HomeMy WebLinkAbout2015_2_4_Local_Law_No_2 Local Law No. 2 - 2015 This local law shall be known as the “Amended definition of ‘Area Resident’ for the residential parking system for (a) Washington Square, (b) a section of North Chatsworth Avenue, (c) New Jefferson Street, and (d) Murray Avenue between Myrtle Boulevard and Leafy Lane” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose. By Local Law 4-2014, the Town of Mamaroneck created a Residential Parking Area for the Washington Square neighborhood on the following streets or sections of streets: Washington Square, New Jefferson Street, the section of North Chatsworth Avenue between Myrtle Boulevard and the northern boundaries of the lots on the opposite side of the street improved with the buildings known by the postal addresses of 35 North Chatsworth Avenue and 40 North Chatsworth Avenue and the section of Murray Avenue between Myrtle Boulevard and Leafy Lane. The Town Board adopted this law pursuant to the power given by section 1662-d of the New York Vehicle and Traffic Law. The Town Board considers the section of Myrtle Boulevard lying between North Chatsworth Avenue and Madison Avenue to be part of the Washington Square neighborhood. On that section of Myrtle Boulevard, there are some residential units. The Town Board determines that owners of motor vehicles, who reside on this section of Myrtle Boulevard, if otherwise eligible, should be allowed to obtain WS Resident Parking Permits so that they can park their motor vehicles in the Residential Parking Area defined in Local Law 4-2014. Furthermore, when section 1662-d of the New York Vehicle and Traffic Law was enacted, the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue lay in a Business District: B zoning district. Afterwards, the Town Board rezoned this section of Myrtle Boulevard to a Business-Residential District: B-R zoning district whose principal uses include multi- family housing. Accordingly, there may be additional residential units constructed on the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue. This local law expands the definition of “Area Residents” so that owners of motor vehicles, who reside on this section of Myrtle Boulevard, if otherwise eligible, may obtain WS Resident Parking Permits. This local law shall not be construed as expanding the Residential Parking Area to include the section of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue and the rules regarding parking now in effect shall continue to apply. Section 2 – Amendment of a current section of the Mamaroneck Code. The definition of “Area Resident” that appears in section 219-2.1 B. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: “Area Resident” means a person who resides within the Residential Parking Area or who resides on the section of Myrtle Boulevard that lies between North Chatsworth Avenue and Madison Avenue. A person who is employed by an entity that maintains a place of business on this section of Myrtle Boulevard but who does not reside on this section of Myrtle Boulevard is not an “Area Resident”. Section 3 – Severability. Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date. This Local Law shall become effective upon filing with the Secretary of State. January 21, 2015
