MAMARONECK, HELD MARCH 21st, 1973, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

APPROVAL OF MINUTES
The minutes of the regular meeting of March 7th, 1973 were
presented and on motion duly made and seconded, approved as
submitted.
OLD BUSINESS
1. Recommendation of the Attorney
re Lenox Construction Company
The Supervisor presented a letter addressed to her by the
Attorney under date of March 9th, 1973, recommending settle-
ment of the Supreme Court litigation of Lenox Construction
Corporation against the Town of Mamaroneck, which was herewith
ordered received and filed for the record.
Mrs. Helwig reported that the suit was originated by Lenox
Construction Corporation as a result of a disagreement with
the Town over costs of sewer installations on Griffen Avenue.
She explained that the sewer construction was found to be un-
satisfactory upon completion and additional work had to be
done in order that the job could be accepted by the Town and
the County of Westchester. At that time the Town withheld
payment of the sum of $3,500, to Lenox Construction Corpora-
tion until the work was completed satisfactorily. The construc-
tion company claimed an additional $27,365. above the contracted
- price because of the additional work performed but the Town
contended it had no obligation for costs incurred in correcting
the installation.
The Attorney, Mrs. Helwig stated, recommended the settlement
of $5,000, to be favorable to the Town and requested the Town
Board to adopt a resolution authorizing him to dispose of the

litigation.
At this time, she asked the Board's pleasure in this matter
and thereupon, on motion by Councilman Faiola, seconded by Coun-
cilman Vandernoot, it was unanimously
RESOLVED, that the Town Attorney be and he
hereby is authorized to dispose of the
Supreme Court litigation of Lenox Construc-
tion Corporation against the Town of Mamaro-
neck for the sum of $5,000. , with the parties
exchanging general releases.
2. Notice of Public Hearing
re Nonpayment of Taxes by Railroad
The Supervisor presented a Notice of Hearing from Hon. Charles
D. Henderson, Chairman of the Assembly Standing Committee on
Local Governments, advising that a public hearing to consider
legislation to aid municipalities suffering real property
tax revenue losses due to nonpayment of taxes by railroads in
bankruptcy or reorganization will be held at 9:00 a.m. on
March 26th, 1973 in the Assembly Parlor, Room 306, The Capitol
Building, Albany, New York, which was herewith ordered received
and filed.
Mrs. Helwig reported that the Assessor had prepared information
regarding this showing that were railroad properties taxed at
normal levels, the two Villages, the Unincorporated Area--:and
the School District would receive $152,534.36 in revenues from
them. As the present state aid amounts to only $25,984.90,
this is a loss of $127,549.46 or 83%.
She further stated that Mr. Doyle is preparing to send a
communication, to be made a part of the record of the hearing,
to the Chairman of the Assembly Standing Committee on Local
Governments urging that Committee to take the necessary steps
to help alleviate the present railroad losses being suffered
and endorsing the proposal to increase state aid presently
provided.
NEW BUSINESS
1. Report - Narcotics Guidance Council
Robert Whitfield
The Supervisor, at this time introduced Mr. Robert Whitfield,
Coordinator of the Narcotics Guidance Council, appearing on
behalf of Dr. Fred Feuerbach, Chairman, who outlined the
various prevention, treatment and counselling programs conducted
by the Council. He also spoke of its goals and the services
to the Community, citing the Hot Line as the greatest in the
County.
Mr. Whitfield reported that the Council's activities range
from crisis intervention in cases of very serious drug involve-
ment to "a hand holding process" in following up on drug prob-
lems. In an effort to bring drug counselling services to the
youth of the whole community, the Narcotics Guidance Council
is reaching into the schools by lecturing in class and getting

kids to talk about problems they usually would not discuss in
class, he said.
He further explained that a parents group was started about
two months ago to meet every Tuesday from 8 to 9:30 p.m.
to help each other with problems concerning their child's
involvement with drugs. Parents have the opportunity to talk
openly and freely and professional consultation is available.
In answer to a question of would you like more volunteers, Mr.
Whitfield said that more volunteers who can give three to six
hours a month are needed to man the Hot Line phones. He stated
that in two weeks a new training cycle would begin and residents
are welcome to join.
Mr. Whitfield spoke also of the Community Counselling Center at
234 Stanley Avenue and the Storefront at 639 Mamaroneck Avenue
which offer . individual, group and family counselling, rap
sessions, vocational training, etc.
In concluding his report, Mr. Whitfield said that the Narcotics
Guidance Council had received excellent cooperation from the
Daily Times in informing the community about its activities.
Mrs. Helwig thanked Mr. Whitfield for coming this evening and
Councilman Vandernoot remarking that the Narcotics Guidance
had long needed a good Coordinator said, "We expect great
things from Bob".
2. Request to Advertise for
Informal Bids - Two-way Radio,
Town Engineer's ear
The request of the Engineer addressed to the Board under date
of March 20th, 1973 regarding a two-way radio for his car was
herewith presented and ordered received and filed with the
Board confirming with the Engineer that a report on the informal
bids to be opened on April 16th would be submitted at the reg-
ular meeting on April 18th, 1973.
3. Authorization to Advertise for
Street Lighting Equipment
Pursuant to memorandum addressed to the Board by the Town
Engineer under date of March 20th, 1973 herewith presented
and ordered received and filed, on motion by Councilman
White, seconded by Councilman Vandernoot, it was unanimously
RESOLVED, that in accordance with law, the Town
Clerk be and he hereby is authorized to publish
in the official newspaper of the Town of Mamaro-
neck, "The Daily Times", a Notice for Bids, to be
returnable April 18th, 1973, and opened and read
aloud at a regular meeting of this Board at 8:15 p.m.
on that date for street lighting equipment, in accord-
- ande with the specifications set forth in the Notice,
provided that the said specifications have been approved
by the Town Attorney prior to the publication of the
aforesaid Notice for Bids.
COMMUNICATIONS
1. Acknowledgement

The Clerk read for the record an acknowledgement of the

In-Memoriam resolution to former President Lyndon B. Johnson
adopted by the Board on behalf of the Town of Mamaroneck, which
was thereupon ordered received and filed.
2. Acknowledgement
Assemblyman George J. Farrell
Assembly Bill 3332
The Clerk presented a communication addressed to him by Assembly-
- man George J. Farrell, Jr. under date of March 7th, 1973 which
read as follows :
"This will acknowledge with my appreciation your
letter of February 26 concerning Assembly Bill 3332.
Your expression will become a part of the file for
that bill and taken into consideration when this
matter is considered by the committee as a whole."
3. Report of the Annual Meeting
of the Association of Towns
The Clerk presented for the record the report add -the business
session resolutions of the Annual Meeting of the Association
of Towns of the State of New York which were herewith ordered
received and filed.
4. Notice - P.S.C. Notice of Con Edison -
Rules and Regulations for Electric Service
The Clerk reported receipt of a Public Servic Commission
Notice re Rules and Regulations of Con Edison for electric
services which was referred to the Town Attorney for report
back to this Board.
REPORTS

The Clerk presented the following reports which were ordered
received and filed:

February 1973.
The Supervisor --
1. New England Thruway Accident
(Not on Agenda)
At this time Mrs. Helwig commented on the fine work of the
policemen and firemen and praised them for their handling of
the accident on the New England Thruway Saturday morning in
which a tanker truck pinned the driver of a compact car inside
his vehicle for more than an hour. She further stated that
Chief Barasch told her that praise was due the entire tour of
duty at the time of the accident.

Councilman Faiola presented at this time a letter from Fire
Chief Joseph Santoro which read as follows :
"On the morning of March 17th we had a call from
the Town Police reporting a three (3) vehicle
accident on the New York Thruway and a motorist
trapped in his car. Upon arrival Chief Santoro
after viewing the accident and finding the condition
of the car, called for two tow trucks, one from
Excelsior Auto Repairs and one from the Atlantic
Service.
Mr. Emile A. Corriveau of 10 Providence Avenue,
East Providence, Rhode Island, a motorist who
had experienced an incident of this kind, and
a former truck driver was of great help to the
Fire Department in assisting us to extract
the trapped motorist with great patience and
fortitude. Mr. George Lardaro of 230 Pelham
Road, New Rochelle, who was taken to the New
Rochelle Hospital who suffered from multiple
fractures, but is now convalescing.
Thirty-nine volunteers responded to the call
and they did a tremendous job, for which they are
entitled to a JOB "WELL-DONE"."
Mr. Faiola requested that a letter of thanks be sent by
the Board to Emile A. Corriveau for the help this motorist
gave to police and firemen in extricating the trapped
driver which, accordingly, was so directed.

1. Apportionment
Upon presentation of the following apportionment, on motion
by Councilman Vandernoot, seconded by Councilman White, the
following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petition for
the correction of the assessment roll for certain
years pursuant to the provisions of Section 557,
Article 16 of the Westchester County Tax Law;
and
WHEREAS, after due consideration this Board finds
it desirable to grant said petition for the cor-
rection of said assessment roll;
NOW, THEREFORE, BE IT
RESOLVED, that the assessment roll of 1972-1973,
- taxes of 1973, which shows property now appear-
ing on the rolls as follows:

ADJOURNMENT
The Supervisor spoke with sorrow of the passing of George P.
Forbes and thereupon the following resolution was adopted by
acclamation to be spread upon the minutes of this meeting
and forwarded to the members of his family with deep sympathy
and condolences at this time of their great loss :
In Memoriam
WHEREAS, the death of George P. Forbes on March 20th,
1973 has taken from us a man whose life was dedicated
to the welfare and betterment of the Town of Mamaro-
neck;
and
WHEREAS, he served not only as an officer of the Town,
of the Village of Larchmont, of the School District
and of the Federal Government, but was a leading spirit
in establishing many civic organizations;
and
WHEREAS, as founder and publisher of The Daily Times
of Mamaroneck he created a newspaper which has rendered
unique and significant service over many years to the
people of the community;
NOW, THEREFORE, BE IT
RESOLVED, that this Board joins with all the resi-
dents of this community in mourning the loss of
GEORGE P. FORBES
and be it further
RESOLVED, that this resolution be spread upon the
minutes of this meeting which stands adjourned this
evening in honor of and in respect to his memory.
And thereupon since there was no further business to come
before the meeting, on motion duly made and seconded, it was
declared adjourned at 8:55 p.m. , to reconvene on April 4th,
1973.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.

Upon presentation for authorization of payment by Commissioner
Faiola and on his motion, seconded by Commissioner Vandernoot,
it was unanimously

2. Communications
a) Letter from Chief Santoro
This letter was previously discussed under Supervisor.
Commissioner Faiola at this time reported that the Fire
Department was planning tests in the Griffen Avenue area and
along Old White Plains Road and urged residents of this area
not to be alarmed by the fire trucks "screaming" through
their streets.
First Deputy Fire Chief Vincent Ciardullo, upon recognition,
expressed the Fire Department's appreciation for Mr. Emile
Corriveau's assistance at the time of the accident on the
Thruway and urged the Board to issue a proclamation of thanks
to him, which the Board agreed to do if Mr. Ciardullo would
provide the details.
Mr. Cardullo also stated he had gone to the hospital twice
to see the accident victim, George Lardaro of New Rochelle,
and Commissioner Bloom said that this demonstrated the
generous attitude of all the Town's Volunteer Firemen.
3. Adjournment
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at
8 :55 p.m. , to reconvene on April 4th, 1973.
