MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD JULY 8th, 1970, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

THE SUPERVISOR
At this time Mrs. Helwig recognized and welcomed Trustee
Daniel Natchez of the Village of Mamaroneck stating that it
was indeed a pleasure to have him at the meeting.
APPROVAL OF MINUTES
The minutes of the regular meeting of June 3rd, 1970 and the
special meeting of June 17th, 1970 were presented, and on
motion duly made and seconded, approved as submitted.
ADJOURNED PUBLIC HEARING - Local Law No. 3-1970
Code of Ethics
On motion by Councilman Bloom, seconded by Councilman Vandernoot,
it was unanimously
RESOLVED, that the hearing be and it hereby is declared
open.
The Supervisor welcomed Mr. Albert Gaynor and Mrs. Pierce
Mc Creary, members of the Ethics Committee, who were present
this evening.
At the Supervisor's request, Councilman Bloom, Liaison to the
Committee, briefly outlined the purposes of the proposed Code,
explaining that the reason for having such a Code and for the
fast scheduling of its adoption was because this year the
Governor had signed a Law requiring every municipality to
adopt such a Code no later than July 1st of 1970. Therefore,
the Board had appointed a Committee to prepare such a Code
for the Town, and upon submission thereof, had fixed the date

of June 17th for the hearing thereon, which due to certain legal
technicalities, had had to be adjourned to this date.
Councilman Bloom then asked Messers. Johnston and Gaynor whether
they had anything to add -- whereupon Mr. Gaynor stated only
that the proposed Code had been submitted in the hope that it
would meet the requirements of the Board and that the Committee
had been helpful.
The Supervisor then inquired whether there were any other com-
ments, and since not, stated that first those in favor of the
Code, then those in opposition thereto, would be heard.
Since no one spoke either in favor of or in opposition to the
proposed Code, the Supervisor asked if there were any questions
about the Code, and since there were not, on motion by Council-
man Faiola, seconded by Councilman Vandernoot, it was unani-
mously
RESOLVED, that the hearing be and it hereby is
declared closed.
The Supervisor then inquired the Board's pleasure, and
thereupon on a motion by Councilman Bloom, seconded by
Councilman Nagel, the following resolution was adopted by
unanimous vote of the Board, all members being present and
voting "aye":

The Supervisor expressed the Board's thanks and appreciation
to all of the members of the Committee for their diligent
work in preparing this Code, and especially thanked Mr. Johnston,
Mr. Gronberg and Mr. Gaynor for their invaluable assistance.
Councilman Bloom then moved the appointment of a Board of Ethics
in accordance with the provisions of the said Code. This motion
was seconded by Councilman Nagel and the following resolution
thereupon unanimously adopted:
RESOLVED, that pursuant to Local Law No. 3-1970, a

OLD BUSINESS
1. Report - Prince Willows Sewer
Approval of Bond Resolution - $50,000. Additional Funds
Before proceding with the adoption of the bond resolution,
Mrs. Helwig inquired of Mr. Widulski whether the grouting
crews had reported today for the final check of the line
and was advised that they had not but were expected Thursday
morning.
She also referred to a letter addressed to the Board by
Dr. Abby Zelnick of Old White Plains Road and hand delivered
as of this date, stating that she felt the Board should know
of his comments with reference to the grade of a certain man-
hole, etc. Accordingly, she then read the communication which
was thereupon ordered received and filed for the record.
The Engineer, in reply to questioning on the aforesaid letter,
explained the situation which he said would be corrected when
the construction of the curb in this area was completed. He
further explained in reply to a question by Councilman Nagel,
that if manholes were installed at grade level as Dr. Zelnick
had indicated they should be, they could be very easily "lost"
and he cited certain instances where sidewalks had been installed,
lamp posts erected, or extravagant plantings made over a manhole
thus creating extreme difficulty in locating the manholes at times
of emergency.
The Supervisor then reported that the permissive referendum on
the Order for additional funds in the amount of $50,000, had
expired at midnight on July 3rd, and accordingly it was now
in order for the Board to adopt the bond resolution as herein
presented.
Whereupon, following the Clerk's presentation of the Affidavits
of Publication and Posting of the aforesaid Order for the record,

the following resolution was offered by Councilman Vandernoot,
who moved its adoption, seconded by Councilman Bloom, to wit:

A RESOLUTION AUTHORIZING THE ISSUANCE OF $170,000, SERIAL BONDS
OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY
PART OF THE COST OF THE CONSTRUCTION OF A SEWER SYSTEM TO SERVE
AN EXTENSION OF SEWER DISTRICT NO, 1 OF SAID TOWN, TO BE KNOWN
AS SECTION "S" OF SAID DISTRICT.", DULY ADOPTED BY THE TOWN
BOARD OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK,
ON OCTOBER 1, 1969, TO INCREASE THE MAXIMUM COST AND THE
AMOUNT OF SERIAL BONDS TO BE ISSUED THERETO.
BE IT RESOLVED, by the Town Board of the Town of Mamaroneck,
Westchester County, New York, as follows:
Section 1. The title and Sections 1 and 2 of the
bond resolution entitled: "BOND RESOLUTION DATED
OCTOBER lst, 1969. A RESOLUTION AUTHORIZING THE
ISSUANCE OF $170,000. SERIAL BONDS OF THE TOWN
OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO
PAY PART OF THE COST OF THE CONSTRUCTION OF A
SEWER SYSTEM TO SERVE AN EXTENSION OF SEWER
DISTRICT N0, 1 OF SAID TOWN, TO BE KNOWN AS
SECTION "S" OF SAID DISTRICT. " duly adopted by the
Town Board of the Town of Mamaroneck, Westchester
County, New York on October 1, 1969, are hereby
respectively amended to read as follows:
"BOND RESOLUTION DATED OCTOBER 1, 1969.
A RESOLUTION AUTHORIZING THE ISSUANCE OF $220,000. SERIAL
BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW
YORK, TO PAY PART OF THE COST OF THE CONSTRUCTION OF A
SEWER SYSTEM TO SERVE AN EXTENSION OF SEWER DISTRICT NO. 1
OF SAID TOWN, TO BE KNOWN AS SECTION "S" OF SAID DISTRICT.
Section 1. The construction of a sewer system to serve
the extension of Sewer District No. 1 of the Town of
Mamaroneck, Westchester County, New York, known as
Section "S", including appurtenant facilities and
incidental improvements, substantially in accordance
with the map and plan accompanying the petition for
said extension, is hereby authorized at a maximum
estimated cost of $245,000.
Section 2, The plan for the financing of such maximum
estimated cost is as follows:
a) By the issuance of $220,000. serial bonds of
said Town, hereby authorized to be issued
therefor pursuant to the Local Finance Law;
and
b) By the expenditure of $25,000. provided from
available current funds of said District."
Section 2. The validity of the bonds authorized by the afore-
said bond resolution dated October 1, 1969, as amended by this
resolution, may be contested only if:
1) Such bonds are authorized for an object or purpose for
which said Town is not authorized to expend money, or

2) The provisions of law which should be complied with
at the date of publication of this resolution are not
substantially complied with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of such publication,
or
3) Such bonds are authorized in violation of the provisions
of the Constitution.
Section 3. This resolution, which takes effect immediately,
-- shall be published in full in The Daily Times, the official
newspaper, together with a notice of the Town Clerk in sub-
stantially the form provided in Section 81.00 of the Local
Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

The resolution was thereupon declared duly adopted.
2. Report of Planning Board -
Application for Special Permit - Bonnie Briar
The Clerk presented the report of the Planning Board on the
application of Bonnie Briar Country Club for a Special Permit
to enclose the terrace, and inquired the Board's pleasure in
fixing a date for the public hearing as required by Law.
Whereupon on motion by Councilman Nagel, seconded by Council-
man Faiola, it was unanimously
RESOLVED, that this Board hold a public hearing
on the application of Bonnie Briar Country Club
for a Special Permit to enclose the terrace at the
rear of the snack bar on the premises located on
Weaver Street and known as Block 225, Parcel 1, on
the Tax Assessment Map of the Town of Mamaroneck, at
its next regular meeting on August 5th, 1970, at
8:15 p.m., in the Council Room or Auditorium of the
Weaver Street Firehouse, Weaver Street, Town of
Mamaroneck;
and be it further
RESOLVED, that the Clerk be and he hereby is author-
ized to publish in the official newspaper of the Town
of Mamaroneck, "The Daily Times", Notice of such hearing
as required by law.
NEW BUSINESS
1. Application for Special Permit - Adam Libertella
685 Weaver Street, Town
(Construct Wading Pool)
The application of Adam Libertella, owner of premises located
at 685 Weaver Street and known as Block 103, Parcel 5 on the

Tax Assessment Map of the Town of Mamaroneck, for a Special
Permit to construct a wading pool on his premises was presented,
and in accordance with Section 432 of the Zoning Ordinance, on
motion by Councilman Nagel, seconded by Councilman Vandernoot,
it was unanimously
RESOLVED, that pursuant to Section 432 of the Zoning
Ordinance, the aforesaid application is hereby
referred to the Town of Mamaroneck Planning Board for
report to this Board prior to fixing the date for a
- public hearing thereon.
2. Authorization to Advertise for Bids:
a) Highway Improvements - Old White Plains Road
Pursuant to a ,memorandum addressed to the Board
by the Engineer under date of July 2nd, 1970, herewith presented
and ordered received and filed for the record, on motion by
Councilman Faiola, seconded by Councilman Vandernoot, it was

Daily Times", a Notice for Bids, to be returnable
August 5th, 1970, and opened and read aloud at a
regular meeting of this Board at 8:15 p.m. on that
date, for Highway Improvements along Old White Plains
Road in accordance with the specifications set forth
in the Notice, provided that the said specifications
have been approved by the Town Attorney prior to the
publication of the aforesaid Notice for Bids.
b) Grading Hommocks
Pursuant to a memorandum addressed to the Board
by the Engineer under date of July 8th, 1970, herewith presented
and ordered received and filed for the record, on motion by
Councilman Nagel, seconded by Councilman Faiola, it was unani-
mously
RESOLVED, that in accordance with law, the Town Clerk
be and he hereby is authorized to publish in the
official newspaper of the Town of Mamaroneck, "The
Daily Times", a Notice for Bids, to be returnable
August 5th, 1970, and opened and read aloud at a
regular meeting of this Board at 8:15 p.m. on that
date, for Grading of the Hommocks Area, in accord-
ance with the specifications set forth in the Notice,
provided that the said specifications have been
approved by the Town Attorney prior to the publi-
cation of the aforesaid Notice for Bids.
c) Street Lights
Pursuant to a memorandum addressed to the Board
by the Engineer under date of July 8th, 1970, herewith
presented and ordered received and filed for the record, on
motion by Councilman Bloom, seconded by Councilman Vandernoot,
it was unanimously
RESOLVED, that in accordance with law, the Town Clerk

Daily Times", a Notice for Bids, to be returnable
August 5th, 1970, and opened and read aloud at a
regular meeting of this Board at 8:15 p.m, on that
date, for street lighting equipment, in accordance
with the specifications set forth in the Notice,
provided that the said specifications have been
approved by the Town Attorney prior to the publi-
cation of the aforesaid Notice for Bids.
The Supervisor reported the credit on billing for the past
15 months as $843.93, which savings in addition to those to
be realized could be used to purchase additional fixtures
thus speeding up the Town's Lighting Program to at least
some extent.
d) Fuel Oil and Service - Oil Burners
The Supervisor observed that taking bids in this
instance was a departure from preceding practice inasmuch as
it was felt that while the State price was low for furnishing
oil, the service available for burners, etc. , left much to be
desired. She further pointed out that this had been discussed
with the Villages, both of which had already taken bids for
fuel oil and service and awarded local contracts.
Whereupon on motion by Councilman Vandernoot, seconded by
Councilman Nagel, it was unanimously
RESOLVED, that in accordance with law, the Town Clerk

official newspaper of the Town of Mamaroneck, "The
Daily Times", a Notice for Bids, to be returnable
August 5th, 1970, and opened and read aloud at a
regular meeting of this Board at 8:15 p.m. on that
date, for Fuel Oil and Servicing Oil Burners, in
accordance with the specifications set forth in the
Notice, provided that the said specifications have been
approved by the Town Attorney prior to the publication
of the aforesaid Notice for Bids.
3. Report - Traffic Signal Maintenance Contract
Following a brief summarization of the report addressed to the
Supervisor by the Engineer under date of June 25th, 1970 and
herewith ordered received and filed for the record, in accord-
ance with the recommendations of the Engineer and Police Chief,
on motion by Councilman Faiola, seconded by Councilman Vander-
noot, it was unanimously
RESOLVED, that the Traffic Signal Maintenance Contract

a) Chief O'Brien - Annual Chief of Police Conference
Pursuant to memorandum of the Police Commission,
dated June 15th, 1970, herewith presented and ordered received
and filed, on motion by Councilman Vandernoot, seconded by

RESOLVED, that this Board hereby authorizes Chief
O'Brien to attend the Annual Conference of the New
York State Chiefs of Police to be held in Albany,
New York from July 26th through July 30th, 1970,
with expenses not to exceed the sum of $250. to be
paid by the Town, and Car #5 to be used for trans-
portation.
b) Detective Mahoney - Training Program,
Division of Youth

c) Chief O'Brien and Sergeant Barasch -
School of Instruction
Pursuant to memorandum of the Police Commission under
date of June 15th, 1970, herewith presented and ordered received
and filed, on motion by Councilman Vandernoot, seconded by Council-
man Bloom, it was unanimously
RESOLVED, that this Board hereby authorizes Chief
James O'Brien and Sergeant Robert Barasch to
attend the school of instruction on the use of
gas, to be held at the Holiday Inn, Indiana,
Pennsylvania from June 21st through June 24th,
1970, with expenses not to exceed the sum of $150.
per man to be paid by the Town, and Car #5 to be
used for transportation.
Mr. George E. Mills, Jr. - 692 Fenimore Road, Town
Mr. Mills, upon recognition by the Chair, stated that since
the Police Department business was before the Board at this
time, he would like to inquire about the Police Survey and
Traffic Study, calling to attention the fact that the Police
Survey was entitled "Mamaroneck Police Department" rather
--- than "Town of Mamaroneck Police Department" and stated
further that something must be done about traffic on Palmer
Avenue and Myrtle Boulevard, adding that he had addressed the
Commission several times but received no answer.
The Supervisor advised Mr. Mills that under her report later

this evening she would have something to say about the Weaver
Street and Palmer Avenue intersection which it was hoped would
provide some relief to present traffic conditions.
6. Report - Summer Recreation Programs
The Supervisor explained that this item would have to be held
until Mr. Kronenberger, who was issuing permits at the pool,
arrived to present an oral report.
7. Retirement - Giovanni Molle
The Clerk presented a memorandum addressed to the Board by
the Comptroller under date of June 2nd, 1970, informing the
Board of the retirement of Giovanni Molls who had been a
member of the Town Sanitation Department for almost ten years.
The Board expressed its regret at Mr. Molle's retirement and
thereupon on motion unanimously made and seconded, adopted the
following resolution to be spread upon the minutes of this
meeting in appreciation of his service:
WHEREAS, Giovanni Molle, member of the Town of
Mamaroneck Sanitation Staff for the past ten
years, retired as of May 22nd, 1970,
and
WHEREAS, during the years of his service, he was a
loyal and faithful employee discharging his duties
with diligence and competence,
NOW, THEREFORE, BE IT
- RESOLVED, that this Board, the Town Board of the
Town of Mamaroneck, hereby adopts this resolution
to be spread upon the minutes of this meeting in
appreciation of Mr. Molle's services to the Town,
and be it further
RESOLVED, that a copy be forwarded to Mr. Molle
with the Board's appreciation and thanks for
his fine service and very best wishes for the
future.
COMMUNICATIONS
1. General Code Publishers Corporation
The Clerk presented a communication addressed to the Board by General
Code Publishers Corporation under date of June 26th, 1970 offering
to the Town 10 surplus Codes at the nominal bargain price of $30.00
each.
For the Board's information he reported that 35 Codes had been
purchased originally, of which there now remained only 10 and
therefore recommended that the Town avail itself of this offer.
The Comptroller called to the Board's attention that the purchase
would necessitate authorization of a transfer of funds since no
appropriation had been provided in the 1970 budget, and thereupon

on motion of Councilman Faiola, seconded by Councilman Vandernoot,
it was unanimously
RESOLVED, that this Board hereby authorizes the
purchase of 10 Codes at $30. each, and transfer
of funds in the amount of $300-. from Part-town
Surplus to Miscellaneous Item #512 to cover the
cost thereof.
- 2. Letter from Village Attorney Re: Larchmont Reservoir
The Clerk presented a letter addressed to the Board by George
P. Forbes, Jr. , Larchmont Village Attorney, under date of
June 24th, 1970, requesting that that part of the Reservoir
of the Village and its appurtenances, which is located within
the Town of Mamaroneck, be wholly exempted from taxation by
the Town.
The Supervisor advised that this request had been addressed
to the Board in previous years but denied although such
exemptions were permissive under special legislation passed
in 1969.
Councilman Faiola stated that he would like to see the request
denied since he felt that, if it were granted, the Town in
essence would be underwriting the Village of Larchmont Water
Company. He further stated that what he would like to see
come about would be the reaching of an agreement with the
Mayor of the Village of Larchmont for a combined operation
and the utilization of the Reservoir property for recreation
in the not too far distant future.
Councilman Nagel then recommended that no action be taken at
this time pending further study.
Councilman Bloom stated that he agreed with Councilman Faiola's
hope for a joint operation and in view of this, the matter was
tabled for further study.
THE SUPERVISOR
The Supervisor interrupted the order of business to recognize
Mr. Kronenberger, the Recreation Superintendent, who presented
his interim report on the Summer Recreation programs, stating
the attendance at all programs and particularly pointing out
that the two pre-school play-school groups had been oversubscribed
well before the opening date. He also reported on the progress
being made on the tennis court improvements adding that here too
he anticipated a heavy enrollment for the lessons as well as
for use of the courts.
Councilman Nagel asked whether some thought should not be
given to inaugurating a third pre-school group and in reply, Mr.
Kronenberger said that this was being seriously considered by
the Commission and himself in planning next year's programs. He
pointed out that in this particular program there were certain
State Department of Education laws having to do with the number
of youngsters per instructor and the provision of proper facili-
ties for children of this age group which had to be met.
The Supervisor commended Mr. Kronenberger on behalf of the
Board and added her thanks and appreciation for his coming here

this evening to present his report following the session at
the pool.
The Supervisor then stated that the regular order of business
would now be resumed.
3. Notice of Hearing, Village of Larchmont -
Application for Variance of Sign Ordinance
- The Clerk presented the aforesaid Notice which had been referred
to the Attorney and which upon his report of requiring no action
by the Town, was ordered received and filed.
4. P.S.C. - New Rochelle Water Company -
Petition for Higher Rates
The Town Attorney, to whom this Notice had been referred, reported
that as yet no date had been set for the public hearing on the
petition. The Supervisor advised the Board that there were some
26 residents of the Town served by the New Rochelle Water Company
and therefore inquired as to the Board's pleasure in having the
Attorney attend this hearing on behalf of the Town, which was
so directed.
5. Notice of Meeting -
Zoning Board, Village of Larchmont
Upon the Attorney's report that the aforesaid application was
of no concern to the Town, the Notice was hereto ordered re-
ceived and filed.
6. Acknowledgement - Mr. Faiola
For the Board's information, the Clerk presented an acknowledge-
ment of the Town's sympathy from Councilman and Mrs. Faiola
which was ordered received and filed.
7. Acknowledgement - Mrs. Sansone
Also presented and ordered received and filed was an acknowledge-
ment from Mrs. A. Sansone for the In-Memoriam Resolution adopted
by this Board on June 3rd and forwarded to Mrs. Sansone.

The Supervisor --
1. Report - County Tax Apportionments
The Supervisor reported to the Board receipt of the County
Tax Apportionment for 1970.
The Supervisor also reported that in 1970 the Town's proportion
of the County taxes would be less than in 1969 due to the
State Board of Equalization and Assessment's Special Franchise
Assessment which had increased by $98,066.
The Supervisor then also advised the Board that notice had
been received that the railroad property could be placed on the
roll at $180,096. rather than at the former zero ceiling -- but
she assumed in view of the Penn-Central's bankruptcy proceedings,
that the assessment would now go back to the former zero ceiling.
2, Letter - State Department of Transportation
re: Weaver and Palmer Intersection
The Supervisor reported receipt of a letter addressed to her by
Mr. J.D. Manning of the State Department of Transportation under
date of July 2nd advising that the Department would grant a
permit to the Town for the proposed removal of the island and
channelization of traffic at the intersection of Palmer Avenue
and Weaver Street and that an additional permit would be granted
to allow the Town to use the land gained thereby.
Not on Agenda
1. Regional Meeting - Office for Local Government
The Supervisor extended an invitation to the members of the Board
to attend the 1970 Regional Meeting to be held at the Holiday Inn
in Fishkill, New York, on July 24th and also requested authorization
of expenses for those of the Town staff who would attend.
Whereupon, on motion by Councilman Faiola, seconded by Councilman
Bloom, it was unanimously
RESOLVED, that this Board hereby authorizes the attendance
of not more than 15 members of the Town staff of the 1970
Regional Meeting of the New York State Office for Local
Government in Fishkill, New York, on July 24th with expenses
to be paid by the Town in an amount not to exceed the sum
of $10.00 per person.
2. Rent Decontrol
The Supervisor spoke briefly of the action taken by the Village of
Larchmont Board of Trustees in the matter of rent decontrol and

stated that she believed this Board felt that it would be desirable
to have a study made to see if the plan proposed by Larchmont might
be feasible for the Town. Accordingly she said, she had requested
Councilman Vandernoot to chair such a study and was delighted to
report that he had very kindly agreed to do.

Mr. Faiola --
1. Letter of George P. Forbes, attorney for Mrs. Widmark,
re: use of property at rear of Firehouse
Councilman Faiola reported that pursuant to the Board's direction,
Mr. Forbes' letter had been referred to the Fire Council, which
had taken no action thereon referring it back to this Board.
He then stated that he would recommend that hours for the use of
the subject property be established and posted in order to avoid
undue disturbance to neighboring property owners. He also said
that he had noted that Mr. Forbes' letter had requested that
there be no use whatsoever of the property on Sundays, but in
view of the church and resultant increased volumne of traffic on
Weaver Street that he felt this request was unreasonable.
Upon recognition by the Chair, the following persons addressed
the Board on this matter, all speaking very strongly in favor of
the continued useiof this property as a place for small neigh-
borhood children to play, emphasizing hazards and danger to the
children if they had to play in the street.

Also addressing the Board was a Mr. Arthur R. Guadio of 57 Hillcrest
Avenue, who stated that time limits were not the answer inasmuch as
they would in no way eliminate the excessive noise.
Councilman Bloom stated he was indeed well aware of what the persons
who had spoken this evening had said and of how they felt about the
children's playing on this property, but he said he was also aware
that not all people had the same kind of temperment and that inasmuch
as all must be considered, he wondered whether it would not be possible
for the parents to work out some sort of a solution with their own
children that would be acceptable to all of the concerned parties?
Councilman Faiola then suggested that hours of 8 A.M. to sundown be
established -- whereupon the Supervisor, in line with Councilman
Bloom's suggestion, asked whether the group could not designate one
person to visit Mrs. Widmark and talk to her personally in an effort
to reach a mutually satisfactory solution?
Mr. Brenner stated that he would be glad to undertake this on behalf
of the group and to report subsequently to the Board.
The Supervisor thanked Mr. Brenner and all who had come to the meeting
for giving the Board the benefit of their views and suggestions.
Mr. Brenner then requested on behalf of the group, that the record
show its appreciation of the Firemen who had always been such good
neighbors and its great regret of Mr. Muller's retirement which
accordingly was so directed.

Mr. Vandernoot --
1. Report - Conference on Drug Abuse
Councilman Vandernoot reported that the Supervisor and he had
attended the all-day Conference on Drug Abuse at Iona on the
27th of June. He stated that it had been most informative
and instructive and spoke particularly of the sessions held
on the use of instructional programs at early grade levels,
slides showing the results of drug use, and the "Renaisance
Program" devoted to the use of methadone in treatment clinics
for heroin addicts.
He also commented briefly on Chief O'Brien's remarks on law
enforcement and on the fine work being done with young per-
sons by the recently established Narcotics Guidance Council.
2. Report - Plattsburg Conference on Drugs
Councilman Vandernoot called attention to the coming con-
ference on drugs to be held in Plattsburg during the week of
August 9th and to be attended by Detective Mahoney for the
Town, Principal Joseph Downey for the Board of Education,
and a representative from the Narcotics Guidance Council.

1. Progress Report - Joint
Municipal Survey
Councilman Nagel reported very briefly on the status of the
Joint Municipal Survey, remarking that excellent progress
had been made to date and that the Committee and Consultants
would meet on the 23rd, after which he would have a much
more detailed report.

1. Report on Symposia
Councilman Bloom reported on the follow-up meeting on the
four environmental symposia, stating that all had been very
greatly pleased with the results and that it had been re-
solved to have a permanent organization.

Pursuant to the Attorney's request for authorization to
settle the foregoing pending certiorari proceeding for
$42,900. as agreed to by the Assessor, the Board of Review,
and John L. Delius, Attorney, on motion by Councilman Nagel,
seconded by Councilman Vandernoot, the following resolution
was adopted by unanimous vote of the Board, all members be-
ing present and voting "aye":

provided the certiorari proceedings now pend-
ing in the name of Burton Bernard and Norma
Bernard for the years 1966 for the taxes of
1967, 1968 for the taxes of 1969, and 1969
for the taxes of 1970 be discontinued without
costs as against either party;
and it is further
RESOLVED, that all refunds of taxes due by
reason of such reductions be paid without
interest;
and it is further
RESOLVED, that the Town Attorney is hereby
authorized and directed to sign the neces-
sary stipulations to obtain an order of the
Supreme Court providing for such reductions.
2. Penn-Central Application
Fare Increases
The Town Attorney reported that the application of the Penn-
Central Railroad for commuter fare increases, to be effective

as of September 1st, due to operating loss of $117,000. per month and
resultant immediate need for cash to meet payrolls in order to keep the
trains running, was presently under study by the Acting County Attorney,
John J. S. Mead, and the Transportation Action Committee.
Following discussion, the Board unanimously agreed that the Town would
once again do all in its power to oppose the proposed fare restructuring
and to improve service to the commuters and hoped to be able to coordinate
its efforts with those of both the County and the TAC.
3. Authorization - Payment Property
Damage Claim $50.00 Deductible
Pursuant to the Attorney's recommendation for payment of $50.00 deductible
claim to Knox, Lent & Tucker, Inc. , as herewith submitted, on motion by
Councilman Vandernoot, seconded by Councilman Faiola, it was unanimously
RESOLVED, that this Board hereby authorizes payment of claim
of Knox, Lent & Tucker, Inc. , in connection with settlement
of claim of Pablo Correa under Town Policy #RLU467166 with
Royal Indemnity Co. , containing a $50.00 deductible property
damage clause.
4. Report - Sign Violations, Metropolis
Westchester Lanes, Inc.
The Attorney reported that the non-conforming signs were now down at
Metropolis Westchester Lanes, Inc. , and that the entire Town was in
conformance with the Sign Ordinance.
ADJOURNMENT
There being no further business to come before the meeting, on motion duly
made and seconded, it was declared adjourned at 10:20 p.m. , to reconvene

The meeting of the Board of Fire Commissioners was convened immediately
upon adjournment of the Town Board meeting.

Commissioner Faiola presented for approval and authorization of payment
the Fire Department claims, and thereupon on his motion, which was
seconded by Commissioner Vandernoot, it was unanimously
RESOLVED, that the following Fire Department claims as
audited by the Comptroller and approved by the Fire Chief
are hereby approved, and the Supervisor and Comptroller
hereby authorized to pay the same out of the Fire Department
budget for 1970:

— Comptroller under date of June 2, 1970, herewith ordered received
and filed, on a motion offered by Commissioner Faiola and unani-
mously seconded, the following resolution was unanimously adopted:
Whereas, Edward J. Muller, Town of Mamarnneck
Fire Lieutenant for the past twenty-
four' years, has retired as of this
date,

Whereas, during the many years of his service,
he was a loyal and faithful employee
untiring in the performance of his
duties which were discharged with
diligence and competence,
