CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. - ROLL CALL Present: Supervisor Helwig Councilman Faiola Councilman Vandernoot Councilman Bloom Councilman White Absent: None Also Present: Mr. Gronberg - Town Clerk Mrs. Brewer - Deputy Clerk Mr. Johnston - Town Attorney Mr. Aitchison - Highway Superintendent Mr. Altieri - Comptroller Mr. Elfreich - Town Engineer Mr. Paonessa - Building and Plumbing Inspector THE SUPERVISOR The Supervisor greeted Mr. Bill Wightwick, reporter from the Daily Times who formerly attended all Town Board meetings, sincerely welcoming him on behalf of the Board. APPROVAL OF MINUTES The minutes of the regular meeting of April 19th, 1972 were presented and on motion duly made and seconded, approved as submitted. OLD BUSINESS 1. Report on Bid - Supervisor's Car Pursuant to and as recommended in the memorandum of the Town Engineer under date of May 3rd, 1972 herewith presented and ordered received and filed, the order for the Supervisor's car has been placed in accordance with the resolution adopted - I - _ at the last meeting of this Board. 2. Report - Prince Willows Sewer At the Supervisor's request, the Engineer reported that upon inspection the Prince Willows Sewer line had been found acceptable and therefore recommended payment of the retainage. This report was submitted for the Board's information and required no action.. NEW BUSINESS 1. Report on Per Capita State Aid for 1972 For informational purposes a report addressed to the Board by the Comptroller under date of May 3rd, 1972 regarding Per Capita State Aid for 1972 was herewith presented and ordered received and filed. 2. Report on Increase in Health Insurance Effective July 1st, 1972 For information purposes a report addressed to the Board by the Comptroller under today's date reporting on the Health Insurance Rate Increase was herewith presented and ordered received and filed for the record. 3. Authorization - Emergency Overtime Police Department (Report on Cost to Date) - Pursuant to memorandum of the Police Commission under date of April 27th, 1972 herewith presented and ordered received and filed and following the Comptroller's report of the cost to date, namely 458 hours totalling $3,683.75, on motion by Councilman Faiola, seconded by Councilman Bloom, it was unanimously RESOLVED, that as approved by the Board of Police Commissioners, this Board hereby authorizes payment of Emergency Overtime Compensation to the following officers of the Town of Mamaroneck Police Department for the number of hours set forth for each covering the period from March 31st to April 27th, 1972: Name Hours Min. Salary Authorizations for Police Department Pursuant to memoranda of the Police Commission dated April 24th, 1972 and memorandum of the Comptroller under today's date requesting the necessary authorization for salary payment as set forth by the Commission, on motion'by Councilman White, seconded by Councilman Bloom, the following resolution was unanimously adopted: RESOLVED, that this Board hereby approves the following promotions in the Police Department to be effective and to be compen- sated at the salaries set forth herebelow: Sergeant Christopher Loveley - promoted to the rank of Lieutenant, effective as of April 20th, 1972 and to be compensated in the amount of $14,100, per annum, which compensation will be increased to $14,300. as of July 1st, 1972. Detective-Sergeant Robert Barasch - promoted to the rank of Contingent Permanent Lieutenant, effective as of April 20th, 1972 and to be compensated in the amount of $14,100. per annum, which compensation will be increased to $14,300. as of July lst, 1972. Detective Ralph Perritano - promoted to the rank of Detective-Sergeant, effective as of April 20th, 1972 and to be compensated in the amount of $12,500. per annum, which compensation will be increased to $12,700. as of July 1st, 1972. Patrolman Thomas Vitro - promoted to the rank of Contingent Permanent Sergeant, effective as of April 20th, 1972 and to be compen- sated in the amount of $11,985. per annum, which compensation will be increased to $12,185. as of July 1st, 1972. 5. Authorization to Transfer Maintenance Man from Conservation to Police Department Pursuant to memorandum of the Comptroller under date of April 28th, 1972 herewith presented and ordered received and filed, on motion by Councilman Vandernoot, seconded by Councilman Bloom, it was unanimously 3 - RESOLVED, that this Board hereby approves the transfer of John Eney, Park Attendant in the Conservation Department to Assistant Maintenance Man in the Police Department, effective as of May 1st, 1972 and to be compensated at the rate of $2.75 per hour. 6. Engineer's Request for Town to Join American Public Works Association Pursuant to the Engineer's request under date of April 21st, 1972 herewith presented and ordered received and filed, on motion by Councilman Bloom, seconded by Councilman Faiola who stated that he would like to second this motion inasmuch as he thought it important for the Engineer to have contact with others in his field through the attendance of seminars, conferences, etc. , as he had heretofore described, it was unanimously RESOLVED, that the Town of Mamaroneck joins the American Public Works Associ- ation at the annual dues of $60.00. 7. Authorization to Advertise for Bids for uniforms - All Departments Pursuant to a memorandum addressed to the Board by the Comptroller under date of March 3rd, 1972, herewith pre- sented and ordered received and filed for the record, on motion by Councilman Vandernoot, seconded by Councilman Faiola, it was unanimously RESOLVED, that in accordance with law, the Town Clerk be and he hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, "The Daily Times", a Notice for Bids, to be returnable May 17th, 1972, and opened and read aloud at a regular meeting of this Board at 8:15 p.m. on that date, for the rental of uniforms to be used by the Highway, Sanitation, Park, Recreation and Police Departments, in accordance with the specifications set forth in the Notice, provided that the said specifications have been approved by the Town Attorney prior to the publication of the aforesaid Notice for Bids. COMMUNICATIONS 1. County Board of Elections Special Registration Dates The Clerk presented a letter addressed to him by the County Board of Elections under date of April 24th, 1972 which was herewith ordered received and filed, setting the dates of June 12th to 16th, 1972 from 3:00 to 8:00 p.m. at the Town Office as the special registration dates this year, which upon motion duly made and seconded was hereby so authorized by unani- mous vote of the Board. 4 - 2. Notice of Hearing Mamaroneck Village Zoning Board A Notice of a public hearing to be held by the Zoning Board of Appeals of the Village of Mamaroneck on May 4th, 1972 which requires no action on the part of this Board was herewith ordered received and filed. 3. Notice of Hearing Village of Larchmont Board of Appeals A Notice of meeting of the Larchmont Zoning Board of Appeals on Wednesday, May 17th, 1972 regarding Case No. 583 - Daitch Shopwell, 2141 Palmer Avenue, Larchmont, was presented and in accordance with the Board's direc- tion was referred to Mr. Fred Maggini, Chairman of the Planning Board for report. The Board further directed that Notices of the foregoing application be forwarded to all property owners of the Town of Mamaroneck within a radius of 500 feet of the aforesaid property. 4. Boy Scouts - Invitation to 1972 Scout-O-Rama A communication dated April 25th, 1972 from John M. Coughlin, Public Relations Chairman of Hutchinson River Council #401, Boy Scouts of America, announcing the 1972 Scout-O-Rama and attaching complimentary tickets, copies of which had been forwarded to each member of the Board, was presented and herewith ordered received and filed. 5. Acknowledgement - Senator Buckley A letter from United States Senator Buckley acknowledg- ing receipt of copies of resolutions adopted by the Association of Towns was herewith presented and ordered received and filed. 6. Letter - Mrs. Lionel P. Marks A letter addressed to the Town Council by Mrs. L. P. Marks of 75 Howell Avenue under date of May 1st, 1972 requesting permission to have a "recycling sale" on her premises was herewith presented and ordered received and filed. At the Supervisor's request, the Building Inspector out- lined the Attorney's and his interpretation of the Zoning Ordinance explaining that thereunder garage sales were not a permitted accessory use in a residential one-family district and therefore were in violation and denied or stopped by his office whenever known. Consequently his recommendation was that the Board advise Mrs. Marks that she would have to file an application with the Zoning Board of Appeals to permit her to use her property for such purpose. In reply to question of the date of the proposed sale, it was stated that it was scheduled for 5 - this coming Saturday which obviously made such a submission as recommended impossible. Further discussion followed during which both Council- men Bloom and White strongly questioned whether a Zon- ing Ordinance such as the Town's would be held consti- tutional in a court with respect to such usage of a person's private property with the Board consequently directing that study be given to the possible modifica- tion of the existing Ordinance with respect to the re- quirements for such accessory usage if deemed advisable. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed: Report of the Town Clerk for the month of April 1972. Report of the Receiver of Taxes and Assess- ments for the month of April 1972. Report of the Building and Plumbing Inspector for the month of April 1972. Report of the Westchester Shore Humane Society, Inc. for the month of April 1972. Report of the Municipal Dog Patrol for the month of April 1972. Town of Mamaroneck Police Department Annual Report for 1971. Report of the New York State Commission of Correction on the Town Lockup under date of April 21st, 1972. Report of the State Department of Audit & Control - Annual Report of the Town of Mamaro- neck for the year ended December 31st, 1971. Affidavits of Publication and Posting of the amendment of Chapter II of the General Ordinances. THE SUPERVISOR Mrs. Helwig inquired at this time whether anyone present wished to bring any matter to the Board's attention whereupon Dr. C. Alan Mason of 482 Weaver Street addressed the Board inquiring about the availability of the Flood Control Insurance. The Supervisor explained that while there was no definite word from Mr. Krimm's office in Washington, D.C. , that office had advised that they had all of the necessary documents and that everything was in good order. - 6 - REPORTS (continued) The Supervisor -- 1. Report on Bill A9860 The Supervisor called to attention that the Home Rule Request bill to bann hunting migratory birds in Larch- wont Harbor (A9860) was now on the Governor's desk -- asking residents to write or wire at once urging that the bill be signed into law. She explained that the Governor must act on the bill within ten days if the Legislature did not adjourn Saturday but that if it did, he would then have thirty days in which to act and thus her request for immediate action. 2. Cherry Blossom Festival Village of Mamaroneck (Not on Agenda) The Supervisor presented a cordial invitation addressed to her by Trustee Daniel Natchez on behalf of the Festival Committee, inviting the members of the Board to attend this year's Festival May 13th to 21st at Harbor Island, which was herewith ordered received and filed a copy having been forwarded to each of the Councilmen for his information. - The Councilmen -- Mr. Faiola -- 1. Report on Bus Situation At the Supervisor's request Councilman Faiola advised that he had spoken to Mr. Mc Aloon one of the principals of Beechmont Bus Company about utilization of bus routes to carry students as well as commuters, which information, he said, he had requested Mr. Mc Aloon to submit in written form. He also reported that a complaint about a change of route on a student bus which had been registered with the Town and referred to Commissioner Leary had been adjusted by that office as of this date. 2. Holding Tanks (Not on Agenda) Councilman Faiola thanked the Mamaroneck Village Board for holding up enforcement of the law requiring boats to be equipped with holding tanks. He explained that there was a test case pending on this regulation and complimented the Village on holding it up until determination was made by the Federal Government since it would certainly be a burden to yachtsmen to in- stall these tanks and then have to have them removed. - 7 - Mr. Vandernoot -- 1. Report on Mamaroneck Health Center Councilman Vandernoot reported that Dr. Goldman, Commissioner of the County Health Department together with four members of his staff had attended a meeting of local officials and personnel at the Mamaroneck Health Center to explain the reasons for the possible closing of that Agency. The Doctor stated, Councilman Vandernoot continued, that services would not be curtailed and would possibly be en- hanced and that as a result of this meeting a committee had been appointed to look into uses for the present Health Center building should the program be moved to Rye Ridge where greater services (ie. 36 nurses available instead of 3i) would be provided and for which facility transportation would be worked out. He concluded his report by saying that another meeting would be held very soon after which he would report further to the Board. 2. Hot Line Report Councilman Vandernoot submitted the Annual Hot Line Report for 1971 stating that certainly it set forth rather voluminous figures. He also noted that Mrs. Janet Donnelly had tendered her resignation as Coordinator and commented on the fine work she had done and the outstanding contribution she had made to the community through this service -- for which certainly, he said, he felt she was owed a large vote of thanks. All of the members of the Board joined Councilman Vandernoot in paying tribute to Mrs. Donnelly, and in expressing his thanks and appreciation to her and thereupon it was unani- mously directed that a letter thanking Mrs. Donnelly and commending her on her able and diligent service be addressed to her by the Supervisor on behalf of this Board. Mr. Vandernoot presented a letter addressed to the Supervisor by Dr. Fred Feuerbach, Jr. , Chairman of the Larchmont-Mamaro- neck Narcotics Guidance Council under date of May 2nd, 1972, announcing the appointments of Mrs. Gloria Plesent of 6 Walnut Street and Mrs. Alice Kramer of 5 Oakdale Road as Hot Line Aides, which was herewith ordered received and filed. Councilman Vandernoot stated that he and he was sure his colleagues on this Board joined with Dr. Feuerbach in look- ing forward to working with the two new Coordinators, whom he said he felt the Council was fortunate indeed to have. ADJOURNMENT There being no further business to come before the meeting, - 8 - on a motion offered by Councilman White and seconded by Councilman Faiola, this meeting to reconvene on May 17th, 1972, was duly declared adjourned at 9:10 p.m. with the following resolution adopted in memoriam to The Rt. Rev. Monsignor Robert E. Delaney, Pastor Emeritus of Sts. John and Paul Church in Larchmont: WHEREAS, The Rt. Rev. Monsignor Robert E. Delaney, Pastor Emeritus of Sts. John and Paul Church in Larchmont, died on May the first, 1972, and WHEREAS, during his years here as Pastor, he served as the beloved Chaplain of the Town Fire Department and made a great contribu- tion to our young people as Chairman of the Larchmont-Mamaroneck Committee on Family and Youth, and WHEREAS, wherever he served, his compassion and wit endeared him to all who served with him, NOW, THEREFORE, BE IT RESOLVED, that we, the members of the Town Board of the Town of Mamaroneck, do hereby express and record the gratitude of the Town and all of its citizens, and our ap- preciation of Monsignor Delaney's spiritual leadership and faithful service, and be it further RESOLVED, that we convey to the Parish Council of Sts. John and Paul and to his family this expression of our grief and sorrow, and be it further RESOLVED, that this resolution be entered upon the minutes of the Town Board of the Town of Mamaroneck and thatihis meeting stand adjourned this evening in respect to his memory. 9 - BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims Upon presentation for authorization of payment by Commissioner Faiola and on his motion, seconded by Commissioner Bloom, it was unanimously RESOLVED, that the following Fire Depart- ment claims be and they hereby are approved, and the Supervisor and Comptroller author- ized to pay the same out of the Fire Depart- ment budget: Con Edison $ 154.97 Excelsior Garage & Machine 307.64 Works, Inc.
