MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD NOVEMBER 17, 1976, IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 P.M.

OLD BUSINESS
1. Adopt 1977 Preliminary Budget and Set Date for Public Hearing
Supervisor reviewed the Preliminary Budget and highlighted certain
items contained therein, noting that the total appropriations amount
to $5,042,160.00. He also noted that the rate for the residents
of the two villages would be $2.55 per thousand which represents an
increase of 28( and the rate for the unincorporated area residents
would be $49.92 representing an increase of $4.79. Thereupon, follow-
ing a brief discussion and further clarifications by the Councilmen,
and pursuant to the Supervisor's recommendation that this Preliminary
Budget be adopted tonight and that a public hearing be held on December 1,
1976, on motion by Councilman Bloom, seconded by Councilman DeMaio, the
following resolution was adopted by majority vote of the Board:
RESOLVED, that this Town Board does hereby
approve as the Preliminary Budget of this
Town for the fiscal year beginning on the
first day of January 1977, the itemized
statement of estimated revenues and expen-
ditures hereto attached and made a part of
this resolution;
and be it further
RESOLVED, that such Preliminary Budget shall
be filed in the office of the Town Clerk,
where it shall be available for inspection
by any interested person at all reasonable
hours;
and be it further
RESOLVED, that the Town Clerk give Notice
of public hearing in the manner provided

in Section 108 of the Town Law, and that
the Notice be published and posted in sub-
stantially the following form:
Public Notice
Notice is hereby given that the Preliminary
Budget of the Town of Mamaroneck, New York,
consisting of the estimated revenues and
expenditures for the year 1977, has been
completed and filed in the Office of the
Town Clerk of said Town, where the same may
be examined by any person interested therein,
and that a public hearing thereon will be
held by and before the Town Board of said
Town on Wednesday evening, December 1, 1976 at
8:15 o'clock in the Auditorium of the Weaver
Street Firehouse, Weaver Street, Town of
Mamaroneck, New York, at which time and place
all those who appear and are interested will
be given an opportunity to be heard with re-
spect to said Preliminary Budget, or any part
or item thereof.
Please take further notice, that the proposed
salaries of the members of the Town Board are
as follows:
Supervisor - $12,000; Town Councilman (4) -
$2,500 each; and that the proposed salary
of the Town Clerk is $15,755.

RESOLVED, that the Notice shall be published in
the following newspaper having general circulation
within the Town: The Daily Times, on November 20,
1976.
2. Approval of Agreement - Larchmont Reservoir Valve
Supervisor Vandernoot reviewed the past history of the situation
relative to the valve at the Larchmont Reservoir and acknowledged
receipt of a communication from the Westchester County Department
of Planning under date of November 9, 1976, herewith ordered re-
ceived and filed. The communication specifically stated that it
has been determined that the project (installation of the valve)
will not constitute a major federal action significantly affecting
the quality of the environment, and accordingly, the County has
decided not to prepare an Environmental Impact Statement. The
Supervisor further noted that said communication is being sent to
all interested people who would have until November 24th to object
to the decision that the study not be done.

During the discussion that ensued, clarification was made that the
proposed cost of $20,000. will be paid under the Urban County Pro-
gram, however liability will be borne by the Village and Town of
Mamaroneck in as much as they both will benefit from this flood
control project, and Mr. Vandernoot stated that residents living
in the area of the reservoir are now in agreement with the project.
Thereupon, on motion by Councilman DeMaio, seconded by Councilman
Perone, it was unanimously
RESOLVED, that the Town Board of the Town of
Mamaroneck hereby agrees that the Town
of Mamaroneck will indemnify and save
harmless the Village of Larchmont from
any and all claims including but not
limited to any claims by owners of real
property affected by covenants and/or
easements pertaining to the use of the
Larchmont Reservoir for the purposes of
flood control for the benefit of resi-
dents along the Sheldrake River in the
Town of Mamaroneck;
and be it further
RESOLVED, that the Town of Mamaroneck will share
jointly with the Village of Mamaroneck
all costs resulting from the lowering
of the level of the Reservoir by the
Village of Larchmont for the purpose of
flood control, and it hereby assumes
jointly with the Village of Mamaroneck
all responsibility for any lowering of
the Reservoir done at the request of
either the Town of Mamaroneck or the
Village of Mamaroneck;
and be it further
RESOLVED, that this resolution is contingent upon
the adoption of a similar resolution by
the Village of Mamaroneck and the approval
of both resolutions by the Village of
Larchmont.
NEW BUSINESS
1. Comptroller's Request - Authorization to Open Savings Account
Pursuant to the request addressed to the Board by the Comptroller/
Director of Finance under date of November 16, 1976, herewith pre-
sented and ordered received and filed, and following Mr. DeLuca's
explanation of the need for such an account, on motion by Councilman
Perone, seconded by Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby authorizes
the Comptroller and Deputy Comptroller to
open a trust savings account with the Bank
-- of New York, County Trust Region, for the
Town of Mamaroneck Bicentennial Funds;

and it is further
RESOLVED, that hereafter all deposits and
withdrawals shall be authorized when signed
by the signature or facsimile signature of
Joseph F. Vandernoot, Supervisor, and
Carmine A. DeLuca, Comptroller; or Joseph F.
Vandernoot, Supervisor and Genevieve F.
Soriano, Deputy Comptroller.
2. Town Clerk's Request - Authorization for Disposition
of Old Records
Pursuant to presentation of a memorandum addressed to the Town
Board by the Town Clerk under date of November 17, 1976, herewith
ordered received and filed, and following some discussion in which
the Clerk explained the reason for requesting said disposition,
on motion by Councilman Bloom, seconded by Councilman Perone, it
was unanimously
RESOLVED, that the Town Clerk be and she
hereby is authorized to execute the
necessary form and forward it to the State
Education Department for the Commissioner's
consent to dispose of certain old and out-
dated records in her office pursuant to
the provisions of Section 65-b of the Public
Officers Law.
COMMUNICATIONS
1. Letter, Suburban Carting
A letter addressed to Carmine A. DeLuca, Secretary-Treasurer of the
Larchmont-Mamaroneck Joint Garbage Commission under date of Novem-
ber 12, 1976 by Alfred J. DeMarco of the Suburban Carting Corporation
was herewith presented by Supervisor Vandernoot, who explained that
it would be more economical for the Town to continue under its present
policy, and ordered received and filed.
Following some discussion on the aforementioned item, the Supervisor
with the consent of the Board at this time interrupted the regular
order of business in order to move on to Item #2 under The Supervisor
due to its relevance to the letter from Suburban Carting. Mr. Vander-
noot then referred to a meeting held on November 3rd with representa-
tives from LIFE Center, C.A.C. and Joint Garbage Commission and
announced that consideration is being given to a proposed new schedule
whereby garbage will be picked up twice weekly and paper once weekly
on Wednesdays. Specifics of the proposal were outlined by Mr. Vander-
noot and individual Councilmen as well as Mrs. Nancy Hartford to whom
the Board gave credit for bringing to their attention the idea of such
a re-arrangement.
Return to Regular Order of Business
The Supervisor then stated that the next matter on the Agenda Item 2.
- under Communications would now be considered.

2. Letter, PBA - 1977 Collective Bargaining Proposals
Mr. Vandernoot acknowledged receipt of a communication from the PBA,
outlining their 1977 collective bargaining proposals and noted that
he would not be revealing the contents of said communication without
the approval of the person who wrote it since such action could be
misconstrued as unfair labor practice. The communication was here-
with ordered received and filed.
THE SUPERVISOR
1. Report on Agreement with PASNY
The Supervisor reported that the New York State Power Authority has
approved the contract which has been sent to the Governor for sig-
nature. He further stated that the Town hopes to begin receiving
said power in the Spring of 1977. The Power Authority estimates an
annual savings to the Town of approximately $12,000.
2. Report - Re-Arranging Garbage Pickups
( Taken up earlier in the meeting.)
3. Announcement - New Assessor
Mr. Vandernoot recalled his previous announcement on June 2nd of
Mr. Doyle's coming retirement as the Town and Village of Larchmont
Assessor on December 31, 1977.
The Supervisor and each of the Councilmen publicly commended Mr. Doyle
on the job he has done during his service as Assessor in the past ten
years, and noted his unquestionable integrity and the high esteem in
which he is held by all in his profession and those who have been fortunate
to have worked with him.
At this time Mr, Vandernoot announced with pleasure that George K.
Mellersten of Congers, New York who is presently the Assessor for
the Town of Clarkstown will succeed Mr. Neal Doyle as Assessor for
the Town and Village of Mamaroneck effective January 1, 1977.
THE COUNCILMEN
Mr. Bloom
1. Apportionments
Councilman Bloom presented the following apportionments and on his
motion, which was seconded by Councilman DeMaio, the following reso-
lution was unanimously adopted:
WHEREAS, the Assessor has presented petition
for the correction of the assessment roll for
certain years pursuant to the provisions of
Section 557, Article 16 of the Westchester
County Tax Law;

WHEREAS, after due consideration, this
Board finds it desirable to grant said
petition for the correction of said
assessment roll;
NOW, THEREFORE, BE IT

ADJOURNMENT
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at
9:10 P.M. , to reconvene on December 1, 1976.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened imme-
diately upon the adjournment of the Town Board Meeting.

Pursuant to memorandum addressed to the Commission by the Deputy
Comptroller under date of November 16, 1976, herewith presented and
ordered received and filed, on motion by Commissioner Bloom, seconded
by Commissioner Perone, it was unanimously
