Zoning Violation--John Roma The Attorney reported that this action had been before Mr. Justice Doscher and that the complaint had been dismissed without cost up- on his finding that there was only one-family occupancy. OTHER BUSINESS 1. False Alarms--Larchmont Acres The Fire Chief addressed the Board with regard to the false alarms at Larchmont Acres, stating that the last one had occurred at 2.55 a. m. Sunday morning, and advising that the Fire Department re- quested the Town Board to take some action in connection there- - with. After some discussion, it was directed that the Fire Chief, the Police Chief and Commissioner Brush of the Fire Commission and Town Board meet with the owner of the building to discuss what could be done to eliminate such alarms and to report on the meet- . ing at the next meeting of the Board. ADJOURNMENT There being no further business to come before the meeting, it was declared adjourned at 8;55 p. m. , to reconvene on March 16th, 1960. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Communications Commissioner Brush stated that there were no communica- tions to be presented at this meeting. 2. Reports Commissioner Brush stated that there were no reports to be presented at this meeting. 3. Claims Commissioner Brush presented the following Fire Depart- ment claims which had been audited by the Comptroller and approved by the Fire Chief, and on his motion which was seconded by Commissioner Santoro, it was unani- mously RESOLVED that the following claims be and they hereby are approved and the Supervisor and Comptroller be and they hereby are au- thorized to pay the same out of the budget for the Fire Department; Con Edison $ 5. 00 Keeler Associates 1, 023. 53 N.Y. Report--Bids for Two-way Radio System Commissioner Brush informed the Commission that the Attorney had advised him that the bids submitted for the purchase of a two-way radio system were still under study and that the report thereon would be ready to be presented at the next meeting. 2. Change in Civil Service Classification Fire Truck Driver to Fireman C � Commissioner Brush informed the Commission that the Accountant had again been in touch with the County Personnel Office regarding this matter. He stated that the Personnel Director had ad- vised that the request was still under consider- ation and that it was hoped a final decision would be reached within the next few months. 5. Adjournment There being no further business to come before the meeting, it was declared adjourned at 9.00 p. m. , to reconvene on March 16th, 1960. T 91erk
