HomeMy WebLinkAbout2012_11_19_Local_Law_No_7 Local Law No. 7 - 2012 This local law shall be known as the “Conforming provisions of Chapter 195 of the Town Code to the Town’s new taxable status of May 1” Law BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: By Local Law No. 3-2012, the Town Board exercised the right given to it by section 283.141 of the Laws of Westchester County, as amended by Westchester County’s Local Law No.3 of 2008, to change the Town’s taxable status date from June 1 of each calendar year to May 1 of each calendar year. The Town Board did so by adding a new Article IX to Chapter 195 of the Code of the Town of Mamaroneck. In doing so, the Town Board inadvertently neglected to amend other sections of Chapter 195 where the Town Code recites “June 1” as the Town’s taxable status date. This local law is designed to make the sections of Chapter 195 lying outside Article IX recite that the town’s taxable status date is May 1. Section 2 – Amendment of a current section of the Mamaroneck Code: Sections 195-6A and 195-39A of the Code of the Town of Mamaroneck hereby are amended by deleting the word “June” from each section and substituting the word “May” in its place. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State.
