CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. ROLL CALL Present: Supervisor Kane Councilwoman Helwig Councilman Quadrine Councilman Chalif Councilman Faiola Absent: None Also Present: Mr. Gronberg Mr. Johnston Mrs. Brewer Mr. Altieri Mr. Paonessa APPROVAL OF MINUTES The minutes of the special meeting of October 12, 1966 and the regular meeting of October 19, 1966, were presented, and on motion duly made and seconded, approved as presented. OPENING OF BIDS - Electronic Accounting Machine The Clerk presented the affidavit of publication of the Notice for Bids for the record and opened and read aloud the fol- lowing bids: Bidder Bid Burroughs Corporation $10, 400. 00 (Less allowance for Burroughs Accounting Machine 500. 00 Net Bid---------------- 9, 900. 00 The National Cash Register Co. 11, 466. 00 Allowance for Burroughs Accounting Machine 100. 00 Net Bid---- ---------- 11, 366. 00 The Board, in accord with usual procedure, referred the bids to the Town Attorney, Receiver of Taxes and Comp- troller for study and recommendation for purchase to this Board at its December 7, 1966 meeting. -1 PUBLIC HEARING - Local Law No. 3 for 1966 On motion by Councilwoman Helwig, seconded by Councilman Faiola, it was unanimously RESOLVED, that the public hearing be and it hereby is declared open. The Clerk presented the Affidavit of Publication of the Notice of Hearing for the record, and the Attorney, at the Super- - visor's request, reviewed and explained the proposed Law. The Supervisor inquired whether any one present wished to be heard on this Law as proposed - and since no one did, on motion by Councilman Quadrine, seconded by Councilman Chalif, it was unanimously RESOLVED, that the public hearing be and it hereby is declared closed. And thereupon, since the Board was ready for the question, on motion by Councilwoman Helwig, seconded by Councilman Quadrine, upon roll call, the following resolution was adopted by unanimous vote of the Board with all members present and voting: RESOLVED, that this Board hereby adopts Local Law No. 3 of the Town of Mamaroneck for the year 1966, which reads as follows: A Local Law to regulate, protect and promote the or- derly use of Conservation Areas in the Town of Ma maroneck. TITLE. This local law shall be known and cited as LOCAL LAW #3-1966 of the Town of Mamaroneck. Section 1. Definitions. Unless otherwise expressly stated, whenever used in this law, the following terms shall be deemed to mean: (a) "Conservation Committee" - the Conservation Advi- sory Committee of the Town of Mamaroneck. (b) "Town" - the unincorporated area of the Town of Mamaroneck. (c) "Conservation Area" - any place or area in the Town of Mamaroneck legally set apart and accepted as such and placed under the jurisdiction and care of the Conser- vation Advisory Committee, including any lake, pond, pool, river, brook or other body or stream of water, either natural or artificial, located therein. (d) "Permit" - a written authorization for the exercise of a specified privilege issued by the Conservation Com- mittee or its duly appointed officer. _Z_ (e) "Persons" - shall mean any individual, firm or corporation and all other entities of any kind cap- able of being sued. Section 2. Hours of use. Conservation areas of the Town shall be open to the public from dawn to dusk only. No person shall en- ter upon Conservation lands at any other time ex- cept for emergency purposes unless by written per- mit issued by the Conservation Committee or its duly authorized agent. Section 3. Interfering with Conservation Areas or improvements thereon. No person shall disturb any Conservation lands or take up or remove, or in any manner disturb or in- terfere with any trees, shrubs, plants, ,soil, sod, compost, gravel, fences, signs or any other prop- erty except by direction of the Conservation Com- mittee and under the supervision of its duly appointed custodian. Section 4. Destruction of, or injury to, property No person shall cut, break, destroy, or in any way injure or deface any tree, shrub, plant, grass, fence, post, railing, chain, sign, sign-post, tree-guard, lamp, lamp-post, bridge structure or any other property in or upon any conservation lands, nor shall any fallen trees or branches be cut or removed except by direction of the Conservation Committee. Section 5. Destruction of, or injury to, wild-life No person shall hunt, chase, shoot, trap, catch, dis- charge or throw missiles at, or disturb any living creature in any Consrervation area. Section 6. Fires and the prevention thereof No person shall make, cause or allow any fire to be set in any part of any Conservation area, or suffer or permit any person in or under his or her charge, cus- tody or control, to make or cause any fire. All cig- arettes, cigars or other such material must be thor- oughly extinguished in order to prevent fire, and no stubs, butts, matches or other such materials shall be scattered or disposed of except in designated re- ceptacles placed along the trails in the area. Section 7. Pollution, littering, rubbish and refuse No person shall throw, place, deposit, drop, excrete, discharge or leave in or on any Conservation lands or any waters therein or on any paths, walks, trails or roads thereof, any garbage, organic refuse, offal, urine, fecal or other offensive matter, ashes, cinders, 3- stone, dirt, filth, dross, rubbish, grass clippings, leaves, paper, pasteboard, wood metal, fruits, vegetables, other foodstuffs, vehicles and or parts thereof, or any manufacturing, trade or household waste, or any other refuse material, or any sub- stance or material of any nature whatsoever. Section 8. Bathing, Boating, Skating or other winter sports No person shall wade or bathe in or enter in or up- on the waters in any Conservation area; or place or enter or operate any raft, float or similar object thereon; or place or operate any toy boat or similar device thereon. No person shall skate, ski, tobog- gan, sleigh or indulge in any of the so-called winter sports in or on any Conservation area or any of the waters therein, except within such areas as the Conservation Committee may, in its discretion,: from time to time, designated and set apart for such purpose and then only at such times, in such manner and subject to such regulations as the said Committee may direct and determine. Section 9• Camping and picknicking No person shall camp, bivouac, pitch tent, picnic, feast, consume food or beverages in or upon any C n- servation area or on any of the waters, paths, or trails thereof. Section 10. Baseball and other games No person shall throw, cast, catch, kick or strike with any implement whatsoever any baseball, golf ball, football, or other object or play at any game in or up- on any Conservation lands. Section 11. Animals, Injury or possible injury to plantings No person shall tie any animal to any tree, plant or shrub, in or upon any Conservation area, or, having charge of any such animal, allow or cause it to injure any such tree, plant or shrub. Section 12. Disorderly conduct. No person shall in any recreation area (a) use any threatening, abusive or insulting language; (b) do any.obscene or indecent act; (c) throw stones or throw missiles; (d) beg or publicly solicit subscriptions or contribu- tions; (e) tell fortunes; (f) play cards or other games of chance, or use or op- erate any gaming table or instruments; (g) climb upon any tree, building, wall, fence, shel- ter, seat, sign, pole or other construction; 4 (h) fire or carry any firearms, firecrackers, tor- pedo, or fireworks; (i) make fire; (j) do any act tending to a breach of the public peace; (k) carry on any commercial activity. Section 13. Traffic regulations No person shall operate, drive, or propel, and no owner thereof shall cause or permit to be operated, driven or propelled on any Conservation area, any bi- cycle, motorcycle, motor-tricycle, automobile, or other vehicles, however propelled, or any vehicle drawn by horses or other animals recklessly or neg- ligently or at a speed or in a manner so as to en- danger the life, limb or property of any person. No person shall propel, ride, drive, or operate on any footpath, walk or elsewhere in any Conservation area, other than on the streets and roadways thereof, any bicycle, tricycle scooter, roller skates or other ve- hicles of any nature whatsoever other than baby car- riages, wheel chairs, and similar vehicles designed exclusively for the transportation of infants and of disabled persons. No horseback riding shall be per- mitted in any Conservation area. Nothing in this sec- tion shall prevent the operation of fire fighting equip- ment or police vehicles on the trails, nor shall trucks or other equipment operated by duly authorized per- sonnel under the direction of the Conservation Com- mittee be prohibited. Section 14. Parking vehicles No person shall park a motorcycle, automobile or horsedrawn vehicle in any Conservation area, except within such areas as the Conservation Committee may, in its discretion, from time to time designate and set apart for such purpose and then only at such times, in such manner, and subject to such rules and regulations as said Committee may direct and determine. No per- son shall park, place, or leave any bicycle, tricycle, scooter, wheelchair, baby carriage, or similar vehicle or any object or thing whatsoever on any footpath, walk trail, or steps or any other place designated for the use of pedestrians in any Conservation area, or in any place where such objects might or could obstruct or interfere with the free passage of pedestrians therein. Section 15. Posting bills or placards, distributing cards, circulars, or pamphlets No person shall post, affix, place or leave any bill, placard, notice or other paper in or upon any structure, tree, fence, post, railing, bench, rock article or thing within any Conservation area, nor paint, write, mark, draw, or affix with any substance or material whatsoever, thereon or therein, any advertisement, notice of exhor- tation or any other writing, drawing or making of any kind whatsoever, and no person shall distribute, hand out, -5- cast about any card, circular, pamphlet or other printed matter, or other property or material of any nature whatsoever within any Conservation area. Section 16. The violation of any of the foregoing paragraphs, provisions, and/or section of this Local Law is here- by declared to be a misdemeanor and any person vio- lating the same shall be guilty of a misdemeanor and - shall, on conviction before a Justice of the Peace, be punished by a fine not exceeding $50. 00, or in default of payment of such fine, by imprisionment not exceed- ing thirty (30) days. Section 17. If any section or part of section, paragraph or provi- sion of this Local Law be declared invalid or uncon- stitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or sections, provision or part of a provision or para- graph of this Local Law. and be it further RESOLVED, that the Town Clerk be and he hereby is authorized and directed to publish and post Notice of the adoption of the foregoing Local Law and file copies thereof with the Secretary of State and State Comp- troller of the State of New York as required by law. OLD BUSINESS 1. Applications for Swimming Pool Permits a. Mr. Edward De Martin Pursuant to direction at the last meeting, notification of the subject application was sent to the following prop- erty owners in the area of the proposed pool with replies received as noted herebelow and filed for the record: Dr. James Q. Haralambie 32 Bonnie Way Larchmont - No objection Mr. Adam Sumetz 570 Fenimore Road Larchmont - No reply Mr. and Mrs. Charles Martin 30 Bonnie Way Larchmont - No reply Village of Larchmont Larchmont - No reply -6- The Clerk then presented a memorandum addressed to the Board by the Building Inspector under date of October 31, 1966, recommending approval of the ap- plication subject to the conditions stated therein which was herewith ordered received and filed for the record. The Supervisor inquired whether anyone wished to be heard, and since no one did, the following resolution was offered on motion by Councilman Faiola, seconded by Councilwoman Helwig, and adopted by unanimous vote of the Board upon roll call with all members of the Board present and voting: WHEREAS, Mr. Edward De Martin has presented an application for a permit to construct a permanent in the ground concrete swimming pool and appurtenances on premises located at 12 Park Hill Lane, Town, and known as Block 104, Parcel 217 on the Assessment Map of the Town of Mamaroneck; and WHEREAS, the Building Inspector of the Town of Ma- maroneck has examined the plans and specifications for the proposed pool as revised and amended; and WHEREAS, the Building Inspector finds that the re- vised plans and specifications as amended and sup- plemented to include certain recommended condi- tions conform in all respects with the requirements of the Swimming Pool Ordinance (Article 23 of the Building Code), and therefore recommends that the application be approved; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. De Martin for a permit to construct a swimming pool on prem- ises located at 12 Park Hill Lane, Town, and known as Block 104, Parcel 217 on the Assessment Map of the Town of Mamaroneck, is hereby approved, and the Building Inspector is hereby authorized to issue a permit for same provided the pool is constructed in conformance with the revised plans and specifi- cations submitted and filed with the revised appli- cation as amended and supplemented to show com- pliance with the following conditions: 1. That the area adjacent to the southerly end of the pool be planted with 6'-high evergreens to form a screen. 2. That no equipment used in connection with the - pool be installed without the approval of the Building and Plumbing Inspector. 3. That no temporary or portable cabanas or awning be placed on the property. --7- 4. That any contemplated above-ground area lighting shall be shielded and directed away from neighboring properties. 5. That the pool be kept empty and no part of the structure or facilities be used until a certificate of approval is issued by the Building Department. 6. That the applicant shall obtain a Building Per- mit within thirty (30) days of the filing of this resolution with the Town Clerk and that work be completed within one (1) year of the date of said resolution. and be it further RESOLVED, that a certified copy of this resolution be forwarded to the applicant and to the Building Inspector for his files. b. Mr. and Mrs. George Kurzman Pursuant to direction at the last meeting, notification of the subject application was sent to the following prop- erty owners in the area of the proposed pool with replies received as noted herebelow and filed for the record: Mr. Carl Mydans 212 Hommocks Road Larchmont - No objection Mrs. Charlotte Lifschultz 220 Hommocks Road Larchmont - No reply The Clerk then presented a memorandum addressed to the Board by the Building Inspector under date of Octo- ber 31, 1966, recommending approval of the application subject to the conditions stated therein, which was here- with ordered received and filed for the record. The Supervisor inquired whether anyone wished to be heard, and since no one did, the following resolution was offered on motion by Councilman Faiola, seconded by Councilman Quadrine, and upon roll call, adopted by unanimous vote of the Board with all members thereof present and voting: WHEREAS, Mr. and Mrs. George Kurzman have presented an application for a permit to construct a permanent in the ground concrete swimming pool — and appurtenances on premises located at 214 Hom- mocks Road, Town, and known as Block 416, Par- cel 36 on the Assessment Map of the Town of Ma- maroneck; and -8- M1 'P WHEREAS, the Building Inspector of the Town of Mamaroneck has examined the plans and specifi- cations for the proposed pool as revised and amended; and WHEREAS, the Building Inspector finds that the revised plans and specifications as amended and supplemented to include certain recommended conditions conform in all respects with the re- -- quirements of the Swimming Pool Ordinance (Ar- ticle 23 of the Building Code), and therefore rec- ommends that the application be approved; NOW, THEREFORE, BE IT RESOLVED, that the application of Mr. and Mrs. George Kurzman for a permit to construct a swim- ming pool on premises located at 214 Hommocks Road, Town, and known as Block 416, Parcel 36 on the Assessment Map of the Town of Mamaro- neck, is hereby approved, and the Building In- spector is hereby authorized to issue a permit for same provided the pool is constructed in confor- mance with the revised plans and specifications submitted and filed with the revised application as amended and supplemented to show compliance with the following conditions: 1. That no temporary or portable cabanas or awn- ings be placed on the property. 2. That any contemplated above-ground area light- ing shall be shielded and directed away from neighboring properties. 3. That the pool be kept empty and no part of the pool or facilities be used until a certificate of completion and approval is issued by the Building Department. 4. That the applicant shall obtain a Building Per- mit within thirty (30) days of the filing of this resolution with the Town Clerk and that all work be completed within one (1) year of the date of said resolution. and be it further RESOLVED, that a certified copy of this resolution be forwarded to the applicant and to the Building In- spector for his files. NEW BUSINESS 1. Authorization for Purchase of Check-signer Pursuant to the Supervisor's request, on motion by Council- -9- woman Helwig, seconded by Councilman Chalif, it was unani- mously RESOLVED, that pursuant to Section 29 (3) of the Town Law of the State of New York, which provides for the signing of checks by facsimile signature of the Super- visor and Comptroller as reproduced by a machine or device commonly known as a Checksigner, this Board hereby authorizes the purchase of such a Checksigner machine to be used for the purpose of signing checks of the Town of Mamaroneck. 2. Appointment of Dog Enumerator for 1967 Pursuant to communication addressed to the Supervisor by the State of New York Department of Agriculture and Markets under date of October 18, 1966, and in accord with the Town Clerk's recommendation, on motion by Coun- cilman Chalif, seconded by Councilman Faiola, it was unanimously RESOLVED, that pursuant to Section 108 of the Agri- culture and Markets Law, Eugene Agnessanto of 83 Myrtle Boulevard, Town, be and he hereby is ap- pointed Dog Enumerator in the unincorporated area of the Town of Mamaroneck for the year 1967. COMMUNICATIONS 1. Request of Planning Board for Approval of Bond Reduction - Murdock Woods Pursuant to request of the Planning Board, dated October 27, 1966, as herewith presented and ordered received and filed for the record, on motion by Councilman Quadrine, seconded by Councilman Chalif, it was unanimously RESOLVED, that this Board hereby authorizes the re- duction of the Performance Bond for the construction of roads, drains, etc. in the Murdock Woods - Sec- tion 5 sub-division, from $200, 000. 00 to $20, 000. 00, pursuant to recommendation of the Town Engineer and resolution adopted by the Planning Board of the Town of Mamaroneck on October 4, 1966, and here- with filed for the record. Z. Letter of Resignation - William Aitchison The Clerk presented a letter addressed to the Board by William Aitchison under date of October 24, 1966, tendering -- with regret his resignation as Intermediate Account Clerk of the Town of Mamaroneck, effective November 9, 1966, be- cause of securing another position both more attractive fi- nancially and from the standpoint of advancement. -10- 25 The members of the Board expressed their apprecia- tion of Mr. Aitchison's service, their regret at his loss and best wishes for his future, which the Supervisor was requested to convey to him. And thereupon, on motion by Councilwoman Helwig, seconded by Councilman Faiola, it was unanimously RESOLVED, that this Board hereby accepts with regret the resignation of William Aitchison, In- termediate Account Clerk of the Town of Mamar- oneck, effective as of November 9, 1966. REPORTS The Town Clerk -- The Clerk presented the following reports which were herewith ordered received and filed for the record: Report of the Receiver of Taxes and Assessments for the month of October, 1966. Report of the Westchester Shore Humane Society, Inc. for the month of October, 1966. Report of Receipts and Disbursements of the Town of Mamaroneck for the period from January 1 through September 30, 1966. Affidavits of Publication and Posting of the Resolution authorizing acquisition of the Thruway Surplus prop- erty (Ref. 69) as required under law. The Supervisor -- 1. Letter from Edward Fischer Superintendent of Highways The Supervisor reported receipt of a letter from Edward Fischer, Superintendent of Highways of the Town of Ma- maroneck, under date of October 25, 1966, tendering his resignation from that position, effective October 26, 1966. The resignation was accepted as submitted pursuant to law and the communication ordered received and filed as part of the record of this meeting. 2. Resolution, Village of Larchmont Appointment of Dr. Joseph C. McLain — to Library Board of Trustees For the record, the Supervisor presented the resolution adopted by the Village of Larchmont Board of Trustees appointing, in conformance with this Board's recom- -11- mendation, Dr. Joseph C. McLain of 4 Birch Road, Town, to the Board of Trustees of the Larchmont Public Library, which was herewith ordered received and filed. Councilman Chalif -- Councilman Chalif stated that he had no report at this time. Councilwoman Helwig -- 1. Proposition No. 1 Councilwoman Helwig presented, distributed and explained materials published in support of Proposition No 1 which is to be voted on November 8th, requesting that the Board do all possible to urge support of this Proposition. 2. County Hearing - Soil and Water District Councilwoman Helwig advised that Mrs. Edward Munzer of the Conservation Advisory Committee would appear in be- half of the Committee at the Board of Supervisors Hearing on November 7th, in support of the formation of a Soil and Water District in Westchester County. 3. Expense Authorization - Regional Plan Conference Pursuant to request of Councilwoman Helwig, on motion by Councilman Faiola, seconded by Councilman Quadrine, it was unanimously RESOLVED, that Councilwoman Helwig be and she hereby is authorized to represent the Town of Ma- maroneck at the Regional Plan Conference in New York City, with expenses in a sum not to exceed $10. 00 paid by the Town. 4. Apportionment Councilwoman Helwig presented the following petition from the Assessor requesting correction of the assessment roll so as to permit the apportionment of taxes, and on her motion, seconded by Councilman Chalif, the following reso- lution was adopted unanimously WHEREAS, the Assessor has presented the following petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Adminis- trative Code, known as the Westchester County Tax Law; and WHEREAS, after due deliberation, this Board finds it desirable to grant said petition for the correction of said assessment roll: NOW, THEREFORE, BE IT -12- Jam t RESOLVED, that the assessment roll of 1966, taxes of 1967, which shows property now appearing on the roll as follows: Block Parcel Name Land only 815 813 Lucy Savone $ 2, 700 be corrected as follows in accordance with the pro- visions of subdivision 5 of Section 557: Block Parcel Name Land only 815 813 Lucy Savone 2, 650 815 821 Laurina Signorelli 50 5. Elementary School Science Association Conference (Not on Agenda) Councilwoman Helwig advised the Board that the Con- servation Advisory Committee had been invited to be present and to have an exhibit at the New York City Ele-:-:- mentary Science Association Fall Conference -- and that it was an honor to be so included. Councilman Quadrine -- Councilman Quadrine presented oral informational re- ports on the following: a. Drains, Avon Road and Hartung Street - work pro- gressing well with Avon Road soon to be completed. b. Incinerator Summary, Metcalf & Eddy - that a re- port on the proposed expansion plans, being re- viewed by this renouned firm at no cost to the Town, would be presented shortly. c. Fill - County Sewage Disposal Plant - that the Town was receiving a gift of fill from the County Disposal Plant through the generosity of Mr. Edward Meehan, who was in charge of present construction work on that site. He explained that the 400 yards of fill could be moved by the Town Highway Department in one day with no "out of pocket" money outlay by the Town. Councilman Faiola -- - 1. Report on Proposed Parking Restrictions on Myrtle Boulevard Councilman Faiola advised the Board that the Board of Police Commissioners reported that it agreed with the rec- ommended restriction of parking on the south side of Myrtle -.13- Boulevard along the curb from Weaver Street to the Lake except where the openings between the Islands are lo- cated, and would proceed to draw up the necessary Ordi- nance and post signs. He requested that a public hearing be held on such Ordi- nance as soon as possible and that the residents of the area be given notification of the change. - Z. Reconstruction of Maxwell Avenue Councilman Faiola requested that consideration be given to parking conditions on Myrtle Boulevard in view of the starting of the reconstruction of Maxwell Street and result- ing shifting of cars formerly parked there to Myrtle Boule- vard - where quite a problem comes about therefrom. The Town Attorney -- 1. Cancellation of Tax Liens Block 313 - Parcel 271 Pursuant to the Attorney's request for authorization for cancellation of the following taxes, on motion by Council- woman Helwig, seconded by Councilman Chalif, the follow- ing resolution was adopted unanimously RESOLVED, that the following tax liens held by the Town of Mamaroneck and covering tax parcels owned by the Town of Mamaroneck be cancelled and the rec- ord of such tax liens marked paid and cancelled: On Block 313, Parcel 271 -- $87. 06 as follows: Year of Sale Amount of Lien 1956 $ 3. 91 1957 7. 07 1958 7. 19 1959 7. 65 1960 7. 91 1961 8. 11 1962 8. 21 1963 8. 64 1964 9. 20 1965 9. 39 1966 9. 78 2. Revocation of Permit to Solicit Norman T. Maynard Pursuant to the Attorney's request and memorandum of infor- mation of the Chief of Police under date of November 2, 1966, herewith presented and filed for the record, on motion by Coun- cilman Faiola and seconded by Councilman Quadrine, it was unanimously -14- 429 RESOLVED, that pursuant to Section 10 of Chapter 8 of the General Ordinances of the Town of Mama- roneck, the Permit to Solicit issued to Norman T. Maynard on September 26, 1966, be and it here- by is revoked. 3. Approval of Performance Bond Soundview Woods, Section 3 In accordance with the Planning Board' s request and the Attorney' s recommendation, on motion by Councilman Faiola, seconded by Councilman Chalif, it was unanimously RESOLVED, that this Board in accordance with the request of the Town of Mamaroneck Planning Board, and recommendations of the Town Engineer and Attorney, hereby approves the Performance Bond No. 755660, in the amount of $27 , 000. 00, dated October 10, 1966, upon which the Continen- tal Casualty Company is Surety, and Investors Collateral Corp. , of 166-11 Hillside Avenue, Jamaica, New York, is Principal, for the "subdivision of Soundview Woods, Section 3, located on property known and described as Block 228, Parcels 46 and 75 on the Tax Assess- ment Map of the Town of Mamaroneck, as authorized by resolution adopted June 22, 1966 by the Plan- ning Board of the Town of Mamaroneck.
