CALL TO ORDER The Supervisor called the meeting to order at 8:15 p. m. ROLL CALL Present: Supervisor Kane Councilwoman Helwig Councilman Quadrine Councilman Chalif Councilman Faiola Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Deputy Clerk Mr. Altieri - Comptroller Mr. widulski - Town Engineer APPROVAL OF MINUTES On motion duly made and seconded, the minutes of the Regular Meeting of March 2, 1966 were approved as submitted. OLD BUSINESS a. Report on Bids for Supervisor ' s Car Pursuant to recommendation of the Comptroller, Engineer and Attorney, on motion by Councilwoman Helwig, seconded by Councilman Quadrine, it was unanimously RESOLVED, that this Board hereby accepts the low bid, to-wit the bid of Flinn Motor Corp. in the amount of $2, 183.67 for furnish- ing to the Supervisor one (1) automobile in conformance with the details set forth in the specifications therefor. Following explanation by the Comptroller that the aforementioned low bid was $183 .67 over the budget appropriation thereby necessitating a -1- transfer of funds, on motion by Councilman Quadrine, seconded by Councilman Faiola, it was unanimously RESOLVED, that this Board hereby authorizes the transfer of $183 .67 from General Town Contingency to the Department of Engineer A/C203. b. Application of Bonnie Briar - Special Permit - Parking Area At the Supervisor ' s request, the Engineer reviewed the application together with the recommendation sub- mitted by the Planning Board, herewith ordered filed for the record, which report stated that the applica- tion required a Special Permit as provided for in Section 432 of the Zoning Ordinance of the Town of Mamaroneck, and thereupon on motion by Councilman Quadrine, seconded by Councilman Chalif, it was unanimously RESOLVED, that a public hearing on the aforementioned application for a Special Permit be held before this Board on April 6, 1966, and be it further RESOLVED, that the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaro- neck, The Daily Times, Notice of said hearing as required by law. Amendment of Planning Board Rules & Regulations (Increase of Fees) Upon presentation of a report from the Planning Board proposing to increase certain fees and herewith ordered received and filed for the record, following the Attorney' s advice that the Planning Board must hold a public hearing on such proposed amendment and then sub- mit report of its action thereupon to this Board, on motion by Councilman Chalif, seconded by Councilwoman Helwig, it was unanimously -4- RESOLVED, that the Planning Board report, dated March 16, 1966, concerning the proposed amendment to the Planning Board ' s Rules and Regulations so as to increase cer- tain fees, be re-submitted to said Planning Board for public hearing before that Board as provided by law, with report of the Planning Board ' s action following such hearing submitted to this Board. c. Approval of Reduction of Perfor- mance Bond (Leatherstocking Lane) Upon Councilman Quadrine ' s request and motion by him, seconded by Councilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes the reduction of the Performance Bond for the construc- tion of roads, drains, etc. in the Leatherstocking Lane Subdivision from $64, 000. to $30, 000. pursuant to the recommendation of the Town Engineer and resolution adopted by the Planning Board of the Town of Mamaroneck on March 1, 1966 and herewith filed for the record. COMMUNICATIONS a. Acknowledgement of Resolution - Senator Gioffre The Clerk presented a letter addressed to him by Senator Anthony B. Gioffre dated March 8, 1966 acknowledging receipt of a copy of a resolution adopted by the Town Board, expressing its opposi- tion to Mayor Lindsay' s Commutters ' Income Tax proposal, herewith ordered received and filed for the record. b. Resolution from City of Mt. Vernon, New York The Clerk presented a letter addressed to him by the City Clerk of the City of Mount Vernon dated March 14, 1966 protesting the proposal of Mayor Lindsay to impose personal income tax on commuters, which was herewith ordered received and filed for the record. C. Acceptance of Voting Machine - Westchester Day School With reference to the disposal of old voting machines and pursuant to resolution adopted on July 21, 1965 and -5- further resolution of January 26, 1966, upon the Clerk' s request, on motion by Councilman Faiola, seconded by Councilman Chalif, it was unanimously RESOLVED, that this Board hereby authorizes the transfer of "old" Voting Machine #7713 to the West- chester Day School in accordance with communication addressed to the Town Clerk by Dr. S. Maurice Plotnick, Headmaster, under date - of March 11, 1966. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed: Report of the Municipal Dog Patrol for the month of February 1966. Annual Report of the Supervisor of the Town of Mamaroneck for the year ended December 31, 1965 . The Supervisor -- a. Death of Pasquale Loiaconi - former Town Highway Employee The Supervisor advised the Board of the death of Pasquale Loiaconi, former member of the Town Highway staff who had served the Town for forty years and following the Board ' s expression of sorrow, on unanimous motion it was RESOLVED, that at the close of the business session this meeting stand adjourned in memory of Mr. Pasquale Loiaconi and that the Supervisor forward to Mrs. Loiaconi the In Memoriam resolution unanimously adopted with the Board ' s sympathy and deepest condolences. b. Tribute to Police Officers Peritano and Costello Following the Supervisor ' s brief resume of the ceremony on March 19, 1966 at Police Headquarters at which the American Red Cross Life Saving Awards were presented to Officers Peritano and Costello for saving the life of four- week-old Renee Piacitelli when responding to an emergency call and following each of the Councilmen ' s congratula- tions and high commendation of Officers Peritano and Costello, on unanimous motion it was -6- A RESOLVED, that this Board hereby congratu- lates Police Officers Ralph Peritano and John Costello on receiving the American Red Cross Life Saving Award for their meritori- ous action in saving the life of four-week- old Renee Piacitelli on December 18, 1965; and be it further RESOLVED, that Officers Peritano and Costello -- are hereby highly commended for their dispatch, their sound judgment and the exercise of the technical skills vital in this emergency situ- ation prior to the arrival of the physician; and be it further RESOLVED, that this resolution, unanimously adopted by this Board in tribute to the said officers, be incorporated in their service records and spread upon the minutes of this meeting as a public tribute, with a copy for- warded to Messrs. Peritano and Costello with the grateful appreciation and highest commen- dation of this Board. C. Annual Report of Police Department - 1965 Discussion of this report was deferred to the next meeting. d. Fixing of Date for Tax Lien Sale - (May 18, 1966) For the Board' s information, Supervisor Kane announced that the date of Wednesday, May 18, 1966, had been recom- mended as the date for the 1966 tax lien sale in memoran- dum of the Receiver of Taxes, herewith ordered received and filed for the record, and on motion by Councilman Faiola, seconded by Councilwoman Helwig, it was unanimous- ly RESOLVED, that Wednesday, May 18, 1966, be and it hereby is designated as the date for the 1966 Tax Lien Sale of the Town of Mamaroneck, at 10: 00 a. m. e. Project - "Medicare Alert" The Supervisor presented a letter signed by Mrs . Edward H. Weinberg, dated March 7, 1966, urging the senior citizens of Mamaroneck to sign up for Medicare before March 31, 1966, which was ordered received and filed for the record, with Medicare information to be circulated to the offic e staff and in every possible way. -7- Councilman Chalif -- a. Insurance Councilman Chalif advised the Board that he had received all of the insurance information he had requested and that a full report thereon would be submitted to the Board at the conclusion of his study. Councilwoman Helwig -- a. Authorization for Engagement of Secretary for Joint Planning Meetings. Pursuant to Councilwoman Helwig ' s request, on motion by Councilman Faiola, seconded by Councilman Chalif, it was unanimously RESOLVED, that secretarial services be provided for two Joint Planning Committee meetings for the Unincorporated Area of the Town, to be held on March 17th and March 23rd, 1966, said services to be com- pensated at the rate of $3.12 per hour in an amount not to exceed the total sum of $50. 00 and be it further RESOLVED, that the transfer of the sum of $50.00 from Part Town Contingency to Joint Planning Committee be and it hereby is authorized. Councilman Quadrine -- a. Proposed Bills - Real Property Tax Law (Not on Agenda) Councilman Quadrine verbally reported on two proposed bills to amend the Real Property Tax Law, discussion of which was deferred to the next meeting of the Board. Councilman Faiola -- a. Fire Insurance Rating Councilman Faiola reported on the progress being made with regard to the Fire District Insurance Rate, stating that pre- -- paration of the new Underwriter ' s survey was under way. -g- s'a re c The Town Attorney -- a. Adoption of Resolution for Continuance of Youth Council Pursuant to the Town Attorney's report and on his recommendation, on motion by Councilman Faiola, seconded by Councilwoman Helwig, both of whom testi- fied to the fine job performed by the Youth Council during the past year and to the Town ' s good fortune -- in having such a group, the following resolution was unanimously adopted: WHEREAS, it has been found that a Youth Service Project is beneficial to the youth of the Town of Mamaro- neck, as well as to the community in general; BE IT THEREFORE RESOLVED: That the Town of Mamaroneck does here- by continue the Youth Service Project as established under authority of Chapter 636 of the Laws of 1956, as amended, Article 19-A of the Executive Law; and That such project or program included therein the Youth Council known as the "Larchmont-Mamaroneck Committee on Family and Youth" , to administer such program or project; and That said Youth Council shall have the power and it shall be its duty to: 1. Co-ordinate, co-operate and contact existing services or agencies work- ing with and concerned with youth and their problems, including, but not limited to: schools, churches, employers, service clubs and organi- zations, welfare departments, police, municipal boards, courts and similar organizations ; 2. Assist youth with their problems ; 3. Foster educational, vocational or instructional programs in connection with youth; 4. Study and analyze conditions and statistical records and data on youth and their problems and make recommen- dations related to the same; -9- 5 . Do all things necessary and desirable to carry out the powers and duties herein granted, as well as those powers and duties set forth by the New York State Division of Youth; and 6. File an annual report with the Town Board of the Town of Mamaroneck. That the said Youth Council is hereby authorized to act for the Town of Mamaroneck and apply to New York State for any and all benefits as provid- ed by law; and That the Town Board of the Town of Mamaroneck reserves the right to audit all expenditures upon which claim for reimbursement are to be based; and That the Youth Council may adopt and amend rules and regulations for the conduct of its own affairs ; and That the term of office of the members of said Youth Council shall be for a period of one year ; and That this entire resolution is subject to passage of the same resolution by the Village of Larchmont and the Village of Mamaroneck. b. Report - Bill to Amend Real Property Tax Law as it Would Apply to the Intro- duction of the Equalization Rate in a Certiorari Trial. Following a detailed explanation of the said proposed bill by the Town Attorney and on his recommendation, the Board directed that the Attorney address letters to the legislators concerned enclosing therewith copy of the following resolution: RESOLUTION URGING THE MEMBERS OF THE STATE LEGISLATURE TO SUPPORT RICHARD A. CEROSKY' S PROPOSED BILL (A. I . #2189 AND COMPANION BILL S. I. #2444) TO AMEND SECT. 720 OF THE REAL PROPERTY TAX LAW, TO PROVIDE THAT IN A PROCEEDING TO REVIEW AN ASSESSMENT OF REAL PROPERTY, HEREAFTER COMMENCED, EVIDENCE MAY NOT BE GIVEN BY EITHER PARTY AS TO THE STATE EQUALIZATION RATE ESTABLISHED FOR THE ROLL CONTAINING THE ASSESSMENT UNDER REVIEW. WHEREAS, this Board strongly believes that the intro- duction of the state equalization rate as evidence in proceedings to review tax assessments seriously pre- judices the Town ' s defense of its tax assessments, and _10_ Resolved, that this Board hereby expresses its sincere appreciation of Mr. Loiaconi ' s long and able service to the Town of Mamaroneck prior to his retirement; and Be it further Resolved, that this meeting stands adjourned this evening in memory of Pasquale Loiaconi. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims. Mirabella to Mr. McDonell, Village Manager. -12- Pursuant to letter of Robert C. McDonell, Village Manager, Mamaroneck, New York, dated March 21, 1966, in connection with copy of letter of J. Mirabella, Communications Consultant, New York Telephone Company, dated March 15, 1966, herewith presented and ordered filed for the record, on motion by Commissioner Faiola, seconded by Commissioner Helwig, it was unanimously RESOLVED, that this Commission hereby authorizes the installation of a tele- phone extension from the Mamaroneck Police Department switchboard (OW. 8-2400) to the Alarm Room of the Town of Mamaro- neck Fire Department (TE. 4-2100) at the Weaver Street Firehouse, Weaver Street and Edgewood Avenue, Town, at a cost of $7 . 35 per month, or $88.20 per annum, less 25% discount, or $66 .15 per annum, one-half of which (or $33 .08) is to be borne by the Town of Mamaroneck, the other half (or $33 .08) by the Village, with the installation charge of $5 . 00 paid equally by the two said municipali- ties in the sum of $2 . 50 each. 4. Other Business Commissioner Faiola again briefly reported on the status of the new Fire District Insurance Rating as reviewed under his Town Board report, expressing on behalf of the Commission, its sincere thanks and appreciation to Mr. Lyle Brown for his untiring efforts in working on this matter with the Town during the past several years. 5. Adjournment There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:30 p, m. , to reconvene on April 6, 1966.
