HomeMy WebLinkAbout1972_11_15 Town Board Regular Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD NOVEMBER 15th, 1972, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER --- The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Helwig Councilman Faiola Councilman Vandernoot Councilman Bloom Councilman White Absent: None Also Present: Mr. Gronberg - Town Clerk Mrs. Brewer - Deputy Clerk Mr. Johnston - Town Attorney Mr. Aitchison - Highway Superintendent Mr. Altieri - Comptroller Mr. Elfreich - Town Engineer APPROVAL OF MINUTES The minutes of the regular meeting of November 1st, 1972 were presented and on motion duly made and seconded, approved as submitted. OPENING OF BIDS - Auxiliary Generator Weaver Street Firehouse The Clerk presented the Affidavit of Publication of the Notice for Bids for the record and opened and read aloud the only bid submitted, that of Samuel L. Greenspan of Larchmont, New York, in the amount of $2,000.00 with the non-collusive statement signed,and thereupon on motion by Councilman Faiola, seconded by Councilman Vandernoot, it was unanimously RESOLVED, that subject to examination and approval by Councilman Faiola, the Town Engineer, the Attorney and the Comptroller, this Board hereby accepts the bid of Samuel L. Greenspan of 6 Virginia Place, Larchmont, New York, in the amount of $2,000.00, for furnishing one (1) 15 KW gasoline driven generator to be used by the Town of Mamaroneck Fire Department, in accordance with the specifiea- tions set forth in the Notice for Bids. - 1 - rg OLD BUSINESS 1. Reports on Opening of Informal Bids The Clerk presented written reports addressed to the Board by the Engineer under dates of November 9th and 10th, 1972 on: a) metal lockers for Police Headquarters and b) carpet- ing for Police Headquarters, which were hereto ordered re- ceived and filed for the record. 2. Report on V.A.C's Use of Court House Basement Pursuant to a report addressed to the Board by the Engineer under date of November 14th, 1972 on the Volunteer Ambulance Corps ' use of the basement in the Court House herewith presented and ordered received and filed, on motion by Councilman Faiola, seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby approves the Volunteer Ambulance Corps ' request for the use of the basement of the Court House at 1201 Palmer Avenue provided that the following alterations recommended by the Town Engineer are made at the expense of the Volunteer Ambulance Corps, subject to the approval of the Chief of Police: 1) Throw bolt on door at top of stairs (inside). 2) Reverse lock type door knob on interior door from clerk's office to stairway downstairs. 3) Necessary 2 x 4 partitioning around toilet as desired by Volunteer Ambulance Corps. NEW BUSINESS 1. Salary Authorizations Recreation Pursuant to memoranda of the Superintendent of Recreation under dates of November 9th and 14th, 1972 herewith presented and ordered received and filed, on motion by Councilman Faiola, seconded by Councilman Vandernoot, it was unanimously RESOLVED, that as recommended by the Recreation Commission, this Board hereby authorizes that the following personnel be engaged and com- pensated as set forth below: Effective Name Title Date Salary Ingrida Miemis Sr. Rec. Fixing Date for Preliminary Budget Hearing In accordance with the Supervisor's request and following her explanation, on motion by Councilman White, seconded by Coun- cilman Vandernoot, it was unanimously RESOLVED, that the date of the first regular meeting in December be and it hereby is changed from Wednesday evening, December 6th to Thursday evening, December 7th, 1972, at which time two public hearings will be held for the purpose of considering first, a proposed increase in the water rate schedule and second, the adoption of the 1973 Preliminary Budget of the Town of Mamaroneck; and be it further RESOLVED, that the Clerk be and he hereby is directed to publish the necessary Notices of the aforesaid hearings as required by law. 3. Authorization - Snow Control, State Highways The Supervisor called on the Superintendent of Highways who explained that notwithstanding the proposal to lessen the amount of monies paid to municipalities for snow removal and the meetings subsequently held with local Highway Superintend- ents to discuss the matter, it had been determined that the State would continue at least for this year under the 1946 contractual agreement. Whereupon on a motion offered by Councilman Faiola and seconded by Councilman White the following resolution was adopted by unanimous vote of the Board: WHEREAS, Sect. 12 of the Highway Law, as amended by Chapter 305 of the Laws of 1946, provides that if the removal of snow and ice from the State Highways is taken over by the County, the County can arrange with the Town Superintendents or Village Street Commissioners of the various towns/villages in the County of Westchester and the Villages therein for the removal of the snow and ice from such State Highways as are within their municipal boundaries and the entire cost of such work will be reimbursed by the State; and WHEREAS, the Town of Mamaroneck under date of November 8, 1946 entered into a contract with the County of Westchester for the removal of snow and ice from the State Highways within the said Town in accordance with the provisions of Sect. 12 of the Highway Law as amended, and under date of October 20, 1971 extended the said contract for the 1971-1972 season; NOW, THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck extends - 3 - the above-mentioned contract with the County of Westchester for an additional year; and be it further RESOLVED, that a certified copy of this resolution be forwarded to the Westchester County Commissioner of Public Works. COMMUNICATIONS 1. Letter - Frederick S. Claar 23 Stonewall Lane, Town The Supervisor called on Mr. Frederick S. Claar pursuant to his request in note addressed to the Board under date of November 10th, 1972 herewith presented and filed, in which he had asked that his wife and he residing at 23 Stonewall Lane and their neighbors, Mr, and Mrs. James Banks residing at 21 Stonewall Lane be given time to address the Board this evening regarding the deplorable and dangerous condition of the road leading off Stonewall Lane to their driveways, which road they had understood was a part of Stonewall Lane. Mr. Claar called to attention that the road off of Stonewall Lane to his and his neighbor's driveways was in extremely dangerous and hazardous condition, and that when Mrs. Claar had gone to the Town offices to request its repair, she had been informed that this was not a Town-owned road but rather privately-owned property. This was indeed difficult to under- stand, he said, since he had been told by the former owner of the premises that his property was on Stonewall Lane and he couldn't help but wonder whether there might not be some error in the Town's records? Mr. Banks, upon recognition, advised the Board that he had owned his home for 16 years and that he had been told by the builder who had owned the property when he bought it that this road was a part of Stonewall Lane. The Supervisor advised Messers. Claar and Banks that the Town's records showed that that particular portion of Stonewall Lane leading to the driveways of #21 and #23 was owned by Mrs. Idella Marks who owned a large tract of ground in that area, and that for that reason,the Town could not repair it since it was illegal for a municipality to improve privately-owned property at public expense. In reply to a question asked by Mrs. Banks as to who would be held responsible in case of injury on this road, the Attorney advised that the property owner was liable. Councilman Faiola asked whether, even if this road were privately owned, the immediate problem was not go get the situation remedied immediately? - The Supervisor agreed that this was the problem but that since the property in question was privately owned,the Town could not repair it with public funds or without the consent of the property owner. Mr. Faiola then asked whether the Town sent Police and Fire equipment up there and was answered affirmatively. The Attorney then suggested that the Town put Mrs. Marks on notice by calling the condition of her property to her attention and requesting here to repair it adding that she might not be - 4 - aware of the situation since she did not live here and that in the past he had found her to be cooperative and certainly he felt she should be given notice. Following some further discussion the Board unanimously directed the Attorney to get in touch with Mrs. Marks, putting her on notice of the condition of this particular property which was owned by her and advising her that this matter should be attended to immediately either by having the work done by engaging a paving contractor or by grant- ing the Town Highway Department permission to do so with the understanding that the Town would be reimbursed for the cost of such repairs. Councilman White then inquired, in the interest of finding a way to provide these services to the residents, about the possibility of initiating an action to acquire this land in view of the fact that it had been used 16 years without objection by Mrs. Marks. The Town Attorney expressed some doubt as to this being any kind of solution in this instance due to the length of time usually involved in any land acquisition matter. The Supervisor then asked Mrs. Clear about the lighting in her area of the street and upon being informed that there was no public lighting, requested the Engineer to check on this matter. The discussion concluded when Mrs. Claar asked Mrs. Helwig what procedure she should follow now .and was advised by the Supervisor that she would keep both parties concerned in- formed as to developments. 2. Letter - Mrs. Rhoda Krell, Health and Safety Chairman, Central School P.T.A. The Clerk presented a letter addressed to the Supervisor by Rhoda H. Krell, Health and Safety Chairman of the Central School P.T.A. , conveying the P.T.A. 's thanks to the Town Council and officials for the flashing beacon lights in- stalled on Palmer Avenue, which was herewith ordered received and filed. The Supervisor reported that work at the Palmer and Weaver intersection was progressing and that it was to be hoped the light for which all had been waiting so long would be in by the end of this month. 3. Notice of Public Hearing Board of Trustees Village of Mamaroneck The Attorney presented a Notice of Hearing before the Board of Trustees of the Village of Mamaroneck on November 27th, 1972 for the purpose of amending the Zoning Ordinance and Zoning Map of the Village of Mamaroneck, which he said re- quired no action by this Board and was accordingly ordered received and filed. 4. Notice of Meeting - Zoning Board of Appeals, Village of Larchmont The Attorney also presented a Notice of meeting of the Zoning Board of Appeals of the Village of Larchmont which also re- quired no action by this Board and was accordingly ordered - 5 - I ` q received and filed. Dr. C. Alan Mason - 482 Weaver Street In reply to Dr. Mason's comments relating to the possible danger of flooding again during the recent heavy storm, Mrs. Helwig reported that she had attended a meeting this past Monday in the County and had been told by Mr. Robert Jonas, Soil and Water District Director, that it seemed as though there would be federal money available for small stream --- projects and she had understood that meetings would be held in connection with this subject. Dr. Mason thanked the Supervisor and again stated that he would be glad to attend any meetings upon notification thereof. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed: Report of the Receiver of Taxes and Assess- ments for the month of October 1972. Report of the Building and Plumbing Inspector for the month of October 1972. Report of the Municipal Dog Patrol for the month of October 1972. Report of the Westchester Shore Humane Society, Inc. for the month of October 1972. Financial Report for the year ending December 31st, 1971 submitted by Glick-Freedman & Meckler, Certified Public Accountants. Summary of Budget Appropriations and Expenditures January 1st through September 30th, 1972. The Supervisor -- 1. Change of Date - Conference on Discontinuance of Bus Service Larchmont Acres Apartments The Supervisor called to attention the notice of a second postponement of the Conference on the discontinuance of the bus service at Larchmont Acres which was now adjourned to Tuesday, November 28th, at 10:00 A.M. She advised the Board that Mr. Preston White and Mr. Erik Vieux of Larchmont Acres and the Attorney had been sent copies of this adjournment notice so that all interested residents would be advised of the postponement of this meeting. 6 - 2. Letter re Decal Parking The Supervisor presented a copy of the letter addressed to the residents of the Town with an attached stamped return postcard to be placed on all cars in the Town and Village parking areas, explaining that the Board had felt it vould be wise to poll those using the areas in order to determine whether or not;commuters of the Town of Mamaroneck would be interested in the availability of a decal area at less cost than the daily metered parking. 3. Public Hearing - Water Rate Increase The Supervisor stated that in addition to the public hear- ing on the adoption of the preliminary budget, it would be necessary to schedule a hearing on the proposed increase in the water rate schedule immediately preceding the budget hearing inasmuch as this would have an affect on the 1973 budget and requested the Board's pleasure thereon. Whereupon on a motion by Councilman Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that this Board hold a Public Hearing on Thursday evening, December 7th, 1972 in the Auditor- ium of the Weaver Street Fire House immediately preceding the hearing on the adoption of the Preliminary Budget, for the purpose of considering a proposed increase in the water rate schedule; and be it further RESOLVED, that the Clerk be and he hereby is author- ized to publish in the official newspaper of the Town of Mamaroneck, "The Daily Times", Notice of such Hearing as required by law. NOT ON AGENDA The Supervisor called to the Board's attention the fine job performed by Mr. Gronberg in this year's Presidential election and referred to the cards he had included with each I;nspector's check, thanking them for their outstanding cooperation and assistance during the long and grueling Election Day. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9:10 p.m. , to reconvene on December 7th, 1972. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. - 7 - 1. Claims Upon presentation for authorization of payment by Commissioner Faiola and on his motion, seconded by Commissioner Vandernoot, it was unanimously RESOLVED, that the following Fire Department claims be and they hereby are approved and pay- ment thereof hereby authorized from the Fire Department budget subject to approval by the Town Comptroller: Con Edison $192.88 R. Reports Commissioner Faiola presented the Fire Report for the month of October 1972. At this time Commissioner Faiola advised the Commission that Deputy Chiefs Santora and Ciardullo had reported to him on the inspections made throughout the year which certainly --- substantiated and attested to the need and use of the second Chief's car. 3. Other Business Pursuant to report of the Engineer addressed to the Fire Com- mission under date of November 15th, 1972, on motion by Com- missioner Faiola, seconded by Commissioner Vandernoot, it was unanimously RESOLVED, that the Commission hereby authorizes the refurbishing of eleven windows in the Audi- torium of the Weaver Street Fire House at a cost of $45.00 per window or a total sum of $495.00 by Diamond Do-All Ltd. of Larchmont, New York. The Supervisor expressed her pleasure that a solution to this problem existing for some time with the windows in the auditor- ium would not only provide for the opening and closing of these windows--but at considerably less cost than formerly estimated at anytime during the past several years during which this matter has been under consideration. 8 - 4.
