CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. ROLL CALL Present: Supervisor Kane Councilwoman Helwig Councilman Quadrine Councilman Chali£ Councilman Faiola Also Present: Mr. Gronberg - Town Clerk Mrs . Brewer - Deputy Clerk Mr. Johnston - Town Attorney Mr. Altieri - Comptroller Mr. Widulski - Engineer APPROVAL OF MINUTES On motion duly made and seconded, the minutes of the Regular Meeting of April 6, 1966 were approved as submitted. OLD BUSINESS 1. Application - Bonnie Briar Country Club - Permit to Construct Reservoir The Supervisor called on Councilman Quadrine to whom this application had been referred at the last meeting. Councilman Quadrine and the Town Engineer then presented the plan as amended in accord with Councilman Quadrine ' s and the Town Engineer ' s recommendations and thereupon since there were no further questions regarding the appli- cation, on his motion seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby approves the application of Bonnie Briar Country Club for a permit to construct a reservoir as set forth in the Plans and Specifications as amended and herewith filed with said application; and be it further RESOLVED, that the Engineer be and he hereby is authorized to issue a building permit for the aforementioned construction. -1- rl .3 2 . Appointment - Board of Review Following the Supervisor ' s explanation of the procedure followed by the Town in appointing' a Board of Review, and his request for nominations therefor, the following names were submitted. Councilwoman Helwig placed in nomination the name of William G. Massey, Jr. of 290 Weaver Street, Town, to sE�rvP as Chairman and after presenting a brief resume of his qualifications and experience, and highly commending his former service, on her motion, seconded by Councilman Quadrine, it was unanimously RESOLVED, that pursuant to Section 529 of Chapter 852 of the Laws of 1948 (Westchester County Administrative Code) , William G. Massey, Jr. , a resident tax- payer of the Town of Mamaroneck, be and he hereby is appointed a member and Chairman of the Board of Review, to sit on Tuesday, Wednesday, Thursday and Friday, June 21, 22, 23 and 24, 1966, from 10:00 a. m. to 4 :00 p. m. daily, and to be compensated at the rate of $62 .50 per day but not to exceed the total sum of $250.00. Councilman Quadrine then placed in nomination the name of William H. Johnson of 225 Maple Street, Village of Mamaroneck, and after presentation of a brief resume and commendation of his former ser- vice on said Board, on his motion, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that pursuant to Section 529 of Chapter 852 of the Laws of 1948 (Westchester County Administrative Code) , William H. Johnson, a resident taxpayer of the Town of Mamaroneck, be and he hereby is appointed a member of the Board of Review, to sit on Tuesday, Wednesday, Thursday and Friday, June 21, 22, 23 and 24, 1966, from 10 :00 a. m. to 4 :00 p. m. daily, and to be compensated at the rate of $62. 50 per day but not to exceed the total sum of $250. 00. Councilman Chalif placed in nomination the name of Alan F. Gray of 46 Mayhew Avenue, Village of Larchmont, and following a brief resume and tribute of his past service, on his motion, seconded by Councilman Faiola, it was unanimously RESOLVED, that pursuant to Section 529 of Chapter 852 of the Laws of 1948 (Westchester County Administrative Code) , Alan F. Gray, a resident taxpayer of the Town of Mamaroneck, be and he hereby is appointed a member of the Board of Review -2- to sit on Tuesday, Wednesday, Thursday and Friday, June 21, 22, 23 and 24, 1966, from 10:00 a. m. to 4 :00 p. m. daily, and to be compensated at the rate of $62. 50 per day but not to exceed the total sum of $250. 00, and be it further RESOLVED, that the aforementioned appointees be so notified in accordance with the fore- going resolutions. 3. Alteration of Election Districts The Clerk presented the following memorandum address- ed to the Board under date of April 18, 1966, "The attached map shows the alteration of the Eighth and Tenth Election Dis- tricts and the creation of the Twenty- Fifth Election District. "These changes have the approval of the Republican and Democratic Town Chairmen. "If this proposal is acceptable, the vote by districts at present would be as follows: 8th District 655 10th District 684 25th District 269 " Whereupon, following the Supervisor ' s observation that the proposed changes were in the best interest of the community and convenience of the voters, on motion by Councilwoman Helwig, seconded by Councilman Chalif, it was unanimously RESOLVED that the Election District Map submitted at this meeting, as amended, altering the Eighth and Tenth Election Districts and the creation of the Twenty- Fifth Election District in the Town of Mamaroneck be and it hereby is approved; and be it further RESOLVED that the boundaries of said Eighth, Tenth and Twenty-Fifth Election Districts in the Town of Mamaroneck, as shown on said map, be and they hereby are described as follows : District No. 8 Bounded on the south by Long Island Sound, on the east by the Village of Larchmont- Town of Mamaroneck boundary line; on the north by the center line of Boston Post -3- Road; on the west by the center line of Beach Avenue from its intersection with the Boston Post Road to the center line of Oak Avenue; and the center line of Oak Avenue from its intersection with the center line of Beach Avenue to its intersection with the center line of Larchmont Avenue, and the center line of Larchmont Avenue from its intersec- tion with the center line of Oak Avenue to its intersection with the center line of Park Avenue, then along the center line of Park Avenue from its intersection with the center line of Larchmont Avenue through Larchmont Manor Park to Horseshoe Harbor and the waters of Long Island Sound. District No. 10 Bounded on the south by the waters of Long Island Sound, on the west by the Village of Larchmont-Town of Mamaroneck boundary line; on the north by the center line of Boston Post Road; on the east by the center line of Beach Avenue from its intersection with the Boston Post Road to the center line of Oak Avenue, then along the center line of Oak Avenue from its intersection with the center line of - - Beach Avenue to its intersection with the center line of Larchmont Avenue, then along the center line of Larchmont Avenue from its intersection with the center line of Oak Avenue to its intersection with the center line of Park Avenue, then along Park Avenue from its intersection with the center line of Larchmont Avenue through Larchmont Manor Park to Horseshoe Harbor and the waters of Long Island Sound. District No. 25 Beginning at a point where the boundary line between the City of New Rochelle and the Town of Mamaroneck intersects the center line of the New York, New Haven and Hartford Railroad tracks ; thence easterly along the center line of the New York, New Haven and Hartford Rail- road tracks to its- intersection with the boun- dary line between the Village of Larchmont and the Town of Mamaroneck; thence southerly along said boundary line to the center line of Boston Post Road ; thence easterly along the center line of Boston Post Road to its intersection with the center line of the Village of Larchmont-Town of Mamaroneck boundary line; thence southerly along the Village of Larchmont-Town of Mamaroneck boun- dary line to the highwater line of Long Island -4- �';_:, Sound; thence southwesterly and north- westerly along the high water line of the waters of Long Island Sound to its intersection with the boundary line between the City of New Rochelle and the Town of Mamaroneck; thence in a generally northerly direction along the said City of New Rochelle-Town of Mamaroneck boundary line to the point or place of beginning. NEW BUSINESS 1. Applications for Swimming Pool Permits a) Dr. and Mrs. Richard D. Meyers 20 York Road, Town The Clerk presented the application of Dr. and Mrs. Meyers for a swimming pool permit as submitted to the Building Inspector under date of April 4, 1966, together with the Building Inspector ' s memor- andum of April 15th, recommending that the applica- tion be granted subject to the conditions set forth therein, which were herewith ordered received and filed for the record. The Board, in accord with usual procedure, directed that the neighboring property owners be notified of this application and that the matter be deferred to the May 4th meeting in order to allow time for the members of the Board to personally in- spect the site of the proposed pool and afford those notified an opportunity to reply if desired. b) Mr. William Byrnes 7 Cornell Street , Town The Clerk presented the application of Mr.William Byrnes for a swimming pool permit as submitted to the Building Inspector under date of April 8, 1966, to- get-her with the Building Inspector ' s memorandum of April 15th, recommending that the application be granted subject to the conditions set forth therein, which were herewith ordered received and filed for the record. Letter - Martin L. Bloch The Clerk presented a letter addressed to the Town Council under date of April 9, 1966 by Martin L. Bloch, offering verbatim reporting services, which was herewith ordered received and filed for the record. 2. Board of Education - Request to Use Voting Machines Pursuant to request of the Board of Education dated April 5 , 1966 herewith presented and filed for the record, on motion by Councilman Faiola, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby grants the request of the Board of Education to use three (3) voting machines for the school elections at the Junior High School on May 3, 1966. 3. Meeting Notices - a) Harrison Town Board - Amendment of Zoning Ordinance. b) Village of Larchmont - Board of Appeals c) Village of Larchmont - Board of Trustees The Clerk presented the aforementioned notices of meetings which were herewith ordered received and filed for the record upon the Attorney ' s advice that no action was required by this Board. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed for the record: Report of Westchester Shore Humane Society, Inc. for the month of March, 1966. Report of Municipal Dog Patrol for the month of March, 1966. The Supervisor -- 1. Letter from Mrs. Pasquale Loiaconi The Supervisor read for the Board ' s information a letter addressed to the Councilmen and himself by Mrs. Pasquale Loiaconi in appreciation of the resolution adopted by this Board in memoriam to her husband at its March 16th regular meeting. -6- 2 . Proclamation The Supervisor presented a communication addressed to him by the National Elks requesting that the week of May 1 through May 7, 1966 be proclaimed Elks National Youth Week, and thereupon on motion by Councilman Quadrine, seconded by Councilman Faiola, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized on behalf of the Board, to proclaim the week of May 1 through May 7, 1966 as ELKS NATIONAL YOUTH WEEK throughout the Town of Mamaroneck. 3 . Lease for Town Offices (Not on Agenda) The Supervisor explained the proposed extension of the lease for the Town Offices and requested that he be authorized to execute same on behalf of the Town subject to approval by the Town Attorney. Councilwoman Helwig stated that since the Board had discussed this at considerable length, it was her recom- mendation that the Supervisor be so authorized and there- upon on her motion, seconded by Councilman Chalif, it was unanimously RESOLVED, that the Supervisor be and he is authorized to execute the lease for the Town Offices of the Town of Mamaro- neck located at 158 West Boston Post Road, Mamaroneck, subject to approval of the Town Attorney. Councilman Chalif - 1. Insurance (Not on Agenda) Councilman Chalif reported that the Insurance Study was progressing and that a report would be submitted in the near future. Councilwoman Helwig - 1 . Apportionments Councilwoman Helwig requested authorization of the following petitions submitted by the Assessor for the correction of the assessment roll so as to permit the apportionment of taxes, and thereupon on her motion, seconded by Councilman Quadrine, the following resolu- tion was adopted by unanimous vote: -7- WHEREAS, the Assessor has presented petitions for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Administrative Code, known as the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petitions for the correction of said assessment roll: NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1965 , taxes of 1966, which shows property now appearing on the roll as follows: Block Parcel Name Land Imp. Report - Thruway Noise Abatement Committee Councilwoman Helwig reported to the Board that Rep. Theodore Kupferman, Congressman of the 17th District, had requested the Committee to forward all -8- available data on the Noise Abatement Bill as he was endeavoring to introduce similar legislation at the national level. She advised that all such information had, of course, been forwarded to Rep. Kupferman and that it was very gratifying indeed to the Committee to be the recipient of such a request. Councilman Quadrine -- 1. Bid Authorizations a) Garbage Truck Pursuant to memorandum of the Town Engineer dated April 15, 1966 herewith presented and filed for the record on motion by Councilman Quadrine, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the Town Engineer to prepare specifications for the purchase of one (1) new (1966) 31000 GVW garbage truck chassis and sixteen (16) cubic yard body load packer body, and be it further --- RESOLVED, that the Town Clerk, in accordance with law, hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, "The Daily Times", Notice for Sealed Bids to be opened and read aloud on May 4, 1966 at meeting of this Board, for furnishing to the Town of Mamaro- neck Sanitation Department, aforemen- tioned garbage truck in accordance with the specifications set forth in said Notice. b) Utility Truck Pursuant to memorandum of the Town Engineer dated April 15 , 1966 herewith presented and filed for record, on motion by Councilman Quadrine, seconded by Councilman Chalif, it was unanimously RESOLVED, that this Board hereby - authorizes the Town Engineer to prepare specifications for the purchase of one (1) new (1966) 15, 000 lb. GVW Chassis and utility type body including telescopic lift -9- device, 8000 watt generator and miscel- laneous controls, and be it further RESOLVED, that the Town Clerk in accor- dance with law, hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, "The Daily Times", Notice for Sealed Bids to be opened and read aloud on May 4, 1966 at meeting of this Board, for furnishing to the Town — of Mamaroneck the aforementioned chassis and utility type body in accordance with the specifications set forth in said Notice. c) Street Lighting Fixtures Pursuant to memorandum of the Town Engineer dated April 15 , 1966 herewith presented and filed for the record, on motion by Councilman Quadrine, seconded by Councilman Faiola, it was unanimously RESOLVED, that this Board hereby authorizes the Town Engineer to prepare specifications for the purchase of street lighting fixtures used in the street lighting improvement pro- gram, and be it further - RESOLVED, that the Town Clerk, in accordance with law, hereby is authorized to publish in the official newspaper of the Town of Mamaro- neck, "The Daily Times" , Notice for Sealed Bids to be opened and read aloud on May 18, 1966 at meeting of this Board, for furnishing to the Town of Mamaroneck Street Lighting Dis- trict, the aforementioned street lighting fixtures in accordance with the specifications set forth in said Notice. 2. Authorization - Purchase and Installation of Parking Meters a) Station Parking Lot Pursuant to memorandum of the Town Engineer dated April 15, 1966 herewith presented and filed for the record and following some discussion and advice of the Comptroller, on motion by Councilman Quadrine, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the purchase of thirty (30) parking meters in accordance with the specifications set forth in the aforementioned memorandum, for a total cost not to exceed the sum of $2, 200. , and be it further -10- RESOLVED, that this Board hereby authorizes the transfer of a sum not to exceed $2, 200. from General Town Surplus to Enterprises- Parking Fields A/C 401. b) Vine Street Pursuant to memorandum of the Town Engineer dated April 15, 1966 herewith presented and filed for the -- record, and following some discussion and advice of the Comptroller, on motion by Councilman Quadrine, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the purchase of ten (10) parking meters in accordance with the specifications set forth in the memorandum herewith filed, for a total cost not to exceed the sum of $500. 00, and be it further RESOLVED, that this Board hereby authorizes the transfer of a sum not to exceed $500. 00 from General Town Surplus to Enterprises- Parking Fields A/C 401A. 3. Prince Willow Sewer (Not on Agenda) Councilman Quadrine reported to the Board that the preparation of the Plans and Specifications for the proposed Prince Willow sewer was proceeding. Councilman Faiola -- 1. Report - Family and Youth Committee Councilman Faiola submitted the minutes of the Larchmont-Mamaroneck Committee on Family and Youth and informed the Board of the following changes in the Advisory Board List: Additions to: Counseling Division - Mr. Eugene Talgo 419 Warren Avenue Mamaroneck. Municipal Liaison - Mr. Raymond P. Faiola 10 Woody Lane Larchmont. Service Organ - Dr. Joseph Roth 91 Palmer Avenue Larchmont -11- and the deletion of Mr. James Gunn, Mr. Raymond Faiola and Mr. Kenneth Lein from the Service Organ. Town Attorney - The Attorney reviewed the procedure for amending the Ordinance particularly calling attention to the length of time amendment required, and recommended that rather than amend the Ordinance the Board adopt a Local Law which would empower the Supervisor to impose or remove restrictions on --- using water and thus implement changes with the same dis- patch the villages and cities enjoyed under their laws. The Supervisor presented a statement submitted by George Straub, Manager of the Westchester Joint Water Works under date of March 21, 1966, which recommended that the present restrictions be removed to permit the re-establish- went of lawns and shrubbery this spring, and thereupon since the Board agreed with the Attorney's recommendation, follow- ing the Supervisor's commendation of the Attorney's good thinking in this instance, it was on motion by Councilwoman Helwig, seconded by Councilman Chalif, unanimously RESOLVED, that a public hearing be held by this Board at its next regular meeting on Wednesday, May 4, 1966, at 8:15 p. m. in the Council Room of the Weaver Street Firehouse, Weaver Street and Edgewood Avenue, Town of Mamaroneck, to consider the adoption of a Local Law empowering the Supervisor to impose and remove prohibitions and restrictions on the use of water obtain- ed from the Town water supply which is not essential to public well-being and authoriz- ing the Supervisor to terminate water service and impose penalties for the violation of _ tbTsrlaw; and be it further RESOLVED, that the Clerk be and he hereby is authorized to publish such Notice in the official newspaper of the Town of Mamaroneck, "The Daily Times", as required by law. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:10 p. m. , to reconvene on May 4, 1966. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims Commissioner Faiola presented for approval and authorization of payment the Fire Department claims, and thereupon on his motion, seconded by Commissioner Helwig, it was unanimously -12- RESOLVED, that the following Fire Department claims as audited by the Comptroller and approved by the Fire Chief are approved, and the Supervisor and Comptroller are authorized to pay the same out of the Fire Department budget: R. Other Business a) Report on Insurance Rating Commissioner Faiola advised the Board that progress was being made in the matter of obtaining a better Fire Insurance Rating. -- b) Presentation of Badges The Fire Chief presented to each Commissioner a Town of Mamaroneck Fire District #1 badge which were received with appreciation. 5.
