CALL TO ORDER The Supervisor called the meeting to order at 8 :15 p.M. ROLL CALL Present: Supervisor Helwig Councilman Faiola Councilman Nagel Councilman Chalif Councilman Vandernoot Absent: None Also Present: Mr. Gronberg - Town Clerk Mr. Johnston - Town Attorney Mrs. Brewer - Deputy Clerk Mr. Aitchison - Supt. of Highways Mr. Altieri - Comptroller Mr. Widulski - Town Engineer APPROVAL OF MINUTES The minutes of the regular meeting of March 5th, 1969, were presented, and on motion duly made and seconded, approved as submitted. OPENING OF BIDS 1. Earth Fill for Hommocks The Clerk presented the Affidavit of Publication of the Notice for Bids for the record, and opened and read aloud the following bids : Bidder Bid Westchester Contracting Co. $ 1. 60 per cu. yd. Sharot Excavation, Inc. 2. 26 " And thereupon pursuant to usual practice, on a motion offered by Councilman Nagel and seconded by Council- man Faiola, it was unanimously -1- RESOLVED, that the foregoing bids be referred to the Town Engineer, Town Attorney and Comptroller for examin- ation and review, and that upon sub- mission of their reports thereon, all things being equal, the bid be awarded to the low bidder, to-wit: Westchester Contracting Co. , in the amount of $1. 60 per cu. yd. MOVE TO AUDITORIUM The Supervisor directed that the meeting be moved to the auditorium so that all could be comfortably seated be- fore proceeding with the order of business on tonight ' s agenda. PUBLIC HEARING - Local Law #1 - 1969, (Letter, St. Thomas Vestry) . The Clerk presented for the record, the Affidavit of Publication of the Notice of Hearing, and thereupon, on a motion by Councilman Nagel and seconded by Councilman Faiola, it was unanimously RESOLVED, that the Hearing be and it hereby is declared open. The Supervisor requested those who wished to be heard to come forward, stating their name and address for the record. The following persons then addressed the Board, each speaking briefly to the points set forth in the written statements presented and herewith ordered received and filed as part of the record of this hearing. Mr. Bernard B. Kubisak of 752 Forest Ave- nue, Town -- statement filed on behalf of The--Christian Family Movement. Rev. Henry J. Mansell - Sts. John and Paul Church -- statement filed on behalf of the Clergy. Mrs. Herbert Ascher - 11 Byron Lane, Town -- statement filed on behalf of the Larchmont League of Women Voters. Mr. Alexander D. Forger - 74 Magnolia Ave- nue, Village of Larchmont -- statement filed on behalf of the Larchmont Fair Housing Committee. The Foregoing statements, in general, while favoring the adoption of an Open Housing Local Law objected to the Law as proposed because of its alleged lack of provision for enforcement, posting and penalties. Also heard in objection to the adoption of the proposed Law for the same general reasons were: -3- 82 Mrs. Harry Vinograd - 531 Weaver Street, Town. Mr. Frederic D. Cuneo - 80 West Garden Road, Town. Mr. & Mrs. Joel Hasen - 213 Villa Avenue, Village of Mamaroneck. Mrs. Peter Fousek - 1294 Palmer Avenue, Town. - Mr. James Adams - 295 Murray Avenue, Town. Also heard speaking in favor of the proposed Law as submitted were Mr. Isaac Kaplan of 82 Magnolia Avenue, Village of Larchmont, who stated that he felt there was no need for any such law in this community but that he favored the one as herein presented if there were such need, and Mr. Sidney Philip, Chair- man of the Town Commission on Human Rights. At the Supervisor ' s invitation, the Town Attorney then addressed himself to the Law as proposed em- phasizing the following points in response to the remarks made this evening. 1. Swiftness on the local level -- the Attor- ney stated that of all the laws and or- dinances he had reviewed, the law as herein proposed was the swiftest. 2. Enforcement on the local level -- the Attorney stated that he did not know what was meant by this. 3. Posting -- The Attorney stated that, in his opinion, posting would be a depriva- tion of the fundamental constitutional rights granted to everyone, that is due process of law. If such posting were to be found unjustifiable, he said, it would render the person who did it liable in damages. Also, he said, if the person hearing the complaint were to do the posting, he would be setting himself up as Judge, Jury, and Prosecutor which was specifically prohibited under Sub-section 4 of Section 297 of the Execu- tive Law. 4. State Office-- The Attorney stated that he had gone to the State Office in White - Plains to ascertain why there was such pressure for a law at the local level and had been advised by the Director that it was caused largely because many persons in the local communities felt action by the State to be slow and involved. He further stated that the Director had -4- informed him that although processing of claims was commenced on the day of receipt of the written charge or at the latest on the following day, one of the causes for the complaints was due to the fact that many of the files forwarded by the local municipalities were inadequate for proper processing thus necessitating the estab- lishment of a new file and this means new hearings on the State level, and that another cause was that in many instances the person charged with discriminatory practise requested adjournments. The Attorney also said that he would like to point out here that the State agency was staffed with the attorneys who were special- ists in this field, hearing examiners, process servers, office personnel, etc. needed to handle these matters while the Town most certainly was not, and that therefore the Town would have to engage such professional personnel at the times it was needed. 5. Injunctions -- The Attorney stated that an injunction presupposed a pending action -- That it would only be obtained from the Supreme Court and was very drastic. 6. "Model Ordinance" -- With respect to the adopt- ion of laws based on the so-called "Model Ordinance" as submitted by The League of Women Voters, the Attorney stated that he had spoken with several attorneys on Eastern Long Island and had found that their pro- cedures necessarily might vary from ours in- asmuch as they had District Courts as opposed to our County Courts. 7. Jurisdiction of Local Courts -- The Attorney stated that since the jurisdiction of the local court is limited by the State Con- stitution and the Judiciary Law, it could not be enlarged or expanded by the Town Board. 8. Purpose of Proposed Law -- The Attorney stated in response to Mr. Forger ' s repeated question as to what the proposed law did -- that it put a person on notice that a com- plaint had been filed with him and that if attempts to reconcile the matter proved futile, it would be referred by his attorney immediately to the State Division of Human Rights which was eminently qualified and -- had been created solely for the enforce- ment of this law. Upon receipt of a complaint, the Attorney would immediately notify the person charged and file a copy of that notice with the -5- 84 State, wherefore the fifteen-day period allowed in the Law was not for naught, In reply to the Supervisor' s question as to whether any member of the Board wished to make any comment or observation, Councilman Chalif stated that the suggestions and remarks offered this evening were inordinately valuable to the Board although inclusion of the "teeth" requested might be of some question as to constitutionality. He further stated he thought in light of the evening ' s observations that the Board found itself in the position of needing to give further consideration to what would meet the various points which had been raised. He added that in his opinion, however, this Law as proposed was not either com- pletely futile or insulting and certainly that it was a Law. The Supervisor then stated that unless there was further discussion, the Chair would entertain a motion to close the hearing. At this time the Clerk requested that before the hear- ing closed, the letter addressed to the Board by the Vestry of St. Thomas ' Church favoring the adoption of a Fair Housing Law be presented, and thereupon it was ordered received and filed as part of the record of this hearing. Whereupon, on motion by Councilman Chalif, seconded by Councilman Nagel, it was unanimously RESOLVED, that the hearing be and it hereby is declared closed. The Supervisor then inquired the Board ' s pleasure, and on a motion by Councilman Chalif, seconded by Councilman Nagel, it was unanimously RESOLVED, that the proposed Local Law #1-1969 as herein presented be re- referred to the Town Attorney for further study and subsequent re- submission to this Board. OLD BUSINESS 1. Bill for professional services - Proskauer Rose Goetz & Mendelsohn. Upon presentation of the Comptroller ' s request for authori- zation to pay bill rendered for professional services by Proskauer Rose Goetz & Mendelsohn pursuant to statement herewith presented and ordered received and filed for the record, on motion by Councilman Nagel, seconded by Councilman Faicla, it was unanimously -6- RESOLVED, that this Board hereby author- izes payment of bill for professional services rendered by Proskauer Rose Goetz & Mendelsohn to the Town of Mamaroneck in connection with the proceeding brought against the Mamaroneck P. B. A. , Inc. , by the Public Employment Relations Board pur- suant to Section 210. 1 of the Civil Service Law, in the amount of $8, 981.45, covering the period from October 1, 1968 through February 28, 1969. 2. Reports on: a) Snow Removal Expense - Disaster Expenditures. The Clerk presented for the Board ' s information, a memorandum addressed to the Board by William T. Aitchison, Superintendent of Highways, under date of March 19, 1969 together with letter dated March 10, 1969 addressed to the Chairman of the Board of Sup- ervisors of Westchester County by Harold F. Delaney of The Westchester County Association on "Plan Bulldozer", which were herewith ordered received and filed. b) County Superintendent of Highways Meeting. The Superintendent of Highways briefly reported on a meeting of the Superintendents of Highways in Westchester County, stating that the principle points set forth by all regarding the emergency snow of February 9th and 10th were: 1. Need for and removal of abandoned cars on highways and the difficulty of plow- ing caused by parked and/or abandoned cars. 2. Inadvisability of the purchase of heavy equipment by municipalities due to purchase and maintenance costs and in- frequency of use. 3. Difficulty of rental of contractors ' heavy equipment because of Union cost regulations. NEW BUSINESS 1. Fix date for 1969 Tax Lien Sale. -7- The Supervisor read a memorandum addressed to her by Leo N. Orsino, Receiver of Taxes, under date of March 7th, 1969, requesting that the date for the 1969 Tax Lien Sale be fixed, which was herewith ordered re- ceived and filed for the record, and thereupon, on motion by Councilman Nagel, seconded by Councilman Chalif, it was unanimously RESOLVED, that this Board hereby authorizes that the 1969 Tax Lien Sale be held on Thursday, May 22nd, 1969. 2. Engagement of Senior Law Stenographer. Pursuant to memorandum addressed to the Board by the Comptroller under date of March 5th, 1969, herewith ordered received and filed, on motion by Councilman Chalif, seconded by Councilman Faiola, it was un- animously RESOLVED, that this Board hereby approves the engagement of Kathleen R. Hackett, as Senior Law Steno- grapher of the Town of Mamaroneck to replace Agnes K. Kiernan termin- ated as of February 26th, 1969, said appointment to be probationary, ef- fective as of March 5th, 1969 and to be compensated at the rate of $5,255. 00 per annum. 3. Authorization of Salary Increments - Police Department. Pursuant to memorandum addressed to the Board by the Comptroller under date of March 17th, 1969, herewith ordered received and filed, on motion by Councilman Faiola, seconded by Councilman Vandernoot, it was unanimously RESOLVED, that this Board authorizes payment of the following mandatory salary increments in accordance with the Compensation Plan for 1969, as follows: Efft. Letter, Larchmont Ridge Home Owners Association. The Clerk read into the record the following letter addressed to the Council by E. J. Gerrity, Vice President of the Larch- mont Ridge Home Owners Association, under date of March 7th, 1969: "On February 18, in behalf of our Association, I sent a letter to the Supervisor, with copies to the members of the Council on an individual basis. Unfortunately, I was away and unable to attend the Council meeting subsequent to the receipt of my letter. I have been advised that because of a techni- cality the letter I sent in behalf of the Association was not discussed at your public meeting. I would hope that my information is incorrect, but I was told that my letter was not discussed because it was not addressed to the Council as such, but to the Supervisor as an individual, and to the members of the Council as individuals. If that was the reason why the letter was not discussed publicly, I would appreciate confirmation of that fact, since the Association ' s position is intended for full public airing. I send this letter, therefore, to make cer- tain that there is no misunderstanding of our position. -9- Let me make clear that this letter is sent in behalf of our Association. It stems . from our concern about the deficient snow removal performance by the Town of Mamaro- neck during and since the snowstorm of Sunday-Monday, February 9-10. Our purpose is not to point out the in- adequacies which have been so ably set forth in the editorials of The Daily Times. Like that newspaper we seek to prevent a recurrence. It was interesting to read that Mrs. Helwig personally manned the phone in the Highway Department garage to aid the work crews. Her reaction to the need was commendable and we appreciate it. But her act demonstrates clearly the deficiency in Town planning that was so obvious dur- ing the storm. We ask why it was necessary for Mrs. Helwig to become a clerk? The answer is that the Town was not pre- pared, that it had no plan for such an emergency. We would like to know what has been done since the storm so that it does not happen again. It would also be interesting to know what plans the Town has to meet other emergencies that might strike. Is anyone assigned to this type of emergency planning? We would welcome the comments of the Council. For the record, you should be aware that during the period when the storm began at 2:30 a.m. on Sunday, February 9, a snowplow traversed our streets but once-- that occasion being on the evening of Monday, February 10--until a period nine days later had elapsed. On the one occasion that the plow did traverse our streets during that period it left a path only wide enough for one vehicle. As one possible solution we suggest that in order to avoid a repetition of this sort of service, the Council con- sider setting up a panel of experts chosen from your fellow citizens to help with the planning job that so badly needs doing. " The Supervisor reviewed the correspondence of Mr. Gerrity with the Councilmen and herself, including her reply to the current letter and inquired whether Mr. Gerrity, or any representative of the Larchmont Ridge Home Owners Association, was present. -10- 8 Since no one was, the Supervisor stated that the Board would give serious study and consideration to the suggestions set forth in the foregoing communication, but also stated for the record that neither she nor the members of the Board agreed that a poor job of snow removal had been done in the unincorporated area during the past emergency storm. 2. Resignation of Town Justice. The Clerk presented a letter addressed to the Board by Town Justice George D. Burchell under date of March 5th, 1969, tendering his resignation from that office due to his appointment by the Governor as a Judge of the County Court, which was herewith ordered received and filed. The Supervisor stated that Judge Burchell had made a real contribution to the administration of the Town Justice Court though only appointed last May and that he had all the qualities of mind and heart that made for an outstanding member of the Bench. She observed, therefore, that his loss to our local Justice Court was compensated for by the County Court ' s gain through the Gov- ernor ' s appointment and then inquired the Board ' s pleasure in accepting the resignation. Each of the members of the Board heartily endorsed the Supervisor ' s remarks and after observing that they had no choice in accepting this resignation adopted the following resolution on motion unani- mously made and seconded: Whereas, Judge George D. Burchell, Town Justice of the Town of Mamaroneck, has tendered his resignation effective as of March 5th, 1969, and Whereas, during the time he presided as Judge, he has given unstintingly of himself and of his time, knowledge and particular ability in his efforts on behalf of the citizens of the Town and all those who appeared before him, and Whereas, he brought to the bench exceptional wisdom, compassion and understanding, using his rare perception to make many contributions to the forthright and courageous adminis- tration of justice, -11- Now Therefore Be It Resolved, that this Board reluctantly and regret- fully accepts the resignation of Judge George D. Burchell as Town Justice of the Town of Mamaroneck, and be it further Resolved, that this resolution, unanimously adopted by this Board, be spread upon the minutes of this meeting as a public record of tribute to him, and be it further Resolved, that a copy be forwarded to Judge Burchell with the sincere thanks, appreciation and best wishes of the community which he has served with such deep devotion, dedication, and unique distinction. 3. Letter, Louis Romita - Commendation of Police Officers. The Clerk read a letter written by a Mr. Louis Romita on March 14th, 1969 paying tribute to Police Officers Charles 'Baumblatt and Frank Adamo of the Town of Mamaroneck Police Department for their personal atten- tion and excellent service to his wife and children at the time they were involved in an auto mishap, which was herewith ordered received and filed with copies forwarded to the Police Commission and the Police Department of the Town of Mamaroneck. 4. Youth Council Resolution - Village of Mamaroneck. For the Board ' s information, the Clerk presented a certified copy of the resolution adopted by the Board of Trustees of the Village of Mamaroneck continuing the Youth Service Project for another year, on March 10th, 1969, `ahich. was .herewith ordered received and filed for the record. 5. Public Service Commission Notice - New Haven Hearing. The Clerk presented a Notice of Hearing before the Public Service Commission on March 24th, 1969, copy of which had been forwarded to Councilman Chalif, and which was herewith ordered received and filed. -12- 91 REPORTS The Supervisor 1. Lease, Station Parking Lots. The Supervisor read a letter addressed to her by Charles E. Pound, Commissioner of the County of Westchester De- partment of Parks, Recreation and Conservation, under date of March 6th, 1969, with regard to renewal of the lease pending proposed purchase of the Station parking lots, copies of which had been forwarded to each member of the Board for his information, and which was herewith ordered received and filed for the record. She stated that it was to be hoped from the favorable tenure of this letter that the necessary appraisals on the subject parcels would soon be completed and the Town actually able to proceed with the proposed purchase. 2. Letter, Commissioner Moore. At the Supervisor ' s request the Clerk read a letter addressed to Supervisor Helwig by Thomas F. Moore, Jr. , Chairman of the Board of Police Commissioners, under date of March 14th, 1969, tendering his resignation from that Commission, which was herewith ordered re- ceived and filed as part of the record of this meeting. In reply to the Supervisor ' s inquiry as to the Board' s pleasure in this matter, Councilman Nagel stated that as in the case of Judge Burchell the Board had no alternative to accepting with regret Commissioner Moore ' s resignation with the thanks and appreciation this Board felt for his long arduous and dedicated service. Mrs. Helwig said that in accepting Commissioner Moore ' s resignation she believed the Board should note that this entire community was greatly in the Commissioner ' s debt for the time, energy and knowledge which he had devoted to the Police Department during the past seven years. She further remarked that she believed that the Town was particularly in his debt for the past fifteen months of his service as Chairman when he had placed his own wishes, his personal convenience and even his health second to his steadfast and courageous devotion -- to the welfare of the Police Department and the Town. He endured misunderstanding and even abuse for the sake of the principles he believed to be essential to the best interests of the police officers and the citizens of this community. -13- It is not by chance, she said, that affairs and men of high professional quality have been attracted and appointed to serve in the Town. In large measure the excellence of the Town Police Department over the years has been due to the caliber of citizens who have served with integrity and diligence as members of our Board of Police Commissioners. To the honor list of dedicated and hard-working citizens who have served as Police Commissioners, we will now add the name of Thomas F. Moore, Jr. , who has served us all with outstanding ability, firm convictions and great courage and who has earned not only our gratitude but the right to honorable - and we hope a peaceful - retirement, and thereupon, on motion unanimously made and seconded, the following resolution was adopted; Whereas, Thomas F. Moore, Jr. , member and Chair- man of the Board of Police Commissioners of the Town of Mamaroneck, has tendered his resignation from that Board to be effective as of April lst, 1969, and Whereas, during these years when he served both as member and Chairman of that Commission, he has given unstintingly of his time, knowledge, skill, and special abilities in his efforts on behalf of the Police Department and the citizens of this Town, and Whereas, especially during the past fifteen months he has endured many trials and tribulations from both within and without the Police Department without complaint and without compromise of the principles essential to the best interests of the Police Officers and the citizens of this community, and Whereas, he has at all times throughout his tenure of office administered the affairs of the Police Department with inviolate integrity and steadfast and unfaultering courage, Now Therefore Be It -14- CAS Resolved, that this Board regretfully accepts the resignation of Thomas F. Moore, Jr. , as Chairman of the Board of Police Com- missioners of the Town of Mamaroneck, and be it further Resolved, that this Board hereby unanimously adopts this resolution to be spread upon the minutes of this meeting as a permanent and public record of tribute to Com- missioner Moore, and be it further Resolved, that a copy be forwarded to Commissioner Moore with the deep and sincere thanks, appreciation, and best wishes of the members of this Board, the entire staff of the Town Government, and the citizenry of this community which he served with selfless diligence and devotion, ever adhering to those principles which he deemed to be right. The Councilmen Councilman Vandernoot -- -- 1. Apportionments Upon presentation of the following apportionments, on motion by Councilman Faiola, seconded by Councilman Chalif, the following resolution was unanimously adopted: WHEREAS, the Assessor has prezented a petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said petitions for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1968, taxes of 1969, which shows prop- erty now appearing on the roll as follows : -15- 9_ Block Parcel Name Land Only 229 77 Tract Developers, Inc. $ 10, 500. 00 be corrected as follows in accordance with the provisions of subdivision 5 of Section 557 : Block Parcel Name Land Only 229 77 Tract Developers, Inc. $ 10,400. 00 229 76 Peter S. ADJOURNMENT There being no further business to come before the meet- ing, on motion duly made and seconded, it was declared -16- adjourned at 10:05 p.m. , to reconvene on April 2nd, 1969. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Reports a) Chatsworth Gardens Fire Commissioner Faiola commented briefly on the serious Chatsworth Gardens fire on March 12th, 1969, advising that the Chief was submitting a full report. He ex- pressed the compliments and commendations of one and all for the outstanding performance of duty of the Town Fire and Police Department, including all volun- teers and all of the neighboring community departments which had so quickly and competently assisted during the long weary hours of fire fighting. He stated further that the first alarm had sounded at 11 :35 a.m. with the assist calls at 11:55 a.m. , certainly proving that no time had been wasted. He said that there were six aerials and seven pumpers at the scene and certainly all were aware of the tremendous job that had been done by the Chief and all of the forces. Commissioner Faiola further said that the community was indeed grateful that there had been no serious or critical injuries and no deaths and that Mrs. Rodgers, who had been taken to the hospital, he understood, was continuing to improve. -17- 9 The Fire Chief, on behalf of the firemen and police of this community and all neighboring communities, expressed their thanks and gratitude to one and all. 3.
