HomeMy WebLinkAbout2015_2_4_Local_Law_No_3 Local Law No. 3 - 2015 This local law shall be known as the “Creation of a Sustainability Collaborative for the Town of Mamaroneck” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows: Section 1 – Purpose. The Town Board declares one objective of the Town of Mamaroneck is to preserve and enhance the long term viability of the Town from both environmental and fiscal perspectives. To do so, the Town should engage, as advisors to the Town Board, residents who have experience, expertise or a willingness to research ways that the Town can accomplish this objective. By this local law, the Town Board creates an advisory body of citizens to be called the Sustainability Collaborative for the Town of Mamaroneck. Section 2 - Adoption of a new chapter of the Code of the Town of Mamaroneck. The Code of the Town of Mamaroneck hereby is amended by creating a new chapter that provides as follows: Chapter 191 Sustainability Collaborative § 191-1. Establishment. There shall be a Sustainability Collaborative in the Town of Mamaroneck. It shall serve as an advisor to the Town Board and to such other authorities, boards, departments, committees, commissions and employees of the Town as the Town Board may authorize from time to time. The Sustainability Collaborative’s role is strictly advisory. It cannot bind or commit the Town or any of its authorities, boards, departments, committees, commissions and employees to any contracts, or to undertake, or refrain from taking any action. § 191-2. Goals. A. The goals of the Sustainability Collaborative are to make recommendations for (i) maintaining and improving the quality of life in the Town, (ii) developing programs and protocols designed to prepare, mitigate and/or respond to, and from the aftermath of natural or other disasters, (iii) preserving the Town’s natural resources, (iv) wherever possible and cost efficient, continuing to deliver the same types and levels of services to the community (or adding to or improving such services or the delivery thereof) in ways that reduce pollution, conserve or reduce the consumption of energy or make the use of town resources more efficient, (v) improving the Town’s resiliency in combatting shortage of supplies and power if such shortages arise, and (vi) improving the Town’s long term ability to provide basic needs such as fuel, power, food and water to the community. B. The Sustainability Collaborative shall report its activities and make its recommendations to the Town Board in September of each year and at other times either upon request of the Town Board or on its own initiative. Section 3-Amendment of a section of the Code of the Town of Mamaroneck. Paragraph A of section 5-3 of the Code of the Town of Mamaroneck hereby is repealed and the following is substituted in its place: Except for current members of the Sustainability Collaborative, all members shall be residents. Section 5 – Adoption of a new section of the Code of the Town of Mamaroneck. Section 5-9 hereby is added to the Code of the Town of Mamaroneck and provides as follows: § 5-9. Sustainability Collaborative. A. The Sustainability Collaborative shall consist of up to ten members. The Members shall be known as Member A, Member B, Member C, Member D, Member E, Member F, Member G, Member H, Member I and Member J. All of the members shall be appointed by the Town Board. Annually, the Town Board shall designate which of the members shall serve as the Chairperson for that year. If at any time there are fewer than ten members who have been appointed to the Sustainability Collaborative the “whole number” (as that term is defined in NY General Construction Law § 41) shall mean the total number of members who have been appointed to the Sustainability Collaborative. B. Except for persons appointed in 2015, and except as provided in § 5-9 D of the Code, the terms of office of each member shall be three years and shall expire on the 31st day of December of the year in which the term expires. C. The term of office of a member appointed in 2015 shall commence on the date selected by the Town Board in its resolution making the appointment, but the term of office of: (1) Member A, Member B and Member C shall expire on December 31, 2015, (2) Member D, Member E and Member F shall expire on December 31, 2016, and (3) Member G, Member H, Member I and Member J shall expire on December 31, 2017. D. If a person is appointed or qualifies as a member after January 1 of the year in which the term of that person’s office was scheduled to begin, that person’s term shall expire on the December 31st on which that person’s term was scheduled to expire even though that person shall have served less than three years. E. Section 6 – Severability Should any court of competent jurisdiction declare any provision of this Local Law invalid or unconstitutional, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 7 – Effective Date This Local Law shall become effective on the date that it is filed in the office of the Secretary of State February 4, 2015 Town Board Public Hearing
