MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD JUNE 7th, 1972, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Helwig Councilman Faiola Councilman Vandernoot Councilman Bloom Absent: Councilman White Also Present: Mr. Gronberg - Town Clerk Mrs. Brewer - Deputy Clerk Mr. Johnston - Town Attorney Mr. Aitchison - Highway Superintendent Mr. Elfreich - Town Engineer APPROVAL OF MINUTES The minutes of the regular meeting of May 17th, 1972 were presented and on motion duly made and seconded, approved as submitted. OLD BUSINESS 1. Postponement of Returnable Date for Bids for Vaccum Basin Cleaner In accordance with the Engineer's request the returnable date for the bids for a Vacuum Basin Cleaner was postponed for the second time to the next meeting of the Board on July 5th, 1972. 2. Report on Correction of Firehouse Doors - Town Engineer At the Supervisor's request the Engineer reported that the contract for the work on the Firehouse doors had been completed in accordance with the specifications and that he had requested an inspection by the State Labor Depart- ment for final approval. - 1 - 3. Memo - Rental of Uniforms (Not on Agenda) The Clerk read the following memorandum addressed to the Board by the Superintendent of Highways, Town Attorney and Comptroller under date of May 26th, 1972 in compliance with the direction at the last meeting, which was herewith ordered received and filed: "Pursuant to the Town Board Resolution, May 17, 1972, the undersigned have reviewed the bids for the rental of uniforms and find the low bid acceptable. The contract is being prepared by Mr. Johnston, Town Attorney and will be forwarded to Standard Uniform Service, Inc. , for signature." NEW BUSINESS 1. Salary Authorizations for Summer Recreation Pursuant to memoranda of the Superintendent of Recreation under dates of May 22nd and 23rd, 1972, herewith presented and ordered received and filed, on motion by Councilman Bloom, seconded by Councilman Faiola, it was unanimously RESOLVED, that as recommended by the Recreation Commission, this Board hereby authorizes that the following Recreation Personnel be engaged and compensated as set forth below: Date Name Title Effective Salary Thomas Lynch Rec. Transfer of Funds Memorial Park Repairs Pursuant to memorandum of the Comptroller under date of June 7th, 1972, herewith presented and ordered received and filed for the record, on motion by Councilman Bloom, seconded by Councilman Vandernoot, it was unanimously RESOLVED, that this Board hereby authorizes the following transfer of funds within the 1972 Budget and Surplus Funds in order to meet the increase in cost for the asphalt resurfacing and replacement of concrete walks at Memorial Park in accordance with the recommendation of the Recreation Com- mission: From General Town Surplus $850.00 To A/C 7020.2 Equipment - 201 Memorial Park, etc. 850.00 5. Authorization for Babe Ruth League to Sell Bumper Stickers The Supervisor stated that although there was no formal request, she had been asked by the Babe Ruth League to obtain authorization for the sale of Babe Ruth League Bumper Stickers at $1.00 each in support of its new Senior League and to declare the opening date of June 11th as Babe Ruth League Day -- with the first game being played at 3 p.m. at the Ruth Green Field. Whereupon on motion by Councilman Faiola, seconded by Council- man Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the sale of Bumper Stickers at $1.00 each by the Babe Ruth League. 8 - 6. Transfer of Funds - General Code Publishers Corp. (Not on Agenda) Following the Clerk's explanation and presentation of a claim from the General Code Publishers Corp. and pursuant to memorandum of the Comptroller under date of May 3rd, 1972, herewith presented and ordered received and filed, on motion by Councilman Faiola, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the following transfer of funds within the 1972 Budget and Surplus Funds : From General Fund - Town Outside Villages - Surplus $1,300.00 To General Fund - Town Outside Villages 1,300.00 Appropriation COMMUNICATIONS 1. Letter, Parish Council Sts. John & Paul The Clerk presented an acknowledgment of the In-Memoriam Resolution to Rt. Rev. Msgr. Robert E. Delaney from the Parish Council of Sts. John and Paul Church, which was herewith ordered received and filed. 2. Letter, Ms. Marianne E. Delaney The Clerk presented an acknowledgment of the In-Memoriam Resolution to Rt. Rev. Msgr. Robert E. Delaney from his Niece, Ms. Marianne E. Delaney, which was herewith ordered received and filed. 3. Invitation Automobile Club of New York Luncheon Award of Pedestrian Safety Citation The Clerk presented a letter from the Automobile Club of New York inviting the Town to be present on June 13th, 1972 at the luncheon to be held at Tavern-on-the-Green in Central Park, New York, to receive a Pedestrian Safety Citation for having no pedestrian accidents in the Town of Mamaroneck for four years, which would be attended by Lt. Christopher Loveley and Sgt. Frank Silvestri. 4. Letter, Rotary Club of Larchmont A letter addressed to the Board by the Rotary Club of Larchmont thanking the Police Department for its excellent cooperation at the Annual Antique Flea Market was herewith presented and ordered received and filed. - 9 - 5. Notice of Hearing - Board of Appeals Village of Larchmont The Clerk presented a Notice of Hearing by the Board of Appeals of the Village of Larchmont on June 21st, 1972 which had been forwarded to the Attorney and Chairman of the Planning Board, Mr. Maggini, and which meeting would be attended by Mr. Maggini, and thereupon was ordered re- ceived and filed. THE SUPERVISOR In reply to the Supervisor's query as to whether anyone present had any matter they wished to present, the following persons addressed the Board: Mr. Steve Radding - 484 Weaver Street Mr. Radding called to the Board's attention the infestation of rats along the Sheldrake River stating that at a previous date when the County had been called and taken immediate and excellent steps to remedy the situation and, upon again calling the Health Department, a letter was requested from the Town because of very strong protests of trespassing registered with the County by one resident of the area concerned. Whereupon on motion by Councilman Faiola, seconded by Councilman Bloom, it was unanimously RESOLVED, that a letter be addressed to the County Health Department requesting its assist- ance, thanking it for past aid, and assuring the Town's full cooperation in this instance. Dr. C. Alan Mason - 482 Weaver Street Dr. Mason spoke of the flooding on Sunday remarking on the almost miraculous escape of the houses in his area from inundation during the violen storm and confirmed the Supervisor's report of the Engineer's calls to the Corps of Engineers in an effort to get the project started, adding that he too had made such a call and had received the same information on Monday. Mr. Walter Lowman - 8 Woody Lane Mr. Lowman referred to the letter of the Automobile Club of New York awarding the Town a Pedestrian Safety Citation for achieving a record of having no pedestrian fatalities in the last four years inquiring whether such a Citation included pedestrian accidents other than fatalities -- referring particularly to the recent incidence of a child being hit at Weaver Street and Forest Avenue. He stated --. that he was extremely concerned about traffic conditions around the Murray Avenue School at the time the children were crossing Route 125 and that although there was an excellent traffic guard stationed at this corner, he had almost been hit himself on several occasions and asked - 10 - a� whether it would be possible to have squad cars at this corner in order to augment safety precautions? The Supervisor advised in reply that this particular Citation referred only to fatalities, but that there was a study pres- ently being made by the A.A.A. of all safety conditions 'at the schools with the report and recommendations therefrom expected momentarily and Councilman Faiola recited that this Board had been trying to get the State to install a traffic signal at this corner for the past several years but so far the best that the Town had been able to get were the flashing lights. Dr. C. Alan Mason Dr. Mason again addressed the Board remarking that since the State had installed the "No Parking"signs, the traffic flow had increased materially on Weaver Street with much faster driving. The Supervisor, in reply to Dr. Mason, stated that she was awaiting pertinent information one of the residents of the area had volunteered to bring in and further that Mr. Krail of the State Department of Transportation had agreed to re- study this entire situation. Councilman Vandernoot suggested that all of this informa- tion be forwarded to the Police Commission, which was there- upon so directed. REPORTS The Town Clerk -- The Clerk presented the following reports which were ordered received and filed: Report of the Town Clerk for the month of May 1972. Report of the Receiver of Taxes and Assess- ments for the month of May 1972. Report of the Building and Plumbing Inspector for the month of May 1972. The Supervisor -- 1. Relining Pipe - Doris Road & Fairway Drive The Supervisor reported that as she knew the Board would _ recall when it had authorized two projects to be done by the Westchester Joint Water Works, it had asked for a cost estimate on each. Mr. Straub, she continued, advised that the relining of the pipe on Doris Road and Fairway Drive had been estimated at about $7,800, but would cost less than $3,500. He did not have an estimate for the other job on Hommocks Road but the work there would be done by the Water Works he further advised. - 11 - 2. Report - County Solid Waste Disposal The Supervisor stated that there was not very much she could add to what had already appeared in the local paper on this subject and referred specifically to the article in tonight's paper which stated that Judge Frankel had ordered that certain procedures as stated therein were to be followed without any delay, while certain others were left open. Mrs. Helwig further reported that the Incinerator Com- mission was having studies made regarding any possible reuse of the incinerator as well as of other processes, and further advised that a flier was now being prepared about glass and paper collection which would be delivered by the Sanitation men throughout the Town and Village. She then recognized Mrs. Willey whom she knew was interested and informed in this field and asked whether there was any- thing further she would like to comment on at this time? Mrs. Willey advised that her committee in L.I.F.E. had obtained some reports and in reply to Councilman Vander- noot's request, stated that she would be glad to see that copies were furnished to the Supervisor. Mrs. Judy Gutland of "C.E.Q. advised the Board that her request for publication of a notice about the newspaper pick-up in the local paper had been refused since it had already been published, and Councilman Faiola stated that he understood two of the highway staff served as guides on these pick-ups and that he felt since Derrico made money from this operation that the Town should be compensated for time and that a letter so stating should be directed to the Company. Mr. Aitchison confirmed Councilman Faiola's report and explained that the Company kept changing its drivers thus necessitating guides for each pick up. For the Board's information, Mrs. Willey who explained that she was involved in this through the League of Women Voters, said that she had learned that Briarcliff Manor received $5.00 to compen- sate for the time of each man who was used as a guide. She also inquired whether further thought was being given to these efforts, whereupon the Supervisor advised that the Commission was sending Mr. Kellogg, Mr. Elfreich and Mr. Aitchison to Milford and New Canaan to view their operations and report thereon to the Commission. 3. Request for Authorization for Town Attorney to Initiate Action vs M. T. A. The Supervisor stated that because of the flooding situation still obtaining on the Thruway at the foot of Cabot Road due to inadequate drainage through property owned by the M. T. A. under the railroad tracks, she would like the Board to author- ize the Attorney to initiate such action as might be neces- sary to rectify the condition if the Town was unable to work out a cure with the M. T. A. She further stated that the condition had now existed for some 13 years and that the Town had requested the M.T.A. to include rectification of this situation in its plans for the renovation of the station which it had rejected. Further she reported that since the Thruway road bed could be adversely affected by such flooding, she had arranged an appointment for Mr. Aston, the M.T.A. Engineer and Mr. Pendle- ton, Chief Engineer of the State Thruway Authority, to meet 12 - with Mr. Kellogg, Mr. Elfreich, Mr. Aitchison and herself to discuss this situation. And thereupon on motion by Councilman Faiola, seconded by Councilman Bloom, it was unanimously RESOLVED, that the Town Attorney be and he hereby is authorized to initiate such action as might be necessary against the M.T.A. to -- correct the flooding situation on the Thru- way at the foot of Cabot Road due to inadequate drainage through M.T.A. property under the railroad tracks. 4. Bill - Duck Hunting (Not on Agenda) The Supervisor reported that the Governor had signed into law the Home Rule Request Bill banning all duck hunting in the Larchmont Harbor and stated that she would like to congratulate the Attorney on his efforts and his hard work to overcome some of the objections this Bill had met in its uncertain course through the Legislature. She further paid tribute to the citizens of C.E.Q. and to Assemblyman Pisani and Senator Gioffre who had submitted the Bill and guided its course. Councilman Faiola moved that a letter of thanks be addressed to the two legislators, which motion was seconded by Council- man Bloom and unanimously so ordered. 5. Death of Mr. Loren Dodson and Officer John Leonard (Not on Agenda) The Supervisor called to the Board's attention the recent passing of Mr. Loren Dodson, former member of the Board of Police Commissioners on May 27th, 1972 in Naples, Florida, and also that of Officer John Leonard, former member of the Town Police Department, on June 6th, 1972, and thereupon following an expression of sympathy by each of the members of the Board and tribute to Messrs. Dodson and Leonard for the service each had rendered to this community, it was unanimously directed that a letter be addressed to the families of Mr. Dodson and Officer Leonard expressing the community's sympathy and condolences at this time. The Councilmen -- Mr. Faiola -- 1. Memo re Stage Weaver Street Firehouse Councilman Faiola observed that as the Board knew quite a bit of renovation work had been recommended for the Fire- house in order to provide more locker room and dressing room space for the men by partitioning of the stage. He presented a memorandum addressed to him by the Senior Engineering Aide under date of May 24th, 1972, which was herewith ordered received and filed for the record - 13 - listing three informal bids received for this work and requested in accordance with the recommendation that the contract be awarded to the lowest bidder -- namely, Victor Ferreti, in the amount of $600., which on his motion, seconded by Councilman Bloom, was thereupon unanimously so ordered. 2. Utility Poles and Street Lights Councilman Faiola called to the Board's attention that Con Edison and/or the Telephone Company had still failed to remove certain utility poles lying along the side of a road where a new pole had been installed which he described as both unsightly and hazardous. He also complained of the tremendous problem the Town was having concerning the ener- gizing of certain poles where the street lights had been out for many months. The Supervisor said she felt perhaps lighting should have priority over the removal of poles since there had been some poles without lights for some time, noting however that in a case of real emergency, Con Edison had never failed to respond very promptly. Mr. Faiola then said that while he agreed that lighting should be given top priority, he still felt that the removal of these poles was essential, and he suggested that if legally sound, one way of expediting this might be to hold up the payment of bills. At his request, the Attorney stated that he would be glad to examine the law in this respect, and thereupon in accordance with Mr. Faiola's further suggestion, it was directed that the Supervisor address a letter to Con Edison on behalf of the Board reciting these conditions and requesting rectification as promptly as possible. Mr. Bloom -- 1. Request for Approval - Attendance of ENCOM Seminar, Thomas Amlicke Councilman Bloom presented a letter addressed to the Board by Thomas Amlicke under date of June 6th, 1972, which was here- with ordered received and filed. On his motion, seconded by Councilman Faiola who commended Mr. Amlicke for being willing to take the time to attend this conference, the following resolution was unanimously adopted: RESOLVED, that this Board hereby authorizes Thomas R. Amlicke, Chairman of the Conservation Advisory Committee, to attend the seminar on ecology and the environment being held at the Silver Bay Association, Silver Bay, New York, from July 2nd to July 7th, 1972, with expenses paid by the Town in an amount not to exceed the sum of $150.00. OTHER BUSINESS Mr. Walter Lowman -- Mr. Lowman again addressed the Board saying that while this - 14 - was the first Town Board meeting he had ever attended, certainly it would not be the last. He stated that he envied local govern- mental bodies which did not have to submit budgets to the people as the School Board did, and that he saw two areas that were Town real problems for the Ton and the School Board: first, certioraris (which he said he had been told had reduced the tax base by some two million dollars) and second, the need to broaden the tax base. He said he knew that this Board had given much thought to this in the past and would continue to do so in the future and encouraged it to stay on the ball and to get several other balls rolling. The Supervisor suggested that perhaps Councilman Vandernaot would like to comment since he was close to these matters as he was presently chairing a Committee of this Board studying the apartment situation in the Town and also was a part of the Committee of the School Board studying the tax base. Mr. Vandernoot briefly outlined a questionnaire directed to all apartment residents in an effort to obtain actual factual information which would assist the Committee and the Board in its deliberations, remarking that while obviously the easiest thing for the Board to do would be to remove rent control entirely were it not for the plight of those who would be seriously jeopardized by such an action. He also referred to the efforts of the Village of Larchmont several years ago when it had worked long and diligently to get landlords and tenants to agree to a three-year plan for removal of rent control -- to which the landlords had agreed but the tenants for obvious reasons had not. Mr. Lowman then asked whether Mr. Mumma, President of the Board of Education, was going to address this Board on these subjects? Mrs. Helwig replied that she believed so -- and in fact had thought he might be at this meeting but presumed since she had not heard further, that it would now be at the next meeting. With reference to broadening the tax base, Councilman Bloom reviewed the adoption of the new Zoning Ordinance in 1959 and the Planners ' review in 1966, at which time certain proposals had been made to increase the industrial and commercial zoning which, he said, the people of this com- munity had rejected. Further, he pointed out that as the Supervisor had said, Councilman Vandernoot was now working with the Committee of the School Board which was endeavor- ing to find out whether the people in our community actually did want a higher tax base or whether they really wanted to continue to keep the Town the land of community it was. As to the Town budget, Councilman Bloom noted that while it was not voted on by the people, it was by law subject to public hearing prior to adoption, which hearings, he added, had always been very poorly attended. Communications a) Request to Use Fire Chief's Car Pursuant to written request of the Fire Chief dated June 2nd, 1972 and herewith presented by Commissioner Faiola and ordered received and filed, on motion by him and seconded by Commissioner Bloom, it was unanimously RESOLVED, that this Commission hereby authorizes. the Fire Chief to use his car #2231 to drive to the Hotel Concord, Monticello, New York for the Chief's Con- vention to be held from June 18th through June 20th, 1972, at no expense to the - 16 - 2 Town of Mamaroneck. b) Authorization to Advertise for Bids for Uniforms Pursuant to a letter addressed to the Board of Fire Com- missioners, dated June 2nd, 1972 herewith presented by Commissioner Faiola and ordered received and filed, on his motion, seconded by Commissioner Vandernoot, it was unanimously RESOLVED, that in accordance with law, this Commission hereby authorizes publication in the official newspaper of the Town of Mamaro- neck, "The Daily Times", of a Notice for Bids for Firemen's Uniforms and Caps, said bids to be returnable July 5th, 1972, to be opened and read aloud at a regular meeting of the Board of Fire Commissioners in the Council Room or Auditorium of the Weaver Street Firehouse, Town of Mamaroneck, and to be in accordance with the specifications set forth in the said Notice. 4. Request to Purchase Deluge Gun and Mounts (Not on Agenda) In accordance with Commissioner Faiola's recommendation and correspondence addressed to the Commission by the Fire Chief under date of June 5th, 1972, herewith presented and ordered received and filed for the record, on his motion, seconded by Commissioner Bloom, it was unanimously RESOLVED, that this Commission hereby auth- orizes the Town of Mamaroneck Fire Depart- ment to purchase from the low bidder, Ameri- can LaFrance, one (1) Deluge Gun at a cost of $975.00 and one (1) Mount at a cost of $130.00, in accordance with the specifica- tions set forth in the Notice for Bids. 5. Emergency Lighting Units (Not on Agenda) Since only one bid had been received, Commissioner Faiola recommended that further bids be requested for these units which was thereupon unanimously so ordered by the Commission. 6. Other Business a) The Town Attorney (Not on Agenda) The Attorney stated that there had been two very suspicious fires in the Town on which the Building Inspector and he --- needed reports very quickly from the Fire Chief as called for under Section 27-5 of the Fire Prevention Code of the Town of Mamaroneck and since these had not been forwarded as of this date, he asked that the Commission have these delivered to him as promptly as possible. - 17 - In accordance with Commissioner Faiola's request, it was thereupon unanimously directed that the Attorney state his request in a letter addressed to Mr. Faiola. 7.
