CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Burchell Councilman Kane Councilman Brush Councilwoman Helwig Councilman Cook Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Delius - Town Attorney Mr. Orsino - Receiver of Taxes Mr. Kellogg - Town Engineer Mr. Fischer - Supt. of Highways Mr. Altieri - Town Accountant Mr. Kronenberger - Supt. of Recreation Mrs. Brewer - Secretary ORGANIZATION MATTERS' The Supervisor presented the organization matters for 1962 in accordance with the agenda, and following due considera- tion, the Board unanimously adopted the following reso- lutions: 1. Authorization of Salaries for Elected Officials On motion by Councilwoman Helwig and seconded by Councilman Kane, it was RESOLVED, that the salaries of all elected offi- cials of the Town of Mamaroneck for the year 1962 are to be the salaries stated and appro- priated in the annual budget or estimate for the year 1962 as follows: Name Title Salary George D. Appointment and Salary Town Officers On motion by Councilman Kane and seconded by Councilman Brush, it was RESOLVED, that the following persons are hereby ap- pointed as Town Officers as of January 1, 1962 in ac- cordance with the provisions of the Town Law, to serve for the respective terms and at the annual salary or rate of compensation hereinafter stated, such salary or compensation to be paid from the amounts appro- priated in the annual budget or estimate for the year 1962, or so much thereof as shall be sufficient topay the salary or compensation as hereby fixed: Name Office Term Salary John L. Appointment and Salary Building & Plumbing Inspector On motion by Councilman Brush and seconded by Councilman Cook, it was RESOLVED, that this Board hereby approves the pro- visional appointment of William Paonessa as Building & Plumbing Inspector of the Town of Mamaroneck, ef- fective as of January 1, 1962, and tobe compensated at the rate of $5450. 00 per annum. 4. Authorization of Bonds Elected Officials On motion by Councilman Cook and seconded by Councilwoman Helwig, it was RESOLVED, that the following bonds for elected of- ficials are hereby required pursuant to Town Law and approved as follows. Bond, George D. Burchell as Supervisor of the Town of Mamaroneck, conditioned for the faithful performance of his duties includ- ing the payment of all school moneys pur- suant to Section 25 of the Town Law, upon which the National Surety Corporation is surety in the penal sum of $25, 000. for a term of two years. Bond, Charles J. Gronberg as Clerk of the Town of Mamaroneck, conditioned for the faithful performance of his duties including the depositing of all funds or moneys of the z.. Rte.. Town of Mamaroneck received by him pur- suant to Section 25 of the Town Law, upon which the National Surety Corporation is surety in the penal sum of $4, 000, for a term of two years. Bond, Munn Brewer as Justice of the Peace of the Town of Mamaroneck, conditionedfor the faithful performance of his duties includ- ing the depositing of all funds or moneys of the Town received by him pursuant to Sec- tion 25 of the Town Law, upon which the Sun Insurance Company is surety in the penal sum of $4, 000, for a term of four years. 5. Authorization of Bonds Appointed Officers and Employees On motion by Councilwoman Helwig and seconded by Councilman Kane, it was RESOLVED, that pursuant to Town Law, a bond is re- quired for the faithful performance of the duties of each of the appointed officers and employees listed below and authorized as follows in the amount stated with sufficient surety to be approved by this Board and the form to be approved by the Town Attorneys Office Amount Term --' Comptroller 4, 000. 2 yrs. Authorization for Salary Payment on motion by Councilman Brush and seconded by Councilman Cook, it was RESOLVED, that the salary of all officials and em- ployees of the Town of Mamaroneck be paid on a bi- weekly basis, effective January 1st, 1962. 8. Appointment of Deputy Receiver of Taxes In accordance with the request of the Receiver of Taxes herewith presented and filed for the record, on motion by Councilman Cook and seconded by Councilwoman Helwig, it was RESOLVED, that in accordance with the request of the Receiver of Taxes, this Board hereby aPproves the ap- pointment of Donna Comstock, Intermediate Account Clerk, as Deputy Receiver of Taxes, authorized to receive tax money, give proper receipt therefor in her name, enter such payments upon the records, and deposit tax money in the bank for the year end- ing December 31st, 1962, 9, Appointment of Person Authorized to Receive Tax Money In accordance with the Tax Receiver's request, herewith pre- sented and filed for the record, on motion by Councilwoman Helwig and seconded by Councilman Kane, it was RESOLVED, that in accordance with the request of the Receiver of Taxes, this Board hereby approves the ap- pointment of William Kirtland, Intermediate Clerk, as a person authorized to receive tax money, give proper receipt therefor in his name, enter such payments up- on the records, and deposit tax money in the bank for the year ending December 31st, 1962, 10, Appointment of Deputy Town Clerks Upon presentation of a certificate of the appointment of two Deputy Clerks pursuant to Subdivision 10 of Section 30 of the Town Law, herewith ordered received and filed, on mo- tion by Councilman Kane and seconded by Councilman Brush, it was RESOLVED, that in accordance with the Town Clerk's --- certificate, the appointment of Donna Comstock and Jennie Hopson as Deputy Town Clerks of the Town of Mamaroneck for the year 1962, be and it hereby is approved, 11. Appointment of Registrar of Vital Statistics On motion by Councilman Brush and seconded by Councilman Cook, it was RESOLVED, that Charles J. Gronberg be and he here- by is appointed Registrar of Vital Statistics of the Town of Mamaroneck, for a term of two years beginning on January 1, 1962 and terminating on December 31, 1963; and be it FURTHER RESOLVED, that the Supervisor be and he hereby is authorized to sign the Certificate of Appoint- ment of the Registrar of Vital Statistics, to be filed with the New York State Department of Health, 12, Appointment of Constables On motion by Councilman Cook and seconded by Councilwoman Helwig, it was RESOLVED, that the following persons be and they here- by are appointed Civil Officers of the Town of Mamaro- neck, with powers and duties of Constables in civil ac- tions and proceedings only as provided in Section 20 1 (a) of the Town Law, to serve without salary for a term of one year, starting January 1, 1962 and term- inating December 31, 1962: Dominick Faillace 1421 Mamaroneck Ave. Mamaroneck, New York Timothy Courtney - 104 Post Road Larchmont, New York Joseph Tezzi - 28 Madison Street Mamaroneck, New York Frank Comblo - 225 Highview Street Mamaroneck, New York 13. Authorization of Bonds for Constables On motion by Councilwoman Helwig and seconded by Council- man Kane, it was RESOLVED, that the appointed Constables, Dominick Faillace, Joseph Tezzi, Timothy Courtney and Frank Comblo, each file a bond in the amount of $4000, for the faithful performance of his duties, said bond to be for one year and approved by the Town Attorney, with premium for same paid from Town funds. 14. Appointment of Police Pension Fund Trustee On motion by Councilwoman Helwig and seconded by Council- man Kane, it was RESOLVED, that Town Councilman C. Benjamin Brush, Jr, be and he hereby is appointed a mem- ber of the Board of Trustees of the Police Pension Fund of the Town of Mamaroneck, for a term of one year, commencing January 1, 1962 and ter- minating December 31, 1962. 15. Appointment of Town Historian On motion by Councilwoman Helwig and seconded by Council- man Kane, it was RESOLVED, that William G. Fulcher be and he here- by is appointed Town Historian of the Town of Mamar- oneck, effective January 1, 1962 and to serve at the pleasure of the Board, -- 16. Appointment of the Board of Police Commissioners _Following presentation of a letter from Charles Henderson, in which he tendered his resignation as a member of the Board of Police Commissioners because of moving to Jamestown, New York, herewith ordered received and filed, on motion by Coun- cilman Brush and seconded by Councilman Cook, it was RESOLVED, that the resignation tendered by Charles Henderson as a member of the Board of Police Com- missioners due to leaving Town, be and it hereby is accepted with regret; and be it FURTHER RESOLVED, that the Supervisor, on be- half of the Board, so notify Mr. Henderson, expres- sing the Board's appreciation of his service and ex- tending its best wishes to him and his family in their new home, Councilman Brush then placed in nomination as replacement for Mr. Henderson, the name of Mr, Thomas F. Moore, Jr„ presenting a brief biography of his qualifications and back- ground and thereupon, since there were no further nomina- tions, on motion by him and seconded by Councilman Cook, it was RESOLVED, that Thomas F. Moore, Jr. , 334 Weaver Street, Town, be and he hereby is appointed a member of the Board of Police Commissioners, to serve at the pleasure of the Board; and be it FURTHER RESOLVED, that Alan M. Welty, 5 Ken- mare Road, and A. C. Viebranz, 126 Garden Road East, Town, are hereby reappointed members of the Board of Police Commissioners, to serve at the pleasure of the Board; -- and be it FURTHER RESOLVED, that the Clerk is hereby dir- ected to so notify the persons hereinabove named of their appointment, 17. Reappointment of Member of Park Commission Following Councilwoman Helwig's nomination of John Oliver for his third term of office as a member of the Park Com- mission, which was offered with great pleasure and high commendation of his past highly advantageous service to the Town, on motion by her and seconded by Councilman Kane, it was RESOLVED, that John W. Oliver, 41 Glenn Road, Town, be and he hereby is reappointed a member of the Park Commission, to serve for a term of three years, be- ginning January 1st, 1962 and terminating on December 31st, 1964, and be it FURTHER RESOLVED, that the Clerk be and he hereby is directed to notify Mr. Oliver and the Board of Park Commissioners to this effect, 18. Appointment of Auditors for 1962 On motion by Councilman Kane and seconded by Councilman Brush, it was RESOLVED, that the firm of Glick-Freedman, Certified Public Accountants, New Rochelle, New York, be and it hereby is appointed to au- dit the records of the Town of Mamaroneck for the year 1962; such service to be rendered for a fee of $2700, 00 as appropriated in the annual budget or estimate for the year 1962, 19, Approval of Supervisor's Appointment Members of Examining Board of Plumbers The Supervisor appointed the following licensed plumbers to serve on the Examining Board of Plumbers pursuant to Ar- ticle 2, Section 12 of the Plumbing Code of the Town of Ma- maroneck, and requested the Board's approval thereof. Whereupon, on motion by Councilman brush and seconded by Councilman Cook, it was RESOLVED, that this Board hereby approves the Supervisor's appointment of the following persons to the Examining Board of Plumbers, each to serve for the term of office herein designated: Peter F. Kane Jr, for a two-year term of office, terminating December 31st, 1963, Sam Paonessa for a two-year term to terminate on December 31st, 1963, Victor J. Kriss for a one-year term to terminate December 31st, 1962, and be it FURTHER RESOLVED, that the Clerk so notify Mr. Paonessa and Mr. Kriss, 20, Authorization of Compensation Secretary to Supervisor In accordance with the Supervisor's request, on motion by Councilman Brush and seconded by Councilman Cook, it was RESOLVED, that the compensation of the Super- visor's Secretary be and it hereby is fixed in the amount of $6, 000 per annum beginning as of January 1st, 1962, 21. Appointment of Board Committees In accordance with the Supervisor's recommendation, on motion by Councilwoman Helwig and seconded by Council- C man Kane, it was RESOLVED, that in accordance with the Supervi- sors recommendation, the following Committees of the Board are hereby designated for the year 1962; Councilman Kane Finance, Public Works Councilman Brush Insurance, Fire, Police Councilwoman Helwig Parks, Recreation Councilman Cook Assessments, Civil De- fense, Planning and Zoning, and Miscel- laneous Affairs 22. Fixing of Dates for Town Board Meetings In accordance with the Supervisor's request, on motion by Councilman Cook and seconded by Councilwoman Hel- wig, it was RESOLVED, that regular meetings of this Board be held at 8.15 p.m. in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, on the first and third Wednes- day evening of each month of the year with the exception of June, July, August and September, during which months the Board shall meet only on the first Wednesday evening of the month. 23. Designation of Official Newspaper Following an expression of appreciation of the fine coverage given the Town during the past year, on motion by Council- man Cook and seconded by Councilwoman Helwig, it was RESOLVED, that "The Mamaroneck Daily Times" be and it hereby is designated as the official news- paper of the Town of Mamaroneck for the purpose of publishing notices. 24. Designation of Depositories for 1962 On motion by Councilman Kane and seconded by Councilman Brush, it was RESOLVED, that the following Banks and Trust Companies are hereby designated as depositories for funds of the Town of Mamaroneck for the year 1962, and that the escrow agree- ments between these bands and the Town of Mamaroneck presently in effect shall be continued. The County Trust Company The First National Bank of Mount Vernon The National Bank of Westchester The First Westchester National Bank and be it FURTHER RESOLVED, that all withdrawals from the hereinabove named accounts shall be upon the signa- ture of the Supervisor of the Town of Mamaroneck, and the counter-signature of the Comptroller of the Town of Mamaroneck. 25. Approval of Contractfor 1962 Westchester Shore Humane Society Upon presentation of the contract between the Town of Mamar- oneck and the Westchester Shore Humane Society, Inc. for 1962, on motion by Councilman Brush and seconded by Coun- cilman Kane, it was RESOLVED, that the Supervisor be and he hereby is authorized to execute the contract between the Town of Mamaroneck and the Westchester Shore Humane ,Society, Inc, for the year 1962 in the amount of $2090, 00 as provided in the 1962 an-. nual budget or estimate, 26. Approval of Contract for 1962 Larchmont Public Library Upon presentation of the contract between the Town of Mamar oneck, the Village of Larchmont, and the Larchmont Public Library for the year 1962, on motion by Councilman Cook, which was seconded by Councilwoman Helwig, it was RESOLVED, that the Supervisor be and he hereby is authorized to execute the contract for 1962 between the Town of Mamaroneck, the Village of Larchmont, and the Larchmont Public Library in the amount of $29, 478, 00 as provided in the annual budget or estimate for the year 1962. 27. Authorization of Membership Association of Towns of New York State On motion by Councilwoman Helwig and seconded by Council- man Kane, it was RESOLVED, that the Town of Mamaroneck continue its membership in The Association of Towns of the State of New York for the year 1962, 28. Authorization of Membership Municipal Finance Officers Association - -- On motion by Councilman Kane and seconded by Councilman Brush, it was RESOLVED, that the Town of Mamaroneck continue its membership in The Municipal Finance Officers Association for the year 1962. P1 29. Authorization for Execution of Lease for Town Offices The Clerk presented the lease for the rental of the Town Offices at 158 West Boston Post Road, Village of Ma- maroneck, for the year 1962 and requested that the Board authorize execution of same. Whereupon, on motion by Councilman Brush, which was seconded by Councilman Cook, it was RESOLVED, that the Supervisor be and he here- by is authorized to execute the lease for the ren- tal of the premises used for the Town of Mamar- oneck Offices, located at 158 West Boston Post Road in the Village of Mamaroneck, said lease being in the amount of $4, 500. 00 for the year 1962 as provided in the annual budget or esti- mate for that year. 30. Authorization for Amendment of Compensation Plan Upon presentation of the Town Accountant's request for the Board's authorization of the Compensation Plan for the Town of Mamaroneck as amended for the year 1962, on motion by Councilman Brush and seconded by Coun- cilman Kane, it was RESOLVED, that the salary scale of Civil Service employees of the Town of Mamar- oneck, adopted January 4th, 1961, be and it hereby is amended as follows. Whereupon, on motion by Councilman Brush and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby accepts the bid of the only bidder, Gestetner Corporation, for fur- nishing to the Town of Mamaroneck one (1) Elec- tronic Stencil Scanning Machine, in the amount of $1895, 00, b) Recreation Station Bus For the record, the Clerk presented the affidavit of publica- tion of the notice for bids, and opened and read aloud the following bids. OLD BUSINESS 1. Report - Larchmont Gardens Apartments Pursuant to the correction of violations still existing at Larchmont Gardens Apartments, the Engineer reported that representatives of the Town, the Village, and the apartment management, had met yesterday and today with the result that the management was contacting the Tenants Association and would endeavor to work out a plan of mutual cooperation in an effort to eliminate un- satisfactory conditions, effect a general clean-up and improve maintenance standards. The Board directed that this matter be continued on the agenda and that a further report of progress be sub- mitted at the next meeting with the Engineer and Build- ing Inspector continuing their inspections of the said premises in the meantime. 75 NEW BUSINESS There was no new business to come before the meeting. COMMUNICATIONS 1, Letter from Board of Elections The Clerk presented a letter from the County Board of Elec- tions advising that pursuant to the provisions of Section 64 of the Election Law.Districts 5 and 17 must be altered, divided or new districts created, and therefore requested that a Com- mittee be appointed to study the matter. Meehan, be and they here- by are appointed to a Committee to study the revision of Districts 5 and 17 and submit recommendations thereon to this Board, 2. Letter from Department of Agriculture and Markets For the Board's information, the Clerk presented a letter from the State of New York Department of Agriculture and Markets, dated December 19th, 1961, renewing for 1962 the immunity granted to the Town for scouting purposes in connection with dutch elm disease, which was ordered re- ceived and filed. In connection therewith and upon reminder by Councilwoman Helwig; on her motion, which was seconded by Councilman Cook, it was unanimously RESOLVED, that Ralph Robins be and he hereby is appointed liaison representative to the State in the conduct of the dutch elm disease survey in the Town for the year 1962. 3. Letter from the New York Fire Insurance Rating Organization For the Board's information, the Clerk presented a letter addressed to the Supervisor under date of December 27th, 1961, advising that in accordance with the Townas request, the New York Fire Insurance Rating Organization would -- make a complete inspection of the fire protection facilities of the Town, starting on Monday, January 15th, 1962, which was herewith ordered received and filed for the record, 4, Letter from Department of Audit and Control The Clerk presented a letter from the State of New York De- partment of Audit and Control inviting Town officials to at- tend a conference to be held in Garden City on January 8th with reference to a proposed recodification of the current laws governing public purchasing and conflict of interest. Whereupon, following a lengthy discussion, it was directed that Councilman Cook and/or Councilman Kane attend said hearing in person representing this Board and presenting for this Board the following resolution, which was offered on a motion by Councilman Cook, seconded by Council- woman Helwig, and upon roll call, adopted by unanimous vote, all members of the Board being present and voting: W he r e a s , the Board of Trustees of the Village of R, j Larchmont will hold a public hearing on Tuesday, January 9, 1962, at 8.15 p.m. , to consider the proposed rezoning of the Post Road Nursery property in the Village of Larchmont from resi- dence and business to business at the request of Frank Rodriquez; and W here as , the matter to be considered by that Board also appears to be of great interest and concern to the Town of Mamaroneck in view of the - fact that Town property immediately abuts the property in question, Now, Therefore , Be It Resolved , that, in accordance with the opinion and recommendations of the Town of Mamaroneck Planning Board, this Board hereby expresses its opposition to the change of zoning as proposed, or to the use of this property for a 40Regional Shop- ping Center", and requests the Board of Trustees of the Village of Larchmont to refuse to take any action favoring such use of this property as sug- gested in this proposal. With reference to the report presented by the Planning Board in this matter, Councilwoman Helwig suggested that a letter be directed to the Chairman of that Board, advising that this Board had particularly noted and heartily commended the suggestion closing the report, and suggesting that the Plan- ning Board contact the Planning Boards of both Villages and endeavor to obtain coordination in a long-range planning and development program of the Post Road area as suggested, which the Supervisor was thereupon directed to address to Mr. Maggini for this Board, The Town Attorney -- 1) Consolidated Edison - Proposed Increase in Street Lighting Rates Upon the Attorney's recommendation that the Board officially protest the proposed increase in street lighting rates, on mo- tion by Councilman Kane and seconded by Councilman Brush, it was unanimously RESOLVED, that the Town Attorney be and he hereby is authorized and directed to prepare and present this Board's official protest of the increase in street lighting rates proposed by Consolidated Edison Com- pany, 2) Retirement of Town Attorney Following the Attorney's statement that in accordance with the provisions of the New York State Employees Retirement Sys- tem, his retirement would become mandatory on the first day of the month following his 70th birthday on February 21st next, it was unanimously on a motion offered by Council- man Brush and seconded unanimously RESOLVED, that the Supervisor be and he hereby is directed to request the Civil Service Commis- sion of the State of New York to grant John L. Delius, Town Attorney, an extension of service to terminate at the expiration of his present term of office on December 31st, 1963, OTHER BUSINESS 1) Mr, John Devlin In response to the Supervisor's inquiry, Mr, John Devlin ad- dressed the Board, highly commending the Board on the ac- tion taken in the matter of the requested change of zoning of the Post Road Nursery property in the Village of Larchmont, ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared ad- journed at 9010 p.m., to reconvene on January 17th, 1962, BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was con- vened immediately upon the adjournment of the Town Board meeting, 1.
