CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Helwig Councilman Faiola Councilman Vandernoot Councilman Bloom Councilman White Absent: None Also Present: Mr. Gronberg - Town Clerk Mrs. Brewer - Deputy Clerk Mr. Aitchison - Highway Superintendent Mr. Elfreich - Town Engineer APPROVAL OF MINUTES The minutes of the regular meetings of February 7th and 21st, 1973 were presented and on motion duly made and seconded, approved as submitted. PUBLIC HEARING - Application of Winged Foot Golf Club for Special Permit - Extension of Kitchen Facilities '.. The Clerk presented the Affidavit of Publication for the record and presented the report of the Planning Board under date of February 21st, 1973 recommending approval of this request which was herewith ordered received and filed. On motion by Councilman Faiola, seconded by Councilman White, it was unanimously RESOLVED, that the public hearing be and it hereby is declared open. The Supervisor then inquired of the Board whether there were any questions and since there were none, stated first those in favor of the application, then those opposed would be heard. In Favor: __. Mr. James Nolletti, Applicant Mr. Nolletti, spoke briefly to his application, concluding his remarks by stating he would be glad to answer any questions. - 1 - In Opposition: No one. Whereupon on motion by Councilman Faiola, seconded by Council- man White, it was unanimously RESOLVED, that the public hearing be and it hereby is declared closed. And thereupon in reply to the Chair's query of the Board's pleasure, on motion by Councilman Vandernoot, seconded by Councilman Bloom, the following resolution was adopted unani- mously WHEREAS, the Winged Foot Golf Club has submitted an application for a Special Permit to allow .the construction of a 15' x 30' addition to the Winged Foot Clubhouse kitchen in a Residential District (R-30 Zone) as shown on the plans and specifications filed with the appli- cation, on premises located on Fenimore Road and known as Block 347, Parcel 1 on the Tax Assessment Map of the Town of Mamaroneck; and WHEREAS, said application was referred to the Town Board by the Building Inspector on the grounds that the plans were subject to a special permit to be granted pursuant to Section 449, as amended, of the Zoning Ordinance insofar as the proposed installa- tion is an extension or addition to a non-conforming use; and - WHEREAS, the applicant has applied to this Board for a special permit as provided in Section 449, as amended, of the Zoning Ordinance, and which application this Board has referred to the Planning Board for re- port, which as received, recommends that the applica- tion be granted; and WHEREAS, a public hearing was duly held before this Board at this meeting with Notice thereof duly pub- lished as required by law pursuant to Section 449, as amended, of the Zoning Ordinance and all present were heard on the application; NOW, THEREFORE, BE IT RESOLVED, that the application of Winged Foot Golf Club is hereby granted and the Building Inspector authorized to issue a special permit for the construction of a 15' x 30' addition to the Winged Foot Clubhouse kitchen, said addition to be constructed in accordance with the plans filed with the application therefor and herewith filed as part of the record of this meeting. The Clerk was directed to forward certified copies of the fore- going resolution to the applicant and Building Inspector upon approval of the minutes of this meeting. 2 _ '`��� OLD BUSINESS 1. Report on Informal Bids Street Lighting, Hommocks Road A report addressed to the Board by the Town Engineer under date of March 7th, 1973 reporting on the opening of the in- formal bids and recommending acceptance of the low bid was herewith presented and ordered received and filed for the record. And thereupon, in response to the Supervisor's query as to the Board's pleasure, the following resolution was adopted unani- mously on a motion offered by Councilman Faiola and seconded by Councilman Bloom: RESOLVED, that this Board hereby accepts the bid of the low bidder, to-wit that of Mains and Mains, in the sum of $1,975. for street lighting in that portion of Hommocks Road specified in the detailed drawings and specifications prepared by the Town Engineer and submitted with the request for in- formal bid proposals. 2. Notice of Acceptance for Training Courses At the Supervisor's request, Councilman Vandernoot explained that applications for the Comptroller and himself to partici- pate in a joint course for "Personal Management Skills in a Labor Contract Environment" being offered by the New York State Department of Civil Service at the Holiday Inn in Elms- ford on March 12th, 19th, 26th and April 2nd, and 9th, had been made by the Town Board and notice of their acceptance received. He further stated that since the Comptroller would be away on a short vacation on March 12th, the Supervisor would attend that day's session with him. The Supervisor explained that while the course was free, it was an all-day session and that no meal allowance was made, adding that she felt lunch should certainly be provided at no expense for those attending this course. Whereupon on motion by Councilman Faiola, seconded by Council- man Bloom, it was unanimously RESOLVED, that this Board hereby authorizes an allowance not to exceed the sum of $100. to cover luncheon expenses for Councilman Vandernoot and the Comptroller while attend- ing the five sessions of this Personal Management Course. NEW BUSINESS 1. Authorization - Collection of State, County, Town and Special District Taxes Pursuant to the Tax Receiver's request for authorization to collect the 1973 State, County, Town and Special District taxes and publish and post the necessary Notice therefor, on motion by Councilman Bloom, seconded by Councilman White, it was unani- mously 3 - RESOLVED, that this Board hereby authorizes the Receiver of Taxes of the Town of Mamaroneck to collect the 1973 State, County, Town and Special District taxes and the water rents which become a lien on January 1st, 1973; and be it further RESOLVED, that in accordance with the provisions of Section 550 of the Westchester County Admini- strative Code, "The Daily Times", the official newspaper published in the Village and the Town of Mamaroneck, be and it hereby is designated as the newspaper in which the Receiver of Taxes and Assessments shall publish the "Notice of the Col- lection of State, County, Town and Special District taxes and water rents"; and be it further RESOLVED, that in accordance with the provisions of Section 550 of the Westchester County Administrative Code, the Town Board does hereby direct the Receiver of Taxes and Assessments to mail to each taxpayer of the Town of Mamaroneck, whose address is known to said Receiver of Taxes and Assessments, a tax bill for all taxes and water rents, the expense thereof to be a Town charge. 2. Authorization - Grant to Larchmont-Mamaroneck Family and Youth Committee At the Supervisor's request Councilman Vandernoot reviewed a request addressed to the Supervisor by Mrs. Elaine Samuels, Chairman of the Larchmont-Mamaroneck Committee on Family and Youth under date of last October 31st, which was herewith ordered received and filed for the record. He then explained that the Board had discussed this request for $500. for a new project and had agreed to appropriate these funds from the Special Fund established by a gift from the Teen Canteen Com- mittee and available for "establishing new programs to benefit young people of high school age", thereby recommending that the request be granted. Councilman Faiola asked whether the money in this Special Fund was not earmarked solely for equipment, raising the point since in this new program said funds would be used for salaries? In reply, the Supervisor and Councilman Vandernoot both explained that when this Special Fund had been established it had been definitely earmarked for "funding new programs". Whereupon on motion by Councilman Vandernoot, seconded by Council- man White, it was unanimously RESOLVED, that this Board hereby approves the request of the Larchmont-Mamaroneck Committee on Family and Youth for a grant in the amount of $500. for the establishment of a new program at the Youth Center (The Alley Inn) in the Parish House of St. Thomas 's Church in Mamaroneck; and be it further 4 - RESOLVED, that the Comptroller be and he hereby is authorized to make the necessary transfer of funds therefor. Councilman Vandernoot at this time noted that at the last meeting of the Family and Youth Council a request had been made for gifts of any furniture, particularly any kind of chairs for the Teen Canteen's use at the Parish House. The - Supervisor suggested that perhaps some attic searching would produce some items that would answer this request. 3. Resolution Designating Youth Council Pursuant to communication addressed to the Board by Oscar Birch, Projects Coordinator of the Larchmont-Mamaroneck Com- mittee on Family and Youth under date of March 2nd, 1973 re- questing renewal of the resolution which was herewith ordered received and filed, on motion by Councilman Vandernoot, seconded by Councilman Faiola, the following resolution was unanimously adopted: RESOLVED, that the Town of Mamaroneck does hereby establish a Youth Service Project as authorized by Chapter 636 of the Laws of 1956, as amended, Article 19-A of the Executive Law; and That said Youth Council shall have the power and it shall be its duty to: 1. Coordinate, cooperate and contact existing services or agencies working with and con cerned with youth and their problems, in- cluding, but not limited to schools, churches, employers, service clubs and organizations, welfare departments, police, municipal boards, courts and similar organizations; 2. Assist youth with their problems; 3. Foster educational, vocational or instructional programs in connection with youth; 4. Study and analyze conditions and statistical records and data on youth and their problems and make recommendations related to the same; 5. Do all things necessary and desirable to carry out the powers and duties herein granted, as well as those powers and duties set forth by the New York State Division of Youth; and 6. File an annual report with the Town Board of the Town of Mamaroneck. That the Youth Council is hereby authorized to act for the Town of Mamaroneck and apply to New York State for _ any and all benefits as provided by law; and That the Town Board of the Town of Mamaroneck reserves the right to audit all expenditures upon which claim for reimbursement are to be based; and That the Youth Council may adopt and amend rules and - 5 - regulations for the conduct of its own affairs; and That the term of office of the members of said Youth Council shall be for a period of one (1) year; and That this entire resolution is subject to passage of the same resolution by the Village of Larchmont and the Vil- lage of Mamaroneck. 4. Report on Purchase of Town Road Materials for 1973-74 For informational purposes the report of the Superintendent of Highways on the opening of bids for materials to be used on Town roads for the period of March 4th, 1973 through March 5th, 1974 and award of contract was herewith presented and ordered received and filed. 5. Authorization - Emergency Overtime Compensation a) Police Pursuant to memorandum of the Police Commission under date of February 20th, 1973, herewith presented and ordered received and filed for the record, on motion by Councilman White, seconded by Councilman Bloom, it was unanimously RESOLVED, that as approved by the Board of Police Commissioners, this Board hereby authorizes payment of Emergency Overtime Compensation to the following officers of the Town of Mamaroneck Police Department for the number of hours set forth for each covering the period from January 16th to February 20th, 1973: Name Hours Min. Authorization - Compensation Police In-Service Pursuant to memorandum of the Police Chief under date of Febru- ary 20th, 1973, herewith presented and ordered received and filed, on motion by Councilman Vandernoot, seconded by Council- man Faiola, it was unanimously RESOLVED, that as approved by the Board of Police Commissioners, this Board hereby authorizes over- time payment to the thirteen Police Officers named in the foregoing memorandum for attendance at a training class on February 17th, 1973. 7. Report - New Law Granting Tax Abatement for Property Damage Resulting from Hurricane Agnes At the Supervisor's request the Clerk read into the record the following memorandum addressed to the Supervisor by the Asses- sor under today's date, in connection with passage of Assembly Bill 2239A(Tax Abatement for Damage Resulting from Hurricane Agnes) into Law: "A. Claims for damage to real property caused by Hurricane Agnes must be filed by not later than March 15, 1973. Representatives of the State Board of Equalization and Taxation will make the necessary inspections on each claim and compute the damage, if any, resulting from the storm. B. No later than April 16th, the State Board will send a certified list of properties for which applications for which damage evaluations have been made and the percentage loss, if any, for each parcel as determined by State Board. C. Not later than May 16th, the Assessor shall complete an abatement list setting forth the description, name of owner and percentage loss of each parcel. D. Not later than May 22nd, a public notice to be published at least once in the official newspaper. 7 - Specifying time and place list may be seen until June 1st, also the day the Board of Review shall meet to hear requests for modification of the percentage loss. The Receiver of Taxes shall mail a notice to each property owner included on the list specifying the percentage loss for each parcel. E. The Board of Review shall prepare and verify a statement showing any changes in the percentage loss and deliver such statement to the State Board within 5 days after the hearing. Any changes made by the Board of Review shall not be applicable unless the State Board concurs. F. The tax enforcement officer shall certify to the State Board the amount of refunds of taxes not later than 30 days after the refunds have been made. G. Applications for State and Federal Assistance on behalf of municipal corporations shall be made by the County Treasurer to the State Board for its Review, verification and recommendation for approval. I am aware of the briefness of this memorandum as it pertains to the Act and I suggest that a thorough analysis of its contents be made by our legal department." The Supervisor explained for the information of anyone present concerned in this matter that the forms which had to be filed by March 15th were available in the office of the Westchester County Tax Commission and suggested that anyone so interested call Mr. Douglas Cronk of that Commission for information regarding the filing of these claims. She then complimented the Assessor, Mr. Doyle, for his diligence in obtaining as much information as he had in the very short time elapsing since the Town was notified of the passage of this Law on Monday, March 5th. COMMUNICATIONS 1. Report on Larchmont Acres Bus Service At the Supervisor's request, the Clerk read into the record the following communication addressed by Geraldine Waggoner, Principal Rent Examiner of the Executive Department, Division of Housing and Community Renewal, under date of March lst, 1973 pertaining to the discontinuance of the Larchmont Acres bus service and the reopening of the hearings in connection therewith: "Commissioner Herman has been following the Larchmont Acres bus matter with close and continu- ing interest and wishes you to be advised that a de- cision has been reached. As the Commissioner is out of the Country, on his behalf I forward copies of the decision. The Order and Opinion sets forth the many factors con- sidered in reaching the decision to reduce the rent of the tenants who were using the private bus service on - 8 - p the date of its discontinuance. Many of the tenants whose names appear on page four of the Order are those from the list submitted by you on their behalf. The names on your list which do not appear in the Order are tenancies which are not subject to the State rent control haw. Copies of the Order have been mailed to each tenant affected by the decision. Under separate cover, we are forwarding a small supply of the decision so that you may advise the decontrolled tenants of the effect of the decision. On behalf of the Commissioner, I wish to thank you for your interest and assistance." Mrs. Helwig stated that about 75 names had been submitted in the list referred to in the foregoing communication and that 40 of those were under rent control and eligible for the rent reduction granted. She further expressed appreciation and thanks for the Commission's willingness to reopen the hearings on this matter. 2. Notice of Meeting Larchmont Zoning Board The Clerk presented a notice of a meeting before the Larchmont Village Board of Appeals to be held on Wednesday evening, March 21st, 1973, advising that a copy thereof had been for- warded to the Town Attorney and Chairman of the Planning Board, which was thereupon ordered received and filed. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed: Report of the Receiver of Taxes and Assessments for the month of February 1973. Report of the Building and Plumbing Inspector for the month of February 1973. Report of the Municipal Dog Patrol for the month of February 1973. Report of the Westchester Shore Humane Soci- ety, Inc. for the month of February 1973. The Supervisor -- 1. Fix Date for Tax Lien Sale Purusant to memorandum of the Receiver of Taxes under date of March 1st, 1973, herewith presented and ordered received - 9 and filed for the record, on motion by Councilman Bloom, seconded by Councilman White, it was unanimously RESOLVED, that the Supervisor be and she hereby is authorized to designate Wednesday, May 23rd, 1973 as the date of the annual tax lien sale for the Town of Mamaroneck. In reply to a question raised by Mrs. Theodore Shultz of 25 Alden Road as to the fairness of this practice and whether a list of these liens was published, the Supervisor stated that the Board followed the letter of the law governing tax lien sales meticulously, and that a list of the liens was both published once a week in the Daily Times for three weeks prior to the date of sale and posted in five locations throughout the Town as required by law. Also at this time, Mrs. Snyder asked whether there had been any decision on the Guadagnola hearing? The Supervisor replied that there had not been and that she understood the transcript of the hearing had just been received and was presently under study by the Zoning Board. She also stated that when that Board reached a decision, it would be fully publicized so that all interested parties would have ample notice thereof. 2. Fix Date for Public Hearing re Firemen's Contract At the Supervisor's request, the Clerk read into the record the following letter addressed to her by Kenneth J. Valle, President, Town of Mamaroneck Paid Fireman's Association, under date of March 7th, 1973: "Please be advised that local 898 held a meeting at Fire Headquarters the night of March 6, 1973 and rejected the latest offer of the Town Board. The body feels the offer was well below the recom- mendation of the Fact Finders report. We hereby request the Town Board to set up a public hearing as set forth in 209E of the Taylor Law." Mrs. Helwig said she had discussed this with the Board and it would like to fix a date for this hearing at this time. After some discussion since Councilman Vandernoot would not be present at the April 4th meeting and since there was not sufficient time to publish the required legal notice of hearing before the next meeting on the 21st of March, it was recommended that the second meeting in April, on the 18th, be set for the hearing. Mrs. Helwig asked Mr. Valle whether this date was acceptable and upon his reply in the affirmative, on motion by Councilman Bloom, seconded by Councilman White, it was unanimously RESOLVED, that the Town Board of the Town of Mamaro- neck will, pursuant to Sub-paragraph E (III) of Section 209 of the Civil Service Law, State of New York, conduct a public hearing at 8:15 p.m. on April 18th, 1973 in the Council Room or Auditorium located at the Weaver Street Firehouse situated at the corners of Edgewood Avenue and Weaver Street in the Town of Mamaroneck. - 10 - This hearing is called so as to allow the parties to the contract negotiations between the Paid Firemen of the Town of Mamaroneck and the Town of Mamaroneck to explain their positions with respect to the Report of the Fact Finder bearing date January 25, 1973; and be it further RESOLVED, that the Clerk be and he hereby is author- --- ized to publish in the official newspaper of the Town Mamaroneck, "The Daily Times", Notice of such hearing as required by law. 3. Living Room Forums The Supervisor called attention to the invitation circulated with the agenda this evening and packet of materials to be used at the first meeting of the series of "Living Room Forums" for residents of the Town to be held at her home tomorrow even- ing, March 8th. She extended a cordial invitation to all present and stated that she was hopeful residents would call and volunteer the use of their living rooms for continuance of these informal meetings so that the Council could learn first-hand of some of the needs and desires of the community and how best to meet them. She particularly referred to the new map on the front cover which she said she felt to be the best the Town had ever had in its clear delineation of the boundaries of the three geographical areas comprising the Town and recitation at a glance of the area and population of each of the three divisions. 4. Questionnaires for Senior Citizens (Not on Agenda) Mrs. Helwig also called attention to the questionnaires prepared by a Committee of the Larchmont-Mamaroneck Committee on Family and Youth and distributed last Monday at the local banks to senior citizens -- a copy of which, she said, she understood would appear in the Daily Times. She stated that the response to date had been substantial and rewarding and that it was hoped many more replies would still be received. Councilman Vandernoot added that the choice of last Monday for circularization had been largely because the Social Security checks had been received on Saturday and the Committee had therefore felt that a large distribution would be realized by having the questionnaires available in the banks on-Monday. . , The Councilmen -- Mr. Bloom -- (Not on Agenda) 1. Bottle Collection Councilman Bloom said he had noticed some mixture of brown, green and clear bottles in the bins when he had visited the collection depot last Saturday and requested the paper to urge all residents to avoid mixing the types of glass Because sorting the bins ' contents made for wasted time and created additional expense in - 11 - Tj F ff'� the conduct of this very sound ecological program. The Supervisor noted that glass and newspaper recycling programs were responsible for a 2,000 ton decrease in the amount of solid waste hauled from the Unincorporated Area and Village of Larch- mont to the Croton dump in 1972. This decrease, she stated, represented a savings of some $17,000, in dumping fees at Croton in addition to lessening the costs relating to hauling the waste. She further reported that the poundage of garbage per person per day hauled had decreased from 3.54 pounds in 1971 to 3.1 pounds in 1972. 2. Decal Parking - Lot No. 1 (Not on Agenda) Mr. Bloom asked the Clerk for a report on the number of decals issued - which Mr. Gronberg reported as 54 this period, where- upon in response to both the Supervisor's and Councilman Bloom's suggestion that another flier be sent out, Mr. Gronberg stated that a Renewal Notice would be mailed well before April 1st, the beginning of the second quarter. Mr. Vandernoot -- 1. Apportionment Upon presentation of the following apportionment, on motion by Councilman Vandernoot, seconded by Councilman White, the follow- ing resolution was unanimously adopted: WHEREAS, the Assessor has presented petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Tax Law; and WHEREAS, after due consideration this Board finds it desirable to grant said petition for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1972-1973, taxes of 1973, which shows property now appearing on the rolls as follows : Block Parcel Name Land Imp. Resolution, Larchmont Village Board of Trustees Councilman Vandernoot said that he would like to propose a resolution which he then presented for adoption by this Board in conjunction with that adopted by the Village of Larchmont Board at its meeting Monday evening, which he thereupon so moved. The motion was seconded by Councilman Bloom and the following resolution thereupon duly adopted by unanimous vote of the Board: RESOLVED, that this Board hereby agrees to accept the report of the Tri-Municipal Study Committee, dated January 30th, 1973, copy of which was presented at the regular meeting on February 21st, 1973; and be it further RESOLVED, that this Board hereby directs the Super- intendent of Highways and the Town Attorney to meet with representatives of the Village of Larchmont to study the details and procedures to accomplish the consolidation of the Sanitation District of the Town of Mamaroneck and the Sanitation function of the Village of Larchmont, and to make their report to this Board and the Village of Larchmont Board of Trustees. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 8:55 p.m. , to reconvene on March 21st, 1973. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims Upon presentation for authorization of payment by Commissioner Faiola and on his motion, seconded by Commissioner White, it was unanimously RESOLVED, that the following Fire Department claims as audited by the Comptroller and ap- proved by the Fire Chief are hereby approved, and the Supervisor and Comptroller hereby authorized to pay the same out of the Fire Department budget: Con Edison $ 5.00 Frank's Fuel, Inc. 190.87 I. & T. Plumbing & Heating Co. , Ind. 27.35 - Merson Uniform Co. 80.70 New York Telephone Co. 9.84 Suburban Communications, Inc. 54.35 Total $ 368.11 - 13 - 2. Reports Commissioner Faiola presented the Fire Report for the month of February 1973 which was ordered received and filed for the record. Commissioner Faiola at this time commended the Chiefs for the interest and enthusiasm shown during the past few weeks at the Sunday drills, particularly remarking on the new men and urg- ing Chief Ciardullo to "keep up the good work". 3. Adjournment There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:00 p.m. , to reconvene on March 21st, 1973. Town Cler 14 -
