MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON THURSDAY, MARCH 22, 2018, BEGINNING AT
5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM

CALL TO ORDER - WORK SESSION
On motion Abby Katz, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened
at 5:00PM.
TAKEN OUT OF ORDER
Hommocks Conservation – Kayak Launch Study
Additionally present: Jill Fisher Recreation Superintendent and Jay Reichgott President of Reichgott
Engineering.
The Town Board reviewed a feasibility analysis, prepared at the request of the Town, for a Kayak Launch at
the Hommocks Conservation Area. In short, the analysis confirmed that there are too many obstacles and it
would be too costly to develop a kayak launch at this site. The Town Board would like to investigate
developing a reduced fee for Town residents to use the launch facilities currently available in the Village of
Mamaroneck, and courtesy usage for Town residents to use the facility in the Village of Larchmont.
Discussion – Waiver of Penalties – Sweetwater Condominiums
The Town Board reviewed a confidential memorandum from Mr. Maker explaining the current unpaid taxes
on parking spaces at Sweetwater Condominiums located in the Village of Mamaroneck. In order to best
understand the situation, Mr. Maker provided a very detailed memo explaining the current tax situation, and
a detailed plan of resolution. The approval for this item is on the Town Board’s regular agenda for this evening.
Update – Honeywell Energy Performance Contract
Mr. Altieri stated that the Town continues to audit the energy savings from the Honeywell Performance
Contract. Currently the analysis shows a savings shortfall totaling $70,000, an amount Honeywell has agreed
to reimburse the Town. Mr. Altieri further explained that the energy savings shortfalls appear primarily for
the street lighting. The Town is continuing to work with Celtic Energy, who the Town has contracted with, to
further analyze theses savings shortfalls, specifically, with respect to the street lighting, to determine whether
the amounts provided by Honeywell are accurate.
Continued Discussion – Comprehensive Plan
Supervisor Seligson opened the discussion by stating that in her research she finds that most municipal
comprehensive plans are based on land use - municipalities with open space. For the Town, which is mostly

built out, that is not the case, and therefore the focus should be more on quality of life, on utilizing and
maximizing what we currently have. Abby Katz added that although not all of the following necessarily falls
under the work of a comprehensive plan, she would like the Town to address the following: 1) traffic volume
2) traffic signals, specifically left turn signals 3) sidewalks 4) bike lanes 5) parking, specifically, commuter
parking on residential streets 6) the Floor Area Ratio law 7) open space 8) vacant lands, specifically potential
subdivisions 9) review of current Business Residential /Services Business Residential Zoning. Councilwoman
Elkind Eney agreed and would like to add, an overall review of recreation, and a better development of the
Boston Post Road corridor to feel more in keeping with the Villages. Supervisor Seligson added sustainability
and resilience to the list, as well as affordable housing, and Councilman King added with respect to resiliency
to focus on where we want to be in 10 years of more. Mr. Altieri added that the Town should review the
complete streets analysis, and Councilwoman Fiddelman stressed the importance of developing a mission
statement.
Proposal – Restoration of the Delancey Cemetery
Mr. Altieri explained that he recently met with Mike Tripicco from the Mamaroneck Historical Society about
the society’s plan to restore the Delancey Cemetery. Mr. Tripicco provided Mr. Altieri with historical
background of the Delancey Cemetery, a scope of work and an action plan. The Town Board is happy to see
the Historical Society take up this project. The Society is hoping the Town can provide a survey of the
Cemetery.
Request for Executive Session
On motion of Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, the Board unanimously
agreed to enter into an Executive Session to discuss appointments to Boards and Commissions.
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Board unanimously agreed to
resume the Regular Meeting.
Reorganization – Planning Board Membership
The Town Board reviewed the appointments for this evening. There are no new members, only
reappointments necessitated to comply with the new legislation formalizing the reduction from seven
members to 5 members.
Primer – Community Development Block Grant Program
Due to the short amount of time remaining, this item was moved to the next Town Board worksession.
Request for Executive Session
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Board unanimously agreed
to enter into an Executive Session to discuss the employment history of individuals in the Police Department
and the Recreation Department.
On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Board unanimously agreed to
resume the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 PM, she then pointed out the location of the exits.

Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening,
adding this is an open meeting that all residents are welcome to attend.
RECOGNITION – LVAC Member Alex Rapp for Meritorious Service
Supervisor Seligson explained that while attending a wedding Mr. Rapp was instrumental in saving a
woman’s life. Supervisor Seligson introduced the Chief of the Volunteer Ambulance Corp, John Pomponio,
who in turn thanked the Town Board for recognizing Mr. Rapp, and then further stated the events of Mr.
Rapp’s medical intervention.
Supervisor Seligson then presented Mr. Rapp with the Town’s Certificate of Recognition. Followed by Mr.
Rapp thanking the Town Board.
Fire Chief Paul Tortorella gave an update of the Fire Department, then presented the new Commissioners,
Sabrina Fiddelman and Jeffery King with their Fire Commissioner badges.
SUPERVISOR’S SUMMARY REPORT
March is supposed to come in like a lion and leave like a lamb. This March came in like a lion and

kept on roaring. It has been a tough month. Friday March 2 we were hit by the first and worst of 4
nor’easters this month. The winds from Storm Quinn gusted to 78 mph and caused catastrophic
damage in the Town of Mamaroneck and Westchester County. About half of the residents of the
Town were without power by the evening of March 2nd. The Town mobilized its Emergency
Operations Center (EOC), connected with our Con Ed liaison, opened a warming center at the Sr.
Center/VFW and mobilized the entire highway department to begin cleanup. Within 2 days the
highway department cleaned up all trees and debris that were not involved with downed wires.
They continued to pick up storm debris for 2 weeks. Con Ed didn’t have enough crews to provide the
cut and clear crews needed throughout the County. They called for mutual aid assistance, but those
crews didn’t start arriving until Monday. Town Administrator Steve Altieri and I were on daily
conference calls with Con Ed and Westchester County advocating for help for our residents. I issued
daily calls and emails with updates on recovery and municipal services. Those notices were posted
on the Town’s website and Facebook page.
If you did not receive the calls and emails, we need you to please sign up for emergency alerts on the
Town’s website www.townofmamaroneckny.org. Go to the Swift 911 box on the bottom left of the
homepage and give us your cell phone number and email address. I’m sending a postcard to all
households in the Town as well to remind everyone to sign up. The emergency call system only
captures land lines automatically. In order to reach you during a power outage we need to have
your cell phone numbers and email addresses.
We know the information and communication coming from Con Ed was problematic. There was
conflicting information and misinformation. There has been a major outcry from municipal officials,
including myself, for Con Ed to improve communications and work with local municipalities to
allocate better resources.

We canceled the March 7 Town Board meeting and closed the office that day due to the second

nor’easter and we rescheduled the March 21 TB meeting due to yesterday’s storm. In the 18 years
I’ve been on the TB, I don’t remember the weather ever targeting TB meetings so specifically.

The Town is no longer picking up storm debris, but organic collection begins April 5.
It has been difficult to focus on other Town business when we are in storm recovery mode. However,
a few other programs and events actually occurred. I want to congratulate the three winners in
Larchmont Village’s election on Tuesday. Congratulations to mayor Lorraine Walsh on being
reelected, to Trustee Peter Fanelli on his reelection and to Sarah Bauer, elected to trustee for the
first time. Thank you to trustee Carol Miller for her service to the Village and community.

Students from several local high schools held a rally on March 14 in Harbor Island Park to call for a
safer world and schools after the Parkland Fla. shooting. They gave speeches, read poems, and
performed songs. They carried themselves with such poise, composure and courage that I felt great
pride in their efforts and they made me feel once again proud to be part of this community.
I will let my fellow board members discuss the other events during their remarks.

LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of
New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on March 8,
2018 a Public Hearing will be held on Wednesday, March 21, 2018 at 8:00 PM or as soon
thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York
to consider, “Conversion of a temporary partial exemption for Cold War Veterans” Law.
Purpose
By Chapter 290 of the Laws of 2017, the State of New York amended section 458-b of the Real
Property Tax Law to authorize local governments to allow Cold War veterans to be eligible for
the Cold War veteran partial exemption for as long as they qualify for the exemption. Before
this amendment, the exemption lasted for only 10 years. The County of Westchester has passed
a local law eliminating the duration of the partial exemption. This local law does likewise for the
Town tax.
Presently there are 36 persons in the Town who receive this exemption. The savings in Town tax
for these veterans is less than $10,000 per year.

Local Law No. 3 - 2018
This local law shall be known as the “Conversion of a temporary partial exemption for Cold War
Veterans to a permanent partial exemption for Cold War Veterans” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
By Chapter 290 of the Laws of 2017, the State of New York amended section 458-b of the Real
Property Tax Law to authorize local governments to allow Cold War veterans to be eligible for the
Cold War veteran partial exemption for as long as they qualify for the exemption. Before this
amendment, the exemption lasted for only 10 years. The County of Westchester has passed a local
law eliminating the duration of the partial exemption. This local law does likewise for the Town tax.
Presently there are 36 persons in the Town who receive this exemption. The savings in Town tax for
these veterans is less than $10,000 per year.
Section 2 – Amendment of current sections of the Mamaroneck Code:
Sections 195-29 through and including 195-33 of the Code of the Town of Mamaroneck hereby are
repealed and the following substituted in its place:
§ 195-29 Purpose.
The purpose of this article is to create a partial exemption from real estate taxes levied by the Town
of Mamaroneck on property owned by a person who (i) served on active duty in the United States
Armed Forces during the time period from September 2, 1945 to December 26, 1991, (ii) was
discharged or released therefrom under honorable discharge conditions and (iii) satisfies any other
requirements set forth in § 458-b of the New York Real Property Tax Law. This article makes the Code
of the Town of Mamaroneck consistent with section 473.331 of the Laws of Westchester County.
§ 195-30 Definitions.
As used in this article:
ACTIVE DUTY
Full-time duty in the armed forces, other than active duty for training.
ARMED FORCES
The United States Army, Navy, Marine Corps, Air Force and Coast Guard.
COLD WAR VETERAN
A person who (i) served on active duty in the armed forces during the time period from September
2, 1945 to December 26, 1991, (ii) was discharged or released therefrom under honorable conditions
and (iii) satisfies any other requirements set forth in § 458-b 1(a) of the New York Real Property Tax
Law.
QUALIFIED OWNER
A Cold War veteran, the spouse of a Cold War veteran or the surviving spouse of a deceased Cold
War veteran who remains unmarried. Where property is owned by more than one qualified owner,
the exemption to which each is entitled may be combined. Where a Cold War veteran is also the
surviving spouse of a Cold War veteran and has not remarried, such person may also receive any
exemption to which the deceased spouse was entitled.
QUALIFIED RESIDENTIAL REAL PROPERTY
Property owned by a qualified owner which is used exclusively for residential purposes; provided,
however, if any portion of such property is not used exclusively for residential purposes, but is used
for other purposes, such portion shall be subject to taxation and only the portion used exclusively

for residential purposes shall qualify for the exemption provided by this article. Such property must
be the primary residence of the qualified owner; unless the qualified owner is absent from the
property due to medical reasons or institutionalization subject to such time limitations, if any, as are
set forth in § 458-b1(f) of the New York Real Property Tax Law.
LATEST CLASS RATIO
The latest final class ratio established by the New York State Board of Real Property Tax Services
pursuant to Title One of Article 12 of the New York Real Property Tax Law for use in a special
assessing unit as defined in § 1801 of the New York Real Property Tax Law.
LATEST STATE EQUALIZATION RATE
The latest final equalization rate established by the New York State Board of Real Property Tax
Services for the Town of Mamaroneck pursuant to Article 12 of the New York Real Property Tax Law.
SERVICE CONNECTED
Disability incurred or aggravated in the line of active duty, or death resulting from a disability
incurred or aggravated in the line of active duty.
§ 195-31 Application for exemption.
An application for the exemption authorized by this article shall be made by the qualified owner, or
all of the qualified owners, of qualified residential real property on a form prescribed by the New
York State Board of Real Property Tax Services. The qualified owner or owners shall file the
completed form in the assessor's office. The assessor shall determine the applicant’s eligibility for
the exemption authorized by this article as of the first taxable status date following the submission
of a complete application therefor. The applicant shall be required to refile at such times and under
such circumstances as may be set forth in § 458-b (4) of the New York Real Property Tax Law. Any
person convicted of willfully making any false statement in the application for such exemption shall
be subject to the penalties prescribed in the New York Penal Law.
§ 195-32 Amount of exemption; limitations.
A. Qualified residential real property shall be exempt from taxation to the extent of 15% of the assessed
value of such property; provided, however, that such exemption shall not exceed $54,000 or the
product of $54,000 multiplied by the latest state equalization rate, or, in the case of a special
assessing unit, the latest class ratio, whichever is less.
B. In addition to the exemption provided by this article, where the Cold War veteran received a
compensation rating from the United States Department of Veterans Affairs or from the United
States Department of Defense because of a service-connected disability, qualified residential real
property shall be exempt from taxation to the extent of the product of the assessed value of such
property multiplied by 50% of the Cold War veteran disability rating; provided however, that such
exemption shall not exceed $180,000 or the product of $180,000 multiplied by the latest state
equalization rate, or, in the case of a special assessing unit, the latest class ratio, whichever is less.
C. If a Cold War veteran receives an alternative veterans' exemption under Article VI of this chapter,
the Cold War veteran shall not be eligible to receive an exemption under this article.
§ 195-33 Duration of exemption.
The exemption provided by this article shall be granted for as long as a qualified owner owns a
qualified residential real property. Exemptions provided by this article in existence prior to January
1, 2018 shall not expire on their tenth (10th) anniversary but shall continue for as long as the
qualified owner owns a qualified residential real property, without the qualified owner having to file
another application.
Section 3 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional
provisions.

Section 4 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

AFFAIRS OF THE TOWN
1. Appointments – Boards & Commissions
Due to new legislation changing the number of Planning Board Members from seven to five, the remaining
members need to be officially appointed to their new terms of office.
On motion of Supervisor Seligson, seconded by Councilwoman Elkind Eney, it was unanimously
RESOLVED, that Eileen Weingarten be appointed as Member E of the Planning Board, said term
shall expire on December 31, 2022, and

RESOLVED, that Ralph Engel be appointed as Member B of the Planning Board, said term shall
expire on December 31, 2019, and

2. Waiver of Penalties – Sweetwater Condominiums
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the following was
approved,
WHEREAS, in 2008, the 90 condominium units known as Sweetwater were added to the
Town’s assessment roll, and
WHEREAS, Sweetwater’s off-street parking spaces were not assessed separately. Instead,
their value was included in the assessment for the units, and
WHEREAS, there are 117 off-street parking spaces at Sweetwater, and
WHEREAS, so long as the unit owners paid their taxes and the sponsor of the Sweetwater
condominium, Mamaroneck Partners, LP (Sponsor), paid the taxes attributable to the other
27 off-street parking spaces, all of the taxes attributable to the off-street parking spaces were
being paid, and
WHEREAS, unlike the Town, the Village of Mamaroneck created separate tax lots for each
parking space so that the owners of each unit received two tax bills from the Village – one
for their unit and one for the parking space associated with their unit, and the Sponsor
received Village tax bills for each of the 27 additional off-street parking spaces (Excess
Spaces), and
WHEREAS, when the 2013 revaluation was performed, the Town created one additional lot
(9-2-497.91) consisting of the Excess Spaces and assessed that additional lot to the Sponsor,
which to the Town’s knowledge at that time, was the owner of 9-2-497.91 and
WHEREAS, as a result, tax bills for Town, County and School taxes for the Excess Spaces were
sent only to the Sponsor, and
WHEREAS, unknown to the Town, the Excess Spaces were being sold individually, meaning
that a person acquiring one of the Excess Spaces was not receiving tax bills from the Town,
since only one such bill was sent and that bill went to Mamaroneck Partners, LP, and
WHEREAS, after paying the Town and County tax for 2014, the Sponsor realized that it was
paying taxes on off-street parking spaces that it did not own and therefore ceased paying the
Town, County and School taxes on the Excess Spaces, and

WHEREAS, this situation was rectified on the Town’s 2016 assessment roll, and
WHEREAS, the Town and County taxes for 2015 and 2016 and the School taxes for the
2014/2015, 2015/2016 and 2016/2017 tax years have not been paid, and
WHEREAS, the Sponsor is willing to pay the principal amount of these taxes on those Excess
Spaces that it owns and to arrange for payment of the principal amount of these taxes from
the other owners of those Excess Spaces if the Town Board were to waive the interest
accrued on those taxes, and
WHEREAS, the total amount due, including interest and penalties, as of March 31, 2018 is
$41, 673.59, of which $11,202.71 is interest and penalties, and
WHEREAS, given the confusion created by the separate assessments of the off-street parking
spaces by the Village of Mamaroneck and the different method of issuing tax bills because of
the Village’s separate assessment of the off-street parking spaces that resulted and since the
Town was unaware that the Sponsor was selling Excess Spaces, thereby preventing the Town
from adjusting its assessments to reflect such sales.
NOW THEREFORE, BE IT
RESOLVED, that it is in the best interest of the Town, that the Town Board hereby authorize the
cancellation of the $11,202.71 in unpaid interest and penalties that have accrued upon the
Excess Spaces, and
BE IT FURTHER
RESOLVED, that acting pursuant to Real Property Tax Law section 1182, if the Town receives
$30,470.88 on or before March 31, 2018 in payment of the Town and County taxes for 2015 and
2016 tax years and the School taxes for the 2014/2015, 2015/2016 and 2016/2017 tax years, the
Receiver of Taxes shall cancel the $11,202.71 of interest and penalties accrued upon the Excess
Spaces as of March 31, 2018 and record such cancellation on the books and records of the Town.
