MINUTES OF A REGULAR MEETING OF THE TOWN BOARD
OF THE TOWN OF MAMARONECK, HELD OCTOBER 6, 1965,
IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE-
HOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
Deputy Supervisor Kane, in the absence of the Super-
visor, who was delayed, called the meeting to order at
8:15 p. m.

APPROVAL OF MINUTES
The minutes of the regular meeting of August 4, 1965
were presented, and on motion duly made and seconded,
approved as corrected.
OLD BUSINESS
1. Report - Application for Special Permit
Chatsworth Garage, Inc.
Mr. Robert Garlock, attorney for the applicant,
presented an additional petition carrying some
sixty signatures, in support of his client' s
application, which was herewith ordered received
and filed as part of the record of this meeting.
Mr. Johnston, Town Attorney, at the Chair ' s
request, reported that in accordance with Article
4, Section 400. 1 of the Zoning Ordinance, his
opinion had not changed in that this application
did not fall under the jurisdiction of this Board.
Mr. Garlock then stated that the washing of cars
was a traditional part of the servicing of auto-
mobiles as long as it was conducted within the
servicing building --
Mr. Johnston replied that regardless, anything
not recited in the Ordinance was outside the juris-
diction of this Board and could not be placed under
its jurisdiction.
After some further debate between the Attorneys,
Councilman Brush stated that it was his under-
standing the Board was not voting on whether or

not there should be an automatic car wash in
this building but only on the Board' s juris-
diction in this matter.
Councilwoman Helwig seconded Councilman
Brush ' s statement.
And thereupon, following some further discussion,
during which Councilman Quadrine requested the
definition of "public garage and filling station",
Mr. Garlock asked, "If this is not an extension of
use, what is such?", and the Deputy Supervisor re-
marked that he sympathized with the client, but
was convinced this was purely a matter of jurisdic-
tion and that he had implicit confidence in the
Town Attorney' s opinion thereon, since the Board
signified that it was ready for the question, the
following resolution was offered on a motion by
Councilwoman Helwig and seconded by Councilman
Brush:
WHEREAS, an application dated July 1,
1965 for a Special Permit to install
automatic car wash equipment at Chats-
worth Garage, Inc. , located at 1 Vine
Street, Town, on premises known as
Block 127 Parcel 730 on the Tax Assess-
ment Map of the Town of Mamaroneck, was
disapproved by the Building Inspector
pursuant to Article IV, Section 449 of
the Zoning Ordinance as amended April
17 , 1963, and Section 432 of that Ordi-
nance which requires Special Permit from
the Town Board;
and
WHEREAS, pursuant to Section 432 of the
Zoning Ordinance, the said application
was duly referred to the Planning Board
for report;
and
WHEREAS, pursuant to Section 432 of the
Zoning Ordinance, a public hearing on
said application was duly held by this
Board on September 15, 1965 following
publication of Notice of Hearing therefor
as required by law;
and
WHEREAS, said hearing was deferred to this
date pending the Town Attorney' s report on
the brief submitted by the applicant' s
attorney on September 15th;
and
WHEREAS, all persons present who desired to be
heard in the matter of this application were
heard both on September 15th and on this date;
and
WHEREAS, this Board was advised by the Town
Attorney that it lacked jurisdiction to
entertain this application;

NOW, THEREFORE, BE IT
RESOLVED, that the application of Chatsworth
Garage, Inc. for a Special Permit to install
automatic car wash equipment at the said
garage, located at 1 Vine Street, Town, on
premises known as Block 127 Parcel 730, be
and it hereby is denied on the grounds that
this Board lacks jurisdiction to entertain
this application.
The vote on the foregoing Resolution was as follows:

The Resolution was therefore declared duly adopted.
NEW BUSINESS
1. Public Hearing - Amendment of Water Control Ordinance.
On motion by Councilman Kane, seconded by Councilman
Brush, it was unanimously
RESOLVED, that the public hearing be and it
hereby is declared open.
The Clerk presented for the record the affidavit of
publication of the Notice of Hearing, and the Attorney
presented the following letter addressed to the Super-
visor by George H. Straub, Manager of the Westchester
Joint Water Works under date of September 14, 1965:
"At the regular meeting of the Board of Trustees held
last evening, it was resolved that all sprinkling of
lawns and gardens be prohibited. I have been directed
to inform you so that the prohibition may be incorporated
in the Town Ordinance as quickly as possible.
"This action was determined upon on the earlier request
of New York City. All other municipalities in West-
chester County dependent on City water have previously
taken such a step. While our local Mamaroneck River
supply was available we felt justified in permitting
the limited sprinkling incorporated in your ordinance.
Since this is now depleted and we are completely depen-
dent on New York resources, the additional step is
necessary.
"Will you therefore delete paragraph (1) under Chapter
IX-E, Section 3, of the Water Control Ordinance and
place the appropriate paragraph under Section 5 (Certain
Uses are Prohibited) ?
"The following wording is suggested:-

'Watering Yards - The sprinkling, watering or irri-
gation of shrubbery, trees, lawns, grass, ground
covers, plants, vines, gardens, vegetables, flowers
or any other vegetation is prohibited except by the
use of pails or watering cans held in the hand. '"
The Deputy Supervisor then inquired whether anyone
present wished to be heard on this matter, whereupon
the following persons addressed the Board:
Mr. Frank Claps, Jr. requested that the proposed amend-
ment allow for the watering of new lawns and the treat-
ment of diseased plants and shrubbery. He further
stated that the New York Turf & Nurserymen' s Association
felt that this provision , if adopted as proposed, would
be discriminatory in that it would preclude the practice
of the nursery profession. He also advised that he had
appeared before the City Council of New Rochelle and
that it was going to propose an amendment which would
take care of this request.
Mr. Otto Scheuble, a resident of the Town, spoke in oppo-
sition to the proposed amendment on the ground that mort-
gage money could not be obtained on property unless it
was completely improved, including the planting of grass
and shrubbery.
And thereupon, since no one else wished to be heard, on
motion by Councilman Brush, seconded by Councilwoman
Helwig, it was unanimously
RESOLVED, that the hearing be and it hereby is
declared closed.
Whereupon, following some further discussion since the
Board signified that it was ready for the question, on
a motion offered by Councilman Brush and seconded by
Councilman Quadrine, the following resolution was adopted:
RESOLVED, that the Water Control Ordinance, as
adopted on August 4, 1965 and known as Chapter
IX-E of the General Ordinances of the Town of
Mamaroneck, be and it hereby is amended so as to:
Delete paragraph (1) of Section 3
and
Add a new paragraph (g) to Section 5, "Certain
Uses are Prohibited" , which shall read as follows :
(g) Watering Yards : The sprinkling, watering or
irrigation of shrubbery, trees, lawns, grass,
ground covers, plants, vines, gardens, vegetables,
flowers or any other vegetation is prohibited ex-
cept by the use of pails or watering cans held in
the hand.
and be it further

RESOLVED, that the Town Clerk of the Town of
Mamaroneck is hereby authorized and directed
to publish and post this notice as required
by law.
Upon roll call, the vote on the foreging Resolution
was as follows :

2 . Public Hearing - Prince Willows
Sewer Extension
on motion by Councilman Brush, seconded by Council
woman Helwig, it was unanimously
RESOLVED, that the public hearing be and it
hereby is declared open.
The Clerk then presented for the record, the affidavit
of publication of the Notice of Hearing, and the Attorney
briefly reviewed the history of this petition.
In response to the Chair ' s invitation, Mr. Herbert
Stoller, President of the Stonewall Lane Association,
addressed the Board, reminding all present that the
Prince Willow residents had been trying to obtain
sewers for approximately the past ten years -- and
that he now believed the petition to be completely
in order with regard to plans, specifications, etc.
Mr. Harry Ekizian, President of the Prince Willows
Association, also addressed the Board, stating that
he felt there was no need to repeat any arguments in
this matter, and that all were simply anxious to ob-
tain the sewer and to move forward with the necessary
procedure.
Councilman Quadrine called to attention the fact
that the Supervisor had obtained $95, 000.00 from
the County so that the spur connection necessary
for the proposed sewer would be built, and there-
upon, following the Deputy Supervisor ' s expression
of thanks and appreciation to Mr. Stoller, Mr. Eki-
zian and to Mr. and Mrs. Mort Levin, also residents
of the area long active in this matter, since no one
else wished to be heard, it was, on motion by Council-
woman Helwig and seconded by Councilman Kane, unani-
mously
RESOLVED, that the hearing be and it now is
declared closed;
And thereupon, since the Board signified that it was
ready for the question, the following resolution was
offered:

IN THE MATTER of the Proposed Extension of
Sewer District No. 1 of the Town of Mamaroneck,
County of Westchester, State of New York.

WHEREAS, a petition for the creation of a proposed sewer
extension known as Section "S" to Sewer District No. 1
in the Town of Mamaroneck, Westchester County, New York,
the said petition being dated May 15, 1964, was duly pre-
' sented to this Town Board, together with the necessary
map and plan allotted thereto;
and
WHEREAS, the said map and plan were duly filed in the
office of the Town Clerk; and
WHEREAS, an order was duly adopted by the Town Board on
September 15, 1965, reciting the filing of said petition,
the improvements proposed, the boundaries of the propos-
ed district, and the estimated expense thereof, and specify-
ing October 6, 1965, at 8:15 o ' clock P.M. in the Council
Room of the Weaver Street Firehouse, Weaver Street and
Edgewood Avenue in the Town of Mamaroneck, as the time
when, and the place where, said Board would meet to con-
sider said petition, and hear all persons interested in
the subject matter thereof and concerning the same;
and
WHEREAS, said Town Board caused a copy of said Order cer-
tified by the Town Clerk, to be published and posted accord-
ing to law; and
WHEREAS, said hearing was duly held at the time and place
so fixed by order,
NOW, ON MOTION of Councilwoman Christine K. Helwig and second-
ed by Councilman Peter F. Kane, it is
RESOLVED AND DETERMINED, that
(a) the petition aforesaid is signed and acknowledged or
proved as required by law; it duly complies with the re-
quirements of Section 191 of the Town Law as to the suffi-
ciency of signers with respect to the boundaries of the
proposed district as herein approved and it is otherwise
sufficient;
(b) all the property and property owners within the pro-
posed district are benefited thereby;
(c) all the property and property owners benefited are in-
cluded within the limts of the proposed district; and
-- (d) it is in the public interest to grant in whole the re-
lief sought, and it is further

RESOLVED AND DETERMINED, that the establishment of
an extension to Sewer District No. 1 as proposed
in said petition be approved; that the improvement
therein mentioned be constructed upon the required
funds being made available or provided for ; and that
such district shall be designated and known as Sec-
tion "S" of Sewer District No. 1 of the Town of
Mamaroneck and shall be bounded and described as
follows :
BEGINNING at a point on the easterly side of Old
White Plains Road, where the same is intersected
by the southerly boundary line of lands now or
formerly of Seymour and the northerly boundary
line of parcel No. 8, the property of Westchester
County Park Commission (known as Saxon Woods Park) ;
thence from said point or place of beginning along
the westerly boundary line of the lands of West-
chester County Park Commission, the following courses

and it is further
RESOLVED AND DETERMINED, that the Town Clerk of this
Town shall, within ten (10) days after the adoption
of this resolution, file certified copies thereof in
duplicate in the Office of the State Department of
Audit and Control at Albany, New York, with application

by this Board in duplicate for permission to create
such district as provided for the Town Law, Section
194 ; and that such application shall be executed by
and in behalf of the Town Board by the Supervisor of
the Town.

At this time, 9:05 p. m. , Supervisor Burchell arrived
and assumed the Chair.
3. Application for Appeal from Decision of
Building Inspector - Sign Variance -
Longines Symphonette.
The Clerk presented the application submitted by the
Longines Symphonette, 200 Myrtle Boulevard, Town, for
appeal from the Building Inspector ' s disapproval pur-
suant to Article 19, Section 10 of the Building Code of
the Town of Mamaroneck, of its application for a Sign
Variance to allow the installation of an illuminated
wall sign having a section containing numerals employing
intermittent light sources, which was herewith ordered
received and filed as part of the record of this meeting.
Following some discussion of the date for the first
November meeting since the Preliminary Budget for 1966
by law must be presented between November 10th and 15th,
and since it was required by law that a public hearing
be held by this Board in the matter of the aforesaid
application, on motion by Councilman Kane, seconded by
Councilman Brush, it was unanimously
RESOLVED, that this Board convene for its
first regular meeting in November on the
second Wednesday evening thereof, November
10th, rather than on the first Wednesday
evening, November 3rd, so that the Prelimi-
nary Budget for 1966 may be presented in
accordance with law,
and be it further
RESOLVED, that a public hearing will be
held by this Board at its first regular
meeting in November, on November 10, 1965,
--- at 8 :15 p. m. in the Council Room of the
Weaver Street Firehouse, Weaver Street,
and Edgewood Avenue, Town of Mamaroneck,
to hear the appeal of The Longines Sympho-
nette from the decision of .the Building Inspector

pursuant to Article 19, Section 12 of the
Building Code, refusing a permit for a
business sign on its premises located at
200 Myrtle Boulevard, and known as Block
133, Parcel 602 on the Town of Mamaroneck
Assessment Map;
and be it further
RESOLVED, that the Town Clerk be and he
hereby is authorized and directed to
publish in the official newspaper of the
Town of Mamaroneck, The Daily Times, Notice
for such Public Hearing as required by law.
4. Employment of Senior Stenographer
Pursuant to memorandum addressed to the Board by
the Comptroller under date of October 4, 1965,
herewith presented and filed as part of the record
of this meeting, on motion by Councilman Kane,
seconded by Councilwoman Helwig, it was unanimously
RESOLVED, that Mrs. Rita Johnson of
2 Stonelea Place, New Rochelle, be
and she hereby is appointed a Senior
Stenographer in the office of the
Building Inspector and Engineer of
the Town of Mamaroneck, said appoint-
ment to be a probationary appointment
effective as of October 7, 1965, and
to be compensated at the rate of $4, 680.
per annum.
COMMUNICATIONS
1. Salary Authorization
School Crossing Guard
Pursuant to request of the Police Chief, dated
September 29, 1965, herewith presented and ordered
received and filed for the record, on motion by
Councilman Brush, seconded by Councilman Quadrine,
it was unanimously
RESOLVED, that Mark A. Forrester of 105
Fenimore Road, Mamaroneck, be and he here-
by is appointed as a School Crossing Guard
of the Town of Mamaroneck, effective as of
September 30, 1965, and to be compensated
at the rate of $8.00 per day.

The Supervisor --
1. Joint Town and Village
Economy Operations Committee
The Supervisor presented a report written by Mayor
Ryan, of a meeting held by the Supervisor with Mayors
Ryan and Phillips, Jr. , on September 24, 1965 regard-
ing the establishment of a citizen committee from the
three municipalities to study economy operation,
possible consolidation of services, and possible re-
assessment, which was herewith ordered received and
filed as part of the record of this meeting.
He requested the Board, in line with the aforesaid
report, to be ready to submit recommendations for the
three prospective appointees to such a Committee from
the unincorporated area so that the Committee member-
ship could be appointed as quickly as possible.
2. Conveyance of Dillon Park
County Sewage Pumping Station
Pursuant to the Supervisor ' s advice that the County
Department of Public Works was now ready to proceed
with the conveyance of the Dillon Park Sewage Pumping
Station property to the Town upon receipt of resolution
so requesting, on motion by Councilwoman Helwig, second-
ed by Councilman Kane, the following resolution was
adopted by unanimous vote of the Board, all members
thereof being present and voting, with the Supervisor
directed to forward certified copy of same to Mr. Guy
E. Griffin of said County Department of Public Works
RESOLVED, that this Board hereby requests
the Department of Public Works of the
County of Westchester to convey to the
Town of Mamaroneck for park and recreation
use, the property owned by the County and
formerly used for the Dillon Park Sewage
Pumping Station, as shown on Map entitled
"Westchester County Department of Public Works,

2046", prepared by Carl J. Suhr, Pro-
fessional Engineer & Land Surveyor, N.
Y. State Lic. No. 10317, and approved
by James C. Harding, Commissioner of
Public works, in September 1965, with the
understanding that the existing Pumping
Station building is to remain standing
- and that there is no objection to filling
in the interior well used for pumping
equipment.
Upon roll call, the foregoing resolution was adopted
by unanimous vote of the Board, all members thereof

3. Conference - Westchester Council
of Social Agencies, Inc.
Upon the Supervisor ' s presentation of his invitation
as County Legislation Chairman to be a participant at
the Twelfth Annual Westchester Conference of Community
Services on anti-poverty, to be held on October 21st,
which Supervisor Migliaccio would cover for him at the
County level since two prior speaking commitments prevent-
ed his attendance, on his recommendation that two members
of the Board be authorized to attend at Town expense,
following some discussion on motion by Councilman Kane,
seconded by Councilman Brush, it was unanimously
RESOLVED, that Councilwoman Helwig and
Councilman Quadrine be and they hereby
are authorized to attend the Twelfth
Annual Westchester Conference of Com-
munity Services, sponsored by The West-
chester Council of Social Agencies, to
be held Thursday, October 21, 1965, from
2 :30 p. m. to 9:30 p. m. , at the Jewish
Community Center of White Plains, with
expenses to be paid by the Town in an
amount not to exceed the total sum of $16.
Councilwoman Helwig --
1. Implemention - Noise Law.
Councilwoman Helwig reported that the State Police
had made the first arrest under the new anti-noise
law. She also reported that the Committee would meet
to discuss the matter of what should be done regarding
enforcement locally on State roads, reciting briefly
some of the problems related thereto.

1. Assessor ' s Report -
1965-1966
Councilman Kane presented the Assessor ' s Report
for 1965-1966 as submitted by the Assessor on
September 15, 1965, which was herewith ordered
received and filed for the record.
Councilman Brush --
1. Committee on Family and Youth
Councilman Brush stated that he was very happy
to inform the Board that the Committee on Family
and Youth was now included as a recipient of funds
for 1966 in both the Larchmont and Mamaroneck
Community Chests.
Councilman Quadrine --
1. Award of Bid - Highway Dump Truck.
Pursuant to the Highway Superintendent ' s recommen-
dation that bid be awarded to the low bidder, on
motion by Councilman Quadrine, seconded by Councilman
Kane, the following resolution was offered:
WHEREAS, the Town Superintendent of
Highways did, on the 6th day of October,
1965, duly recommend the purchase of a
certain Highway Dump Truck for Highway
Department operation pursuant to the
provisions of Section 142 of the Highway
Law,
NOW, THEREFORE, BE IT
RESOLVED, that pursuant to Section 142
of the Highway Law the Town Superintendent
of Highways is hereby authorized to purchase,
in accordance with the provisions of Article
5-A of the General Municipal Law, with the
approval of the County Superintendent of High-
ways, the following:
One new Highway Dump Truck as per specifica-
tions to be furnished to the Town of Mamaro-
neck Highway Department by Mamaroneck Garage,
Inc. , the low bidder, for a price of $4, 375 .
less trade-in for a 1950 Brockway Dump Truck
(Highway Truck #10) in the amount of $400. or
a net price of $3, 975. (Thirty-nine hundred
seventy-five Dollars and 00/100 cents) .
and be it further
RESOLVED, that the Town Superintendent of Highways
is hereby authorized, subject to the approval of
the County Superintendent of Highways, to surrender
to the vendor one (1) 1950 Brockway Dump Truck (Town
of Mamaroneck Highway Truck #10) as part payment for
the above truck to be purchased.

The foregoing resolution, upon roll call, was adopted
by unanimous vote of the Board, all members thereof being
present and voting.
2 . Report - Grif£en Avenue Sewer
Pursuant to Councilman Quadrine ' s report and recommen-
dation, on his motion, seconded by Councilman Kane, it
was unanimously
RESOLVED, that this Board hereby authorizes
the construction of two (2) additional man-
holes in locations specified by the Town
Engineer in the Griffen Avenue Sewer Exten-
sion, in order to provide proper maintenance
for said sewer, said manholes to be construct-
ed at a cost not to exceed the total sum of
$1, 900. over the contract price for said sewer
construction.

1. Settlement - VGM CORP. Certiorari.
Pursuant to letter addressed to the Town Attorney under
date of September 10, 1965, by Victor R. Wolder, attorney,
re: VGM CORP. Certiorari Proceedings, herewith presented
by the Town Attorney and in accordance with his recommen-
dation for settlement thereof, on motion by Councilman
Kane, seconded by Councilman Quadrine, the following reso-
lution was adopted by unanimous vote of the Board, all
members thereof being present and voting:
WHEREAS, heretofore writs of certiorari were
obtained by VGM CORP. , owners of a parcel of
property known and described as Block 903,

WHEREAS, the Town Attorney recommends to this
Board that the proceedings be settled and dis-
continued upon the reduction of certain of
these assessments ;

RESOLVED, that the assessments for the years
1964 for taxes of 1965 and 1965 for taxes of
1966, upon property owned by VGM CORP. and
described upon the Assessment Map and Assess-
- ment Roll of the Town of Mamaroneck as Block

provided the certiorari proceedings now
pending in the name of VGM CORP. for the
years 1964 for taxes of 1965 and 1965 for
taxes of 1966, be discontinued without
costs as against either party; and it is
further
RESOLVED, that all refunds of taxes due by
reason of such reductions be paid without
interest; and it is further
RESOLVED, that the Town Attorney is hereby
authorized and directed to sign the neces-
sary stipulations to obtain an Order of the
Supreme Court providing for such reductions.
2 . Certiorari Proceedings - Chatsworth
Gardens Apartments - Unit B
Pursuant to communication addressed to the Town Attorney
under date of September 9, 1965, by Harry G. Davidson,
attorney for Chatsworth Gardens Apartments, Unit B, in its
certiorari proceedings herewith presented by the Attorney
and in accordance with his recommendation for acceptance
of the stipulation described therein, on motion by Council-
man Brush, seconded by Councilman Kane, it was unanimously
RESOLVED, that in the matter of the Chatsworth
Gardens Apartments, Unit B, certiorari proceed-
ings, the Town Attorney be and he hereby is
authorized and directed to stipulate to include
the 1965 assessment in the proceedings now pend-
ing and awaiting decision, and to agree that the
1965 assessment shall be fixed by the Referee in
the same amount as he determines the 1964 assess-
ment to be, in accordance with letter addressed
to the Town Attorney by Harry G. Davison, Esq. ,
under date of September 9, 1965 and herewith
presented.

There being no further business to come before the
meeting, on motion duly made and seconded, it was
declared adjourned at 9 :30 p. m. , to reconvene on

BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was
convened immediately upon the adjournment of the Town
Board meeting.
1. Claims
Commissioner Brush presented the Fire Department claims
for approval and authorization of payment, and thereupon,
on his motion, seconded by Commissioner Kane, it was
unanimously
RESOLVED, that the following Fire Department
claims, which have been approved by the Fire
Chief and audited by the Comptroller, be and
they hereby are approved, and the Supervisor
and Comptroller authorized to pay the same
out of the 1965 Fire Department budget:

Commissioner Brush presented the Fire Report for the
month of September, 1965, which was herewith ordered
received and filed.

There were no communications to be presented at this
meeting.
4. Other Business
1. Lt. Louis Testa and
Fireman Earl Mellor
Commissioner Brush called to the Commission's attention
that both Lieutenant Testa and Fireman Mellor each of
whom had joined the Town on October 1, 1940, had complet-
ed their twenty-five years of service with the Town of
Mamaroneck Fire Department. He presented a brief resume

of their service with the Town, and after commending
each on his splendid discharge of duty during all of
these years, moved that the Supervisor address a
letter to Lt. Testa and Fireman Mellor on behalf of
this Commission, expressing its congratulations and
paying tribute to them on their long, loyal and out-
standing record of service with the Town of Mamaroneck
Fire Department.
Whereupon, the following resolution was adopted by
unanimous vote, Commissioner Brush' s motion having
been unanimously seconded:
RESOLVED, that the Supervisor be and he
hereby is authorized and directed to
address a letter to Lt. Louis Testa and
Fireman Earl Mellor on behalf of this
Commission, congratulating them on their
completion of twenty-five years of service
in the Town of Mamaroneck Fire Department,
and expressing the appreciation and grati-
tude of the residents of this community as
well as of this Commission for their able
discharge of duty and meritorious service
at all times as members of the staff of the
Town of Mamaroneck Fire Department during
the past twenty-five years they have so
diligently served in this post.
2 . The Fire Chief
In reply to the Fire Chief ' s question, the Commission
stated the "Rules and Regulations" would be acted upon
at the next meeting.
5 . Adjournment
There being no further business to come before the meet-
ing, on motion duly made and seconded, it was declared
adjourned at 9:40 p. m. , to reconvene on October 20, 1965.
