MINUTES OF A REGULAR MEETING OF THE TOWN BOARD, OF
THE TOWN OF MAMARONECK, HELD NOVEMBER 10, 1965, IN
THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE,
WEAVER STREET, TOWN OF MAMARONECK.

The Supervisor called the meeting to order at 8:15 p.m.

PUBLIC HEARING
Application of Longines Symphonette for Appeal from the
Building Inspector's Disapproval of Application for Permit.
On motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED, that the public hearing be
and it hereby is declared open.
The Clerk presented the affidavit of publication of
the Notice of Hearing for the record, the application for
appeal from the decision of the Building Inspector as sub-
mitted by Longines Symphonette, and the report of the
Building Inspector, dated November $, .1965, all of which
were herewith ordered received and filed as part of the
record of this hearing.
The Supervisor then inquired whether any one present
wished to be heard on this application, whereupon Mr.
Cartan, representing Longines Symphonette, addressed the
Board.
And thereupon since no one else wished to be heard,
on motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED that the hearing be and it hereby is
declared closed.
Whereupon, since the Board signified that it was
ready for the question, the following resolution was
offered on motion by Councilman Kane, seconded by
Councilman Brush:

OLD BUSINESS
1. Planning Board Reports .
(a) Bonnie Briar Application for Special Periit
(Construction of Additional Pa 71ing Area ).
The Clerk presented the following report addressed
-- to the Town Board by the planning Board under date
of November 3 , 1965:
''This Board did not act on the application of
Bonnie Briar Country Club for a s-oecial permit
to create additional parking spade because the
preliminary sketches presented lacked dimensions ,
specifications and details of construction.

We are of the opinion that since no permit
has been granted for this work, that work
should cease immediately until a permit
is granted. "
Since no one was present on behalf of the Club, the Board,
by common consent, directed the Building Inspector to ad-
vise the Club in accordance with the Planning Board report.
(b) Application of Chatsworth Garage
for Amendment of Zoning Ordinance
With reference to the petition of Chatsworth Garage,
Inc. requesting pursuant to Article VI of the Zoning
Ordinance of the Town of Mamaroneck, amendment of
Article II, Section 220 of said Ordinance so as to in-
clude the following sentence:
"The word 'care' shall be deemed to include
the washing of motor vehicles both by hand
and by mechanical means",
which had been presented and referred to the Planning
Board for report at the last meeting of this Board,
upon presentation of said report which, in accordance
with the Town Attorney's recommendation, suggested
wording other than the above as proposed in applicant's
petition, on motion by Councilman Kane, seconded by
Councilwoman Helwig, it was unanimously
RESOLVED, that the Town Clerk be and he here-
by is authorized to publish in the official news-
paper of the Town of Mamaroneck, The Daily
Times, the following Notice:
PLEASE TAKE NOTICE that pursuant to Section
600. 1 of the Zoning Ordinance of the Town of Ma-
maroneck, the Town Board of the Town of Mamar-
oneck will hold a public hearing on December 1,
1965, at 8:15 p. m. , in the Council Room of the
Weaver Street Firehouse, Weaver Street, Town of
Mamaroneck, to consider the adoption of an
amendment to the Zoning Ordinance of the Town of
Mamaroneck by amending Section 410 of said Or-
dinance entitled, "Schedule of Regulations", so as
to add under - "Permitted Special Uses" - in the
"Schedule of Permitted Uses in Business and In-
dustry Districts", a new Item 7. , which shall
read as follows:
"Automatic car washing facilities as an ad-
junct to existing gasoline filling stations
-- and/or public garages".
PLEASE TAKE FURTHER NOTICE that all interested
persons are invited to be heard at said meeting at the
above time and place.

Councilman Ouadrine stated that he would like to have
a report from the Planning Consultants, Raymond and May,
on this matter and the Board, by common consent ' there-
upon directed that such request be made to the consul-
tants ; report to be submitted to this Board before
December ist, 1965.
2. Report of Consultant Engineers on Request of
l,Teighan d Necarsulmer - Carducci from Valle.
The Clerk presented the following report submitted
by the Acting Town Engineer in accordance with the
Board's request at its October 20, 1965 meetings
"I have investigated the engineering aspects
of this matter and submit the following report:
1. Zoning - The property is in an R-6 Zone and
with the proposed dimension would comply with R-6
requirements , but the lot sizes can not be reduced.
2. Apparently 5 of the owners fronting on 114yrtle
Boulevard who own the lots directly in the rear
(lots fronting on Laurel Avenue) want to maintain
their Drivacy and do not ti-rant laurel Ave. cut
through. They claim that their property runs to
the middle of the proposed street, extending 25.01
beyond the mapped property line. That these claims
are not in accord with the sellers intent would seem
to be proved by the fact that the street sewers are
laid in and through the property claimed.
3. Laurel Avenue (the street under discussion' has
been improved with setter t'rroughout, from Thompson
Street to Weaver Street. Water main has been in-
stalled except ifn area under discussion. There is
no gas in the street . The street has been paved
from Thompson Street to cleaver Street with the
exception of 669 ft. of which 361.56 ft. represents
the frontage of the property under discussion.
�+. This street cannot be realigned without di-
minishing lot sizes which are nou at a minimum.
a. The ends of Laurel Ave. are at present fixed
by lines of the installed pavement. Safe curves
could not be installed.
b. A narrow street would be dangerous without
turn around facility= or through access .
c. A 25' wide street would not conform to
planning requirements nor could it be accepted
legally, and if the street were realigned or
made narrower here the serer oiould be in private
property beyond the street line.
I can see no solution except to construct Laurel
Avenue as originally intended.
I recommend that the Town Counsellor be requested to
determine what, if any, rights the claimants have to
the obstructing property with a view to opening Laurel
Street throughout.E4
Report included print showing condition of Laurel Street
which was herewith filed for the record.

Since no one a=ppeared on behalf of the applicant,
the Supervisor stated that the problem seemed to be
basicly a legal one and the matter was therefore tabled
pending further advice from the attorney for the appli-
cant.
PTE�vd BUSINESS
1. Appointment of Dog Enumerator.
Pursuant to communication addressed to the Supervisor
by the State of New Fork Department of Agriculture
and =Markets under date of October 189 19657 on motion
by Councilman Brush, seconded by Councilwoman elvJig,
the following resolution was adopted unanimously:
RLSOLD, that =Pursuant to Section 108
of the Agriculture and ilarhets Law,
Eugene Agnessanto be and he hereby is
appointed as Dog Enumerator in the
unincorporated area of the Town of
Mamaroneck for the year 1966 .
2. Expense Authorization -
Police Commission.
Pursuant to request of the Police Commission dated
'November 5, 19659 herewith -presented and filed for the
record, on motio=n by Counci lmian 3rush, seconded by
Councilwoman Helwig it was unanimously
RESOLVED,, that this ]Board hereby
authorizes pay*_tent of the expenses
of Chief Yerick, Lieutenant 11ancusi,
and Detective Sergeant Loveley, at
a meeting to be held by the Federal
Bureau of Investigation to discuss
law enforcement trends for 1966 on
November 17, 1965 at Bear 'fountain,
INew York, said expenditure in an
amount not to exceed the sum of
$20.009 to be Daid from the proper
item in the 1965 Police Department
budget.

1. Amencsent of Water Control Ordinance
(Memo from George Straub).
The Su_Dervisor presented the following letter
addressed to him by George H. Straub, Manager,
Westchester Joint slater Works , under date of Nov-
ember o, 1965:
,,On September 14th o:e wrote you requesting
that Chapter LK-E, Section 3 , of the Water
Control Ordinance be amended with an appro-
priate paragraph entitled Watering Yards .
By resolution of the Board of 'Trustees at
the regular meeting held November 8th, it
is further suggested that an exception be
made so that
"Cormrnercial gardeners , landscape gar-
deners , and nurserymen shall not be pro-
hibited by the regulation from using water
for the purpose of applying chemical or
other treatment to laians for insect and
disease control, or for the purpose of
watering new plantings or shrubbery by
means of a hose or sprinkler" .
Our Board miade no commitment for the Spring
of the year 1966. This exception is expected
to expire at the end of 1Aarch, 1966, "

Ordinance, adopted August 4, 1965, and known
as Chapter LK-E of the General Ordinances of
the Town of Mamaroneck, by adding a new

Section 3 of the said Ordinance, so as to
make an exception thereto, which shall read

2. Letter from Eamaroneck Village Manager
re - Fire Dispatch Switchboard.
The Su,ervisor presented the following letter
addressed to him by the Village Manager of the Village
of Eaamaroneck under date of November 1, 19-5:

,hillirs has also mentioned the subject
to you, of the need for a line from our
switchboard to your fire dispatch switch-
board in order to communicate between our
two jurisdictions on requests for fire
assistance.
If your government would be interested
in participating on this sort of a tele-
phone tie line on a 50-50 basis , I would
be haply to investigate the procedures
required to install sixth a line as well
as the cost on a :monthly basis to each
of us.
It seems to me that this sort of comuni-
cation tie in would offer substantial
advantages to the residents of the Town
and the Village and it is with this in
mind that this matter is called to your
attention" .
The Board after some discussion being heartily in
accord with 1,9r. McDonell's suggestion, on motion
by Councilman Brush, seconded by Councilwoman
Helwig unanimously
RESOLVED, that a communication be
addressed to the Village Tanager of
the Village of Mamaroneck stating
that this Board is interested in
participating in a "communication
tie-in" and requests that you proceed
to investigate the procedures required
to install such a line , as well as the
cost on a monthly basis to each muni-
cipality, with report thereon to this
Board.
The Clerk was directed to so advise 11r. icDonell,
Village 1lanager of the Village of Mamaroneck.

Councilwoman Helvig --
1. Letter from The Pinchot Institute.
Councilwoman Helwig presented the following letter
addressed to her by atthew J. Brennan. Director
of The Pinchot Institute under date of 6ctober 19,
1965:
"Thank you for voar -_ind words about the
recent confe-rerxce at The Pinchot Institute.
It is we wllao are in your debt, not only
for allowing us the privilege of thinking
of ifamaroneck as one of "our" models for
education in the total environment, but
for having you with us at this conference
so that all of our other cooperating
school sVsteins in New Jersey, Pennsylvania,
Connecticut and 2-s'aryland could have the
opportunity of learning about your program.
I think it was especially appropriate that
you were able to come yourself. It is not
often that we have such interest and support
from our community leaders. The children
of Mamaroneck who will benefit from the
work of those who are prey..*iding this excellent
program in total education, using the outdoor
laboratory as well as the indoor facilities
vai11 be rewarded as a result
of the school,
Of your leadership and efforts.
Tou may be sure that The Pinchot Institute
will not only continue but increase its
efforts to be of service to your program so
that it may truly become a model for America".
She further advised the Board that the results of
the conference would be written up and circulated by the
Institute and that the Town of Hamaroneck would be des-
cribed therein as one of the eight municipalities par-
ticipating in this pilot project.
2. Governor' s Beautification Program.
Councilwoman Helwig briefly outlined for the Board' s
information. Governor Rockefeller' s Beautification Program
as presented by Sir. Daniel A. Riordan, Jr. , Field Repre-
sentative , New York State Executive Departaent Division
for Youth, at a conference on November 9, 1965.
The project was subsequently described to the Con-
servation Advisory Committee,and thereupon following
some discussion by the Board she offered the following
resolution which was seconded by Councilman Kane,
WHEIREEAS, under Governor Rockefeller' s
Beautification Program, State funds are
available for conservation projects
- em_pioying young men ages 16 - 21, and
Whereas , the Sheldrake River Trails
Conservation area of the Town of
I?amaroneck offers an unusual oppor-
tunity for effective and advantageous
use of funds for such a beautification
project ;

NOW, THEREFORE, BE IT
RESOLVED, that the Town Board authorizes
a formal application to the New York
State Division for Youth for State funds
for a conservation project in the summer
of 1966 to be administered by the Town
of Mamaroneck Conservation Advisory
Committee and directs that Committee to
take all necessary steps to complete
such an application' it being understood
that the contract for such a project if
recommended by the State Division for
Youth would be submitted to the Town
Board for final approval .
The foregoing resolution was adopted by
unanimous vote of the Board with all
members thereof present and voting aye
on a motion offered by Councilwoman Helwig
and seconded by Councilman Dane."
Councilman Kane --
1. Report red "black Out's.
Councilman Dane reported that during the darkness
last night ' he toured the Town with the Police and
that he wished to pay public tribute to the members
of our Police and Fire forces who came in voluntarily
and did everything possible to assist our citizens
during this "black out" period.
-- Mr. Jerome Wanshel, who was present' suggested
that a committee be set up which would be "on call''
should such a happenstance again. occur.
The Supervisor replied that in our Civil Defense
and Red Cross Disaster set up , as well as our Police
and Fire emergencies , such a committee was , in essence ,
in existence.
Councilman Brush --
Councilman Brush had no report other than fire
matters .
Councilman Q adrine --
1. Commendation.
Councilman Quadrine paid public tribute to the
Superintendent of highways and his staff for their
excellent performance of duty in connection with
the recent "moving of a. compressor".
-- 2. Report - Griffen Avenue Sewer.
Councilman Quadrine reported that the Acting
Town 'Engineer advises that work was progressing
satisfactorily on the Griffen Avenue Sewer Ex-
tension.

NOW, THEREFORE BE IT
RESOLVED, that permission be granted to
the City of New =Sochelle to construct or
have constructed said sewer lateral and
connect same to the Pryer iianor Lane
sanitary set,Jer in the Town of harmaroneck,
subject to the following conditions :

1. That nothing other than ordinary house-
hold sewage be discharged into the line
and that no drainage lines be connected
thereto.
2. That the proposed lateral shall be built
and maintained without cost to the Town
of Mamaroneck.
3. That Plans and Specifications be sub-
ject to review and amendment by the
Town of Mamaroneck.
4. That construction of sewer and appur-
tenances be subject to inspection by
the Town of Mamaroneck.
5. That leakage test be made and certified
to the Town of Mamaroneck by Profes-
sional Engineer indicating that sewer
has passed Westchester County require-
ment. Town of Mamaroneck Inspector
to be present at test.
6. Permit for street opening (Pryer Lane)
to be obtained and all charges for it,
and repair of it, and repair of street,
to be paid by Contractor.
The Clerk was directed to advise Shelly Fashions, Inc.
of the Board's approval of this request subject to the con-
ditions listed in the Acting Town Engineer's report.
4. Street Light Authorizations
Pursuant to memoranda, addressed to the Board by the
Comptroller under dates of November 1st and 8th, 1965,
herewith presented by Councilman Quadrine and filed as
part of the record of this meeting, on his motion, sec-
onded by Councilman Brush, it was unanimously:
RESOLVED, that street lighting installation jobs
#36 and #37, be and they hereby are authorized
as follows:
Job #36
One (1) new "Ad. Hat" on 8' arm, on Pole
No. AxZ BA W/8, at the corner of Doris
Road and Wagon Wheel Road, at a cost
not to exceed the sum of $60. 99•
Job #37
One (1) new "Quad" on 8' arm, on Pole No.
A 2 XSA opposite Old White Plains Road,
at a cost not to exceed the sum of $94. 60.
The Town Attorney --
1. Approval of Performance Bond - Baldwin Hills
Pursuant to the Attorney's request and upon his and the
Planning Board's recommendation, on motion by

Councilwoman Helwig, seconded by Councilman Brush,
it was unanimously
RESOLVED, that this Board in accordance with
the recommendation of the Town Attorney and
the Acting Town Engineer, hereby approves
Performance Bond No. 2234172, in the amount
of $180, 000. , dated July 29, 1965, upon which
the Continental Casualty Company is Surety
and Jason-McKenna Construction Corp. of 230
West Third Street, Mount Vernon, New York,
is Principal.
PRESENTATION OF
1966 PRELIMINARY BUDGET
The Supervisor presented the Preliminary Budget for 1966
as prepared from the departmental requisitions, reviewing
in detail the transmittal letter submitted therewith and each
page of the proposed budget.
He then inquired whether anyone wished to be heard on
the budget or any particular part thereof, whereupon the
following persons addressed the Board:
Mrs. Jerome Kaufman - 41 Eton Road, Town
Mrs. Kaufman spoke on the matter of police salaries,
stating that she believed they should be higher - and
also questioned the matter of budget presentation since
it was her understanding that the Preliminary Budget,
once adopted by this Board, could only be lowered -
not raised - at the hearing.
Mr. Joseph Minniti - 280 Murray Avenue, Town
Mr. Minniti also addressed himself to the matter of
police salaries - stating that it was his feeling that
they should be higher and that the citizenry of this
community would be willing to vote any necessary ad-
tional monies to so provide.
Mrs. Daniel S. Lukas - 152 Valley Stream Road, Town
Mrs. Lukas added her voice to the plea for higher sal-
aries for the Police Department force -- asking what

Mr. Jerome N. Wanshel - Spanish Cove Road, Larchmont
Mr. Wanshel asked about the return of monies collected
-- by fines under the new Suburban Town Law - and also
suggested that copies of the proposed Preliminary Budget
be made available to the public prior to the meeting at
which it was to be presented.
Mr. Howard Schwartz - 51 Valley Road, Town

Mr. Schwartz suggested that in the future, the Notice
of Meeting for the particular meeting where the Pre-
liminary Budget would be presented, carry this in-
formation.
The Supervisor replied to the questions addressed to
the Board, and for the information of all present, explained
that this year the Board, as the Budget Committee, had ac-
cepted the salary recommendations for the Police which
the Police Commission had submitted. He also directed,
with the Board's acquiesence, that Mr. Schwartz's sugges-
tion of noting the Preliminary Budget presentation be noted
on the Notice of Meeting in the future.
And thereupon since no one else wished to be heard and
the Board signified that it was ready for the question, on
a motion offered by Councilman Brush and seconded by
Councilman Kane, the following resolution was adopted by
unanimous vote of the Board:
RESOLVED, that this Town Board does hereby pre-
pare and approve as the Preliminary Budget of this
Town for the fiscal year beginning on the 1st day of
January, 1966, the itemized statement of estimated
revenues and expenditures hereto attached and made
a part of this resolution;
and be it further
RESOLVED, that such Preliminary Budget shall be
filed in the Office of the Town Clerk, where it shall
be available for inspection by any interested person
at all reasonable hours;
and be it further
RESOLVED, that this Board shall meet at 8: 15 p. m.
on the 1st day of December, 1965, for the purpose
of holding a public hearing upon such Preliminary
Budget;
and be it further
RESOLVED, that the Town Clerk give Notice of
such public hearing in the manner provided in Sec-
tion 113 of the Town Law, and that such Notice be
published and posted in substantially the following
form:

Notice is hereby given that the Preliminary Budget
of the Town of Mamaroneck, New York, consisting
- of the estimated revenues and expenditures for the
year 1966, has been completed and filed in the Of-
fice of the Town Clerk of said Town, where the
same may be examined by any person interested
therein, and that a public hearing thereon will be
held by and before the Town Board of said Town on
Wednesday, December 1, 1965, at 8:15 p. m. , in

the Council Room of the Weaver Street Firehouse,
Weaver Street, Town of Mamaroneck, New York,
at which time and place all those who appear and

heard with respect to said Preliminary Budget,

OTHER BUSINESS
1. Mrs. Ruth Green -
Mrs. Green extended a most cordial invitation to the mem-
bers of the Board on behalf of the Mayor and Board of

Trustees of the Village of Larchmont, to the Opening of the
new Playhouse at Flint Park, on Saturday afternoon, No-
vember 27th, at two o'clock.
2. Mr. Jerome N. Wanshel -
Mr. Wanshel addressed the Board, speaking in strenuous
protest to the type of development permissable under the
Zoning Ordinance on the Boston Post Road through the un-
incorporated area.
He recommended to the Board that a review of the Zon-
ing Ordinance be undertaken to see what could be done to
prevent further such development - such review to be
begun at the earliest possible date.
3. Mrs. K. E. Godfrey -
Mrs. Godfrey questioned whether provision was made in
the budget for our Town Planning Board to join with other
Planning Boards (Regional, etc. ) in its studies.
The Chair assurred Mrs. Godfrey that such provision
was made and that the Town Planning Board enjoyed mem-
bership in such groups.
ADJOURNMENT
There being no further business to come before the meeting,
on motion duly made and seconded, it was declared adjourned
at 10:00 p. m. , to reconvene on November 23, 1965.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was con-
vened immediately upon the adjournment of the Town Board
meeting.

Commissioner Brush presented for approval and authori-
zation of payment, the Fire Department claims, and there-
upon on his motion, seconded by Commissioner Kane, it
was unanimously
RESOLVED, that the following Fire Department claims
as approved by the Fire Chief and audited by the Comp-
troller, be and they hereby are approved, and the Su-
pervisor and Comptroller be and they hereby are auth-
orized to pay the same out of the 1965 Fire Department

1. Liability Insurance Policy
for Volunteer Firemen
Commissioner Brush presented for the Commission's
approval and authorization, a new liability insurance
policy affording greater coverage for the volunteer
firemen as forwarded by The Hartford Insurance Group,
and thereupon, following some discussion, on motion
by Commissioner Brush, seconded by Commissioner
Helwig, it was unanimously
RESOLVED, that this Commission hereby author-
izes the purchase of a new liability insurance
policy covering volunteer firemen with the Hart-
ford Insurance Group, as herewith presented, at
an annual premium of $441. 78, effective January
1, 1966;
and be it further
RESOLVED, that the policy superseded by the
new policy be cancelled.
Z. Rules & Regulations
for Paid Fire Personnel
The Commission , through Commissioner Brush, ex-
tended its compliments and commendation to the Fire

Chief on the preparation of the proposed Rules and Reg-
ulations for Paid Firemen, advising that the Commis-
sion had reviewed the proposed Rules & Regulations
very carefully and had no changes or suggestions of
offer.
Whereupon, on his motion, seconded by Commissioner
Helwig, it was unanimously
RESOLVED, that this Commission hereby approves
the "Rules & Regulations Governing Paid Personnel
of the Town of Mamaroneck Fire Department" as
herewith presented and filed as part of the record
of this meeting.
3. Burning at Town Dump
The Fire Chief again brought up the matter of the burn-
ing at the Town Dump, suggesting that this Commission
give serious consideration to --
a) Provision of adequate hose
b) Constant supervision of burning
c) Better cooperation from Dump Attendant in the
matter of extinguishing minor fires.
The Commission thanked the Chief, stating that his sug-
gestions would be given serious consideration.
5. Adjournment

on motion duly made and seconded, it was declared adjourned
at 10:20 p. m. , to reconvene on November 23, 1965.
