HomeMy WebLinkAbout1968_06_05 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD JUNE 5th, 1968, IN THE COUNCIL ROOM OF THE WEAVER STREET FIRE- HOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER -- The Supervisor called the meeting to order at 8:15 p. m. and in connection with the tragic shooting of Senator Robert Kennedy in Los Angeles, requested that a moment of silent prayer for his recovery be observed. Councilman Chalif then suggested that a telegram be sent to Mrs. Robert Kennedy at The Good Samaritan Hospital in Los Angeles on behalf of this Board and the Town of Mamaro- neck, which was unanimously so directed. ROLL CALL Present: Supervisor Kane Councilwoman Helwig Councilman Chalif Councilman Faiola Councilman Nagel Absent: None Also Present: Mr. Gronberg - Town Clerk Mrs. Brewer - Deputy Clerk Mr. Altieri - Comptroller Mr. Paonessa - Building & Plumbing Inspector Mr. Widulski - Town Engineer APPROVAL OF MINUTES The minutes of the regular meeting of May 15th, 1968, were pre- sented, and on motion duly made and seconded, approved as sub- mitted. PUBLIC HEARING - Adoption of New Swimming Pool Ordinance On motion by Councilman Faiola, seconded by Councilman Nagel, it was unanimously RESOLVED, that the Public Hearing be and it here- by is declared open. The Clerk presented the Affidavit of Publication of the Notice of Hearing for the record and the Building Inspector, at the Supervisor's request, explained that adoption of the new Or- dinance was proposed so that it would no longer be necessary to obtain a Special Permit for the construction of a family swimming pool. He pointed out that under the new Ordinance, applications for swimming pool permits would be handled by the Building Department as were Building Permits - and that —1- if the application complied with all requirements of the Ordi- nance, the permit would be issued by that office. In cases where the application did not comply, he continued, the ap- plicant would appeal to the Zoning Board for a variance. Councilwoman Helwig inquired whether the portable type pools that did not conform would come up for review and was advised in reply by Mr. Paonessa that they would since such permits we:-e approved for a period of only two years. The Supervisor inquired whether any one present wished to address the Board either in favor of or in opposition to the proposed ordinance, whereupon Mr. Mosher commendedthe Board on this very forward-moving step, one which, he said, perhaps should have been done long ago. And thereupon since no one else wished to be heard, on mo- tion by Councilman Faiola, seconded by Councilman Chalif, it was unanimously RESOLVED, that the Public Hearing be and it hereby is declared closed. Whereupon since in reply to the Chair's query, the Board was ready for the question, on motion by Councilman Nagel, sec- onded by Councilwoman Helwig, the following Swimming Pool Ordinance which repeals Article 23 of the Building Code of the Town of Mamaroneck as adopted on May 20th, 1959, was adopted: ARTICLE 23 FAMILY SWIMMING POOLS 1. Definition Swimming Pool Shall mean any private pool whether permanently constructed or of the portable type having a depth of more than eighteen (18) inches below the level of the surrounding land, or an above surface pool, having a depth of more than two (2) feet or an area of one hundred and fifteen (115) square feet or greater, designed, used and maintained for swimming or bathing purposes by an individual for use of members of his household and guests, whether located indoors or on the ap- plicant's land as an accessory use to a residence and shall include all buildings, structures, equipment and appurten- ances thereto. 2. Conditions for Accessory Use A. A swimming pool may be permitted in any Zon- ing District only as an accessory structure to a principal building used for residential purposes and shall be located on the same lot with the principal building. Said pool shall be for the exclusive use of the occupants of the principal building and his guests. B. A swimming pool may be permitted in any Zon- ing District when said use is not an accessory -2- 179 structure to a principal building used for resi- dential purposes only upon application to Zon- ing Board of Appeals in accord with this or- dinance. 3. Building Permits No person shall construct, build, erect or enlarge a swim- ming pool until he shall have first obtained a permit there- for. 4. Application for Permit A. Each application for a building permit to con- struct, build, erect, alter or enlarge a swim- ming pool shall be accompanied by plans in sufficient detail to show: 1) Topographical survey of the property on which the pool is to be placed; showing location of pool in relation to all prop- erty lines and other buildings and appur- tenances on the lot. 2) Pool dimensions, depth, volume in gal- lons - cross sections. 3) Waste disposal system. 4) Pool equipment showing details of filters, pump, chlorinator strainers, hair and lint interceptors. 5) Drains and drainage from pool structure to a sanitary sewer. 6) Location of fence and screening around pool. 7) Estimate of cost of said pool. 5. Requirements for Issuance of Permit No permit shall be issued under the provision of this chapter unless the proposed swimming pool or the alterations to an existing swimming pool shall comply with the following re- quirements. A. Locati bn The edge of any swimming pool, deck, or walk shall not be constructed, installed, located, maintained or operated within: 1) Fifteen (15) feet of any side yard lot line, ac- cessory structure, principal structure or ac- cessory structure attached thereto. 2) Twenty (20) feet of any rear lot line. 3) The required front or side yards of any resi- dential property. -3- 180 4) Twenty-five (25) feet of a septic tank or leaching field. B. Construction All material used in the construction of any swim- ming pool shall be of durable quality as determined by the building inspector, and waterproof, and so designed so as to facilitate emptying and cleaning the bottom and sides of the pool. Pool sides shall be smooth and free from cracks, open joints and light in color. Inlets shall be so located and spaced as to insure satisfactory dispersion of in- flowing waters throughout the pool and to permit the draining, cleaning and disinfection of the bottom and sides. Sand, earth or wooden bottoms are prohibited. They shall be so constructed that the area adjacent thereto shall pitch away from the pool and the top of the pool coping shall be at least two (2) inches above the surface of the area surrounding the pool deck. C. Water Supply There shall be no cross connections between the pip- ing system of a swimming pool and portable water system. If water is supplied from a portable water system, the inlet or fill pipe shall be located at least six (6) inches above the overflow level of such pool. D. Drainage There shall be provided at least one metal grated outlet for the drainage of pool water through the use of the filter pump or otherwise and for back- wash water disposal. Such outlet shall have an area of openings at least four (4) times the cross-sec- tional area of the required drain pipe and the drain pipe shall be equipped with a gate valve located out- side the walls of the pool. The drain outlet and drain piping therefrom shall be of such size as to permit the pool to be completely drained in a period of twelve (12) hours for private family use pools, and of four (4) hours for other pools, but shall be not less than three inches in size. E. Enclosure Every swimming pool having a depth of eighteen (18) inches below the level of the land surrounding the pool, or in the case of above-surface pools having a depth of more than two (2) feet or an area of one hundred and fifteen (115) square feet or greater - shall within sixty (60) days,°from the enactment of this ordinance be completely surrounded by a fence or wall of substantial construction as determined by the Building Inspector, not less than four (4) feet and not more than six (6) feet in height, such portion of fencing over four (4) feet in height must be located within twenty-five (25) feet from said pool and not extend into any side or front yard. The fence shall be so constructed -4- 181 as not to have openings, holes or gaps larger than two (2) inches in any dimension. A dwelling or accessory building may be used as part of such en- closure. All gates or doors opening through such enclosure shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times. All gates shall be at the same height as the fence. An above-ground pool with no part of its side-wall height less than four (4) feet above-ground and so constructed by the manufacturer that the vertical sides are smooth, sheer and do not provide any means for intermediate foot or hand holds shall be exempt from the full provisions of the above fence requirements. How- ever, a full height fence with self-closing, self- locking gate capable of being locked with its latch located only on the inside of the gate shall enclose the ladder area not less than four (4) feet in width and four (4) feet in depth, and the ladder shall remain permanently therein. Above-ground pools pro- vided with foot or hand holds (draw handed) and above- ground pools less than four (4) feet side-wall height above ground are not exempt from the full fencing re- quirements. F. Screening. Screening as is deemed necessary by the Building Inspector may be required by him. G. Lighting and Wiring --- Lights used to illuminate any swimming pool shall be so arranged and shielded as to reflect light away from adjoining premises. Electrical fixtures, wiring and installation therefor used in connection with the swimming pool shall conform to the National Board of Fire Underwriters for Electrical Wiring and Apparatus. All wiring for such installation shall be underground. H. Disposition of Waste Water All waste water shall be discharged into a public storm drain, sanitary sewer or drainage ditch, brook or stream. Where waste water cannot be disposed of because of the lack of the above-mentioned facili- ties it shall be disposed of by means of a dry well or series of dry wells, provided that such waste water will not overflow in any instance onto abut- ting property or flood existing leaching fields of a septic tank system. I. Filtering, Sterilizing and Auxiliary Equipment Filtering, sterilizing and auxiliary equipment shall be adequate to maintain the sanitary quality of pool water during each period the pool is in use. Equip- ment containing gases or disinfectants capable of giving off irritating, toxic or flammable fumes shall be located in ventilated rooms or structures. All rooms or structures shall be well lighted and equip- ped with safeguards in case of chlorine leaks. All equipment shall be so constructed or housed so that -5- 182 it may be used without causing any noise or distur- bance to persons residing adjacent to or near the pool. J. Diving Boards No diving board or platform shall be used or in-- stalled in connection with any swimming pool hav- ing a depth of less than eight (8) feet. In swim- __' ming pools of eight (8) feet to eleven (11) feet in depth diving boards may be installed for use in the deep area, provided that they are not more than three (3) feet above water level. In pools over eleven (11) feet in depth standard diving towers may be installed for use in deep area. ABANDONED SWIMMING POOLS If any swimming pool shall be abandoned or permanently discontinued, it shall be filled in, regraded, or dis- mantled and removed from property. All required enclo- sure fencing over four (4) feet in height shall be altered or taken down to comply with code. INSPECTION After a permit has been issued under the provisions of this Ordinance, all work thereunder shall be subject to inspection by the Building Inspector at all times until completion to ascertain that all provisions of this Ordinance and all provisions of the application are be- - ing complied with. The Inspector shall have the authority to stop any part of the work being done under any permit which is not issued in conformity with the application of the permit or with the provisions of this Ordinance. WADING POOLS DEFINITION Shall mean a portable or permanent pool, container, device or structure manufactured and sold as a wad- ing pool or play pool or so placed upon the ground that when filled with water it is suitable for or is used as a swimming, wading or play pool for children and the depth of which is two (2) feet or less. REQUIREMENTS No person shall leave a wading pool uncovered and unattended in such a location or in such a manner as to create a hazard to children living in the neighborhood. No wading pool shall be located in the required front or side yards on any property. SEPARABILITY If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdic- tion, such portion shall be deemed a separate, distinct -6- and independent provision and such holding shall not affect the validity of the remaining portions hereof. VIOLATIONS and PENALTIES Any person violating any of the provisions of this Ordi- nance, as the same may be from time to time amended, for which no other penalty is provided, shall be guilty of an offense punishable by imprisonment for not more than thirty (30) days, and shall subject the offender, for each offense, to a civil penalty not to exceed twenty- five dollars ($25. 00) . Every day or part thereof that such violation shall continue shall be deemed to be a separate and distinct violation of the said several pro- visions of this Ordinance and shall render every person liable for a separate penalty for each such violation, and be it further RESOLVED, that the Town Clerk of the Town of Mamaroneck be and he hereby is authorized and directed to publish and post this resolution as required by law. OLD BUSINESS 1. Progress Report - Weaver Street Sidewalk Pursuant to memorandum of June 4, 1968 addressed to the Board by the Town Engineer, it was on motion by Council- woman Helwig, seconded by Councilman Nagel unanimously RESOLVED, that this Board hereby authorizes and directs the Town Engineer to advertise for bids for construction of the Weaver Street sidewalk, said bids to be returnable July 3, 1968. 2. Application for Swimming Pool Permit (Mrs. Edye Weitz, 31 Emerson Road) Pursuant to direction at the last meeting, notification of the subject application was sent to the following pro- perty owners in the area of the proposed pool, with three replies received and only one objection: Mr. Edward D. Doherty - 60 Edgewood Avenue Mr. Rodney Paige - 58 Edgewood Avenue Mr. Raymond G. Richards - 54 Edgewood Avenue Mr. Thomas McCarthy - 57 Maple Hill Drive Mr. Joseph Noe - 59 Maple Hill Drive -- Thereupon, since each of the members of the Board had per- sonally viewed the site and there were no further questions, on motion by Councilman Faiola, seconded by Councilman Chalif, the following resolution was offered pursuant to the memorandum of the Building Inspector dated June 3, 1968, which was herewith presented and filed with the revised application: WHEREAS, Mrs. Edye Weitz has presented an amended application for a permit to con- struct a swimming pool and appurtenances -7- 184 on premises located at 31 Emerson Road, Town, and known as Block 122 Parcel 348 on the Assessment Map of the Town of Mamaroneck; and WHEREAS, the Building Inspector of the Town of Mamaroneck has examined the plans and specifications for the proposed pool as revised and amended, and WHEREAS, the Building Inspector finds that the revised plans and specifications as amended and supplemented to include certain recommended conditions conform in all respects with the re- quirements of the Swimming Pool Ordinance (Article 23 of the Building Code) and there- fore recommends that the application be approved; NOW, THEREFORE, BE IT RESOLVED, that the application of Mrs. Edye Weitz for a permit to construct a swimming pool on her premises located at 31 Emerson Road, Town, and known as Block 122 Parcel 348 on the Assessment Map of the Town of Mamaro- neck, is hereby approved, and the Building Inspector is hereby authorized to issue a per- mit for same provided the pool is constructed in conformance with the revised plans and specifications submitted and filed with the revised application as amended and supplemented to show compliance with the following conditions: 1. That the pool be placed a minimum distance of 10 feet from the side and rear property line. 2. That a four foot high fence with self-clos- ing and locking gate be installed as shown on the plot plan. i 3. That any contemplated above-ground area lighting be shielded and directed away from the neighboring properties. 4. That the applicant shall obtain a building permit within thirty days (30) of the fil- ing of the Resolution with the Town Clerk and the work is to be completed within sixty days (60) of the date of the said Resolution, and be it further RESOLVED, that said permit shall expire two (2) years from date of said resolution, and be it further -8- 185 RESOLVED, that all work must be completed and the owner obtain a Certificate of Occupancy from the Building Inspector before the pool is used. The foregoing resolution was thereupon adopted by unani- mous vote of the Board with all members present and vot- ing Aye. The Board directed that a certified copy of the fore- going resolution be forwarded to the applicant and the Building Inspector. NEW BUSINESS 1. Application for Non-Conforming Pylon Signs - Flinn Motors The Clerk presented the above referred to application together with report of the Building Inspector addressed to the Board under date of May 29, 1968 which was here- with ordered received and filed for the record. The Board considered the application to be merely a re- application by the owner of the property of that which had been disposed of by this Board at the April 3, 1968 meeting at which a Public Hearing had been had upon the same matter. The Board therefore declined to entertain the application. 2. Salary Authorization - Laborer Pursuant to memorandum of the Comptroller dated May 31, 1968 herewith presented and ordered received and filed for the record, on motion by Councilman Nagel, seconded by Councilwoman Helwig, the following resolution was unanimously adopted: RESOLVED, that this Board hereby authorizes the employment of Stephen J. Schmerge as a Seasonal Laborer in the Park Department for the period May 20, 1968 to September 1, 1968, at an hourly rate of $2, 00. 3. Transfer of Funds (Not on Agenda) Pursuant to memorandum of the Comptroller dated June 5, 1968 herewith presented and ordered filed for the record, on motion by Councilman Chalif, seconded by Councilman Nagel, it was unanimously RESOLVED, that this Board hereby authorizes the following transfer of funds : From General Town Surplus $12,600. To Bond Anticipation Notes, etc. A/C 300 10, 000. Int. on Notes, etc. A/C 508 2, 600. -9- 186 COMMUNICATIONS 1. Letter, Hal N. Feit - Murdock Woods A letter addressed to the Supervisor by Mr. Hal N. Feit of 6 Adrian Circle under date of May 17, 1968 was here- with presented and ordered received and filed for the record. Following discussion of the situation described by Mr. Feit, the Board unanimously directed that this be refer- red to the Town Engineer for his immediate attention and that Mr. Feit be so advised. 2. Letter, Baldwin Hills - Request for Bond Release The Clerk presented a letter addressed to the Town Board by Mr. Charles Kretchmer, President, Baldwin Hills Develop- ment, Inc. , dated May 24, 1968, which was herewith ordered received and filed for the record. The Supervisor inquired of the Engineer whether Mr. Aitchi- son and he had made their inspection and had found all work satisfactorily completed. Mr. Widulski replied that he would like to make a final inspection with Mr. Aitchi- son, the Highway Superintendent, to confirm that every- thing was completed satisfactorily and accordingly Council- man Chalif offered the following resolution which was seconded by Councilman Faicla and adopted unanimously: RESOLVED, that in accordance with the recom- mendation of the Town Engineer, this Board hereby cancels Performance Bond in the amount of $10, 000. upon which the Continental Casualty Company is Surety, and Jason-McKenna Construc- tion Corporation and Thomas McKenna and Jason T. Dendy are Principals, subject to the approval of the Attorney, Engineer and Superintendent of Highways. Mr. Kretchmar, who was present, addressed the Board request- ing that if there should be any work not completed to the satisfaction of both the Highway Superintendent and Engineer, he be permitted to place in escrow a sum of money sufficient to carry the work to completion rather than to continue the Performance Bond, which was acceptable to the Board. 3. Copy of Letter to Tax Receiver A copy of a letter addressed to the Receiver of Taxes by Mrs. James W. Savage of 37 Woodbine Avenue, Larchmont, was herewith presented and referred to the Town Attorney for reply. 4. Letter, Jack Isreeli, 4 Skibo Lane A letter addressed to the Village of Mamaroneck Board under date of May 20, 1968 and forwarded to the Town -10- ISM Board by Mr. A. J. Gianunzio, Clerk-Treasurer of the said Village, was presented and herewith ordered received and filed for the record. It was directed that a copy of Mr. Isreeli ' s communi- cation be forwarded to the Police Chief for reply and that he be so advised. 5. Petition re Revaluation - Dillon Road Area Residents A petition addressed to the Town Council, Attention Mr. Thomas J. McEvoy, Assessor, by some 35 residents of the Dillon Road area regarding revaluation was herewith pre- sented and ordered referred to the Assessor. The Supervisor pointed out to all present that every resident who had a question or complaint regarding revaluation was given time to file a Protest Form and if he so desired to talk personally with the Assessor and/or the Board of Review which would sit this year on June 18th, 19th, 20th and 21st at the Town Office from 10:00 a. m. to 12 :00 N and from 1 :00 p. m. to 4 :00 p. M. 6. Request for Park Facilities - Dillon Park Area The Supervisor presented a communication addressed to him under date of May-1968 and signed, "The Mothers of the Dillon Park Area" which read as follows : "The Dillon Park area of your town has no park facilities. "We of the Dillon Park area are in dire need of a suitable park for our future generation. This is a condition that has prevailed for years. "Our children play in the streets but are chased from one street to another. This is the only solution for the children, but for the mothers it is the fear of get- ting hit by a car. We are tired of our children being chased from the streets and being harassed. "We do hope you of the town board could do something for us before school closes. " Following a rather lengthy discussion of the playground facilities formerly available in this area and today' s situation, Councilwoman Helwig suggested that the mothers concerned meet with the Recreation Superinten- dent and her to discuss the situation in an endeavor toward finding a solution to the problems set forth in the petition. 7. Bill for Westchester Municipal Planning Federation Dues - $25. 00 The Clerk presented a letter from the Westchester Munici- pal Planning Federation dated May 27 , 1968, requesting -11- payment of the annual dues in the amount of $25. 00, which was ordered received and filed. Whereupon, on motion by Councilman Nagel, seconded by Coun- cilwoman Helwig, it was unanimously RESOLVED, that this Board hereby authorizes payment of the Westchester Municipal Plan- ning Federation 1968 membership dues in the amount of $25. 00. 8. Public Service Commission - Notice, Petition Orienta Bus Lines The Clerk presented a Notice of Public Hearing of the State of New York Public Service Commission on the peti- tion of Orienta Bus Lines, Inc. , which, upon the Attor- ney ' s advice of requiring no action by this Board, was ordered received and filed. REPORTS The Town Clerk - - The Clerk presented the following reports which were ordered received and filed for the record: Report of the Receiver of Taxes and Assess- ments for the month of May 1968. Report of the Building & Plumbing Inspector for the month of May 1968. Report of Westchester Shore Humane Society, Inc. for the month of May 1968. Municipal Dog Patrol Report for the month of May 1968. Summary of Receipts & Disbursements for the period January 1, 1968 - April 30, 1968. Affidavit of Publication of Annual Report of the Supervisor. Affidavits of Publication and Posting of Reso- lution Amending Building Code. Affidavit of Publication of Notice of Applica- tion to the New York State Water Resources Com- mission for permit to fill East Creek. The Supervisor - - 1. Appointment, Liaison to Library Board The Supervisor stated that Councilman Chalif had very kindly and graciously consented to serve as Liaison to the Board of Trustees of the Larchmont Public Library, -12- 189 requesting a resolution so stating for the record. Whereupon, the Board with great pleasure unanimously moved, seconded and adopted the following resolution: RESOLVED, that V. L. Chalif, Councilman be and he hereby is appointed as Liaison to the Board of Trustees of the Larchmont Public Library to be effective immediately and to serve at the pleasure of the Board. 2. Letter, Robert W. Bartsch, County Personnel Office The Supervisor presented .:a letter addressed to him by Mr. Bartsch of the County Personnel Office requesting the reclassification of Mrs. Barbara Evangelista at no change in salary. Whereupon, on motion by Councilwoman Helwig, seconded by Councilman Chali£, it was unanimously RESOLVED, that in accordance with the direc- tion of the County Personnel Office, this Board hereby authorizes that Mrs. Barbara Evangelista be classified as Senior Typist instead of Senior Stenographer, said reclassi- fication to be effective at no change in salary. 3. Resignation, Morris Bufi The Supervisor presented a letter addressed to him and the Town Board by Mr. Morris Bufi under date of May 20, 1968, tendering his resignation as Senior Engineering Aide of the Town of Mamaroneck, to be effective as of June 21, 1968. Mr. Kane expressed the Town' s deep regret at losing Mr. Bufi as a member of the staff and its pleasure that this was occasioned only by his obtaining a far better position in the construction industry. Mr. Widulski and Mr. Paonessa, the Town Engineer and Building Inspec- tor respectively with whom Mr. Bufi had worked, each expressed his regret at his loss and highly commended Mr. Bufi ' s job performance during the time he had been associated with the Town. And thereupon, on a motion offered by Councilman Nagel and seconded by Councilwoman Helwig, it was unanimously RESOLVED, that each of the members of this Board along with Mr. Widulski and Mr. Paonessa, the Engineer and Building and Plumbing Inspector respectively, hereby highly commend Mr. Bufi on the excellence of his discharge of all the duties and res- ponsibilities of his position during the time he was a member of the Town staff, and -13- 190 extend their best wishes to him in his new position; and be it further RESOLVED, that Mr. Bufi be forwarded a copy of this resolution with the Board ' s well wishes and sincere thanks and appreciation for his services to the Town. 4. Report on Reapportionment (Not on Agenda) The Supervisor briefly reported the status quo of reap- portionment of the County Board, stating that he would not go into detail as he knew all were well aware of the facts due to the wide and excellent coverage given by the local press. 5. Summer Hours (Not on Agenda) Following a brief discussion upon the request of Council- man Faiola, the matter of summer hours for the adminis- trative staff was tabled. Councilwoman Helwig - - 1. Summer Employees - Recreation Pursuant to memorandum of the Recreation Commission dated June 5, 1968 herewith presented by Councilwoman Helwig and ordered received and filed for the record, on her motion, seconded by Councilman Faiola, it was unanimously RESOLVED, that this Board hereby authorizes the following salary expenditures to the persons listed below for the term of employ- ment and at the rate of compensation speci- fied for each: Program Director Term Per Wk William Celestino Sr. Rec. Mrs. Helwig replied that the Commission had been in touch with the Opportunity Center and also with the High School. In addition, she said, the Town had trained a number of persons sent to it by the Center, some of whom she was delighted to report had left the Town due to obtaining positions in private business. 2. Mrs. Helwig also advised that she was very proud to an- nounce that Skip Close and Molly Jordan who had been trained in the Town ' s own Sailing Program would this year conduct the sailing course. Mr. Mosher thanked Mrs. Helwig and said he was very glad to hear this report. 3. U. S. Department of Health - Conference on Noise Councilwoman Helwig advised the Board that she had been invited to attend the U. S. Department of Health Con- ference on Noise, to be held in Washington, D. C. on June 13th and 14th and requested an expense authoriza- tion not to exceed the sum of $50. 00. Whereupon, on motion by Councilman Chalif, seconded by Councilman Nagel, it was unanimously RESOLVED, that this Board hereby authorizes the expenditure of a sum not to exceed $50. 00 to cover expenses of Councilwoman Helwig in attending the U. S. Department of Health Con- ference on Noise, to be held in Washington, D. C. on June 13th and 14th. The members of the Board commended Mrs. Helwig on her past, present, and future activity in the anti-noise field and noted for the record the recognition her efforts had received as testified to by this invita- tion to attend a national-level conference. Approval of Planning Board Resolution of December 13, 1967 The Attorney presented a resolution adopted by the Town of Mamaroneck Planning Board on December 13, 1967 and submitted for this Board' s approval. Following discussion of questions raised most particular- ly with regard to specifying in the resolution the loca- tion of the area in which any funds given the Town in lieu of property for Park and/or Recreation purposes, it was unanimously directed that action on this matter be tabled. Reports Commissioner Faiola presented the Fire Report for the month of May, 1968 which was ordered received and filed for the record. 3. Communications a) Request for Tree Removal Pursuant to communication addressed to Commissioner Faiola by the Fire Chief under date of May 22, 1968 herewith pre- sented and ordered received and filed for the record, on his motion, seconded by Commissioner Chalif, it was unani- mously RESOLVED, that this Commission hereby authorizes the removal of two trees on the front lawn of the Weaver Street Firehouse premises as set forth in the above mentioned communication. 4. Other Business a) Expense Authorization - Annual Convention Pursuant to the Fire Chief ' s request, on motion by Com- missioner Faiola, seconded by Commissioner Helwig, it was unanimously RESOLVED, that this Commission hereby authorizes the expenditure of a sum not to exceed $400. for the attendance of the Fire Chief and two Deputies at the Annual Convention to be held at the Concord Hotel, Monticello, New York from June 16 through 19, 1968. b) Report - Larchmont Acres Fire Problems In connection with the Larchmont Acres fire incidences, Commissioner Faiola presented the following Notice for- warded to all tenants by the management of said apart- ments : The following article recently appeared in the local newspaper: 'Fire broke out in a basement storage room at Larchmont Acres Apartments yesterday afternoon and was quickly doused by town firemen. A similar fire occurred Wednesday. Both are of suspicious origin, according to Mama- roneck Town detectives who are inves- tigating. ' -18-- 195 "Our superintendent and the police found crumpled newspapers and burned matches at the scene of the recent fire. There is no question in our minds that arson is being committed. As you all know we have had a number of fires over the past six months. We are greatly concerned with this problem and we are hereby offer- ing a $500. reward for information leading to the arrest and conviction of the arsonist. " Commissioner Faiola called to attention the large reward offered and highly commended the management on its co- operation with the Town of Mamaroneck Fire and Police Departments. C. Report - New Rochelle High School Fire Commissioner Faiola and the Fire Chief reported on the Town of Mamaroneck Fire Department ' s participation in the New Rochelle High School fire and Commissioner Faiola advised the Commission of the cancellation of a bill by Mr. "Irv" of the Beechmont Service in gratitude for the cooperation given by this department, suggesting that a "thank you" note be addressed to him on behalf of the Commission.
