TOWN OF MAMARONECK, HELD JANUARY 3, 1968, IN THE COUN-
CIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET,
TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p. m.

APPROVAL OF MINUTES
The minutes of the regular meeting of December 20, 1967
were presented, and on motion duly made and seconded,
approved as presented.
WELCOME TO COUNCILMAN NAGEL
The Supervisor greeted the new Councilman, Mr. Carl
Nagel, cordially welcoming him to the Board and stat-
ing that his would indeed be a major contribution to
the Town due to his particular knowledge, skill and
experience.
Councilman Chalif joined the Supervisor in welcoming
Mr. Nagel, adding that he had known Carl well for a
long time and "some of what I know about him is good,
the rest better: "
Councilman Faiola joined both the Supervisor and Coun-
cilman Chalif in welcoming Mr. Nagel and expressed his
pleasure at having him on the Board.
The Supervisor then extended a special welcome on be-
half of Councilwoman Helwig who, he said, was absent
this evening only because she was confined to bed, and
extended her greetings and best wishes.
In reply, Mr. Nagel said - - "all I can say is that it
is my pleasure to be here. "

ORGANIZATION MATTERS
The Supervisor presented the organization matters for
1968, which following due consideration were unanimous-
ly adopted on the following motions:
1. Salaries of Elected Officials
(as provided in 1968 budget)
On motion by Councilman Chali£, seconded by Councilman
- Faiola, it was unanimously
RESOLVED, that the salaries of all elected
officials of the Town of Mamaroneck for
the year 1968 are to be the salaries stated
and appropriated in the annual budget or
estimate for that year as follows :

RESOLVED, that the following persons are
hereby appointed as Town Officials as of
January 1, 1968 in accordance with the pro-
visions of the Town Law to serve for the
respective terms of office and at the annual
salary or rate of compensation hereinafter
stated, such salary or compensation to be
paid from the amounts appropriated in the
annual budget or estimate for the year, 1968,
or so much thereof as shall be sufficient to
pay the salary or compensation as hereby fixed:

On motion by Councilman Faiola, seconded by Councilman

RESOLVED, that the following positions in the
Competitive, Non-competitive and Exempt
Classes of the Civil Service shown in the bud-
get or estimate are hereby continued and the
annual compensation for the same in the year
1968 is hereby fixed and shall be paid from
the amounts appropriated in the annual budget
or estimate for that year, or so much thereof
as shall be sufficient to pay such annual com-
pensation, to be effective as of January 1st,

and be it further
RESOLVED, that the employment of the last named
persons to the aforesaid positions is in accor-
dance with the classifications made by the
County Personnel Officer under the provisions
of the Civil Service Law of the State, and any
vacancy which now exists, or which may occur in
said positions from time to time, are to be fill-
ed at salaries set in accordance with the provi-
sions of the salary scale adopted by the Town
Board, and in conformity with the Civil Service
rules and amendments thereto for towns, villages
and special districts in Westchester County, New
York.
4. Appointment and Salaries (as
provided in 1968 budget)
Deputy Supervisor - p-t
On motion made by Councilman Chalif, seconded by Council-
man Nagel, it was unanimously
RESOLVED, that this Board hereby approves
the Supervisor' s appointment of Council-
woman Christine K. Helwig as Deputy Super-
visor of the Town of Mamaroneck, to serve
at the pleasure of the Supervisor and to be
compensated at the rate of $600. per annum,
beginning as of January 1, 1968.
Secretary to Supervisor
On motion made by Councilman Chalif, seconded by Council-
man Nagel, it was unanimously
RESOLVED, that this Board hereby approves
the Supervisor ' s appointment of Lavenia Brewer
as Confidential Secretary to the Supervisor,
effective January 1, 1968 and to be compen-
sated at the rate of $8, 510 per annum begin-
ning as of that date.

6. Authorization for Appointment of:
Deputy Receiver of Taxes
Pursuant to request of the Receiver of Taxes, Mr. Leo
N. Orsino, herewith presented and filed as part of the
record of this meeting, on motion by Councilman Faiola,
seconded by Councilman Chalif, it was unanimously
RESOLVED, that this Board hereby approves
the appointment of Raymond C. Bingman,
Intermediate Account Clerk, as Deputy Re-
ceiver of Taxes, authorized to receive
tax money, give proper receipt therefor in
his name, enter such payments upon the re-
cords, and deposit tax money in the bank
for the year ending December 31, 1968.
Assessment Clerk to Receive Tax Funds
Pursuant to request of Mr. Leo N. Orsinc, Receiver of
Taxes, herewith presented and filed as part of the re-
cord of this meeting, on motion made by Councilman
Chalif, seconded by Councilman Faiola, it was unani-
mously
RESOLVED, that this Board hereby approves
the appointment of Charles Kane:d.aAssessment
Clerk, as a person authorized to receive
tax money, give proper receipt therefor in
his name, enter such payments upon the re-
cords, and deposit tax money in the bank for
the year ending December 31, 1968.
Deputy Town Clerks (2)
Pursuant to request of Mr. Charles Gronberg, Town Clerk,
herewith presented and filed as part of the record of
this meeting, on motion made by Councilman Chalif,
seconded by Councilman Faiola, it was unanimously
RESOLVED, that in accordance with the Town
Clerk' s certificates, the appointment of
Mrs. Lavenia Brewer and Mrs. Joanne Colasacco
as Deputy Town Clerks of the Town of Mamaro-
neck for the year 1968 be and it hereby is
approved.
Registrar of Vital Statistics
Pursuant to communication of the New York State Depart-
ment of Health, herewith presented and filed as part of
the record of this meeting, on motion made by Councilman
Faiola, seconded by Councilman Nagel, it was unanimous-
ly
RESOLVED, that Charles J. Gronberg be and he
hereby is appointed Registrar of Vital Statis-
tics of the Town of Mamaroneck, for a term of
office of two years beginning on January 1,
1968 and terminating on December 31, 1969

and be it further
RESOLVED, that the Supervisor be and he here-
by is authorized to sign the Certificate of
Appointment of the Registrar of Vital Statis-
tics, to be filed with the New York State De-
partment of Health.
Trustee - Police Pension Fund
On motion made by Councilman Nagel, seconded by Coun-
cilman Faiola, it was unanimously
RESOLVED, that Town Supervisor Peter F. Kane
be and he hereby is appointed a member of
the Board of Trustees of the Police Pension
Fund of the Town of Mamaroneck, to serve for
a te%m of one year, beginning January 1, 1968
and terminating on December 31st of that year.
Conservation Advisory Committee
On motion made by Councilman Chalif, seconded by Coun-
cilman Nagel, it was unanimously
RESOLVED, that the following persons be and
they hereby are appointed members of the Con-
servation Advisory Committee, to serve for a
term of one (1) year, beginning January 1,
1968 and terminating December 31 of that year:

Mrs. James G. Johnson, Jr.
Mrs. Edward Munzer
Mr. Michael Yahia
Mrs. Rex W. Vincent
Board of Police Commissioners
The Supervisor placed in nomination the name of Mr. Lee
Gagliardi who was recommended by the Town Committee to
fill the vacancy caused by the resignation of Mr. A. C.
Viebranz from the Board of Police Commissioners, and
presented a brief resume of his particular qualifications
and experience, describing him as one who he thought tre-
mendously well qualified to fill this vacancy.
Councilman Chalif remarked that he had had the good for-
tune of knowing Mr. Gagliardi for twenty years and that
he was completely qualified to succeed if not to replace
Mr. Viebranz. His background is extraordinary, his
ability unusual and his training outstanding, he said,
and along with his ability he possesses extraordinary in-
tegrity.
Councilmen Faiola and Nagel concurred in these statements
and added that the Board was fortunate indeed to have
such a man as Lee Gagliardi willing to give the time and
accept the challenge of the job of Police Commissioner.

Whereupon since there were no other nominations, on
motion by Councilman Chalif, seconded by Councilman
Faiola, it was unanimously
RESOLVED, that Lee Parsons Gagliardi be and
he hereby is appointed a member of the Board
of Police Commissioners of the Town of Mama-
roneck, effective immediately and to serve at
the pleasure of the Board,
and be it further
RESOLVED, that Mr. Alan M. Welty and Mr.
Thomas F. Moore, Jr. be and they hereby are
reappointed to the Board of Police Commis-
sioners, effective immediately and to serve
at the pleasure of the Board,
and be it further
RESOLVED, that the Supervisor be and he here-
by is directed to advise Mr. Gagliardi of his
appointment, and the Clerk to advise Messrs.
Welty and Moore of their reappointment to the
Commission.
Approval of Supervisor ' s Appointment of
Examining Board of Plumbers
On motion made by Councilman Chalif, seconded by Council-
----- man Nagel, it was unanimously
RESOLVED, that this Board hereby approves the
Supervisor ' s appointment of the following per-
sons to the Examining Board of Plumbers, each
to serve for the term of office herein designat-
ed:
Councilman Faiola for a two-year term of office
terminating on December 31, 1969,
Mr. Sam Pacnessa for a two-year term of office
terminating on December 31, 1969,
Mr. Victor J. Kriss for a one-year term of office
terminating on December 31, 1968.
Town Historian
On motion made by Councilman Chalif, seconded by Council-
man Nagel, it was unanimously
RESOLVED, that Judge Charles M. Baxter be and
he hereby is appointed Town Historian of the
Town of Mamaroneck, to serve at the pleasure
of the Board.

Member, Park Commission
The Supervisor advised the Board that the term of office
of Mrs. Rex Vincent as a member of the Board of Park Com-
missicners expired December 31, 1967 and requested her
reappointment as unanimously recommended by the Commis-
sion with tribute to her for her outstanding contribu-
tion to the community through her past service on the
Commission.
Whereupon, on motion by Councilman Chalif, seconded by
Councilman Faiola, it was unanimously
RESOLVED, that Mrs. Rex Vincent be and she
hereby is reappointed a member of the Board
of Park Commissioners of the Town of Mama-
roneck, to serve for a term of five (5)
years, beginning January 1, 1968 and ter-
minating December 31, 1972.
7. Bonds for Elected Officials
The following resolution was offered by Councilman Faicla
and seconded by Councilman Chalif. Prior to the vote
thereon, questions by Councilman Nagel as to how the
amounts of the bonds were fixed,and by Mr. Peter Mosher
who spoke from the floor to inquire why there was no bond
for the Tax Receiver, were answered to the effect that
the amount of bond was fixed by law and the bond for the
Tax Receiver did not expire until 1969 since the bond ran
concurrently with the term of office.
Since there was no further discussion, on unanimous vote
of the Board it was
RESOLVED, that the following bonds for elected
officials are hereby required pursuant to Town
Law and approved as follows :
Bond, Peter F. Kane as Supervisor of the Town
of Mamaroneck, conditioned for the faithful per-
formance of his duties including the payment of
all school monies pursuant to Section 25 of the
Town Law, upon which the National Surety Corpo-
ration is surety in the penal sum of $25, 000.
for a term of two years.
Bond, Charles J. Gronberg as Clerk of the Town
of Mamaroneck, conditioned for the faithful per-
formance of his duties including the depositing
of all funds or monies of the Town of Mamaroneck
received by him pursuant to Section 25 of the
Town Law, upon which the National Surety Corpo-
ration is surety in the penal sum of $4, 000. for
a term of two years.

Bond, Anthony Vitetta as Justice of the Peace
of the Town of Mamaroneck, conditioned for
the faithful performance of his duties includ-
ing the depositing of all funds or monies of
the Town received by him pursuant to Section
25 of the Town Law, upon which the United States
Fidelity and Guaranty Company is surety in the
penal sum of $4, 000. for a term of four years.
Bonds for Appointed Officials and Employees
On motion by Councilman Chalif, seconded by Councilman
Nagel, it was unanimously
RESOLVED, that pursuant to Town Law, a bond
is required for the faithful performance of
the duties of each of the appointed offi-
cials and employees listed below, and is
authorized as follows in the amount stated
with sufficient surety to be approved by
this Board and the form to be approved by
the Town Attorney:

On motion by Councilman Chalif, seconded by Councilman
Faicla, it was unanimously
RESOLVED, that the following banks and trust
companies are hereby designated as deposi-
tories for funds of the Town of Mamaroneck
for the year 1968, and that the escrow agree-
ments between these banks and the Town of
Mamaroneck presently in effect shall be con-
tinued:

and be it further
RESOLVED, that all withdrawals from the herein-
above named accounts shall be upon the signa-
ture of Peter F. Kane, Supervisor of the Town
of Mamaroneck, and the counter-signature of
Joseph Altieri, Comptroller.
Councilman Chalif brought up at this time the possibility
of collecting Town, State, County and Special District
-_ taxes in two parts, stating that while he recognized the
town benefitted from interest earned, the taxpayers might
be better served by a system permitting such payment.
This suggestion, by common consent of the Board, was re-
ferred to the Attorney for study.
Councilman Chalif then asked the Comptroller the amount
earned from Certificates of Deposit during the past year
and was advised that it was approximately $47, 500. Where-
upon, the Board expressed its pleasure and commended the
Comptroller on this investment procedure.
Official Newspaper
On motion by Councilman Nagel, seconded by Councilman
Faiola, it was unanimously
RESOLVED, that "The Daily Times" be and it
hereby is designated as the official news-
paper of the Town of Mamaroneck for the
purpose of publishing notices,
and be it further
RESOLVED, that a letter be written to the
Editor of The Daily Times expressing the
Board ' s thanks for the very excellent cover-
age during the past year.
Auditors for 1968
On motion by Councilman Chalif, seconded by Councilman
Nagel, it was unanimously
RESOLVED, that the firm of Glick-Freedman and
Neckler, C. P. A. , 271 North Avenue, New
Rochelle, New York, be and it hereby is appoint-
ed to audit the records of the Town of Mamaro-
neck for the year 1968 ; such service to be ren-
dered for a fee of $3 , 000. as appropriated in
the annual budget or estimate for the year 1968.
Councilman Chalif remarked on the excellence of the job
done annually by Glick-Freedman and Meckler at such a
low price, remarking that this audit at this price
actually constituted a service to the Town of Mamaroneck.

9. Approval of Contracts with:
Westchester Shore Humane Society
The Supervisor stated that for the first time one con-
tract had been submitted for the Dog Patrol and Regular
Service of the Westchester Shore Humane Society, where-
upon on motion by Councilman Faiola, seconded by Coun-
cilman Chalif, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to execute the contract between
the Westchester Shore Humane Society, Inc. and
the Town of Mamaroneck for the year 1968 total-
ling $9, 139. , as provided in the 1968 annual
budget or estimate.
Larchmont Public Library
The Supervisor called to the Board ' s attention that this
year ' s contract with the Larchmont Public Library and
the Village of Larchmont included the sum of $2, 072,
covering the Town' s half of the cost of preliminary archi-
tectural plans and appraisal of property for the propos-
ed addition to the library.
Whereupon on motion by Councilman Chalif, seconded by
Councilman Nagel, it was unanimously
RESOLVED, that the Supervisor be and he hereby
is authorized to execute the contract for 1968
- between the Town of Mamaroneck, the Village of
Larchmont, and the Larchmont Public Library in
the amount of $54, 656. , as provided in the 1968
budget.
10. Authorization for Payment of dues to:
Association of Towns
On motion by Councilman Chalif, seconded by Councilman
Nagel, it was unanimously
RESOLVED, that the Town of Mamaroneck continue
its membership in the Association of Towns of
the State of New York for the year 1968 at the
annual dues of $250.
Municipal Finance Officers Association
On motion by Councilman Nagel, seconded by Councilman
Faiola, it was unanimously
RESOLVED, that the Town of Mamaroneck continue
its membership in the Municipal Finance Officers
Association of the United States and Canada for
the year 1968 at the annual dues of $30.

11. Fixing of Dates for Town Board Meetings
On motion by Councilman Faiola, seconded by Councilman
Chalif, it was unanimously
RESOLVED, that regular meetings of this Board be
held at 8 :15 p. m. in the Council Room of the
Weaver Street Firehouse, Weaver Street, Town of
Mamaroneck, on the first and third Wednesday of
each month with the exceptionzof the months of
June, July, August and September when the Board
shall sit only on the first Wednesday of the
month.
12. Amendment of Compensation Plan
On motion made by Councilman Chalif, seconded by Coun-
cilman Nagel, it was unanimously
RESOLVED, that the salary scale of Civil Service
employees of the Town of Mamaroneck, adopted
January 4, 1967 be and it hereby is amended as
follows :

OLD BUSINESS
1. Report on Bids — Highway and Garbage Trucks
Pursuant to report signed by the Town Engineer, Town
Attorney, Superintendent of Highways and the Comptrol-
ler under date of January 3, 1968 recommending award
to the low bidders which was herewith presented and
ordered received and filed for the record, on motion
made by Councilman Faiola, seconded by Councilman Chalif,
the following resolutions were offered:
Highway Trucks
WHEREAS, the Town Superintendent of Highways
did, on the 3rd day of January, 1968, duly
recommend the purchase of certain equipment
pursuant to the provisions of Section 142 of
the Highway Law,
NOW, THEREFORE, BE IT
RESOLVED, that pursuant to Section 142 of the
Highway Law, the Town Superintendent of High-
ways is hereby authorized to purchase, in ac-
cordance with the provisions of Article 5-A
of the General Municipal Law, with the approval
of the County Superintendent of Highways, the
following:

is authorized (subject to the approval of the
County Superintendent of Highways if value exceeds
$1, 000. 00) to surrender to the vendors, Municipal
Machinery Co. , Inc. , and Willow Motor Sales res-
pectively, the following equipment:
One (1) 1948 Four Wheel Drive (item 2 above) at a
trade-in value of $3, 310.
One (1) 1950 Highway Dump Truck (item 3 above) at
a trade-in value of $150. ;
and be it further

RESOLVED, that contracts for the items purchased
shall be duly executed in triplicate between the
Town Superintendent of Highways and such vendors,
Willow Motor Sales and Municipal Machinery Co. ,
Inc. , and when approved by the County Superinten-
dent of Highways, they shall become effective;
and when said contracts have been executed and
approved, and upon delivery of the items purchas-
ed, the Supervisor shall pay the following amounts
as specified:
(1) $ 8, 250. from current appropriations (Item 3)
(2) 44, 620. from the proceeds of obligations
issued pursuant to the Local Fi-
nance Law
Upon roll call the vote on the foregoing resolution was
as follows :

all voting aye except Councilwoman Helwig who was absent.
The resolution was therefore duly adopted.
Garbage Truck
RESOLVED, that this Board hereby authorizes
acceptance of the low bid, that of Willow
Motor Sales, in the amount of $11, 959. 00 for
furnishing to the Town of Mamaroneck One (1)
Garbage Truck in accordance with the specifi-
cations set forth in the Notice for Bids,
funds for which are provided in the 1968
budget.
The foregoing resolution was unanimously adopted with all
members voting "aye" except Councilwoman Helwig who was
absent.
2. Request for Authorization to Advertise for
Bids for Storm Drain along vine Road
Pursuant to memorandum of the Town Engineer herewith
presented and ordered received and filed for the record,
on motion by Councilman Nagel, seconded by Councilman
Chalif, it was unanimously
RESOLVED, that this Board hereby authorizes
the Town Clerk, in accordance with law, to
publish in the official newspaper of the
Town of Mamaroneck, "The Daily Times" , Notice
for Bids for storm drain along Vine Road, said
bids to be returnable January 17, 1968 in ac-
cordance with the specifications stated in the
Notice for Bids.

Resolution, Weaver Street Sidewalk
The Clerk presented a letter addressed to him by the
County Board of Supervisors under date of December 20,
1967 denying the Town ' s request for the installation
of a sidewalk on Weaver Street from Palmer Avenue to
the Boston Post Road, which was ordered received and
filed for the record.
2. Notice of Hearing - City of New Rochelle
The Clerk presented Notice of Public Hearing of the
City of New Rochelle which, upon advice of the Attor-
ney that no action was required by this Board, was
ordered received and filed for the record.

In Councilwoman Helwig ' s absence, the Supervisor present-
ed the Assessor ' s request to attend the Annual Assessors

Whereupon, on motion by Councilman Chalif, seconded by
Councilman Nagel, it was unanimously
RESOLVED, that this Board hereby authorizes
the expenditure of a sum not to exceed $125.
to cover expenses of the Assessor in attend-
ing the Annual Assessors Conference to be
held in Syracuse, New York, January 14th
through 17th, 1968.

Pursuant to request of Councilman Chalif to amend the
resolution authorizing bids for Town Insurance, on his
motion, seconded by Councilman Nagel, it was unanimous-

RESOLVED, that the resolution adopted on Decem-
ber 6, 1967, in connection with the authoriza-
tion to advertise for bids for Town insurance
be amended So as to read that the bids are to
be returnable on February 7 , 1968, rather than
January 17, 1968.

1. Request for Overnight Parking Permits
Councilman Faiola requested that permits for overnight
parking without fee be granted to active volunteer fire-
men upon approval by the Fire Chief.
A memorandum addressed to the Board by the Police Chief
under date of January 3, 1968 requesting its considera-
tion of such overnight parking without fee for both
active volunteer firemen and policemen, was herewith
presented and ordered received and filed for the record.
During discussion it was stated that the Village of
Larchmont had adopted such a policy for active volun-
teer firemen and that it would seem only proper that
this courtesy be extended to active members of the
Town' s volunteer Fire Department. And thereupon since
there was no further discussion or comment, on motion
by Councilman Faicla, seconded by Councilman Chalif, it
was unanimously
RESOLVED, that the Town Clerk be and he hereby
is authorized to issue permits without fee for
overnight parking upon request of active volunteer
firemen of the Town of Mamaroneck Fire Department,
such requests to be approved by the Fire Chief.

The Town Attorney
1. Authorization to Defend Two Appeals
(Not on Agenda)
Pursuant to the Attorney ' s request, on motion by Council-
man Chalif, seconded by Councilman Faiola, it was unani-
mously
RESOLVED, that the Town Attorney be and he
hereby is authorized to defend two Appeals
to the Appellate Division in the matter of
the actions by John M. Bisaccia and Ralph
Perritano, Police patrolmen, against the
Board of Police Commissioners of the Town
of Mamaroneck.
2. Request of Assessor
(Not on Agenda)
The Town Attorney reported that the Assessor had request-
ed the Board to endorse legislation which would require
that the sale price of real estate be stated on the deeds.
He explained that Mr. McEvoy would like to have the full
purchase price or a comparable value listed on deeds in-
asmuch as Internal Revenue Tax Stamps are no longer
required on deeds, said stamps formerly having been used
to indicate the dollar amount of the transaction. He
further stated that the Assessor ' s Office was presently
at a loss to make apportionments or reassessments.
Councilman Chalif remarked that he could see nothing
against this, but that he would like the matter deferred
in order to afford time for further study.
Mr. Peter Mosher
Mr. Mosher at this time inquired the status of the codi-
fication to which the Attorney replied that the matter
was under study with the President of General Code Pub-
lishers Corp. and officials of the Town concerned with
certain ordinances, and that it was hoped that the pro-
ject would be completed in accordance with the terms of
the contract with General Code Publishers Corp.
Mr. Mosher then suggested that the Legislative Committee
of the Larchmont-Mamaroneck-Harrison Bar Association be
requested to review the ordinances, which suggestion was
taken under consideration.
ADJOURNMENT
There being no further business to come before the meet-
ing, on motion duly made and seconded, it was declared

The meeting of the Board of Fire Commissioners was con-
vened immediately upon adjournment of the Town Board
meeting.

4. The Fire Chief
The Chief discussed the matter of conditions at Larch-
mont Acres inquiring whether any official, for example,
the Fire Chief, except the Building Inspector could be
authorized to issue summonses for violations.
The Attorney replied that under the General Municipal
Law only the Building Inspector could issue such sum-
- monses.
In reply to a question from the floor by Mr. Mosher as
to whether this law could be amended, the Attorney
replied that the matter of obtaining legislation could

be looked into and it was the Commission ' s unanimous
request that the Fire Chief and the Attorney confer
with a view toward taking whatever steps might be
necessary in this direction.
