MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK, HELD MARCH 6, 1968, IN THE COUNCIL
ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET,
_ TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
The minutes of the regular meeting of February 7 , 1968
were presented, and on motion duly made and seconded,
approved as corrected.
PUBLIC HEARING - Local Law #1 - 1968
On motion by Councilman Chalif, seconded by Councilman
Faicla, it was unanimously
RESOLVED, that the hearing be and it hereby
is declared open.
The Clerk presented the Affidavit of Publication of the
Notice of Hearing which was herewith ordered received
and filed, and then read the proposed law for the bene-
fit of those attending the meeting.
The Supervisor inquired whether anyone present wished
to be heard either in favor of or in opposition to the
proposed law, thereupon Mr. Peter Mosher addressed the
Chair inquiring whether the proposed law applied to
any County road or State highway within the Town or just
to the walk along Weaver Street from Palmer Avenue to
the Boston Post Road.
The Attorney, to whom the question was referred by the
Chair, replied that it applied to any County road or
State highway.

The Attorney further stated that the proposed legisla-
tion, Local Law #1, 1968, would supersede.'a section of
the State Highway Law (Section 151) which prohibits a
Town in Westchester County from constructing or maintain-
ing walks along State highways or County roads. He further
stated that such Local Law could be used only if the con-
struction of the walk were financed by a General Town
charge. If the construction were to be financed as a
_ Part Town charge he explained that it was necessary to
obtain legislation (Home Rule Bill) in Albany which pro-
cedure could be lengthy.
The Supervisor inquired whether anyone else wished to be
heard and since no one did, on motion by Councilman Chalif,
seconded by Councilman Faiola, it was unanimously
RESOLVED, that the hearing be and it hereby is
closed.
The Supervisor asked whether the Board was ready for the
question, whereupon Councilman Chalif recommended in the
interest of further consideration by the Council that
decision be reserved and thereupon on his motion, seconded
by Councilman Faiola, it was unanimously
RESOLVED, that decision on adoption of Local
Law #1, 1968, be and it hereby is reserved.
Mrs. Donald H. Chapin, 14 Dimitri Place
Mrs. Chapin upon recognition by the Chair asked whether
this would delay construction of the sidewalk.
In reply Councilman Chalif replied that it would not.
OLD BUSINESS
1. Application of Flinn Motor Corp. -
Sign Variance
With reference to the application of Flinn Motor Corp.
for a sign variance on which decision had been reserved
at the February 21st meeting, the Supervisor inquired
the Board' s pleasure in the matter.
Councilman Chalif recommended denial of the application
for the reasons set forth at the Public Hearing and since
there was no question by any member of the Board, on his
motion, seconded by Councilman Faiola, the following
resolution was adopted by unanimous vote of the Board,
Councilman Nagel being absent and therefore not voting:
RESOLVED, that this Board affirms the decision
of the Building Inspector denying a permit to
Flinn Motor Corp. for the erection of four (4)
non-conforming business signs on the premises bi k
located at 18 Boston Post Road and known as
Block 411, Parcel 249 on the Tax Assessment

2. Recognition of Paid Firemen' s
Association as Bargaining Agent
The Clerk presented a communication addressed to the
Council by James A. Laverty, Secretary of the Town of
Mamaroneck Paid Firemen' s Association under date of
March 4, 1968, which was herewith ordered received
and filed for the record.
Whereupon, in accordance with the Association' s re-
quest and resolution adopted by it and set forth in
the above referred to letter, and upon Councilman
Chalif ' s pointing out that this was the only group
requesting recognition, on motion by Councilman
Faiola, seconded by Councilwoman Helwig, it was unan-
imously
RESOLVED, that this Board hereby recognizes
the Town of Mamaroneck Paid Firemen' s As-
sociation as the sole bargaining agent for
the paid staff of the Town of Mamaroneck
Fire Department under the New York State
Public Employee' s Fair Employment Act.
3. Planning Board Report on Application
of Winged Foot Holding Corp. for a
Special Permit
The Clerk presented the Planning Board report on the
above application, dated March 4, 1968 and stating
its approval of the application following study of
the plans and specifications, which was herewith or-
dered received and filed for the record.
And thereupon, pursuant to" Section 432 of the Zoning
Ordinance, it was recommended that a Public Hearing
on the application be held at the next meeting of the
Board, whereupon on motion by Councilwoman Helwig,
seconded by Councilman Chalif, it was unanimously
RESOLVED, that a Public Hearing be held be-
fore this Board on Wednesday evening, March
20th, 1968, at 8:15 p.m, in the Council
Room of the Weaver Street Firehouse, Weaver
Street, Town of Mamaroneck; to consider the
application of Winged Foot Holding Corp. --
for a Special Permit for additions and al-
terations to the Winged Foot Golf Club;
and be it further
RESOLVED, that the Town Clerk be and he
hereby is authorized to publish in the of-
ficial newspaper of the Town of Mamaroneck,
The Daily Times, Notice for such hearing
as required by law.

NEW BUSINESS
1. Authorization - Collection 1968 Town,
County, State & Special District Taxes
At the Tax Receiver ' s request for authorization to col-
lect the 1968 State, County and Town taxes and publish
and post the necessary Notice therefor, on motion by
Councilman Faiola, seconded by Councilman Chalif, it
was unanimously
RESOLVED, that this Board hereby authorizes
the Receiver of Taxes of the Town of Mamaro-
neck to collect the 1968 State, County, Town
and District taxes and water rents which become
a lien on January 1, 1968,
and be it further
RESOLVED, that in accordance with the provi-
sions of Section 550 of the Westchester County
Administrative Code, "The Daily Times" , the
official newspaper published in the Village
and Town of Mamaroneck, be and it hereby is
designated as the newspaper in which the -
Receiver of Taxes and Assessments shall pub-
lish the "Notice of the Collection of State,
County, Town and District taxes and Water rents, "
and be it further
RESOLVED, that said publication shall be on
March 20,1968 in The Daily Times and shall be
posted thereafter in accordance with law,
and be it further
RESOLVED, that in accordance with the provi-
sions of Section 550 of the Westchester County
Administrative Code, the Town Board does here-
by direct the Receiver of Taxes and Assessments
to mail to each taxpayer of the Town of Mamaro-
neck, whose address is known to said Receiver
of Taxes and Assessments, a tax bill for all
taxes and water rents, the expense thereof to
be a Town charge.
2. Fixing Date - Tax Lien Sale
The Supervisor presented a memorandum addressed to him
by the Receiver of Taxes under date of February 14, 1968
which was herewith ordered received and filed for the
record, and thereupon on motion by Councilman Chalif,
seconded by Councilwoman Helwig, it was unanimously
RESOLVED, that Wednesday, May 22, 1968, be
and it hereby is designated as the date for
the 1968 Tax LienrSale of the Town of Mama-
roneck, at 10:00 a.m.

Pursuant to Comptroller ' s memorandum dated March 4,
1968 and following his explanation thereof, on motion
by Councilwoman Helwig, seconded by Councilman Chalif,
it was unanimously

4. Authorization - Transfer of Funds
( Wood Chipper)
Pursuant to memorandum of the Comptroller under date of
March 4, 1968, requesting transfer of funds to cover the
balance due on Wood Chipper - Sheldrake River Project -
herewith ordered received and filed for the record, on
motion by Councilwoman Helwig, seconded by Councilman
Faiola, it was unanimously
RESOLVED, that this Board hereby authorizes
the following transfer of funds within the
1968 budget:

5. Resolution - Capital Notes Highway Fund -
(Purchase of Highway Equipment)
Pursuant to memorandum of the Comptroller dated March 4,
1968, requesting adoption of Capital Note resolution in
the amount of $49, 500. , herewith ordered received and
filed for the record, the following resolution was offered
by Councilman Faiola, who moved its adoption, seconded
by Councilman Chalif, to wit:
CAPITAL NOTE RESOLUTION DATED MARCH 6th, 1968.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $49, 500.
CAPITAL NOTES OF THE TOWN OF MAMARONECK, WEST-
CHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE
PURCHASE OF HIGHWAY MACHINERY AND APPARATUS FOR
SAID TOWN.
BE IT RESOLVED, by the Town Board of the Town of
Mamaroneck, Westchester County, New York as
follows :
Section 1. The class of objects or purposes to
be financed pursuant to this resolution is the
purchase by the Town of Mamaroneck, Westchester
County, New York, of highway machinery and appa-
ratus. -7-

Section 2. The maximum estimated cost of such
class of objects or purposes is $49, 500. , and
the plan for the financing thereof is by the
issuance of $49, 500. capital notes of said Town,
hereby authorized to be issued therefor pursuant
to the Local Finance Law. Such capital notes
shall be dated March 6, 1968, shall be numbered
1 and 2, shall be of the denomination of $24, 750.
each, shall bear interest at the rate of three
and sixty hundredths per centum (3. 60%) per annum,
payable at maturity, shall mature on March 5,
1959 and March 5, 1970 respectively, with prepay-
ment reserved, and shall be payable as to both
principal and interest in lawful money of the
United States of America at The County Trust Com-
pany in Mamaroneck, New York. Such capital notes
shall be signed by the Supervisor, and attested
by the Town Clerk under the seal of said Town.
Section 3. It is hereby determined that sub-
division 28 of paragraph a of Section 11. 00 of
the Local Finance Law applies to the aforesaid
class of objects or purposes, and that the period
of probable usefulness thereof is five years.
Section 4. The faith and credit of said Town of
Mamaroneck, Westchester County, New York, are
hereby irrevocably pledged for the payment of
the principal of and interest on such notes as
the same respectively become due and payable.
An annual appropriation shall be made in each
year sufficient to pay the principal of and in-
terest on such notes becoming due and payable
in such year.
Section 5. Said notes are hereby sold at pri-
vate sale to The County Trust Company, in Mama-
roneck, New York, at a price equal to the par
value thereof and accrued interest, if any,
from the date of said notes to the date of
delivery thereof. The Supervisor of said Town
is hereby authorized and directed to deliver
said notes to said purchaser upon receipt of
the purchase price, as aforesaid.
Section 6. It is hereby further determined
that no officer or employee of said Town is an
officer, director or stockholder of said pur-
chaser.
Section 7. This resolution shall take effect
immediately. The question of the adoption of
the foregoing resolution was duly put to a vote
on roll call, which resulted as follows :

The resolution was thereupon declared duly adopted.

6. Approval - Installation Parking Meters (16)
Station Parking Lot #1 & Transfer of Funds
Pursuant to memorandum of the Comptroller dated March 4,
1968 and memorandum thereto attached addressed to the
Comptroller by the Town Engineer under date of February
13, 1968, which was herewith ordered received and filed
for the record, on motion by Councilwoman Helwig,
seconded by Councilman Faiola, it was unanimously
RESOLVED, that this Board hereby authorizes
- the purchase of sixteen (16) additional
parking meters and necessary materials for
bumpers and meter posts for Parking Lot #1,
and authorizes the following transfer of
funds necessary therefor:

Councilman Faiola commended the Town Engineer on finding
space for the installation of 16 additional meters in
parking lot #1.
COMMUNICATIONS
1. James D. Knox - P. B. A. Request -
Endorsement of Proposed Home Rule Bill
The Supervisor presented a proposed Bill and supporting
memorandum delivered by James D. Knox, Secretary of the
Westchester County P. B. A. , requesting the Board' s sup-
port of the Home Rule request, which was ordered receiv-
ed and filed for the record.
At the Chair ' s request the Attorney outlined the proposed
Bill, which would amend Chapter 164 of the laws of 1936,
and upon his advice that he could see no objection to the
Board' s endorsement, on motion by Councilman Faiola,
seconded by Councilman Chalif, it was unanimously
RESOLVED, that this Board hereby authorizes
that the Home Rule Request forms for sub- -
mission to both houses of the State Legisla-
ture in support of the P. B. A. bill - A. I.
3060 and S. I. 2098 - entitled:
AN ACT
to amend chapter 104 of the laws of 1936, en-
titled "An act providing for the establishment,
organization and operation of police depart-
ments in the towns of Westchester County" , in
relation to reinstatement after resignation of
a member of a police force -
be executed and returned in accordance with the
directions set forth on said forms.

2. Town of Mamaroneck P. B. A. , Inc.
The Clerk read a letter addressed by Eugene Agnessanto,
Town of Mamaroneck Police Benevolent Association, Inc.
under date of February 16, 1968 which was herewith
ordered received and filed for the record.
Councilman Chalif referred to a second request which had
- been received by this Board and in view of=" the fact that
there were requests from two groups within the same de-
partment he recommended that no action be taken on this
request.
Councilman Faiola inquired what the next step was to
which Councilman Chalif replied "the group could take
such action as provided under the law".
3. Town Clerk - Request Appointment of
Committee - Election Districts
The Clerk read his memorandum to the Board under date
of March 4, 1968 which requested the Board to appoint
a Committee to discuss the alteration and/or creation---
of election districts in the Town of Mamaroneck, here-
with ordered received and filed for the record.
Whereupon on motion by Councilwoman Helwig, seconded by
Councilman Chalif, it was unanimously
RESOLVED, that this Board in accordance with
the Town Clerk's request hereby appoints the
following Committee to discuss the alteration
and/or creation of Election Districts in the
Town of Mamaroneck - Charles J. Wielgus,
Republican Town Chairman, Stuart B. Miller, Jr. ,
Democratic Town Chairman, and Charles J. Gron-
berg, Town Clerk, Town of Mamaroneck.
4. Town Clerk - Purchase of Voting Machines
The Clerk presented the following memorandum addressed
by him to the Board under date of March 4, 1968:
"In the election budget for 1968, there is a sum of
$4, 974. 00, which is for the purchase of three (3).
voting machines.
"I would suggest that this be revised and that the
Town purchase two (2) machines and rent eight (8)
machines for the coming Presidential election.
"I would further suggest that the Town purchase the
eight (8) machines, payment to be made over a five
year period, first payment to be made in 1969.
"The rental paid in 1968 for the eight (8) machines
would be applied against the purchase price.

"in 1968 and 1969, the Town must make a payment of
$3000. 00 on our present Capital Note for the pur-
chase of the ten (10) machines purchased a few
years ago.
"Purchase of two machines @ $1653. 00 $3306. 00
Rental of eight machines C 165. 30 1322.40
$4628. 40
"Purchase of eight machines C 1653. 00 $13224. 00.
Less Rental Paid 1322. 40

"The sum of $11901. 60 is the amount to be paid over
a five year period".
Thereupon pursuant to his request for two resolutions,
one authorizing the Town Clerk to advertise for bids for
the purchase of two new voting machines and the other
authorizing the rental of eight machines, on motion by
Councilman Chali£, seconded by Councilman Faiola, it was
unanimously
RESOLVED, that the Town Clerk in accordance
with law, be and he hereby is authorized to
publish in the official newspaper of the
Town of Mamaroneck, "The Daily Times" , a No-
tice for Bids for two new voting machines,
said bids to be returnable, opened and read
aloud at the regular meeting of this Board
to be held on March 20, 1968 at 8:15 p. m. in
the Council Room of the Weaver Street Firehouse,
—. Weaver Street, Town of Mamaroneck;
and be it further
RESOLVED, that this Board hereby authorizes
the rental of eight (8) voting machines for
the November 1968 Presidential election, at
the prices stated in the hereinabove quoted
memorandum.
5. Board of Elections - Special Registration
The Clerk read a communication addressed to the Board by
the Board of Elections, Westchester County, under date of
March 4, 1968 in which approval of its plans for special
registration from May 27, 1968 to May 31, 1968 was re-
quested.
Following some discussion in which Councilman Chalif
questioned special registration taking place on Thurs-
day, May 30th, Memorial Day holiday, the request was
finally approved by unanimous consent of the Board with
the Clerk directed to so advise the Board of Elections.

6. Letter - Mrs. Reisman - Authorization
of Youth Council
Pursuant to request of Mrs. Philip H. Reisman, Jr. ,
Projects Coordinator, Larchmont-Mamaroneck Committee
on Family and Youth, under date of March 4, 1968 here-
with presented and filed for the record, on motion by
Councilman Faiola, seconded by Councilwoman Helwig,
the following resolution was unanimously adopted with
direction that a copy thereof be forwarded to the Larch-
mont-Mamaroneck Committee on Family and Youth:
RESOLVED, that the Town of Mamaroneck does
hereby establish a Youth Service Project as
authorized by Chapter 636 of the Laws of
1956, as amended, Article 19-A of the Execu-
tive Law; and
That such project or program include therein
the Youth Council known as the "Larchmont-
Mamaroneck Committee on Family and Youth" , to
administer such program or project; and
That said Youth Council shall have the power
and it shall be its duty to:
1. Co-ordinate, co-operate and contact exist-
ing services or agencies working with and
concerned with youth and their problems,
including, but not limited to: schools,
churches, employers, service clubs and
organizations, welfare departments, police,
municipal boards, courts and similar organi-
zations;
2. Assist youth with their problems;
3. Foster educational, vocational or instruc-
tional programs in connection with youth;
4. Study and analyze conditions and statisti-
cal records and data on youth and their
problems and make recommendations related
to the same;
5. Do all things necessary and desirable to carry
out the powers and duties hereingranted, as
well as those powers and duties set forth by
the New York State Division of Youth; and
6. File an annual report with the Town Board of
the Town of Mamaroneck.
That the Youth Council is hereby authorized to
act for the Town of Mamaroneck and apply to New
York State for any and all benefits as provided
by law; and

That the Town Board of the Town of Mamaroneck
reserves the right to audit all expenditures
upon which claim for reimbursement are to be
based; and
That the Youth Council may adopt and amend rules
and regulations for the conduct of its own af-
fairs ; and
That the term of office of the members of said
Youth Council shall be for a period of one year;
- and
That this entire resolution is subject to pas-
sage of the same resolution by the Village of
Larchmont and the Village of Mamaroneck.
Councilman Faiola and all members of the Board commend-
ed this Committee on its outstanding job and expressed
appreciation of its willingness to continue this ser-
vice to the community.
7. Highway Report - Purchase of Road Materials
For the Board' s information the Clerk presented the
Superintendent of Highway' s report on the purchase of
road materials for 1968, which was herewith ordered
received and filed for the record.

The Supervisor called attention to the article in the
March 2, 1968 issue of The Daily Times reporting that
the Court of Appeals had affirmed the ruling of the

Appellate Division in favor of the Town in the matter of
the Soundview Woods water main installation.
2. City of Yonkers Water Bill

The Supervisor reported briefly on the status of the
arrears for water service owed to the Westchester Joint
Water Works by the City of Yonkers.

1. Apportionments
Councilwoman Helwig presented for authorization, the
following petitions submitted by the Assessor for the
correction of the assessment roll so as to permit the
apportionment of taxes, and thereupon on her motion,
seconded by Councilman Nagel, the following resolution
was adopted by unanimous vote of the Board:
WHEREAS, the Assessor has presented a petition
for the correction of the assessment roll for
certain years pursuant to the provisions of
Section 557 , Article 16 of the Westchester
County Administrative Code, known as the West-
chester County Tax Law; and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petitions for
the correction of said assessment roll:

2. County Residual Parcels
For the Board ' s information Councilwoman Helwig briefly
reviewed the status of the remaining County-owned resi-
dual parcels in the Town and requested the Board' s
pleasure in the disposition of same.
Whereupon, on her motion, seconded by Councilman Chali£,
the following resolution was unanimously adopted to be
forwarded to Frank Reagan, Esq. , County Real Property
Consultant in accordance with County policy:
BE IT RESOLVED, that the County of Westchester
should convey to the Town of Mamaroneck, in
accord with the policy of the Westchester
County Board of Supervisors the following par-
cels for municipal purposes which are designat-
ed as residual parcels B, C, I, and a portion
of residual Parcel J.-, contiguous to Parcel I
and running for 160 feet along the N. E. Thru-
way land and further described by sketch
attached; and be it further

RESOLVED, that with regard to these parcels to
be conveyed to the Town of Mamaroneck for muni-
cipal purposes, the Town of Mamaroneck shall pay
the cost of appraising said land and shall also
pay to the County of Westchester, the value set
forth in the appraisals that are to be made of
the above described parcels ; and be it further
RESOLVED, that in the event the Town does not
agree with the appraised value as set forth in
the appraisal obtained by the County, the Town shall
have the right to submit its own appraisal; and be
it further
RESOLVED, that all remaining residual parcels of
surplus lands in the Town of Mamaroneck, owned
by the County of Westchester, be disposed of by
the County of Westchester in accordance with the
disposal policies of the Westchester County Board
of Supervisors ; and be it further
RESOLVED, that the Town Board of the Town of Mama-
roneck, hereby request the Budget and Appropriations
Committee of the Board of Supervisors of the County
of Westchester, to deed directly to the Village of
Mamaroneck, such parcels of land designated as
residual lands, which are situated within the said
Village.

Mr. Peter Mosher
Mr. Mosher inquired whether the fire insurance would be
-- a part of the insurance package or separate if and when
such an insurance package is contracted for to cover the
Town' s insurance needs. He was told that it was assumed

he asked whether it was part of the original package
and was answered in the affirmative.
